ARTICLE ONE EXTRINSIC COMMITMENTS

1. 1 Both pm1ies hereby agree that all conunitments or covenants whether verbal or written, infetTed or implied, that are not expressly incorporated into this Agreement shall be null and void to the extent of any inconsistency.

1.2 As the Union is a member local of the Intemational Alliance of Theatrical Stage Employees and Moving Picture Teclmicians, At1ists and Allied Crafts of the United States, its Ten1tories, and Canada, nothing in this Collective Agreement shall be constmed to interfere with any obligation the Union or its membership may owe to the International Alliance by reason of a pt1or obligation.

Notwithstanding the foregoing, nothing in this Collective Agreement shall be constmed so as to contravene any Federal or Provincial statute or regulation.

ARTICLE TWO OBLIGATIONS

2.1

2.2

The Theatre shall employ and maintain in employment only members ofthe Union who are in good standing, and are supplied by the Union.

The Union shall supply qualified personnel to perfonn work as required by the Theatre under the provisions of this Collective Agreement.

If the Union is unable to supply members as required by the Theatre, the Theatre shall employ non-members provided by the Union under the tetms of this Agreement and at the rates listed in the Rates of Pay appended thereto.

ARTICLE THRE.E JURISDICTION

3.1 Departments

3 .1.1 The Union shall have the jurisdiction over all work perfonned for, or on, The Grand Theatre Mainstage in the following Depat1ments: Stage Carpentry, Scenic Carpentry, Flys, Stage Electrics, Stage Sound, Stage Propet1ies, Stage Wigs and Wardrobe and other Depat1ments as specified by a Yellow Card on the Grand Theatre Mainstage including all the functions necessary for the taking in, setting up, taking down, mnning, rehearsal, putting out and storage of all Mainstage productions.

The Theatre understands that any other uses of the Mainstage shall be scheduled in consultation between the Production Manager and the Stage Carpenter.

3 .1.2 Special Effects shall be installed, operated and maintained by members of the Union under the supervision of the Production Manager. The Theatre shall designate those elements that are Special Effects in consultation with the Head Stage Carpenter and the appropriate depmiment head. The Union shall build Special Effects units after the first or prototype unit.

3.1.3 Costume Props may be excluded from the Union's jurisdiction and these props shall be dete1mined among the Wardrobe Mistress/Master, Headstage Carpenter and Production Manager.

3 .1.4 The Business Agent of the Union or his representative shall be admitted during working hours into any area covered by this Agreement to assess working conditions coming under the jurisdiction of the Union. All reasonable effmis will be made to infonn the Production Manager in advance of such visits.

3 .1.5 The Union shall build sets for the McManus Theatre without imposing jurisdiction on these sets.

3.1.6 In addition to the provisions of Clause 3.1.3, Stage Management may assist performers with oute1wear costume pieces and hats only (as long as the hat is not wom on a wig) during the mn of a performance or on-stage rehearsal. The extent of Stage Management involvement shall be dete1mined in discussion among the Wardrobe Mistress/Master, Headstage Carpenter and Production Manager. Oute1wear shall include, but not be limited to coats, hats, scarves, gloves, and footwear.

3 .I. 7 In addition to the provisions of Clause 3 .1.6, Stage Management may assist in only one (1) complete costume change per perfonnance, with one perfonner, during one continuous period of time. The extent of Stage Management involvement shall be determined in discussion among the Wardrobe Mistress/Master, Headstage Carpenter and Production Manager. All additional costume changes except as in Clauses 3 .1.3 and 3 .1.6 shall be perfonned by Stage Wigs and Wardrobe.

3. 2 Equipment

3.2.1 The Union shall have the exclusive right to handle or operate all machinery, electrical or electronic equipment within each Depmiment, with the following exceptions: (Grand Stage) asbestos fire cmiain, stage work lights, houselights, and house talkback system, and all equipment in the Carpentry Shop.

3.3 I.A.T.S.E. Local 105 Emblem

3.3.1 All items produced in the Scenic Carpentry Shop shall bear the I.A.T.S.E. emblem if such emblem can be applied in such a way as to be hidden from the view ofthe audience at all times when in use.

3.3.2 All productions originating outside thejmisdiction ofthe Union and staged on the Grand Stage shall bear the I.A.T.S.E. emblem.

In the event that the Theatre stages a production on The Grand Stage within the Operating Season that does not bear the I.A.T.S.E. emblem, a fee of $5000.00 shall be levied by and paid to the Union.

In the event that a production is staged on The Grand Stage outside of the Operating Season that does not bear the I.A.T.S.E. emblem, a fee of $100.00 per day, shall be levied by and paid to the Union, for each such day on which members are engaged with respect to that production (pursuant to Section 6.7). Productions occmTing pursuant to Sections 6.12 and 6.13 (Special and Chmitable Events) shall not be subject to this provision.

The Union shall reasonably consider all requests from the theatre to waive this provision.

3.3.3 The I.A.T.S .E. Local lOS emblem shall be displayed in the lobby ofthe Theatre in a conspicuous place. The emblem shall be supplied by the Union and shall remain the property of the Union.

3.4 Transfer Productions

3.4.1 For the purposes of this Agreement, any Grand Theatre Mainstage production, which originates with the Theatre and is re-staged in any other single location with substantially the same scenery, shall be designated as a Transfer Production.

3.4.2 Where a Transfer Production is staged, the Theatre shall employ members of the Union in sufficient numbers (minimum of one person) to effect the transfer and adequately staff the production until the first public presentation thereof at the new location except as may be otherwise agreed in advance as to the number and timing by the Union and the Theatre. Members of the Union employed for this purpose are required to have sufficient knowledge of the production being transferred. Discussions regarding the transfer of scenery, prope11ies, lighting, sound and wardrobe shall be held with the Production Manager.

3.4.3 Transfer Productions shall depend upon the acceptance of the production by a local ofl.A.T.S.E. at the new location as a Transfer Production wherever possible.

3.5 Touting Productions

3.5.1 For the purposes of this Agreement, any Grand Theatre Mainstage production which originates with the Theatre and is subsequently re-staged in at least two (2) additional locations using substantially the same scenery shall be designated a Touting Production.

3.5 .2 Where a Touring Production is staged, the Theatre shall employ members of the Union for the full duration of the tour, under the conditions of the I.A.T.S.E. Traveling Stage Employees ' Contract.

3.5 .3 When a Grand Theatre Mainstage production is re-staged at The Grand Theatre, it shall not be considered to be pmt of the Tour.

3.6 Road Shows

3.6.1 For purposes of this Agreement, all shows originating outside the City of London shall be designated as Road Shows, with the exception of joint productions, co­productions and Grand Theatre Presentations. These Joint productions, co­producti.ons or Presentations are those where the T l1eatre is a joint or co-producer with the intent of equitably sharing costs with one other co-producing company.

3.6.1.1 Notwithstanding the foregoing provision, any production canying a yellow card or a road person shall be deemed to be a Road Show.

3.6.2 For the purposes of this agreement, any theatrical production shall be designated a "joint or co-production" if the Theatre contributes at any stage prior to the opening perfom1ance, fifteen thousand dollars ($15000.00) or more in money, credit, goods, services, or other valuable consideration of any kind whatsoever, or any combination thereof.

