Welcome To Our Symposium

Welcome everyone to The Arc New York’s 2017 annual Guardianship Training Symposium.

This year marks the 47th anniversary of The Arc New York Guardianship Program which provides support, care, advocacy, and assistance to 700 people with intellectual and developmental disabilities and their families throughout New York State. This year’s theme, Changing the Story: Guardianship and Evolving Alternatives, allows for a broad range of current topics to be explored by speakers renowned in New York State, nationally, and internationally. In keeping with the new paradigm, there will be a strong emphasis this year on Supported Decision‐Making. Our 2 ½ day conference is intended to provide the audience with a rich and diverse program replete with topical issues and innovative sessions. We are offering a pre‐conference intensive on Transforming End of Life Care with the MOLST Program: Improving Quality and Honoring Preferences for Persons with Intellectual and Developmental Disabilities presented

by internationally renowned Dr. Patricia A. Bomba, MD, FACP, and Lisa R. Volpe, Esq., Mental Hygiene Legal Service, Second Judicial Department. This training will offer the most current information on guardianship legislation; reform efforts in different areas of supported and surrogate decision‐making. We are very excited to have nationally renowned motivational speaker, Stephen “Dr. Bird” Birchak, Ed.D. Dr. Bird will speak on issues of positive psychology and has spoken to over 200,000 practitioners, professionals, and educators nationwide. We are also honored to have many other prominent moderators, speakers, attorneys, judges, and panelists who will help build on our ongoing efforts to educate and provide practical tools and guidance. We would like to thank all the presenters for their willingness to share their time and expertise with the participants. We hope that you will find the information presented in this Continued Legal Education (CLE) program to be useful as you proceed with planning, helping others in their daily lives, and supporting decision‐making now and in the future. Stephen “Dr. Bird” Birchak Ed.D. Author, professor, counseling psychologist, former college wrestling coach of the year, husband, father, and reformed class clown, Dr. Bird is a na onally recognized speaker on issues of posi ve psychology and has spoken to over 200,000 prac oners, professionals, and educators na onwide. He is the author of “It’s Not a Crisis‐ It’s an Inconvenience!” “The Jerk Whisperer” and the bestselling‐ "How To Build A Child's Character‐ By Tapping Into Your Own.” He speaks to audiences na onwide on how to tap into our best when our best is needed. Dr. Bird is also a strong advocate for “Kindness Educa on” in our schools as he has spoken to thousands of children throughout the na on, and has wri en a children’s book tled “The Bird and the Bear” based on his real life experiences. Dr. Bird offers small changes in our day‐to‐day behaviors that will allow us to reduce stress and deal with the most challenging of situa ons. By pu ng people at the “center” of their decision‐making process, SDM increases self‐determina on, or life control, which has been shown to improve life outcomes such as independence, employment, and community integra on. Funded by a five year grant from the New York State Developmental Disability Planning Council (NYS DDPC), Supported Decision‐Making New York (SDMNY) is crea ng an educa onal campaign about supported decision making (SDM) as an alterna ve to guardianship for a wide variety of stakeholders including people with I/DD, their families, providers, social workers, lawyers, judges and the court system. SDMNY is also conduc ng two pilot projects u lizing SDM, one to divert people with I/DD at risk of guardianship, and the second to use SDM to restore rights to persons currently subject to guardianship. SDM allows persons with I/DD to make their own decisions with support from trusted persons in their lives, thus retaining all of their legal rights, as opposed to guardianship, in which , under exis ng law, all of the persons legal rights are removed and s/he loses the right to make choices about where to live, with whom to associate, healthcare, etc. SDMNY’s work draws upon the human right of legal capacity set forth in the United Na ons Conven on on the Rights of Persons with Disabili es. 5:35 ‐ 6:00 pm ‐ Meet with Sponsors/Exhibitors & Door Prize Drawings …………..………………..Albenia/Foyer

The panelists will review significant li ga on and legisla on pertaining to reform of Ar cle 17‐A of the Surrogate's Court Procedure Act. A federal lawsuit was commenced by Disability Rights New York challenging the statute on cons tu onal and statutory grounds. The lawsuit was recently dismissed, but further remedies may be pursued and the dismissal may not preclude future li ga on. The panel will also address the various bills that were introduced in the Legislature in 2017 to modernize Ar cle 17‐A. The diverse panel made up of a orneys who prac ce in the public and private sector will offer different legal perspec ves on the need for reform and what we might expect to see in 2018 on the li ga on and legisla ve front.

