SIGHT DRIVEWAYS / TRANSPORTATION NOTE:
THE 8/10 OF A MILE SECTION OF WRIGHTSVILLE AVENUE LOCATED BETWEENTHE INTERSECTION OF WRIGHTSVILLE AVENUE/MILITARY CUTOFF AND THEINTERSECTION OF WRIGHTSVILLE AVENUE/EASTWOOD ROAD IS CURRENTLY ASTATE HIGHWAY (SR 1411/2782) MAINTAINED BY THE NCDOT. THE NCDOT ANDTHE CITY OF WILMINGTON (“CITY”) ARE CURRENTLY ENGAGED IN DISCUSSIONSWHICH, IF MEMORIALIZED IN A DEFINITIVE AGREEMENT, WOULD ALLOW THECITY, AT ITS ELECTION, TO MAKE IMPROVEMENTS TO WRIGHTSVILLE AVENUE INACCORDANCE WITH THE CITY'S COMPLETE STREET POLICY ADOPTED IN 2011 INORDER TO PROMOTE ECONOMIC DEVELOPMENT AND IMPROVE PUBLIC SAFETY.
THE PROPOSED AGREEMENT BETWEEN THE CITY AND NCDOT COULD INCLUDETHE FOLLOWING PROVISIONS: THE NCDOT WOULD (A) ABANDON THE SAIDPORTION OF WRIGHTSVILLE AVENUE, (B) PROVIDE FUNDS TO THE CITY FOR THEPURPOSE OF MAKING IMPROVEMENTS TO THE SAID SECTION OF WRIGHTSVILLEAVENUE AS DEEMED APPROPRIATE BY THE CITY IN ITS SOLE DISCRETION, (C)MAKE IMPROVEMENTS AT THE INTERSECTION OF MILITARY CUTOFF ROAD ANDWRIGHTSVILLE AVENUE TO IMPROVE THE LEVEL OF SERVICE AT THATINTERSECTION BY AMENDING THE SCOPE OF NCDOT PROJECT U-5710, WITHTHE SCOPE OF SUCH IMPROVEMENTS TO SUBSEQUENTLY BE APPROVED BYTHE NCDOT AND THE CITY.
IN CONNECTION WITH THE PROPOSED AGREEMENT, THE CITY WOULD (A)ADOPT THE SAID SECTION OF WRIGHTSVILLE AVENUE ONTO ITS MUNICIPALSTREET SYSTEM AND ASSUME FUTURE MAINTENANCE FOR THIS SECTION AND(B) RECEIVE THE FUNDS FROM THE NCDOT FOR THE PURPOSE OF MAKINGIMPROVEMENTS TO WRIGHTSVILLE AVENUE. UNDER NO CIRCUMSTANCESWOULD THE CITY BE OBLIGATED TO MAKE IMPROVEMENTS TO WRIGHTSVILLEAVENUE BEYOND THE LEVEL OF FUNDING PROVIDED BY NCDOT UNLESS ANDUNTIL ADDITIONAL IMPROVEMENTS ARE APPROVED BY CITY COUNCIL.
FURTHER, STATE STREET-GALLERIA, LLC HAS AGREED TO PROVIDE FUNDING TOTHE CITY IN THE AMOUNT OF $500,000.00 AS ITS CONTRIBUTION TO THETRANSPORTATION IMPROVEMENTS. THE CITY AND STATE STREET-GALLERIA,LLC ARE CURRENTLY IN THE PROCESS OF MEMORIALIZING THE FUNDINGCOMMITMENT FROM STATE STREET-GALLERIA, LLC IN A DEFINITIVEAGREEMENT.
THE DEVELOPMENT OF THE GALLERIA IS EXPECTED TO OCCUR OVER TIME WITHFINAL COMPLETION OF THE PROJECT EXPECTED TO OCCUR IN 2025. THE TIADATED MAY 1, 2019 ASSOCIATED WITH THE GALLERIA WAS APPROVED BY THENCDOT AND WMPO. DUE TO THE PROJECT BEING COMPLETED IN PHASES OVERTIME, OFFSITE TRANSPORTATION RECOMMENDATIONS PROPOSED IN THE TIAARE NOT REQUIRED TO BE COMPLETED IN CONNECTION WITH THE INITIALPHASES OF THE DEVELOPMENT. THE WMPO WILL MONITOR THE RATE OFDEVELOPMENT AND THE CORRESPONDING TRAFFIC IMPACTS FROM THEDEVELOPMENT FOR THE PURPOSE OF DETERMINING THE APPROPRIATE TIMINGOF TRANSPORTATION IMPROVEMENTS.
AS SET FORTH IN THE TIA, THE PROPERTY OWNER IS REQUIRED TO REDUCETHE NUMBER OF EXISTING ACCESS POINTS FROM SIX (6) ACCESS POINTS TOTHREE (3) ACCESS POINTS. THE THREE (3) APPROVED ACCESS POINTS AREDEPICTED IN THE ACCOMPANYING PLANS AND WILL BE CONSTRUCTED IN THISPHASE. THE DEVELOPER WILL CLOSE THE ABANDONED ACCESS POINTS DURINGTHIS PHASE OF CONSTRUCTION.