3 .6.3 All Road Shows canying a Yell ow card shall be staffed by the designated Housepersons and other members of the Union in accordance with the minimum staffing requirements specified by this Agreement, the Yell ow card, or Road Show management, whichever is the greater number.

3 .6.4 All Road Shows not canying a Yell ow card shall be staffed by the designated Housepersons and other members of the Union in accordance with the minimum staffing requirements specified by this Agreement or by Road Show Management, whichever is the greater number.

3.6.5 Road shows that are not carrying a yellow card shall operate under "Road Show" rates of pay for all members ofthe Union. Road Shows that are can·ying a Yellow card shall operate on "Yellow Card Road Show" rates of pay for all members of the Union. For both types of Road Shows, all Union members shall work under the provisions of Atticle 6.

3. 7 Media use of Theatre or Shop

3.7.1 Union Rights

3. 7 .1.1 The Union shall have the right to negotiate a satisfactory agreement directly with any Lessee or Invitee, and to execute contractual Agreements pertaining directly thereto as it may think fit.

3.8 Film and/or Television Personnel

3.8.1 \Vhere The Grand Theatre is used for purposes of broadcasting, film making, or for the making of videotape, audio tape, or the preparation of any other video or audio recordings or media of any kind whatsoever, personnel involved therein who are not members of the Union shall not be pem1itted to use, handle, alter or adjust any stage equipment whatsoever.

3.9 Promotional Use ofTheatre

3.9.1 Television, radio, and film personnel shall be pennitted to photograph, film or to make video or audio recordings or media of any kind whatsoever at any place within the Theatre proper for irnn1ediate and non-pem1anent release, for the purpose of news or promotional advertisings for the benefit of the Theatre or its lessees or invitees, provided that such activity does not infringe on the personal privacy of members of the Union while on the job.

3.9.2 Staffmg requirements for such activities, if any, shall be detem1ined by agreement between Production Manager and the Stage Carpenter.

3.9.3 All reasonable effmts shall be made to inform the Stage Carpenter in advance of such visits.

3.10 Use ofTheatre as Sound Stage

3.1 0.1 In the event that the Theatre or any part thereof is used for the preparation of audio recordings or videotape or film or media of any kind whatsoever for commercial or pem1anent release or for conm1ercially reproducing a perfonnance, concert, or other presentation, the Theatre shall infmm the producers thereof that they are responsible for reaching an agreement, hereinafter referTed to as the Production Agreement, with the Union covering wages, hours, and other working conditions.

3.1 0.2 Such an agreement shall be executed by the Union and the Producer, and shall operate independent of this Collective Agreement for the duration of the filming or taping.

3.1 0.3 Such a Production Agreement shall not suspend this Collective Agreement. This Collective Agreement shall remain in force with respect to any matters not dealt with by the Production Agreement.

3.1 0.4 The purpose of a Production Agreement shall be to require wages and working conditions up to the standard of the movie or television industry at the time it is reached, but in no event shall a Production Agreement prescribe smaller minimum calls or a wage lower than the Road Show rate then applicable, and any such Agreement purp01iing to do so is void and of no effect.

3.10.5 The Theatre and the Union agree that the provisions of this Section shall in no way affect the public relations or promotional activities of the Theatre or its lessees or invitees under Section 3.8 of this Agreement.

ARTICLE FOUR CESSATION OF OPERATION

4. 1 It is agreed that in the event that the Theatre ceases to function as a Theatre Company for a period of more than twelve (12) consecutive months, this Agreement shall be null and void as of the last day of that period.

4.2 In the event the Theatre ceases to operate Housepersons shall be given notice, or pay in lieu of notice equal to one (I) week's wages for each year of continuous service, to a maximum of eighteen (18) weeks' wages. One week's wages is equal to f01iy ( 40) hours at the regular rate of pay for the year in which the Houseperson leaves.

ARTICLE FIVE DEPARTMENTS

5.1 Co-operation

5 .1.1 The duties of each Employee under the jurisdiction of the Union shall be confined to the Depmiment to which the Employee is assigned at the time ofthe call. The Union agrees that its members shall provide necessary assistance to those working in other Depmiments in the best interest of co-operation to all concerned.

5 .1.2 Housepersons, when lack of work in their Depmiment pern1its, shall assist other Depmiments in routine maintenance and other tasks within the scope of their expe1iise where requested to do so by the Theatre in order to make up a full 40 hour work week. At no time shall this clause be used to reduce the work historically done by Stage Hands and Dresser/Wigs. The Wardrobe Mistress/Master, when lack of work in the Stage Wigs and Wardrobe Depmiment pennits, shall assist the Production Wardrobe Depmiment in tasks within the scope of the Employee's expe1iise where requested to do so by the Theatre in

order to make up a full 40 hour work week. Such work will take place within The Grand Theatre buildings, not including the Carpent1y Shop and Warehouse.

ooh;/Equipment

5.1.3 The Theatre shall fumish all tools and equipment necessary for the safe and efficient operation of all Departments with the exception of personal hand tools and personal safety equipment.

5.1.4 All Union employees shall repmt for calls equipped with suitable tools.

5.1.5 Suitable Tools shall consist of the following: Stage: #8 Robe1tson Screwdriver, Slot Screwdriver,

Hammer, Crescent Wrench, Knife, CSA Approved Hard Hat Carpentry Shop: 16' Tape Measure, #8 Robettson Screwdriver, Slot

Screwd1iver, Hanm1er, Crescent Wrench, Knife, CSA Approved Hard Hat

5.2.4 The Theatre shall replace all personal tools broken or damaged when used as prescribed in the course of working for the Theatre.

ARTICLE SIX EMPLOYEES

6.1.1 The Theatre shall employ members of the Union in accordance with Al.ticle 2 of this agreement as Housepersons in the following capacities:

Head Stage Carpenter Head Electrician Head Flyperson (Prope1ties) Head Soundperson

Wardrobe Mistress/Master Head Scenic Carpenter First Carpenter Second Carpenter

6.1.2 The Theatre shall have choice of employees designated as Housepersons to the mutual satisfaction of both parties on the Grand Theatre Stage.

6.1.3 In accordance with Article 2 of the Agreement, the Head Stage Carpenter shall always be first called. Housepersons shall then be first called for all events at The Grand Theatre within their area of responsibility by the Head Stage Carpenter and/or Production Manager.

6.1.4 The Theatre shall employ members of the Union as Others in the following capacities in accordance with A1ticle 2 of this agreement: Dressers, Wigpersons, Stagehands, Projectionists, Loaders

6.1.5 The job descriptions for the positions of Housepersons and Others will be as detennined by the Theatre in discussion with the Joint Standing Committee from time to time and be so outlined in an addendum document.

6.1.6 If, in the dete1mination of the Production Manager, the services of a Fly person are not required for a specific production, the Flyperson shall also work as the Stage Prope1iy Person for that show. This determination shall be made at the earliest possible oppmiunity on a per-production basis.

6.1. 7 The Production Manager shall detem1ine if a Stage Prope1iy Person, who is not a Houseperson, is required on a per-production basis.