Speaker: Nina A. Kohn, Esq., David M. Levy Professor of Law and Associate Dean for Research at Syracuse University College of Law; Faculty Affiliate, Syracuse University Aging Studies Ins tute Par cipants will be introduced to the “PRACTICAL” tool, a resource to help lawyers iden fy and consider decision‐making op ons for individuals with disabili es that are less restric ve than guardianship. The speaker, who was part of the team that developed the tool, will walk par cipants through the tool’s steps and give examples of how it might be used in prac ce. The speaker will also walk par cipants through the Uniform Guardianship, Conservatorship, and Protec ve Arrangements Act (UGCOPAA), which was adopted by the Uniform Law Commission in July. UGCOPAA is an updated version of the Uniform Guardianship and Protec ve Proceedings Act, originally promulgated in 1969 as part of the Uniform Probate Code. The new version aims to be er protect the rights of individuals subject to a guardianship or conservatorship. Among other things, the Act includes a clear prohibi on on imposing guardianship if less restric ve approaches such as supported decision‐making meet the person’s needs, new mechanisms for encouraging the use of limited guardianships over full ones, and improved approaches to monitoring guardians. The speaker, who served as the Reporter (or primary dra er) of the Act will discuss the key approaches and innova ons in the Act, and how advocates in New York State can use the Act to improve policy and prac ce.

Erica F. Berman is the Assistant Execu ve Director for Guardianship Services of The Arc New York, and

has been employed by the organiza on for 34 years. Ms. Berman is responsible for the overall administra on of one of the largest non‐profit corporate guardianship programs in New York State, which currently serves as primary, and standby or successor guardian for more than 700 individuals with intellectual and developmental disabili es.

During her tenure at The Arc New York, Ms. Berman has served on a number of local, state, and na onal boards, steering and advisory commi ees, and has contributed to publica ons which have addressed such topics as guardianship, health care surrogacy, Supplemental Needs Trusts and other future planning alterna ves. She was one of the founding members of the nonprofit Guardianship Associa on of New

York State (GANYS) in 1995, an organiza on of professionals, family members and other individuals commi ed to suppor ng guardians and other surrogate decision makers in enhancing the lives of people who require supports. Ms. Berman has coordinated, collaborated on and par cipated in numerous educa on programs throughout New York State on guardianship and related topics and she serves on the panel for the Surrogate Decision‐Making Program, which is administered by the NYS Jus ce Center for the Protec on of People with Special Needs. For more than thirty years, she has assisted with the coordina on of statewide conferences on topics related to guardianship, surrogate decision making, and future care planning that have been held in the Capital Region and in other regions of New York State. Ms. Berman has also served as a board member of the Na onal Guardianship Associa on (NGA), and was appointed as an original Trustee of the Na onal Guardianship Founda on from 1995‐2000. In addi on to serving on the editorial board for and contribu ng to the publica on on Planning for the Future: A Guide for Families and Friends of Persons with Developmental Disabili es, Ms. Berman was a primary contributor to the OMRDD publica on, “Health Care Choices” which is designed to familiarize New Yorkers with health care decision op ons that are available for individuals who have intellectual and developmental disabili es and their families. This was originally published in 2004.

Ms. Berman a ended College in Nashville, Tennessee where she received her Bachelors and Masters Degrees in Special Educa on and Mul ple Disabili es from George Peabody College for Teachers of Vanderbilt University.

