In the recent Presidential Primarydebates, in recent court decisions, andin Obama Administration rulings re-garding the implementation of healthcare law, there has much focus re-cently on the First Amendment'sFreedom of Religion clause. Somehave come to see recent court deci-sions, such as barring references toG-d in school assemblies, and newadministration rules for healthcarewhich limit "religious" activities tothose activities addressed only tomembers of their own reli-gion as part of an orches-trated War on Religion.Others strongly disagree.What is going on? And toquote the classic question,"Is it good for the Jews?"
The Obama Administra-tion is in the process deter-mining the rules which willgovern the new health caresystem under “Obamacare.”In an effort to balance theinterests of certain religious groupsagainst the proponents for all kindsof women’s reproductive health care,including birth control and steriliza-tion, the Administration has come upwith a compromise. “Direct” reli-gious activities, such as churches, syn-agogues, and mosques, would beexempt from requirements to providein the health care insurance they offeremployees things which the religionopposes. Roman Catholic churches,for example, would not be required toprovide birth control to women em-ployed in the actual churches. How-ever, other activities owned orsponsored by the churches, such aschurch-owned hospitals or colleges,would not be exempt from providingfor all kinds of women’s reproductivehealth care in insurance policies toemployees, even for birth control,even if the sponsoring church is the-
ologically opposed to such care. Thiswould apply to any church-ownedprograms which also accept or pro-vide services to non-members oftheir church. Catholic hospitalswould have to provide services op-posed by the religion if non-Catholicsare served by the hospital, as just oneexample. It seems that the only wayout for the Church would be to closeCatholic hospitals to anyone notCatholic.
Think of the most famous hospi-tals, nationally and locally. New YorkPresbyterian. Mt. Sinai. Maimonides.Cedars-Sinai. St. John's. Loma Linda.Providence Hospitals in Burbank,Tarzana, and Mission Hills. All ofthese are not-for-profit hospitals es-tablished by religious charities andmaintained in large part through do-nations and volunteer activity fromthe religious communities. Caring forthe sick, including the sick of otherreligions, is seen by many religiousgroups as a biblical requirement. Allmajor religions see caring for the sickas a religious duty.
The Obama Administration nowcomes and says it is only protected re-ligious activity if only members ofthe specific religious group areserved. A Catholic hospital that ad-mits non-Catholic patients is no
longer seen by the Administration asa protected religious institution. AJewish hospital cannot maintain aJewish religious designation if non-Jewish patients are also admitted.
The Administration's new regula-tions would similarly impact and re-strict groups such as the SalvationArmy from providing temporaryhousing, shelter, and food to Jews inneed, if the Salvation Army wished tocontinue to operate its housing pro-
gram as part of its reli-gious mission. As aformer rabbi in NorthSan Diego County wherethere were few Jewish re-sources, many newly un-employed Jewish parentsand their families wouldhave been denied thetemporary shelter theyneeded if barred frombeing sheltered by theSalvation Army. Thenew regulations would
also bar Jewish religious groups fromhelping Center City children or chil-dren in East Los Angeles with readinginstruction, such as that provided inthe highly popular Koreh L.A. pro-gram, if the literacy program is to beviewed as a religious activity with re-ligious protections.
Imagine the full effect and impactof the government telling religiousgroups they can no longer be seen asperforming religious activities ifthose activities serve individuals ofother religions. You must ask thehungry their religious affiliation be-fore you serve them. You have tolimit the distribution of clothing toonly co-religionists in need.
While there has been little reactionin the Jewish community to theObama Administration redefinitionof “religious activity,” I personally

find this move to be a major attackon religion. There is no protectionof freedom of religion when religionbecomes defined by the govern-ment. I certainly can see why manygroups see this governmental redef-inition of religious activities as an af-front to religion, “A War onReligion.” This particular health careregulation may have a greater impacton Catholics than Jews because ofthe clear restrictions on the use ofbirth control within the CatholicChurch. Ordering the CatholicChurch to pay for birth control foremployees is a violation of its under-lying religious dictates. But the im-pact goes far beyond healthcare.The whole idea of the First Amend-ment’s guarantee of freedom of re-ligion disappears if the governmentrestricts what constitutes religion.Because of the potential negativeimpact for the Jewish communityfrom governmental interference inreligion, this proposed regulation isnot “good for the Jews.”