6.2 Conditions ofEmJ2!oyment for House11ersons

6.2.1 The Operating Season shall be detem1ined by the Production Manager and dates of employment for the Operating Season shall be provided to all Housepersons by June 30 of the preceding Season.

6.3.1 The Theatre and the Union recognize the need for training and agree that the Theatre may, in Agreement with the Union, hire Apprentices to perform work for leaming and training purposes ensuring that no employee provided for in this Agreement is replaced. The te1ms of Apprenticeship will be detennined by a Joint Standing Conunittee and will be outlined in an addendum document to the Agreement.

6.4 Shop Steward

6.4 .. 1 Once designated, the Shop Steward shall be responsible for all matters affecting safety and general working conditions, and shall be the initial referee of complaints and/or grievances from members ofthe Union.

6.5 Safety

6.5.1 Safety Equipment

6.5 .1.1 The Theatre shall fumish all non-personal safety equipment, including eye and ear protection, safety belts and hamesses, machine guards, but not including footwear, gloves or hardhats if required. Employees shall wear or use the safety equipment provided by the Theatre. Refusal or failure to wear or use such safety equipment shall result in the employee being dropped from the call without compensation. The employee shall be given a written waming signed by the representative of the Theatre and a Union representative of the Safety Committee.

If the employee receives three written wamings within a one year period, the Employee shall be subject to the grievance procedure as laid out in Atticle 9.

6.5 .1.2 The Union shall ensure that all employees under its jurisdiction repott for work wearing approved personal safety equipment.

6.5.1.3 In the event that an employee rep01ts for work inadequately equipped, the Employee shall be required to obtain the necessary equipment by the end of the first break at no cost to the Theatre in money or services.

6.5.1.4 Housepersons employed for a full season may receive a subsidy of up to $150.00 bi-annually for the purchase of safety boots upon providing a receipt.

6.5.2 Hazardous Materials I WHMIS Program

6.5.2.1 The Theatre shall comply with the mles and regulations as defmed by the govenunent and the WHMIS program for the use and storage of hazardous materials.

6.5.2.2 The Union has the tight to refuse to deal with any material(s) that are not labeled or do not have an accompanying Material Data Sheet.

6.5.3 Minimum Personnel Calls

6.5.3.1 There shall be at no time fewer than two (2) Union Personnel working in the Scenic Carpentry Shop on a work call.

6.5 .4 Theatre Safety Policy and Prog:rat ll

6.5 .4.1 At a minimum, the Union and its members shall comply with The Grand Theatre Health and Safety Policy and the Ontario Occupational Health and Safety Act.

6.5.4.2 The Theatre shall inf01m the Union of any new policies and procedures developed as pmt of the Safety Program.

6.6 Hours of Work

6.6.1 Housepersons

6.6.1.1 Stage

6.6.1.1.1 During the Operating Season, Housepersons shall work a minimum of 40 hours per week between the hours of 8:00am and 24:00 midnight, between Tuesday and Sunday, inclusive, unless otherwise instructed by the Theatre.

6.6.1.1 .2 Any work perfonned for, or on The Grand Theatre Mainstage outside the Operating Season shall be canied out by the appropriate Housepersons, and the provisions of this agreement shall apply.

6.6.1.1.3 Any work perfonned for, or on The Grand Theatre Mainstage outside the Operating Season shall be canied out by Stagehands and Dressers/Wigs and the provisions ofthis agreement shall apply.

6.6.1.1.4 Outside the Operating Season the provisions of this Agreement goveming all calls and hours of work for Stage Hands shall apply, but where such work is perfonned by a Houseperson, that person shall be paid as such.

6.6.2 Carpentry Shop

6.6.2.1 During the Operating Season Housepersons shall work a minimum of forty ( 40) hours per week between 8:00 and 18:00 hours in five (5) consecutive days between Monday and Friday. This clause may be waived by mutual agreement of the pm1ies.

6.6.2.2 The Head Scenic Carpenter and First and Second Carpenters shall be employed for no fewer than twenty-eight weeks within each Operating Season. A lay-off of no more than two weeks may be scheduled in each Operating Season, the exact schedule of which shall be established by the Theatre no later than June 30 of the preceding season. See Section 6.2.

6.6.2.3 If the situation dictates, the Theatre may call the Head Scenic Carpenter to supervise the dismantling of the Scenery on the Mainstage. These calls shall be considered to be special in nature and must be mTanged at least four ( 4) days in advance with the Production Manager and the Head Scenic Carpenter.

6.6.2.4 Any Scenic Carpentry work for the Theatre, perfonned outside the Operating Season for use on The Grand Stage, shall be canied out by Housepersons where possible and the provisions of this Agreement shall apply.

6.6.3 Stage Hands, Dressers,Wigpersons.Loaders, Drivers, Projectionists

6.6.3.1 Stage Hands and Dressers/Wigpersons shall work a maximum of eight (8) hours a day between the hours of 8:00 and 24:00 midnight, between Tuesday and Sunday inclusive, unless otherwise instmcted by the Theatre.

6.7 Calls

6.7.1 Method of Calls

6. 7 .1.1 The Theatre shall place calls for Employees with the Business Agent, Head Stage Carpenter, Head Scenic Carpenter or Wardrobe Mistress/Master no fewer than 24 hours prior to the time of the call, where circumstances pennit.

6.7.1.2 The Theatre shall place calls, for the next day, with the Business Agent, Head Stage Carpenter, Head Scenic Carpenter or Wardrobe Mistress/Master by the end ofthe present day's call.

6. 7 .1.3 No person other than the Production Manager or other designated representative of the Theatre shall make a job call on behalf of the Theatre, and no member of the Union shall respond to a call that is improperly given.

6. 7 .1.4 Clean up and/or lock up time shall be included in all calls, unless the Theatre and Union agrees that this requirement can be waived.

6.8 Minimum Calls

6.8.1 Except as set out in Aliicles 6.12 and 6.13 (Special and Charitable Events), there shall be a minimum Crew Call of four (4) Union employees for all shows, productions, or paid public presentations on The Grand Stage. The four ( 4) Housepersons must be the Head Stage Carpenter, Head Electrician, Head Flyman, and Head Soundman.

6.8.2 The number of extra Dressers/Wigs people, Stagehands, Scenic Carpenters, Loaders, Drivers or Projectionists shall be detem1ined by the Production Manager in consultation with the Head Stage Carpenter.

6.8.3 A five hour work/show call can be set when the set up, performances and strike of a progranm1e can be completed within five hours. Tllis shall apply to all stage employees working the call. This decision shall be made by the Production Manager in agreement with the Head Stage Carpenter.

6.8.4 Ifperfom1ance show times permit, two performances shall be acconunodated in one show call. This decision shall be made by the Production Manager in agreement with the Union.

6.8.5 All calls shall be a minimum offour (4) hours, with the exception of Clauses 6.9.4, 6.9.5, 6.1 0.1' 6.12.3, 6.20.1.1.

6.8.6 The nonnal work period for the Stage wigs and Wardrobe shall be four (4) consecutive hours before a one hour unpaid rest period shall be provided.

6.9 Work Calls

6.9.1 All calls not otherwise defined shall be designated as ''Work Calls''. A Work Call may include, but not be limited to set ups, put outs and photo shoots.