Dr. Stephan “Dr. Bird” Birchak, Ed.D., is an author, professor, counseling psychologist,

former college wrestling coach of the year, husband, father, and reformed class clown, Dr. Bird is a na onally recognized speaker on issues of posi ve psychology and has spoken to over 200,000 prac oners, professionals, and educators na onwide. He is the author of “It’s Not a Crisis‐ It’s an Inconvenience!” “The Jerk Whisperer” and the bestselling‐ "How To Build A Child's Character‐ By Tapping Into Your Own.” He speaks to audiences na onwide on how to tap into our best when our best is needed. Dr. Bird is also a strong advocate for “Kindness Educa on” in our schools as he has spoken to thousands of children throughout the na on, and has wri en a children’s book tled “The Bird and the Bear” based on his real life experiences. Dr. Bird offers small changes in our day‐to‐day behaviors that will allow us to reduce stress and deal with the most challenging of situa ons. Dr.

Stephen Birchak has become one of the na on's foremost experts in human rela ons in the home, workplace, and in educa onal se ngs. His principles involving human character have been used by parents, teachers, execu ves, corporate leaders, and children. Dr. Birchak was named the 2015 New York State Champion of Character.

Dr. Patricia A. Bomba, MD, FACP, is a na onally‐recognized expert who currently serves as the

Vice President and Medical Director, Geriatrics for Excellus Health Plan, Inc. and subsidiaries of The Life me Healthcare Companies. In her current role, she serves as a geriatric consultant on projects and program development affec ng seniors. She is a na onally recognized pallia ve care and end‐of‐life expert who designs and oversees the implementa on of community projects. Prior to her work at Excellus Health Plan, Inc., she was engaged in private prac ce in Internal Medicine and Geriatrics in Rochester, New York. Dr. Bomba is New York State’s representa ve on the Na onal POLST Paradigm Task Force, a mul state collabora ve. In addi on to serving as a New York State Delegate to the White House Conference on Aging, she served as a member of the Review Commi ee of the Na onal Quality Forum’s “Framework

Christy A. Coe, JD, MS, is a Principal A orney on the staff of the Mental Hygiene Legal Service, Third

Ms. Coe is a 1988 graduate of St. John's University School of Law. In 2013, she a ained her Masters of Science in Bioethics from Union Graduate College (now Clarkson University)/Icahn School of Medicine at Mount Sinai. Her recent ar cle, "Beyond Being Mortal, Safeguarding the Rights of People with Developmental Disabili es to Efficacious Treatment and Dignity at the End of Life," published in the NYS Bar Associa on Journal in October 2016, was based on her Master's Project. Katharine Wilson Conroy, Esq., received her B.A. degree from Newton College of the Sacred

Heart, Newton, MA. She received an M.A. degree from Teachers’ College, Columbia University. A er teaching English full me at White Plains High School and then part‐ me at New Rochelle High School Extended Day Program while she was raising her children, Ms. Conroy a ended Fordham University School of Law, from which she received a J.D. degree. Ms. Conroy spent over 30 years with the law firm previously known as Kent, Hazzard, Wilson, Conroy, Verni & Freeman, LLP, first as an associate and then as a partner. Her prac ce with Kent, Hazzard focused on trust and estate planning and administra on. Her prac ce also included residen al real estate transac ons. In early 2011, Ms. Conroy le Kent, Hazzard and became Of Counsel to Ber ne, Hufnagel, where her prac ce con nues to be in trust and estate planning and administra on and residen al real estate.

Ms. Conroy has been ac ve in community affairs throughout her adult life, including having served for four years as President of The Arc New York, the largest not‐for‐profit provider of services to New Yorkers of all ages with intellectual and other developmental disabili es. She serves at present as the Chairperson of the NYSARC Guardianship Commi ee, and also serves as a Trustee of the NYSARC Trust Services which provides the largest Pooled Trust Program in the Uni es States. Ms. Conroy is on the Boards of The Arc of Westchester of the VNS Westchester. She lives in New Rochelle, NY, where over the years she has served at different mes as a Trustee of the New Rochelle Public Library, Chairman of the Zoning Board of Appeals, and member of the City Council. Ms. Conroy is a member of the New York State, Westchester and New Rochelle Bar Associa ons and enjoys her five children, four in‐law children and ten grandchildren.

