The Future of Intellectual Property and Standards - What Do the Data Tell Us?How do practitioners use the data?

Tim PohlmannCEO IPlytics GmbH

Patents and Standards Data

Patent Databases have little correlation to Standard Databases

from SSOs.

SSO databases are difficult and time-consuming to use.

Any SEP found is frequently divorced from other vital patent information.

Standard Database information can not be used for stand-alone analysis

e.g. Competitive Intelligence

PersonasPORTFOLIO MANAGER

• Does our IP strategy match our business strategy?

• What are the strengths and weaknesses of our portfolio as it relates to SEP?

• How does my SEP portfolio compare to my competitors?

• How does my SEP portfolio relate to different technology generations?

• Are we aligned in our R&D efforts?

TRANSACTION AND LICENSING

• How can I be sure I have the advantage in negotiations?

• What patents and from whom should I buy, license?

• How can I monitor the changing SEP landscape?

• How can I monitor SEP licensing?

STRATEGIC IP ATTORNEY/LEGAL

• What SEP assets do we own?• What technologies/Standards are

covered by our SEP portfolio?• What is their value/status?• Are we declaring enough assets and

early enough?• Can we invalidate patents by standard

contribution related prior art?

Takeaways I

Licensing of SEPs:

o Access to patented standards is not straight forward as some SEPs are cross-licensed, other SEPs may be pooled and in some cases even pooled in more than one pool.

o IP professionals that want to license-in  SEPs  will  need…a. an overview of existing patent pools, as well asb. an overview of SEP ownership as well as c. understanding the different SSO’s  IPR  policies

o …to  have  all  information  at  hand  to  negotiate  a  license.

Takeaways II

Access to Data:

o IP professionals should not only consider information retrieved from patent filing data, but also monitor standardization activities through standards contributions or declarations of SEPs or pooling of SEPs to monitor market trends and competition.

o IP professionals need to be aware that while the market for 5G and other connectivity type technologies is fairly new,  it  is  now  time  to  be  thinking  about…

o what the business will need two, five and 10 years in the future? and

o hand in hand with that, what the patent portfolio will need to support that?

o Be proactive, not reactive. Do not get left behind!