This proposed regulation is justpart of what is going on regardingnew governmental restrictions on re-ligion. There is a recent court rulingwhich not only excludes invocationsand benedictions at public activities,such as school graduations, but pro-hibits the use of the word/nameG-d in such assemblies. A judgewent so far as to threaten a publicschool district superintendent withjail time if G-d were to be men-tioned by any student or school staff.
While some Jews hail this kind ofdecision as actually protecting Jewsfrom mentions of Jesus, this restric-tion of religious expression cutsboth ways. Imagine an OrthodoxJew giving a valedictory addresswithout saying words such as BaruchHashem, or thank G-d. Barring in-dividuals from such free expression
go beyond the elimination of prayerfrom school assemblies. These rul-ings bar everyday speech and expres-sion impacted by religiousbackground. Only the speech of thenon-religious who never make refer-ence to the Almighty is protected.
For the past 40 or more years,there have been attempts to rid themilitary of chaplains. Having thegovernment pay for ministers,priests, and rabbis is seen by manynot just as providing for freedom ofreligion, but actually funding thepractice of religion. But those whooppose the funding of chaplains areblind to the role of chaplains in themilitary. There is a popular, proba-bly true expression: There are noatheists in a foxhole.
In an environment where peoplequestion their faith or seek out inprayer to a higher authority, if therewere no chaplains in the military,there would be no access to religion,and therefore no freedom of reli-gion. When I was stationed at CampPendleton Marine Corps Base as aNavy chaplain, I soon realized thatthe only access to organized religionavailable to most of those stationedat the base was provided by chap-lains. The nearest synagogue formany housed at the base if therewould be no rabbi or Jewish chapelat the base was 30-40 miles away, oreven a greater distance off base.Marines and sailors who have nocars or other transportation to thesefar away synagogues could not at-tend Shabbat or holiday services.New recruits undergoing basic train-ing are not even permitted to leavethe base. In the trying and difficulttimes of the grueling training period,these recruits often question theirfaith and commitments. Denyingaccess to chaplains would be denyingaccess to their religion. Furthermore, the only pro-tected confidential discus-sions on a military base arethose with a chaplain.Records of discussion with apsychologist, a psychiatrist, ora physician can be demandedand reviewed by a command-ing officer. Only conversa-tions with a chaplain areprotected communication.With enlisted and officers ex-periencing frequent encoun-ters with life and deathcircumstances, the role of thechaplain is not only pro-tected, but treated as sacro-sanct in the military. It is thechaplain who is the only per-son to turn to when onequestions his or her con-science in regard to militaryservice.
Those who seek to elimi-nate the role of the chaplainprobably never served in themilitary. They shout outabout separation of churchand state, but ignore the reli-giously charged environmentof the military where ultimateissues of service and themeaning of life permeate thedaily activities of those whoserve.
What kind of society havewe become when we protectthe right to listen to or “sing”rap music at school, includingdegrading terms for women,but we outlaw the saying ofG-d’s name within the sameschool? We permit and pro-mote groups supporting dif-ferent forms of sexualexpression, but restrict prayer
groups. (I personally favorthe ability of many special in-terest groups to meet oncampus, including religiousgroups.) We see teachers en-courage a middle school boyin Ventura County to wearhigh heels if he so wants,while the same school maybar the wearing of a t-shirtwhich may be seen as pro-moting a specific religion.We promote an open societygenerally, but close that soci-ety to the expression of reli-gion.