Joan Cornachio is the Educa on & Training Coordinator for SDMNY. She has been an advocate

and private consultant to families of students with I/DD and au sm for the past 15 years in New York and Western Massachuse s, helping students and families access resources and programming through their local school districts. Joan has also had a long career as a music educator and program director in both mainstream and segregated se ngs. She has used music to build awareness of disability and diversity by direc ng inclusive choirs for young people with and without disabili es in performances and showcases. She was the director of the Berkshire Hills Music Academy Summer Program in South Hadley, MA where she supervised and implemented programming for young adults with I/DD in a residen al se ng. She holds an MS in Educa on from

Syracuse University with a concentra on in Disability Studies. As the mother of two children, including a young adult with I/DD, she has witnessed first‐hand the viability of supported decision‐making as an alterna ve to guardianship.

Lawrence R. Faulkner, Esq., is General Counsel and Director of Corporate Compliance at Arc

Westchester (Westchester County Chapter, The Arc New York). He is Chair of the Health Law Sec on of the New York State Bar Associa on and a member of its Commi ee on Ethical Issues in the Provision of Health Care and a member of the Associa on’s Commi ee on Disability Rights. Prior to joining Arc of Westchester he was the Deputy General Counsel for the New York State Office for People with Developmental Disabili es, (OPWDD), formerly known as OMRDD.

Mr. Faulkner has authored ar cles and spoken on medical care decision‐making and the pa ent who has developmental disabili es; the New York State Do Not Resuscitate and Health Care Proxy statutes; abuse of older adults; guardianship, and supported decision making. Mr. Faulkner was instrumental in the dra ing and passage of the Healthcare Decisions Act for Persons with

Developmental Disabili es. He received a B.A. from Cornell University and a Master's degree and Juris Doctor from the State University of New York at Buffalo.

Lisa K. Friedman, Esq., A orney at Law and member of the Board of Trustees of the NYSARC Trusts, prac ces law in the area of planning for persons with disabili es and their rela ves,

Kris n Booth Glen, Esq., Dean Emerita, CUNY School of Law; Project Director, SDMNY; is

currently University Professor and Dean Emerita at CUNY School of Law. She has wri en and lectured widely on supported decision‐making (SDM). She currently directs the Supported Decision‐Making New York (SDMNY) project and serves on the New York State Bar Associa on’s Disability Rights Commi ee, while also advising the Na onal Resource Center on SDM and the Center for Public Representa on’s SDM pilot project. As Surrogate Judge of New York County, she wrote several groundbreaking decisions on guardianship and persons with Intellectual and Developmental Disabili es. She has also been Commissioner on the American Bar Associa on Commission on Disability Rights and involved in the Uniform Law Commissioners’ revision of the Uniform

Guardianship and Protec ve Procedures Act.

Honorable David H Guy, has served as Broome County Surrogate Court Judge since January,

2011. In addi on to Broome County Surrogate’s Court, Judge Guy handles the Mental Hygiene Law Ar cle 81 Guardianship ma ers throughout the 6th Judicial District and MHL Ar cle 9 cases in Broome County. He serves on the New York State OCA Guardianship Advisory Commi ee and the OCA Second Special Commission on Fiduciary Appointments.

Before becoming Surrogate, Judge Guy was a partner with the Binghamton firm of Coughlin & Gerhart, LLP, where he prac ced in the areas of estate planning and administra on, elder law, real estate, business planning and taxa on. Judge Guy received his BS from University of Rochester (1978) and JD from Albany Law School (1986). He is a member of the New York State and Broome

Honorable John S. Hall, Jr., is the Warren County Court Judge and Judge of the Surrogate’s

Court, where he presides over Ar cle 17‐A guardianship proceedings among his many du es. Judge Hall also serves as an Ac ng Supreme Court Jus ce. Judge Hall is a 1972 graduate of Ithaca College and a 1978 graduate of the New England School of Law. Judge Hall engages in many civic and professional ac vi es through the Warren County Bar Associa on and in 2015, was elected President of the New York State County Judges Associa on.