6.9.2 Four (4) hour calls may, with the approval of the Head Stage Carpenter or Head Scenic Carpenter be extended to five (5) hours. There shall be not more than one such extension in each working day.

6.9.3 Call extensions shall be in one-half (1/2) hom blocks. Calls shall not be nmmally extended beyond the fifth hour, but where such extensions are necessary, the meal penalties ofthis agreement shall apply.

6.9.4 The minimum four (4) hour call shall not apply to employees who have already completed an earlier call dwing the same day, provided that the meal break following the original call does not exceed two (2) hours in duration and that notice of the call-back was given p1ior to the commencement of the meal break. Such call-backs following a meal break shall not be for fewer than two (2) hours duration.

6.9.5 Work Calls for Stage Wigs and Wardrobe (as necessary) shall be at a three (3) hour minimum (this includes fittings), with the option to extend in half(.5) hour increments up to four (4) hours. A work call can be a minimum of two hours in length only if it is preceding a meal break (of one hour minimum and two hour maximum duration) and a subsequent Show Call. Such a two (2) hour call may be used for routine wig and wardrobe maintenance of the cunent production only.

6.9.6 Stage Wigs and Wardrobe put out calls may occur immediately following the conclusion of the final performance of that production, or the following week, at the mutual consent of the Wardrobe Master/Mistress with the Head of Wardrobe and the Production Manager. If a Dresser/Wigperson worked the mn of the show, they shall work the put out regardless of when it occurs.

6.10 Rehearsal Calls

6.1 0.1 Rehearsal calls shall include any call involving the use of scenic or other elements of a production for the purpose of preparing that production for perfonnance, and where those elements are used in a manner in which they will be used during a perfonnance. Rehearsal Calls may also include a photo shoot. Should repair or other work be required to be done before a Rehearsal Call, only the number of Housepersons required, to be detennined by the Theatre in consultation with the Head Stage Carpenter or Wardrobe Mistress, will perfonn such work and be paid the prevailing hourly rate for one hour. There can be a maximum of five (5) such calls per production.

6.10.2 Revision or creation oftechnical elements during a rehearsal call shall be pennitted, with or without the company present, with consultation between the Production Manager and Head Stage Carpenter.

6.1 0.3 The Theatre agrees not to use Rehearsal Calls for the purpose of general maintenance, construction of technical elements, or any other activity not directly related to the preparation of the production for perfonnance, except in emergency situations where the maintenance or repair work is necessary to the continuance or commencement of the rehearsal.

6.1 0.4 A rehearsal call shall be for a minimum of four ( 4) hours with a single 15 minute paid break at a point during the call to be agreed upon by the Stage Manager and Head Stage Carpenter.

6.10.5 Rehearsals shall not be nom1ally extended beyond four (4) hours duration. However, the Production Manager may schedule not more than three (3) minimum five-hour rehearsal calls during the ten (1 0) days inm1ediately preceding the opening of each production, provided that not more than one such call is held on any single work day.

6.10.6 Except as provided above, rehearsal calls shall not be nom1ally extended beyond a fifth hour, but where such extension is necessary, the Meal Penalty provisions of Section 6.16, shall apply against the Theatre or Lessee, as the case may be.

6.10.7 On-stage Rehearsal Calls shall be staffed by the Wardrobe Mistress if any of the real costume elements of the cunent production, for the purpose of preparing that production for perfonnance, are used. This does not include the use of rehearsal costumes.

6.1 0.8 The Union agrees that when maintenance for future rehearsals or perfonnances of the cunent production is required during a rehearsal or perfmmance call, such maintenance shall be allowed. Such agreement shall not be withheld where the amount and type of maintenance for future rehearsals or perfom1ances and the work required for the rehearsal or perfonnance in progress constitute a reasonable workload for the time and personnel called. Within the context of this clause, such maintenance shall not include laundry and wig dressing.

6.11 Show Calls

6.11.1 A Show Call is any call which includes the mnning of any pm1 of a production during which one or more members of the general public are present whether as paying customers or invitees of the Theatre.

6.11.2 A Show Call shall be a minimum of four ( 4) hours in length, and shall commence one hour prior to the scheduled sta11 of the public perfonnance. Where necessary, however, one or more Housepersons may be called one-half (1 /2) hour prior to the

beginning of a performance. Where such an extension is granted, the duration of the Show Call for the affected Houseperson shall be increased to four and one­half ( 4 12) hours.

6.11.3 Stage Wigs and Wardrobe Show Call shall be a minimum of four (4) hours in length, and shall commence one hour prior to the scheduled start of the public perfonnance.

6.11.4 Stage Wigs and Wardrobe Show Call may be extended to a maximum of one hour prior to the Show Call in half hour increments. This extension to the show shall be paid at time and a half (1.5 times) the applicable rate.

6.11.5 The Show Calls of one or more stagehands may be extended beyond the four ( 4) hour minimum without advance consent, but where such an extension is in effect, the Overtime provisions of this Agreement shall apply.

6.11.6 Stage Wigs and Wardrobe Show Call may be extended for a maximum of one (1) hour after the perfonnance for maintenance purposes. All such extensions to the Show Call shall be paid at the applicable rate, providing the call does not pass midnight (24:00); then it shall be covered under Section 7 .1.1.3.

6.11.7 Except as provided above, where a Show Call exceeds four (4) hours in length, all members of the show crew shall be paid at one and one-half (112) times the applicable rate for the excess, in minimum one-half (1/2) hour time units.

6.11.8 A show call includes any cleanup/lockup as required to a maximum of five minutes after Final Curtain. "Final Curtain'' is defined as that time when the houselights are brought up for the exit of the audience.

6.11.9 Where a Show Call is cancelled with fewer than seven (7) days notice, the stage crew scheduled to work such show shall be paid as if the show had been worked and shall not be assigned other work in lieu thereof.

6.11.1 0 When maintenance for the current production is required during a rehearsal or perfonnance, such maintenance shall be allowed. Such agreement shall not be withheld where the amount and type of maintenance constitutes a reasonable workload for the time and personnel called. Within the context of this clause, such maintenance shall not include laundry and wig dressing.

6.12 Special Events

6.12.1 Events staged at The Grand Theatre by the Theatre or other groups may be designated as "Special Events," if and only if, the organizer is based within the city of London, and the event does not require the use of scenic elements apart from ordinary stage draperies and fumiture.

6.12.2 Without limiting the generality of the foregoing, conce1is, fund-raising activities and public speeches or addresses are designated as "Special Events" by mutual consent of Union and Theatre.

6.12.3 Where an event is designated as a "Special Event", the otherwise applicable call may be replaced by a minimum call of two (2) Housepersons for a minimum period of four (4) hours, and separate Put-out call may not be required for the dismantling or restoration of the Stage Area if this is done immediately following the final perfonnance or presentation.

6.12.4 All other provisions of this collective Agreement shall apply to Special Events in the same manner as to other productions.

6.12.5 The precise tem1s and conditions of the reduced call for Special Events shall be detem1ined by the Production Manager in agreement with the Business Agent, in consultation with the designated representative(s) of the Theatre or the lessee or invitee (if any), taking into account the nature of the event and the state to which the Stage Area must be restored following the event.

