1. Bids are invited by the Myanma Oil and Gas Enterprise, No. 44, Complex, Nay Pyi Taw,

Myanmar for the supply of Data Acquision, Data Processing Center and Interpretation Workstation(8)Items

which particulars are attached to this Invitation. Documents related to these Bids are also attached .

2. The interested Bidders should submit the Technical Specifications with Original Bid Bond and

Commercial Quotation in each separate sealed envelopes on which to be addressed to the Managing

Director, Myanma Oil and Gas Enterprise and should reach in Tender Box of the Myanma Oil and Gas

Enterprise not later than 14:00 pm on 2 October 2018.

TERMS AND CONDITIONS

Tender which does not comply in every detail with the following terms and conditions shall not be

considered; -

1. DDP up to MOGE’s Tha Ke Ta Base, Yangon Unit and Total Prices in Myanmar Currency

(Kyats) must be quoted. Also your quoted Total Prices must be included 5% Commercial Tax.

2. If you could accept partial order, please mention minimum order value in technical specification

sheet.

3. The prices are to be valid for 120 days from the closing date of 2 October 2018. The quotation

valid for a shorter period shall be rejected by the M.O.G.E as non-responsive Offer.

4. TO ADVISE

( A ) Earliest delivery period.

( B ) Country of Origin.

( C ) The Name of Manufacturer.

( D ) The Name of Port of Shipment.

5. BID SECURITY (BID BOND)

5-1 The bidder shall furnish, as part of its bid, Bid Security in the amount of Kyats

2,900,000.00 which must be valid Six (6) months from your submission date.

5-2 The bid security is required to protect the M.O.G.E against the risk of Bidder’s conduct

which would warrant the security’s forfeiture, pursuant to Sub-Clause 5-7.

5-3 (a) Bids not accompanied by Bid Security (Bid Bond) (Original) issued by any Bank

shall not be considered.

(b) One Bid Security shall be accepted only for One Offer (One Option).

5-4 Any bid not secured in accordance with Sub-Clause 5-1 will be rejected by the M.O.G.E

as non-responsive.

5-5 Unsuccessful Bidder’s bid security will be discharged / returned as promptly as possible

but not later than (30) days after the expiration of the period of the bid validity prescribed

by the M.O.G.E pursuant to Clause-3

5-6 The successful Bidder’s bid security will be discharged upon the Bidder’s executing the

Contract and furnishing the Performance Bank Guarantee.

5-7 The Bid Security be forfeited;

(a) If a Bidder withdraws its bid during the period of bid validity, pursuant to Clause 3.

(b) In the case of successful Bidder, if the Bidder fails;

(i) To sign the Purchase Contract ; or

(ii) To furnish performance Bank Guarantee.

6. DEADLINE FOR SUBMISSION OF BIDS

Technical Specifications and Commercial Quotation in each separate sealed envelopes must be

delivered into the Tender Box located at the address specified under Clause-18 not later than

14:00 pm on 2 October 2018.

7. LATE BIDS

Any bid received by the M.O.G.E after the deadline for submission of bids prescribed by the

M.O.G.E pursuant to Clause-5, will be rejected and / or returned unopened to the Bidder.

8. PERFORMANCE BANK GUARANTEE

Within ten (10) days of the receipt of Purchase Contract the successful Bidder will be required to

furnish the Performance Bank Guarantee in accordance with the Conditions of Contract, the

Performance Bank Guarantee shall be in the amount of ten (10) percent of the Contract price.

9. REQUIRED DOCUMENT FOR BIDDING

The following documents shall be contained in the bidding as a minimum:

(A) Company Registration and Profile Copy.

(B) Track Record.

(C) Financial Statement. (Latest Audit Report)

(D) Document Copies for Tax and Duty Paid.

10. PAYMENT

( A ) Payment will be made by Kyats in Cross Cheque within 30 Days upon receipt of goods at

MOGE’s Tha Ke Ta Base, Yangon. 2% Withholding Tax will be Deducted and

Transferred to INLAND REVENUE DEPARTMENT’s Account by Name of Supplier.

( B ) No Interest will be charged for delayed payment due to unfavorable circumstances at the

Buyer’s side.

11. To advise Beneficiary’s Name, Address and Banking Details.

12. In the event of purchase, MOGE’S Standard Terms and Conditions of Contract shall be applied.

13. Stamp duty for executing of the Contract shall be borne by SUPPLIER in accordance with

Internal Revenue Department.

14. MOGE reserves the right to reject any partial or whole bid without furnishing reasons.

15. The supplier needs to provide Technical Proposal with the complement of terms and conditions

such as specifications, catalogue, manufacture’s Name, Brand Name, Country of Origin, Model

No, Diagram, Testimonial Certificates, Price Validity, Delivery, Port of Shipment, Payment

Terms and etc ., and Commercial Proposal with Total DDP up to MOGE’S Tha Ke Ta Base,

Yangon value demonstrated by break down price only.

16. The representative of suppliers shall be invited to attend the Tender Opening Meeting. In the

Tender Opening meeting, we shall announce only the list of the suppliers submitting both the

Commercial Proposal and the Technical Proposal completely. Please notice that the illegible and

incomplete offer will not be considered. The Technically acceptable suppliers shall be again

invited to the Tender meeting of the M.O.G.E and we shall open the Commercial Proposals and

slide show the prices.

17. Due to the Price Negotiation Meeting will not be held for the Bid, only one supplier who

submitted lowest DDP up to MOGE’S Tha Ke Ta Base, Yangon price with technically acceptable

shall be chosen to award so that the price should be reasonable and lowest.