Kathryn E. Jerian, Esq., is General Counsel for The Arc New York located in Latham, New York.

She prac ces law in the areas of disability, guardianship, and non‐profit corpora ons. She works extensively in the area of advising The Arc New York and its Chapters on a variety of legal ma ers involving 17‐A guardianships, including counseling on a regular basis regarding the applica on of the law to ma ers of end‐of‐life decision‐making for individuals with developmental disabili es.

Ms. Jerian earned her J.D. in 2007 from Albany Law School, magna cum laude, and her B.A., summa cum laude, in 2000 from the University at Albany. She was the 2006 recipient of the Judge Bernard S. Nicole Jorwic, JD, Director of Rights Policy, The Arc, is the director of rights policy at The Arc of

the United States. Prior to joining The Arc policy team Nicole served as Senior Policy Advisor and Manager of the Employment First Ini a ve in Illinois. Prior to that appointment, Nicole served as the CEO/President of the Ins tute on Public Policy for People with Disabili es. Nicole is also an accomplished special educa on a orney and an advocate for students with disabili es and their families. Nicole is also a sibling, her brother Chris is 28 and has au sm.

Laura J. Kennedy, was elected as the 19th President of The Arc New York, and the largest

nonprofit organiza on of its kind in the na on suppor ng people with intellectual and other developmental disabili es and their families in 2014 at the Organiza on’s 65th Annual Conven on.

Kennedy currently serves as Director of the Early Childhood Direc on Center at Staten Island University Hospital in Staten Island, New York. She and her husband, Henry, (Hal) are the proud parents of four daughters, including one who has a developmental disability.

Kennedy has been ac ve in The Arc New York at both the statewide level for 13 years and serving on the New York City Chapter’s board for 24 years. She has served on The Arc New York Board of Governors represen ng the New York City Chapter, served as Senior Vice President, Vice President of the Southeast Region, Secretary, and chaired The Arc New York Membership Commi ee. She has also served as a member of numerous commi ees, including Ad Hoc Special

Commi ee on Structure, Educa on, Issues and Posi ons, Quality Standards Oversight and Ad Hoc NYSARC MCO Commi ees. She has served as President of the New York City Chapter of The Arc New York for two 3‐year terms and con nues to sit on the Chapter Board of Directors.

She and her husband are the co‐guardians for one of their young adult daughters, and their other adult children serve as standby guardians for their sister. Kennedy believes that both The Arc New York Corporate and Chapters’ Guardianship Programs have been instrumental in suppor ng people with developmental disabili es and their families in the community, and have promoted their independence and self‐determined lives.

Nina A. Kohn is the David M. Levy Professor of Law and Associate Dean for Research at Syracuse

University College of Law, and a faculty affiliate with the Syracuse University Aging Studies Ins tute. She currently serves as the Reporter for the Third Revision of the Uniform Guardianship and Protec ve Proceedings Act, Chair of the Elder Rights Commi ee of the Individual Rights and Responsibili es Sec on of the American Bar Associa on, Chair of the Aging and the Law Sec on of the Associa on of American Law Schools, and Co‐Director of the Aging, Law, and Society Collabora ve Research Network. Professor Kohn’s research focuses on elder law and the civil rights of older adults and persons with diminished cogni ve capacity. Her recent ar cles have addressed such issues as supported and surrogate decision‐making, financial exploita on of the elderly, vulnerability and discrimina on in old age, the prac cal and cons tu onal implica ons of elder abuse legisla on, the poten al for an elder rights movement, and legal educa on. She also authored the textbook Elder Law: Prac ce,

Policy & Problems (Aspen 2014). Consistent with her research interests, Professor Kohn has taught elder law, family law, trusts and estates, torts, and an interdisciplinary gerontology course. Professor Kohn earned an A.B. summa cum laude from Princeton University and a J.D. magna cum laude from Harvard University. She clerked for the Honorable Fred I. Parker of the United States Court of Appeals for the Second Circuit. Following her clerkship, she was awarded a fellowship by the Skadden Fellowship Founda on to provide direct representa on to nursing home residents and frail elders. In 2011, she received Syracuse University College of Law’s Res Ipsa Loquitur award recognizing excellence in teaching, and in 2012 she was selected as Syracuse University’s Judith Greenberg Seinfeld Dis nguished Faculty Fellow.