· .12.6 Th Bu . .,ine.".>s Agent of the Union shall be notified in \vriting at least fourteen (14 days prior to any "Special Event" . An e-mail message written to the Union's Secretary and copied to the Stage Carpenter and the President will be acceptable as notification.

6.13 Charitable Events

6.13.1 Notwithstanding the Union's intention to maintain minimum scales of staffing, wages, and hours of work with regard to any paid presentation on The Grand Theatre Stage, it is agreed that there is merit in waiving or reducing these minimums for charitable or fund-raising events.

6.13.2 The Union shall consider waivers for each such event upon its merits, provided that written application is made to the Business Agent at least fomteen (14) days prior to the event. An e-mail message written to the Union's Secretary and copied to the Stage Carpenter and the President will be acceptable as application. The Union agrees to respond verbally to such requests within five (5) days of the receipt thereof, and to promptly confi1m the response in writing.

6.13 .3 The Theatre shall not request Union members to donate time or services and shall prevent lessees or invitees from making such requests, without the proper approval of the Union.

6.14 High School Project

6.14.1 The Union agrees to cooperate with the historical practice ofthe annual High School Project (HSP) . The parties agree that Depm1ment Heads may choose not to pm1icipate in the HSP. If a Depm1ment Head chooses not to pm1icipate in the HSP, they must notify the Theatre in writing no later than June 1. If the Depm1ment Head chooses not to par1icipate, the Theatre shall then choose the employee to be designated as HSP depm1ment head to the mutual satisfaction of both the Union and the Theatre.

6.15 Breaks

6.15.1 There shall be a single fifteen (15) minute paid break during each four (4) or five (5) hour call, at a time to be agreed upon between the Production Manager or representative and Head Stage Carpenter or the supervising Depm1ment Head.

6.15.2 The Union acknowledges that full breaks may not always be possible dming Show calls.

6.15.3 An unpaid meal break of not less than one (1) hour duration shall be provided after the four1h ( 4111

) hour of all calls not extended to five (5) hours, and after each four ( 4) hours of work performed thereafter.

6.15 .4 With the unanimous consent of the Head Scenic Carpenter, Production Manager and all other personnel called in the Carpentry Shop, the unpaid meal break may be shm1ened to not less than one-half (1/2) hour.

6.15 .5 With the unanimous consent of the Wardrobe Mistress/Master, the Head of Wardrobe, and all other personnel working in the Stage Wigs and Wardrobe Depm1ment, the unpaid meal break may be sh011ened to not less than one-half (1/2) hour.

6.16 Meal Break Penalty

6.16.1 In the event that a meal break is not provided, all affected employees shall be entitled to their choice of a hot or cold meal, delivered to their workstation, and reasonable time to eat.

6.16.2 All affected employees shall also be entitled to a meal penalty bonus calculated at the rate of one and one-half (1 Y:!) times the applicable hourly rate until a proper break is provided. Such bonuses shall be calculated on a half-hourly basis.

6.16.3 On double show days when an appropriate meal beak of one hour cannot be provided in between shows, the Stage Wigs and Wardrobe Depar1ment shall be entitled to meal penalty bonus. The meal penalty bonus is one hour of additional pay at one and a half times (1.5) the base rate.

6.16.4 If a meal penalty falls on a rehearsal or work call, the call shall be paid as stated in Clause 6.16.2.

6.17 Tumaround Time

6.17 .1 There shall be a break of at least nine (9) hours duration between the last call of each workday and the first call of the next day for all Housepersons and other Employees the Theatre may specify, unless otherwise required by law.

6.17 .2 Where such a break cannot be provided, the Employee shall be paid at one and a half (1.5) times the applicable rate for all work done until a nine-hour break is provided.

6.18 Costume Premium

6.18 .1 Where the Theatre requires personnel to perf01m work in a costume designed and provided for a production, the individual(s) involved shall be paid an additional sum often ($1 0.00) dollars per perfonnance.

6.18.2 "Stage Blacks" worn by the running crew shall not be considered to be a costume. "Stage Blacks" shall be worn during rehearsals by all stage running crew from the first technical dress rehearsal, and for all subsequent dress rehearsals and perfom1ances.

6.19 Employee Transportation

6.19 .1 If any employee working under this Agreement is required to be anywhere other than the location to which the Employee has been called, the Theatre shall provide transp011ation to and from the job site or shall be responsible for paying vehicle parking.

6.20 Absences

6.20.1 Absence of a Houseperson

6.20.1.1 Where a Houseperson is unavailable for scheduled work for a time period of fewer than two (2) hours, the Houseperson's minimum hourly workweek shall be reduced accordingly.

6.20.1.2 Where a Houseperson is unavailable for scheduled work for a time period greater than two (2) hours, the senior person already employed in that depm1ment acceptable to the Theatre shall be designated the replacement worker and shall assume all responsibilities and benefits of the position for a minimum of four ( 4) hours, increasing in four ( 4) hour blocks thereafter.

6.20.1.3 If a Houseperson is unavailable for scheduled work and no other people are employed in that Department, the choice of the replacement worker shall be chosen by the Business Agent in consultation with the Production Manager where possible.

6.20.1.4 Where the absence of a Houseperson for any reason exceeds eighteen ( 18) working days, the Theatre shall then have a choice of the replacement worker.

6.20.1.5Where the absence of the Head Scenic Carpenter exceeds the tennination of the setup for the production being worked on, the Theatre reserves the right to make application for a different replacement for the Head Scenic Carpenter, should it so desire.

6.20.2 Leaves of Absence

6.20.2.1 Housepersons with a minimum of four ( 4) consecutive seasons of guaranteed employment may request a Leave of Absence or time off up to a maximum of one Operating season with the written consent of the Production Manager. The written request for tlus Leave of Absence must be made two (2) months before the end of their cmTent contract. An announcement of the intention to retum to the position must be made two (2) months before the end of the Leave of Absence. Service will not accme during the leave of absence. Service earned p1ior to the leave of absence will be retained by the employee. The foregoing provision does not apply, however, to absences taken under Sections 6.20.1, 6.20.3, 6.20.4.

6.20.2.2 Voluntary absences exceeding one year in duration are cause for dismissal unless the written consent of the Theatre is obtained in advance.

6.20.3 Jury Duty and Witness Duty

6.20.3.1 In the event that any Houseperson is summoned to pe1f01m Jury or Witness Duty, the Theatre agrees to pay compensation weekly in the amount of the difference between the full salary or wages that would othe1wise have been earned and any remuneration paid for the Jury or Witness Duty, upon the presentation of documentmy proof of Jury or Witness service.

6.20.4 Bereavement Leave

6.20.4.1 Housepersons shall be entitled to up to four ( 4) days absence with full regular pay during ten (I 0) days inm1ediately following the death of a close relative.

6.20.4.2 For the purposes ofthis provision, "close relative" means a Spouse, Common­Law Pminer, Cruld or Foster Child, Parent, Step or Foster Parent, Grandparent, Sibling, Spouse's Child, Spouse's Sibling or Spouse's Parent or Spouse's Grandparent.