I do not fear those who ex-press or promote religiousvalues. In fact, I see our so-ciety as having been enrichedand strengthened by thosewho have pursued religiousideals. The works of reli-gious leaders and the expres-sion of religion were basic tothe life work of ReverendMartin Luther King, RabbiAbraham Joshua Heschel,and Mother Teresa, workwhich has so positivelyshaped our modern society.We are a better nation be-cause of the impact broughtabout by the pursuit of suchreligious values.
It is not good for the Jewsto have a government whichdetermines what is religiousand what is not religious. Wemust stand vigilant in theprotection of Freedom ofReligion. The loss of reli-gious freedom or the restric-tion of such freedom by thegovernment would be agreater loss than any benefitwhich might accrue from thenew healthcare regulations. •

The portion of Yisro contains per-haps the most popular of all Biblicaltreatises The Ten Commandments.But the portion contains much morethan commandments. It also containsHashem's elocution defining his peo-ple as the most treasured in theworld. What makes Jew chosen? Be-fore giving the Torah to them,Hashem enunciates the prerequisites."And now, if you hearken well to Me andobserve My covenant, you shall be to Me themost beloved treasure of all peoples, forMine is the entireworld" (Exodus19:5). Note: Ju-daism's exclusivityis not dependant onbirthright alone. Itis dependant oncommitment toTorah and Mitzvos.It is not a restrictedclub, limited only tothose whoare born asJews, de-scendants ofAbraham, Isaac and Jacob; it is alsoexclusive to those who commit toobserve, whether, of Asian, African,or European descent. Thus, theTorah clearly states that those whohearken and observe the covenantare worthy to be a beloved treasure.
What needs clarification is the finalstatement, "for Mine is the entireworld." What difference does thatmake in the context of commitment,and Hashem cherishing those whochoose His path?

As a young student in acheder – private Jewishschool, we were discour-aged from playing sports.Our teachers, calledRebbes, were from the oldcountry. They displayed anaversion to any kind of or-ganized sport. For manyof them sports meantbody worship and that wasa big no-no. For others,sports meant pitting theweak against the strongerteaching that the deciding factor inlife is that might counts and what wasright makes no difference. The Rebbesaid, “sports-dos is treif – not kosherand not productive. Sports broughtout the worst in people. You can gethurt, or worse, pick up violenttendencies.”
My friends of European familiestold me that only the irreligious freethinkers sent their children to sports,I felt that this too was not a validexplanation. Since a lot of Americankids that went to gym or soccergames were not free thinkers.Thinking that sports could be the
precursor of becoming faithless wascrazy.
Being one of the only Americanborn students among a class of Eu-ropean children I couldn’t understandwhat was treif with sports. Here inAmerica sports were the in thing. “A
healthy body – a healthy mind”. Iknew of some great Jews in sportslike baseball’s Hank Greenberg andSandy Koufax.
In high school I had a moreenlightened Rebbe who saw sports asa way to unify people of all colors andcreeds. He taught us the following. In
a game everybody learns toplay together that no one cango off and do whatever theywant to. Each player has aresponsibility to each other.The team spirit in playingtogether is what makes thewinning.
So sports become kosherand our school had a basket-ball team.
Later on I attended rabbini-cal seminary. I asked myteacher, an old rabbi in his80s, about sports. He saidsports are good for America.In the old country peoplehad nothing to do on week-ends for entertainment.They would drink and plan
pogroms consisting of killing,robbing and violence. Here inAmerica things are good. The peoplego to games and vent all their energywith something safe and sound.
Thinking about sports I becomeaware of an interesting anomaly. It’s

The most violent sport I can think of is boxing. Yet thatsport has had many Jewish boxers. Starting way back inEngland in 1764 with Daniel Mendoza; the father of the artof boxing. He wrote a book on the art of boxing and taughtdefensive boxing, dubbed “Hit and Hop.” Benny Leonardand Barney Ross were lightweight champions, Lou Tendler,Maxi Rosenblum and Jackie Kid Berg are Jews in the Hall ofFame and so are many others.