Jonathan G. Mar nis, Esq., is the Senior Director for Law and Policy for the Burton Bla

Ins tute at Syracuse University. Jonathan has over 20 years’ experience represen ng people with disabili es to protect their legal and human rights.

In 2013, Jonathan represented Margaret "Jenny" Hatch in the "Jus ce for Jenny" case ‐ the first to hold that a person has the right to use Supported Decision‐Making to make her own life choices instead of being subjected to a permanent, plenary guardianship. In 2016, Jonathan represented Ryan King in the first case in Washington DC to terminate a guardianship in favor of Supported Decision‐Making.

Jonathan has spoken to and trained thousands of people, families, and professionals across the country about everyone's Right to Make Choices and direct their own lives.

Jennifer J. Monthie, Esq., is the Statewide Director of the Protec on and Advocacy (P&A) for

Individuals with Intellectual and Developmental Disabili es (PADD), P&A for Assis ve Technology (PAAT), and P&A for Individuals with Trauma c Brain Injury (PATBI) programs at Disability Rights New York. Prior to her appointment to Director, Jennifer served as staff a orney and senior staff a orney of the PADD program at Disability Advocates, Inc.. Jennifer prac ces in the areas of educa on, community integra on, and civil rights of individuals with disabili es. She is a founding member and current chairperson of the New York State Special Educa on Task Force which fosters collabora on between schools, parents and advocates on Special Educa on. Jennifer is a frequent lecturer to a orneys and other professionals on issues affec ng individuals with intellectual and developmental disabili es.

Honorable Stacy L. Pe t, Surrogate’s Court Judge of Albany County, was admi ed to prac ce

law January 1985 in the State of New York and the US District Court for the Northern District of New York. She received her JD June 1984 from the Albany Law School of Union University, Albany, New York; was Research Assistant to Professor Katheryn Katz 1982‐1984 and assisted with research and wri ng of published law review ar cles. In 1983 she was the Albany Law School Client Counseling Compe on winner.

Judge Pe t has been the Surrogate's Court Judge, Albany County, Albany, NY, since January 1, 2015 to the present. She presides over probate proceedings and will contests, administra on of estates,

Judge Pe t served as Surrogate's Court Chief Clerk, Albany County Surrogate’s Court, Albany, NY, from February 2001 – March 2012. During this me, she implemented UCMS database and managed court caseload, resources, court financial accounts, court budget, sta s cal reports and records management to provide efficient and mely service to all court users. Performed legal review of pleadings filed with the court, conducted hearings, examina ons of witnesses and court conferences, performed legal research and dra ed court decisions, orders and decrees. Tara Anne Pleat, Esq., co‐owns the law firm Wilcenski & Pleat PLLC. She prac ces in the areas of special needs estate planning and administra on, tradi onal estate planning and administra on, long‐term care planning, and elder law. Tara graduated cum laude from Albany Law School with honors in the Estate Planning concentra on and earned her undergraduate degree from the State University of New York at Albany.

Tara is the Vice‐Chair of the Elder Law and Special Needs Sec on of the New York State Bar Associa on. Tara is the co‐editor in chief of the publica ons commi ee of the Elder Law Sec on of the New York State Bar Associa on which publishes the Elder and Special Needs Law Journal on a quarterly basis. In March of 2016, Tara was elected as a Fellow of the American College of Trust and Estate Counsel (ACTEC). ACTEC Fellows are selected on the basis of experience, professional reputa on and ability in the fields of trusts and estates and on the basis of having made substan al contribu ons to these fields through lecturing, wri ng, teaching and bar ac vi es.