6.20.4.3 Employees with guaranteed weekly employment shall be entitled to one day's paid leave for the purpose of attending the funeral of the employee ' s:

6.20.5 For the pmposes of this provision, family will refer to spouse (or common law partner resident with employee), children (including foster children or children of spouse of common law pmtner), parents (including step parents or foster parents), or any relative permanently residing in the employee's household or with whom the employee resides. The total leave with pay for family related responsibilities shall not exceed maximum 3 days during the Operating Season as approved by the Production Manager.

Sick Leave

6.20.6 For the purposes of this provision, sick leave is defined as an illness. The total leave with pay granted under this mticle shall not exceed five (5) days for Housepersons. Proof of illness in the form of a physician's professional ce1tificate shall be supplied to the Theatre upon request.

6.21 Dark Days and Holidm

6.21.1 The Dark Day, i.e. Sunday or Monday, shall be designated by the Theatre with three month's notice. The Dark Day shall be deemed to begin at 24:00 midnight the preceding day and end thi1ty-two (32) hours later. The Dark Day for The Grand Theatre will be Monday.

6.21 .2 The following days shall be considered as Holidays: New Year's Day Civic Holiday Family Day Labour Day Victoria Day Thanksgiving Day Good Friday Christmas Day Canada Day Boxing Day

6.21.3 Any new Holidays so designated by the Legislature of Ontario shall be inc01porated as such in this provision at the date of proclamation.

6.21.4 Any employee who wishes to be absent for two (2) hours to attend memorial services on Remembrance Day shall be allowed to do so without pay.

6.21.5 Whenever any of the above Holidays fall on a Dark Day, unless otherwise designated by govenm1ent, an alternate day off with pay shall be given only to those employees who qualify for the Holiday, pursuant to the provisions of Clause 6.21.8. The altemate day off may be different for Stage Housepersons and Carpenter Housepersons, if agreed to by all parties .

6.21.6 When employees are required to work on the alternate day off, only those employees who qualify for the Holiday, pursuant to the provisions of Clause 6.21.8 , shall be paid as in Sections 7.1.1.2 and 7.1.1.4.

6.21.7 A Holiday shall be deemed to begin at 24:00, midnight, the preceding day and end thi1ty (32) hours later.

6.21.8 Holidays shall count as eight (8) hours worked and shall be paid as such to all employees provided they have worked no fewer than twenty four (24) hours, in the seven days preceding the Holiday.

6.21.9 Sunday shall be deemed to begin at 24:00, midnight, Saturday and end thi1iy two (32) hours later.

6.22 Discrimination

6.22.1 Every person who is an employee has the 1ight to freedom from harassment in the workplace by the employer or agent of the employer or by another employee because ofrace, ancestry, place of 01igin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, age, record of offences, mmital status, family status, or handicap. No Union member may be discriminated against because of anything said or done in the fmiherance of the Union, provided that this does not interfere with the nmmal activities of the workplace.

6.22.2 While working at any Grand Theatre site, all Union members will abide by The Grand Theatre Workplace Violence and Harassment Policies.

ARTICLE SEVEN PAY STRUCTURE

7. I Housepersons,Stage Hands, Dresser!Wigpersons, Loaders, Drivers, Projectionists

7.1.1 Stage

7 .1.1.1 Regular Time

7 .1.1.1.1 Except as otherwise provided in this Agreement, Housepersons. Stagehands, Dressers/Wigpersons, Loaders, Drivers, Projectionists shall be paid at the base rate for each of the first 40 hours of work perfotmed between the hours of 8:00 and 24:00 midnight, between Tuesday and Sunday, of a given week, inclusive.

7.1.1.2 Ove1time

7 .1.1.2.1 Housepersons, Stagehands, Dresser/Wigpersons, Loaders, Drivers, Projectionists shall be paid at one and one-half (1 Y:!) times the base rate for all work perf01med under the following circumstances:

- all work perfonned in excess of 40 hours in a given week

- all work perfonned after eight (8) hours in a day

- all work perfonned in the first four ( 4) hours of a put-out if scheduled immediately following the conclusion of the last performance

-all work perfonned by wardrobe personnel in the hour prior to a 4 hour show call

- all work perfonned in the first eight (8) hours of a statutory holiday or other holiday

-all work perf01med after 18:00 by the Scenic Carpenters

7 .1.1.3 Double Time

7 .1.1.3 .1 Housepersons, Stagehands, Dressers/Wigpersons, Loaders, Drivers, Projectionists shall be paid at two (2) times the base rate for all work perfonned under the following circumstances:

- all work perfonned on the Dark Day

- all work perfonned between 24:00 midnight and 8:00

-all work perfom1ed in a put out call that goes over 4 hours when the put out immediately follows the last perfonnance.

-all work perfonned on Sunday by Scenic Carpenters

7 .1.1.4 Double Time and a Half

7 .1.1.4.1 Housepersons, Stagehands, Dresser/Wigpersons, Loaders, Drivers, Projectionists shall be paid at two and one-half (2 Y:!) times the base rate for all work performed under the following circumstances:

- all work done in excess of eight (8) hours on a statutory holiday or other holiday

7.2 Method of Calculation

7.2.1 The Union agrees that Overiime hours paid on a daily basis shall not be included when calculating overtime payable on a weekly basis, excluding Aliicles 6.16 and 6.17.

7.2.2 The Theatre agrees that the first eight (8) hours worked on statutory holidays and other holidays shall be included when calculating overiime payable on a weekly basis for Housepersons, Stage Hands and Dressers/Wigs.

7 .2.3 Hours worked in one depariment shall count towards hours worked in another.

7.2.4 All overtime hours for the Head Scenic Carpenter, First and Second Carpenters will be paid at the hourly rate in Section 7 .1.1.2.

7.3 Payroll Administration

7.3 .1 The employee shall complete accurate time sheets and provide them to the Production Manager no later than 10 am on the Monday following the work week to which the time sheet applies.

7.3.2 The Theatre agrees to furnish the Union's representative with copies of all time sheets and a summary detailing hours worked, gross wages, benefits paid, and deductions made during the relevant period when requested to do so by the Union's designated representative.

7.3.3 The Theatre agrees to be responsible for all payroll functions.

7.4 Insurance and Compensation

7 .4.1 The Theatre shall cover all personnel pursuant to this agreement with coverage pursuant to the Worker's Compensation Act, or suitable policy of accident and liability insurance.

7.4.2 The Union shall furnish a designated representative of the Theatre with a list of names of all personnel working on each call in a timely manner for the purpose of insurance or Worker's Compensation, as the case may be.

7. 5 G .r ·1J.11 Benefits

7.5.1 The Theatre agrees to submit monthly payments to the Union's Sick and Welfare Fund for all persol1llel employed pursuant to this agreement for the Benefit of the Union.

7.5 .1.1 For all employees, the amount of these payments shall be calculated on four (4) percent of the gross wages for each week.

7.5.2 The Theatre shall be exempt from any liability arising from the administration, save and except for any liability which may arise as a result of the Theatre's failure or refusal to comply with the obligations to make the contributions as and when required by this Article.

