,withfullknowledgeofthenatureandimpactoftheweaponssystem,knowntotheManhattanprojectasearlyas1943;usedDUordnancebywayofattackaircraft,AH-64helicoptergunships,advancedcruisemissiles,CALCMamongothers.PGU-14APIuraniumpiercingmunitionsfiredbyVulcanCanoninstalledonA10Gunships,andAH-64ApachegunshipsapartfromtheBunkerbusterbombs(DUweapons)whichweredroppedfromF-16attackplanes.

ItisauthoritativelyestimatedbyindependentscientificinvestigationsandreportsonrecordbeforethisTribunal,andtheprosecutionconservativelyestimates,thatattheveryminimum500-600tonnesofDUordnancewereusedthroughout

AfghanistanincludingatToraBora,Shaikoot,Paktia,Mazare-e-Sharif,Jalalabad,Nangarhar,Khost,KundozandKabularoundBagramfromOctober2001afterthebombingscommencedon7thOctober2001,whereasDrMohammedDaudMirakioftheAfghanistanRecoveryFundreferstonotlessthan1000tonnesofDepletedandundepletedUraniumbeingused.

On16thJanuary2002,theSecretaryforDefense,Mr.Rumsfieldinabriefingconfirmedthat"highlevelsofradioactivecount"hadbeenconfirmedduetotheresultof"DepletedUraniumshellsonsomewarheads"-ProsecutionDocumentEx.E-122.MrPhilipCoyleSeniorAdviseroftheCentreforDefenseInformationinWashingtonDC,admittedthatDUweaponshadbeenusedinAfghanistan.

ThedocumentedreportsofMarcHeroldandDaiWilliams,ProsecutiondocumentsatEx.E-118andE-119;theSurveyoftheUraniumMedicalResearchCentre,WashingtonDC;ProsecutionDocument-E120;thereportsofDrMohammedDaudMiraki,AfghanRecoveryFund,referredtoabove,ProsecutionDocumentsEx.E-137andE-138,amongotherdocuments;referindetailtothewidespreaduseandeffectsofDUweaponsonthepeopleinAfghanistaninflictingslowandpainfuldeath,termedthe"silentgenocide";affectingtheunborn,alteringirreversiblythegeneticcodeofallthoseexposed.

Testimoniesoffathersandmother,madetothefieldteamsoftheUraniumMedicalResearchCentre(UMRC)arehorrifying:"WhatelsedotheAmericanswant?Theykilledus,theyturnedournewbornsintohorrificdeformations,andthey

turnedourfarmlandsintograveyardsanddestroyedourhomes.Ontopofallthistheirplanesflyoverandsprayuswithbulletswehavenothingtolose.wewillightthemthesamewaywefoughtthepreviousinvaders.(SayedGharibatToraBora).

MsLeurenMoretgavevitalevidenceofUnitedStatesmilitarypolicy,ontheuseofDUweapons,tracingthehistoryofitscreationandthepoliticsofitsuse-ProsecutiondocumentEx.E156.MsLeurenMoretdeposedthat-afterthebombingofHiroshimaandNagasaki,aninternationaloutcryandtabooagainstnuclearweapons,preventedthefurtheruseofnuclearandradioactiveweapons;thispolicywasabandonedin1991;adecisionwasmadebytheStrategicCommandintheUSAtoblurthedistinctionbetweenconventionalandnuclearweaponsbyintroducingDUintothebattlefield;thiswitnesshasaptlydescribedDUasthe"trojan

ThewitnessmaintainedthatitwasthecostfactorwhichmadeDUweaponryanattractiveweaponforthearmsindustry;thoughontheotherhandthecosttohumanity,wasanunacceptablecost;deposingfurther,thatDUbeingabyproductfromnuclearweaponsandnuclearpowerindustries;a"radioactive"hazard,aliabilitytotheDepartmentofEnergy;millionsoftonswerepassedontothe"military-industrial"complexforthemanufactureofweapons.Bysellingdepleteduraniumweaponstomorethan20countries,theDOEhasmadeaprofitablebusinessforthearmsindustry.

Intheseconddocumentproduced,memorandumdated1STMarch1991addressedbyLt.Col.M.V.Zeiman(afterthefirstGulfWarof1991)toMajorLarssonoftheStudiesandAnalysisBranchonthesubjectof"TheEffectivenessofDepletedUraniumPenetrators,ProsecutionDocumentEx.E-127,emphasizesthat"theimpactofDUpenetratorswereveryeffectiveagainstIraqiarmour..therehasbeenandcontinuestobeconcernregardingtheimpactofDUontheenvironmentDUroundsmaybecomepoliticallyunacceptableandthusbedeletedfromthearsenalweshouldensurethutureexistenceIbelieveweshouldkeepthisinmindwhenafteractionreportsarewritten".

Theinterpretationofthismemorandum,bythewitnessLeurenMoret,thatthismemoranduminfactdirected,thatafteractionreportsshouldbefalsified,toconcealtherealeffectsofDUweaponry,iscorrect.

Thethirdsignificantdocumentproducedbythiswitness,isthecommunicationdated19thAugust1993,ProsecutionDocumentEx.E-128,byBrigadierEric.K.Shinskei,attherelevanttimeBrigadierGeneral,GS,DirectorofTrainingforwardedtotheAssistantSecretaryoftheArmy(Installation,logisticsandEnvironment)onthesubject:ReviewofDraftReporttoCongress-HealthandEnvironmentalConsequencesofDepletedUraniumintheUSarmy.ThiscommunicationstatesthatafterOperationDesertStorm(thefirstGulfWar)theGAOexaminedtheArmy'sabilitytocontendwithDepletedUraniumcontamination.TheGAOpublishedadraftmemorandumwhichwasacceptedbytheDepartmentofDefenceon15thJanuary1993whichwasataskingmemorandumdirectingtheSecretaryofArmyto-