Tara is a Past President of the Board of Directors of the Estate Planning Council of Eastern New York. In addi on, Tara is a graduate of the 2006 class of Leadership Saratoga, sponsored by the Saratoga Springs Chamber of Commerce, and currently is a member of the Leadership Saratoga Advisory Board. Tara is a Member of the Board of Directors of AIM Services, Inc., a disability service organiza on based in Saratoga Springs, New York. She is a Member of the Board of Directors of the Wesley Community, a con nuing care community for seniors in Saratoga Springs, New York as well serves on the Board of the Wesley Founda on. Tara also chairs the Planned Giving Commi ee of the Wildwood Founda on, an organiza on that supports Wildwood Programs, a school for individuals with disabili es in Albany, New York.

In the fall of 2012, Tara was appointed as an adjunct professor of law at Albany Law School, where she teaches a course in the spring semester on estate and financial planning for the elderly and individuals with special needs.

Tania F. Seaburg, Esq., is the Interim Execu ve Director for The Arc New York, the largest not‐

for‐profit provider of services to people with developmental disabili es in New York. The Arc New York has a presence in every county in New York State and provides services through forty‐seven dis nc ve Chapters. Ms. Seaburg is responsible for overseeing the implementa on of the organiza on’s strategic goals and objec ves, advancing a comprehensive advocacy agenda, and leading policy programs and opera onal departments of The Arc New York. Ms. Seaburg provides supervision and support in connec on with the The Arc New York Trust Services Department, the Guardianship Program, the Compliance & Quality Assurance Program, Program Services and Governmental Affairs. Ms. Seaburg is also ac vely involved in The Arc New York’s managed care efforts and ini a ves rela ng to the Office for People with Developmental Disabili es (OPWDD) Transforma on Agenda.

Prior to joining NYSARC in 2004, Ms. Seaburg was an associate in the health law department of the Albany law firm Hinman Straub P.C. Ms. Seaburg received her J.D., magna cum laude, from Albany Law School in 1999, and her B.S., summa cum laude, from Valley Forge Chris an College in 1993.

Robin Shaffert, JD, is the Senior Execu ve Officer, Individual and Family Support at The Arc.

Robin started working at The Arc in April 2014. Robin’s work at The Arc reflects her commitment to inclusion, equal opportunity, and social jus ce. Before joining The Arc, Robin was the Policy Director for the Caring Across Genera ons campaign, which is a coali on of over 200 diverse organiza ons commi ed to reforming long‐term services and supports for seniors and people with disabili es. Robin also served as Senior Director of Corporate Social Responsibility for the American Associa on of People with Disabili es (AAPD), where she led AAPD’s par cipa on with Workforce Flexibility 2010 and the Campaign for Disability Employment. She was formerly Deputy General Counsel of Booz Allen Hamilton Inc., an associate at Latham & Watkins, and a law clerk to United States District Court Judge Norma L. Shapiro. She is a magna cum laude graduate of the University

of Michigan Law School and Dartmouth College, and studied for a year as a Fulbright Scholar at the University of Hamburg, Germany. Robin has two adult sons with learning disabili es, grew up with a sister with congenital heart disease and other disabili es, and supported her parents as they ba led progressive diseases.

Sheila E. Shea, Esq. is a graduate of the University of Vermont and the Albany Law School of Union

University. She joined the Mental Hygiene Legal Service, Third Judicial Department in 1987 and in 2007 was appointed as its director. She is the recipient of the 2013 Hodgson/Jacobs Law Award presented by The Arc New York for demonstra ng outstanding commitment and dedica on to improving the lives of people who have intellectual and other developmental disabili es and the 2014 Cerebral Palsy Associa ons of New York Public Service Award. Sheila Shea is admi ed to prac ce law in the State of New York.