7. Group RRSP

7.6.1 The Theatre shall a) Pay to all employees, an amount equal to five percent (5%) of their gross earnings as contributions to the I.A.T.S.E. Local1 05 Group RRSP. The Employer shall forward t1lis amount directly to the Union on a monthly basis, and shall at the same time provide the Unions with a complete remittance breakdown listing the name of each individual for whom the contribution is made and the amount of the contribution. b) Deduct from all employees, an amount equal to five percent (5%) of their gross eamings as contlibutions to the I.A.T.S .E. Local 105 Group RRSP. The Employer shall forward this amount directly to the Union on a monthly basis, with a complete remittance breakdown listing the name of each individual for whom the contribution is made and the amount of the cont1ibution. c) The Theatre agrees that after five (5) years of continuous service that the amount deducted from Housepersons and the amount paid by the Theatre shall increase to six ( 6) percent of the gross eamings.

7. 7 Vacation Pay

7. 7.1 Housepersons with continuous service shall receive Vacation Pay on the following basis:

Year 1 - 1 0 inclusive 6% Year 10-20 inclusive 8% Year 20 plus I 0%

7. 7.2 The Theatre shall pay an amount equal to six ( 6) percent of the gross eamings of each Employee employed pursuant to this Agreement.

7.7.3 The Theatre shall pay existing Housepersons eight (8) percent ofthe gross eamings after (6) years of continuous service, ten (1 0) percent of gross eamings after twelve (12) years of service, and twelve (12) percent of gross wages after twenty (20) years service, payable upon the same te1ms set out in A11icle 7.7.2.

7.7.4 Continuous service shall be more than one full year of Employment including leaves or other absences up to and including one ( 1) year in duration.

7.7.5 Continuous service shall be deemed to be broken should a voluntary leave of absence exceed one ( 1) year or upon tenuination.

7.8 Long Tenu Disability and Life Insurance

7.8.1 Provided such coverage is available, the Theatre shall include Housepersons, if they so elect, in the Theatre's long term disability and life insurance plans in accordance with the Theatre's policy.

ARTICLE EIGHT JOINT STANDING COMMITTEE

8.1 To facilitate discussions on matters of mutual interest, the pmties to tlus Agreement shall establish a Joint Standing Conuuittee.

8.2 Representatives at such meeting will be limited to three (3) representatives of the Theatre, ofwhlch one (1) may be at the request of the Union, and three (3) representatives of the Union, of which one ( 1) may be at the request of the Theatre.

8..3 Meetings will be held at the request of either party on the Employer's premises.

8.4 Consultation may take place for the purpose of providing information, discussing the application of policy or airing problems, to promote understanding, but it is expressly understood that no cormuitment may be made by either pa1ty on any subject that is not within their authority or jurisdiction, nor shall any cormnitment made be construed as to alter, amend, add to or modify the tenus of tills agreement.

ARTICLE NINE GRIEVANCE PROCEDURE

9 . .1 Any misunderstanding or controversy between the Employer and the Union as the compliance of either pmty with any of its obligations hereunder, or any grievance involving the te1ms of this Agreement by the Union, the same shall be handled in the following manner:

Step 1: A complaint which is not settled by the immediate supervisor, shall be reduced in writing, and shall be filed with the Business Agent and the Executive Director. A meeting shall be mutually ananged within seven (7) working days. Those in attendance shall be the employee, his/her supervisor, the Business Agent and the Executive Director.

Step 2: If a satisfactory settlement is not reached at Step 1, the dispute shall be finally and conclusively settled, without stoppage of work, by submission to

Arbitration. A referral to arbitration will be made by either party in writing within 30 days of the receipt of the final decision in Step 1.

ARTICLE TEN ARBITRATION PROCEDURE

10.1 Where a difference arises between the Pa1ties relating to the interpretation, application or administration of this Agreement, including any question as to whether a matter is arbitral, or where an allegation is made that this Agreement has been violated, either of the Parties may, after duly exhausting the Grievance Procedure established by this Agreement, notify the other Pmty in writing of its desire to submit the difference or allegation to arbitration, under Section 44 or 45 of the Act and if under Section 44 the notice shall contain the names oftlu·ee (3) persons selected by the first pmty as being appropriate to act as the Sole Arbitrator herein. The recipient of the notice shall, within five (5) days, infmm the other pmty as to whether or not any of the tlu·ee (3) names submitted by the first party are acceptable to it as Sole Arbitrator, and in the event that recipient of the notice is not able to accept any of the three (3) names so put forward, it shall name tlu·ee (3) persons deemed appropriate by it to act as Sole Arbitrator herein. Within five (5) working days after such suggestions are received from the recipient of such notice, and in the event that none of the six ( 6) names so put fmward are acceptable to both parties to act as Sole Arbitrator, the patties jointly agree to request the appropriate govemment agency for the Province of Ontario to appoint a Sole Arbitrator to hear such grievance. The Arbitration Board shall hear and detennine the difference of allegations and shall issue a decision and the decision is final and binding upon the pa1ties and upon any employee affected by it.

ARTICLE ELEVEN EFFECTIVE DATE

11.1 This Agreement shall be deemed to have come in to force on July 1, 2013, and shall remain in force until the thirtieth day of June, 2018.

11.2 With the exception of the appendices hereto, it shall be renewed annually thereafter unless either party gives written notice of intention to bargain for a new agreement not more than ninety (90) days, and not fewer than thi1ty (30) days, inclusive, prior to the date at which it would othe1wise expire.

ARTICLE T'VELVE MANAGEMENT RIGHTS

12.1 The Union recognizes that it is the exclusive right of the Theatre to:

(a) Maintain order, discipline and efficiency;

(b) Hire, promote, demote, lay off and recall employees through the Union as specified in the terms of this agreement;

(c) Discipline and discharge employees for just cause;

(d) Make suoh reasonable mles and regulations, policy and practices, deemed necessary for the conduct and management of all perfmmance and working conditions.

(e) Generally manage the Theatre and without restricting the generality of the foregoing, to detennine the objectives of the Theatre, to be supplied with quality personnel, to plan, direct and control operations, prope11ies, facilities, programs, systems, and methods, to detennine maintenance of its premises, direct its personnel, detem1ine complement, organization, methods and number, location and classification of personnel required from time to time, the scheduling and assignments of work, the extension, limitation, curtailment or cessation of operations and all other rights and responsibilities not specifically modified elsewhere in this Agreement.

12.2 The exercise of the Theatre's rights shall be subject to the terms and provisions of this agreement, and the mles and regulations ofLocal105 I.A.T.S.E, and the Intemational Alliance of Theatrical Stage Employees and Moving Picture Teclmicians, AI1ists and Allied Crafts of the United States, its Tenitories and Canada, a copy of which shall be provided to the Production Manager. When these 1ights are exercised, it shall be in a manner which is fair, reasonable and consistent with the provisions and te1ms of this agreement.

12.3 The Theatre shall infonn the Union Business Agent and/or President of any change to policies and practices of the Theatre prior to enactment of said changes.

APPENDIX B: HOUSEPERSONS JOB DESCRIPTIONS

Head Stage Carpenter

• The Head Stage Carpenter shall be responsible to the Stage Manager dming the mnning of rehearsals and performances, and to the Production Manager at all times.

• He/she shall be responsible for exercising general powers of supervision over all other Depmiment Heads, with the exception of the Carpentry Shop.

• He/she shall be responsible for the direct supervision of the Stage Carpentry Crew, and for the indirect supervision of all other Union crews through the Heads of the respective Depmiments.