In December 1911, the Empire Athletic Club, located inManhattan, reported that Dr. Louis Wallach, known as LeachCross, “The Fighting Dentist,” won by a knockout in theninth round. He became the hero of the century
A story is told of an exchange that took place betweenWallach’s father, Chaim, and a friend. It seems that LouisWallach had adopted the non-Jewish name Leach so that hisfather, a very religious person, would not know of his son’snew profession. On the night of Louis’ 26th bout, anotherknockout, a friend greeted Papa Wallach with, “Gut Shabbosand Mazel Tov”. Mr. Wallach retorted, “My son – a bum! AYiddish bachur (Jewish young man) does not fight!”Orthodox Jews likened fighting to eating pork. However, hewas soon won over to his son’s profession.
Why would a seemingly Soccer, a innocent no-contact gamecause so much havoc while boxing, the killing machine game,has no such aftermath?
I think we may be losing the spiritual message of the games.The idea of healthy and sound winning to share spirit is lost.
We have lost contact with our souls.
The late Lubavitcher Rebbe, Rabbi Menachem MendelSchneerson, once commented on the game of soccer:“When a child has studied Torah and he wants to go out andplay ball, he should not be criticized. Rather, we must“educate the child according to his way,” i.e. show him howhe can play ball “for the sake of Heaven.” Recreationcontributes to his health which will, in turn, give him a greatercapacity to learn. Playing ball is like taking a pill. Whensomeone is sick, he must take pills to regain his health. Istaking a pill good? In this context, yes. Similarly, is playingball good? Since it contributes to the study,yes. The purposeof a Jewish child’s life is to learn Torah and fulfill mitzvahs.Playing ball can also contribute toward this goal. If he winshe thanks G-d for his victory.”
The Supreme Court forbidding students to lead in prayerbefore a game is wrong. The ruling drives home the messagethat sports are turning players and spectators to worshippingthe body and not the spirit. It has become a sad contact sportwhere players and spectators are only interested in them-selves.
I believe it would do America well not only to have a prayerbefore the game but a prayer after the game thanking G-dfor giving the human race the capability of competing in aharmonious fashion. The spirit of our competition has tolift the spirits of the spectators towards acknowledging thatsports can bring us all together for a good time. If we hadprayed before and after the Soccer game there would haveno losers only winners!

During a recent visit to New York, Los AngelesCounty Commissioner Howard Winkler met withpopular radio host Curtis Sliwa who is the CEO &Founder of the Guardian Angels. The GuardianAngels have managed "Community Safety Patrols"throughout the world for more than three decades.They are comprised of reliable and responsiblevolunteers who patrol streets, neighborhoods andcommunity events to safeguard citizens of all ages.
In light of recent muggings and burglaries in andaround our neighborhoods of Los Angeles,Commissioner Winkler along with other prominentcommunity members is spearheading an effort to setup safety patrols under the auspices of the GuardianAngeles in Jewish communities of Los Angelesmanned by both Jews and non-Jews. The GuardianAngeles have the experience and know-how to or-ganize and manage this type of partnership with locallaw enforcement.

Among the complicated fiduci-ary matters that this week's por-tion discusses, the Torah dealswith seemingly simple and mun-dane issues as well. The Torahtalks about donkeys. Heavily ladendonkeys that belong to yourenemy. The Torah tells us, "if yousee the donkey of someone you hate andyou refrain from assisting him, you shallrepeatedly help him" (Exodus 23:5).Obviously the interjected phrase"and you refrain from assistinghim" begs clarification. After all,if you mustn't refrain from help-ing him, why mention it in thefirst place? Rashi explains that thewords are to be read rhetorically,"Would you refrain from helping him?How can you let a personalgrudge take precedence over thepoor animal's pain? Surely youshall continuously help him."The Talmud (Bava Metzia32) takes the words at face value and explains that thereare actually certain situations where one must actually re-frain from helping unload donkeys. I would also like tooffer the verse at face value.