Ma hew Smith, Esq., is the Senior Project Coordinator of Supported Decision‐Making New

York (SDMNY), a five‐year consor um project between Hunter College/CUNY, New York State Associa on of Community and Residen al Services Agencies (NYSACRA), and the Arc of Westchester and funded by the New York State Developmental Disabili es Planning Council (DDPC). He has worked on pressing disability rights issues in the United States and abroad (Mexico, Argen na, and Bangladesh) and serves as a Research Associate at the Harvard Law School Project on Disability. He has authored amicus briefs in cases involving the UN Conven on on the Rights of Persons with Disabili es and his research has appeared in journals (ABA Journal of Labor & Employment Law, Arizona Journal of Interna onal & Compara ve Law, Nordic Journal of

Human Rights) and books (Derechos Humanos: Retos y Perspec vas, Oxford University Press (forthcoming)). He also serves on the board of Helping Educate to Advance the Rights of the Deaf (HEARD), a not‐for‐profit that advocates for deaf prisoners. He received his Juris Doctor from American University and his Bachelor of Arts from Harvard University. Most importantly, he is the proud brother of a college graduate with Down syndrome.

Nancy Succoso, Special Assistant to the Execu ve Director, Arc of Westchester, Nancy is an advocate,

educator and administrator for the Arc of Westchester Guardianship program. She received her BA from SUNY at New Paltz and MA from Teachers College, Columbia University. Nancy is currently involved with Supported Decision‐Making New York, and is interested in promo ng least restric ve alterna ves to guardianship.

Lisa Volpe, Esq., is a Principal A orney with the Special Li ga on and Appeals Unit of the Mental

Hygiene Legal Service (MHLS), Second Judicial Department. Her work includes appeals and trial support mo on prac ce in all areas of the mental hygiene law, as well as federal li ga on addressing systemic viola ons of the civil rights of individuals with mental disabili es. A significant focus of her appellate and trial prac ce has been ques ons rela ng to end‐of‐life decision‐making for individuals with mental disabili es, and the proper applica on of the Surrogate’s Procedure Act, Ar cle 17A and the Family Health Care Decisions Act.

Ms. Volpe is also a member of the legal wri ng faculty at the Benjamin J. Cardozo School of Law, teaching "Lawyering Skills and Legal Wri ng" to first year law students. In addi on, she recently worked

with faculty of the Sarah Lawrence College Health Advocacy Graduate Program to create an online cer ficate program educa ng primary care providers to the prac cal, legal and ethical considera ons of end‐of‐life planning and discussing Advance Direc ves with their pa ents. In the Spring of 2017, the New York State Bar Associa on Health Law Journal published an ar cle en tled Psychiatric Advance Direc ves: A New York Perspec ve, which Ms. Volpe co‐authored with three other members of MHLS. Prior to her associa on with MHLS, Ms. Volpe was an appellate court a orney with the New York State Supreme Court, Appellate Division, Second Department, where she worked in the law and mo ons departments, and was, for four years, the law secretary to the late Honorable Daniel F. Luciano. She began her legal career in private prac ce as a civil li gator in Los Angeles, California. Ms. Volpe received her JD in 1989 from Southwestern University School of Law, Los Angeles, California; she received her BA in 1978 from Sarah Lawrence College. She is a member of the New York and California Bars.

Parent to Parent of NYS, which began in 1994, is a statewide not for profit organ-ization established to support and connect families of individuals with special needs. The 13 offices, located throughout NYS, are staffed by Regional Coordi-nators, who are parents or close relatives of individuals with special needs. Parent to Parent of NYS is where families of individuals with special needs and the professionals who serve them can meet and share information. We've walked the walk and are here to help other families: Support – We offer parents/caregivers the opportunity to connect one-to-one

with a parent/caregiver of an individual with the same or similar disability or special health care need – someone who has “been there.”

Information & Referral – We help families locate the information and services they need

Trainings – Workshop are available on Understanding Medicaid Service Coor-dination, Record Keeping and Using a Health Care Notebook, and various other topics.

The organization’s parent-matching program is based on a model program used across the country. We assist a parent, who has a child with a developmental disability and/or special health care needs, by locating a volunteer support parent who has a similar experience. When a family initially receives a diagnosis, the emotional response can be overwhelming. Talking with another parent is an ex-cellent resource with helping come to terms with emotional acceptance. You are not alone.