• In the event that a Depmiment Head is not present in the Stage Area, he/she shall supervise the crew of that depmiment directly.

• The Head Stage Carpenter may designate an alternate person to take on all his/her responsibilities in the event that he/she needs to leave the work area.

• The Head Stage Carpenter is designated as the senior Depatiment Head and as such shall be responsible for the efficient planning and execution of all shows coming on to the Grand Theatre stage, in consultation with the Production Manager. This shall include the setting up, movement, and dismantling of all scenery on the Stage Area, scene1y storage areas, orchestra pit and trap room. This scenery shall include the stmctural and mechanical elements excluding those designated as prope1iies that comprise the stage settings.

• The Head Stage Carpenter shall be responsible, within the limits of his expeiiise, for ensuring that all stage equipment is properly maintained, and that the stage and scenery storage areas are kept clear and in a safe condition.

• The Head Stage Carpenter shall be responsible for ensuring that all calls on the stage are provided with adequate labour to carry out the work assigned in a safe and efficient manner, in consultation with the appropriate Depmtment Head(s), Business Agent and the Production Manager.

• In the event that a Shop Steward or Crew Chief is not specifically designated, the Head Stage Carpenter shall act as such, and shall be the initial referee of complaints and/or grievances from members of the Stage Crew.

Head Scenic Carpenter

• The Head Scenic Carpenter shall be responsible to the Production Manager at all times.

• The Head Scenic Carpenter shall be responsible for the direct supervision of the Scenic Carpentry Crew, as well as providing and being accountable for the general supervision of the entire shop facility, not including the direction of non­carpentry personnel.

• The Head Scenic Carpenter is designated the Depmtment Head and shall be responsible for the safe and efficient construction of all Scenic Carpentry Elements and any fumiture pieces that need to be constructed for the Grand Theatre in consultation with the Production Manager. The Head Scenic Carpenter shall be responsible within the limits of his/her expertise for ensuring that all equipment related to the Carpentry Depmiment is properly maintained and where possible shall assist in the maintenance of the Shop Space.

• The Head Scenic Carpenter, in consultation with the Production Manager, shall be responsible for ensuring that an adequate inventory of material and hardware is maintained.

• The Head Scenic Carpenter shall be responsible to the best of his/her abilities for ensuring that other departments shall have access to Scenic Elements for fmther work that is not within his area of responsibility.

• The Head Scenic Carpenter in consultation with the Production Manager and the Business Agent, shall be responsible for ensuring all calls in the shop are provided with adequate labour to cany out the work assigned in a safe and efficient manner.

Head Electrician

• The Head Electrician shall be responsible for the safe and efficient set-up, running, dismantling, and storage of all electrical elements pe1iaining to the Grand Stage Area, including the hanging, cabling, gelling, patching, focusing of lights, setting cues, and the operation of the lighting system during rehearsals and perfom1ances as required by the Theatre.

• The Head Electrician shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and perfonnances, and to the Production Manager at all times.

• The Head Stage Electrician shall also be responsible for the maintenance and repair of all electrical equipment relating to the staging of theatrical presentations on the Grand Stage, including, within the limits ofhis expe11ise, the lighting

Head Soundperson

• The Head Soundperson shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and perfonnances and to the Production Manager at all times.

• The Head Soundperson shall be responsible for all the safe and efficient set-up, ru1ming, dismantling and storage of all materials relating to the Grand Stage sound system, and for the competent operation of the system during the running of any perfo1mances and rehearsals as required by the Theatre.

• He/she shall also be responsible for the creation of audio files and the programming of the playback system as required by the Theatre, for the safe storage thereof, for the cue light system and for the repair and maintenance of all sound equipment within the limits of his/her expe1tise.

Head Ftwerson

• The Head Flyperson shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and perfonnances, and to the Production Manager at all times

• The Head Flyperson shall be responsible within the limits of his expe1tise for the safe and efficient operation and maintenance of the counte1weight fly system and all equipment and hardware relating thereto. He/she shall be responsible for the safe and orderly storage of all rigging hardware, and of any related materials when not in use.

• He/she shall operate the system during all phases of setup, rehearsals and perfonnances as required by the Theatre.

First and Second Carpenters

• The First and Second Carpenters shall be responsible to the Head Scenic Carpenter for the construction of Stage Scenery.

Wardrobe Mistress/Master

• The Wardrobe Mistress/Master shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of on-stage rehearsals and

perfonnances, and to the Head of Wardrobe and the Production Manager at all times.

• The Wardrobe Mistress/Master shall supervise and assign duties to any additional Dressers/Wigs. At any time the Wardrobe Mistress may delegate any of her duties to Dresser/Wigs.

• The Wardrobe Mistress/Master shall be responsible for the safe and efficient set­up, running, dismantling, storage and maintenance of all wigs and wardrobe for all rehearsals and perfonnances on the Mainstage provided the dressing rooms are used by the perfonners. Responsibilities shall include specialty make-up and maintaining hairstyles for perfom1ers who require aid.

• The Wardrobe Mistress/Master shall take care of the transfer of costumes from the Production Wardrobe to the Dressing Rooms for the first Dress Rehearsal. After that, the costumes will be made available for the Production Wardrobe for any notes and alterations necessary until required for the rehearsals and/or perfotmances on the Stage.

• The Wardrobe Mistress/Master shall maintain the wig inventory under the supervision of the Head of Wardrobe. Tllis does not imply exclusive jurisdiction for the Union over the Wig inventory.

Property Perso,n

• The Property Person shall be responsible to the Head Stage Carpenter and the Stage Manager during the mnning of rehearsals and perfonnances, and to the Production Manager at all times.

• The Propetiy Person shall be responsible for the operation and safe storage of all elements considered propetiies ie. elements not wom or patt of the set (excluding costume props) on the Grand Theatre Stage.

• The Propetiy Person shall be responsible for the repair and maintenance of all stage propetiies within the linlits ofhis expetiise.

Extra Union Personnel

• Union Crew working on the Mainstage shall be responsible to the Head Stage Carpenter and the Depatiment Head for whom they are working.

,. Union Crew working at the shop shall be responsible to the Head Scenic Carpenter.

• Dresser/Wig people shall be responsible to the Wardrobe Mistress/Master.

. , The duties and responsibilities of extra Union Personnel shall be detennined by their respective Heads of Depm1ment in consultation with the Head Stage Carpenter on the Mainstage and by the Head Scenic Carpenter at the shop.

Projectionists.

• Where the Theatre stages a presentation which consist primarily of one or more motion pictures, or in which motion pictures fonn a substantial pm1, the Theatre agrees to employ one or more Projectionists to setup, operate, and dismantle the necessary equipment.

• The Union agrees that nothing in the foregoing provision shall be construed so as to include still or moving projection system or video used solely as Scenic Elements of a live stage production.

• When a projectionist is so employed, the Scenic Carpenter rate of pay and minimum call shall apply. The rate of pay for Scenic Element video shall be negotiated between the Union and the Theatre on a show by show basis.

• Where still or motion picture projection apparatus is used exclusively as a scenic element of a live stage production, stagehands shall be responsible for the setting­up, operation and dismantling of the necessary equipment.