As a youngster, I heard the following story about thegreat mussar luminary, Rabbi Yisrael Salanter. RabbiSalanter was traveling by train from Salant to Vilna andwas sitting in a smoking car holding a lit cigar. A youngman accosted him by yelling about the putrid odor of the
smoke. Other passengers wereappalled. After all, they were inthe smoking car. Despite that,Rabbi Salanter extinguished thecigar and opened the train's win-dow to dissipate the fumes. Itwas only a few seconds beforethe young man slammed the win-dow down, while screaming atthe elderly sage for opening it.Rabbi Salanter apologized pro-fusely to the man young enoughto be his child, and buried him-self in a Jewish book of law.
Upon arriving in Vilna, theyoung man was horrified to seethrongs of people gathered toreceive one of Europe's mostprominent Rabbis. The man im-
mediately ran to thehome where RabbiSalanter was staying. Hebegan to beg forgiveness."Don't worry," explained
Reb Yisrael, "a trip can make one edgy. I bear no ill will.Tell me," continued the mussar master, "why did youcome to Vilna?"
The young man explained that he was looking to be-come an ordained shochet and an approbation from aVilna rabbi would be universally accepted. Rabbi Salantersmiled. "My own son-in-law, Reb Elya Lazer, can ordainyou. He is a Rav in Vilna. Rest up and tomorrow you cantake the test.

The next day, it was apparent that the man needed more thanrest, for he failed miserably. However, that did not deter RabbiSalanter. He encouraged the man to try again. For the nextseveral weeks, Rabbi Yisrael arranged for tutors and preparedthe young man well enough to pass Reb Elya Lazer's make-upexam along with the tests of a host of other well-known Vilnarabbis. He even arranged for the man to get a job.
Before leaving Vilna, the man appeared before Reb Yisraelwith tears in his eyes. "Tell me, Rebbe," he cried. "I was ableto understand that you could forgive me for my terrible arro-gance on the train. But why did you help me so much? That,I can never understand."
"Reb Yisrael sat him down, held his hand and explained. "Itis easy to say 'I forgive you'. But deep down, how does one re-ally know if he still bears a grudge? Way down in my heart I
actually was not sure. The only way to remove a grudge is totake action. One who helps another develops a love for theone he aided. By helping you, I created a true love which isoverwhelmingly more powerful than the words, 'I forgiveyou'."
The Torah tells us that if you see the donkey of your enemykeeling from its burden and you want to refrain from helping,know then, that now is the time to help. The minute your feetfalter, then it is time to quicken the pace, overpower your emo-tions and make a move. The Torah understands human natureall too well. The sub-conscience speaks very loudly and oftentells us to take three steps backwards. That is the time to makea move that will heal old wounds and close open sores. Over-powering kindness will not only help ease burdens off a don-key, it will make things a lot lighter for you as well. •

• 3 medium onions, sliced
• 4 green bell peppers,
sliced julienne
• 4 red bell peppers,
sliced julienne
• 3 cups white mushrooms,
cleaned and quarter-cut
• 6 large ripe tomatoes,
large dice
• 2 tablespoons tomato
paste
• 2 cups tomato juice
• 3 tablespoons chopped
shallots (about 3 to 4)
• 3 tablespoons chopped
garlic (about 7 to 8 cloves)
• 1 cup fresh basil leaves,
chopped (about 1/2 bunch)
• 1 cup fresh parsley leaves,
chopped (about 1/2 bunch)
• Salt and freshly ground
black pepper
• 12 (4 to 5-ounce) boneless
chicken breasts
Heat oil in a large saucepot and saute onions, peppers and mush-
rooms until onions begin to turn translucent and peppers begin to
soften. Add tomatoes, tomato paste, tomato juice, shallots, garlic,
basil and parsley. Season with salt and pepper. Let simmer 45 min-
utes until medium thickness.
Preheat a grill to high.
Season chicken breasts with salt and pepper. Grill on both sides
until cooked through. Arrange on serving platter and spoon sauce
around. Serve with a side of polenta (as you would mashed pota-
toes), and remaining sauce in a gravy boat.
