TERMS AND CONDITIONS FOR PURCHASE OF INDIAN MEDICAL JOURNALS

FOR YEAR 2015-16

1 Thane Municipal Corporation reserves the right to reject all or any

tender in part or completely without assigning any reason thereof.

2 Earnest money deposited as specified in tender notice must be paid

with tender form in cash/demand draft payable to Thane Municipal

Corporation Thane. at the extention counter Bank of Maharashtra

Mahapalika Bhavan Thane. and receipt of the same should be produced

at the time of filling of the tender, failing which the tender will be

rejected

3. If INDIAN MEDICAL JOURNALS are to be supplied through distributor,

the tenderer must mention Name and Address of distributor appointed

along with the consent letter from the distributor and or change of

distributor ,after filling the tender will not be considered.

4 INDIAN MEDICAL JOURNALS should be supplied as per publisher’s

publication within 60 days period from the date of publication, without

concrete proof and period for supply will not be considered

5 Library discount should be given separately for each item

6 If INDIAN MEDICAL JOURNALS are not supplied within specific period a

fine as decided during agreement will be levied per day and will be

recovered from the pending bill or from the tender deposite of tenderer

7 If Thane Municipal Corporation requires to purchase INDIAN MEDICAL

JOURNALS from other supplier due to failure of tenderer to supply

ordered books within specific period the excess amount ,incurred in

such purchase will be recovered from the tenderer’s pending bill or from

tender deposite

8 The INDIAN MEDICAL JOURNALS must be supplied as per specification

quoted by the tenderer in the tender form

9 Rejected /loss/missed INDIAN MEDICAL JOURNALS should be replaced

immediately by tenderer at their own cost.

10 Thane Municipal Corporation is not bound for purchase the same

estimated quantity books as mentioned in tender form however the

tenderer has to supply ordered quantity of books as per tender rate

sanctioned.

11. Rates should be quoted inclusive of all taxes ( e.g.excise duty,sales

tax,octroi tax,etc) along with packing and forwarding charges and

charges in Indian Currency

12. Ordered INDIAN MEDICAL JOURNALS must be supplied BY HAND

DELIVERY in Central Library , Rajiv Gandhi Medical \

College,Kalwa,Thane.on

all working days between 11.00 to 17.00 hours. INDIAN MEDICAL

JOURNALS supplied through post parcel,railway,ST parcel will be

rejected

13. The Thane Municipal Corporation will make payment of bill only after

fulfillment of all requirement of the bill within three months period

Part payment of bill under any circumstances will not be accepted.

14. Three tenderer will be selected for each tender item as “First”

“Second” “Third” selection respectively.If first selection tenderer fails

To supply the INDIAN MEDICAL JOURNALS within specified period ,

the order will automatically get cancelled and the books will be

ordered to next selected tenderer.

15. In case of any dispute in respect of supply or any other matter in

regards to sanctioned tender decision of Dean, Rajiv Gandhi Medical

College,Kalwa, Thane Municipal Corporation Thane will be final.

Tenderer will have to bear all expenses of both parties on any matter

raised to court for which the claims will be filed in Thane Municipal

Corporation Area ( i.e. Namely Thane Civil/Criminal Court)

16. Security deposit amounting to 5 % of the total ordered cost will be

deducted from the final payment and will be kept with Thane

Municipal Corporation

E-TENDERING

Sealed tenders are invited through e-tendering by two-bid system from

reputed publishers, distributors and suppliers for the supply of INDIAN MEDICAL

JOURNALS

Tender should remain valid for 180 days from the due date of tender.

Tenderers specifying validity less than 180 days shall be rejected

outright.Conditional tenders will not be accepted.

ENVELOPE NO:- I

TECHNICAL PART

Envelope No I will contain following documents in serial order:

1 Forwarding letter in prescribed Performa as per Annexure no. I.

2 Statement of particulars of publisher /distributor/supplier etc. in

prescribed Performa as per Annexure II.

3 E.M.D. (earnest money deposit) paid challan copy Every tenderer

will have to deposit an amount of By cash or D.D. D.D.should be

drawn in name of TMC E – Tendering Vide challan credited in the

Bank of Maharashtra Thane Municipal Corporation account. No

interest shall be paid on deposit.

4 Shop & Establishment clearance certificate

5 VAT Certificate

6 Membership of Bombay / Delhi Book sellers Association Letter

should be attached

7 Details about the past experience certificate in respect of supply of

medical books to state /central Govt. or their undertaking /semi Govt.

bodies and local authorities (with out disclosing rates their in ) not older

than 5 years (only Exp.certificates orders will not be considered)

8 Good Office Committee Membership Registration with Currency Conversion

rates

COMMERCIAL PART

This envelop will be opened for scrutiny only when documents as mentioned

above in envelope No. I are found acceptable The date and time of opening of

envelope II will be intimated to the responsive tenderer under certificate of

posting and the date of opening will not be earlier than seven days from the date

of issue of letter the same will also be notified on notice board of the hospital no

complaints for non receipt of such letter will be entertained.

Envelope No II should contain

1. Item wise rates in prescribed form

The rates should be quoted inclusive of all taxes, transportation,

octroi, packing and forwarding etc.

2 Discount offered on each item should quoted separately

3 Rates for all items are compulsory

GENERAL TERMS AND CONDITION

1. The decision of The Dean Rajiv Gandhi Medical Collage is final and binding. The

Dean Rajiv Gandhi Medical Collage do not pledge himself to accept the lowest or

any tender and reserves the right to accept the lowest or any tender and reserves

right to split the quantity amongst the eligible Tenderers and to relax any of the

conditions of this tender.The Dean Rajiv Gandhi Medical Collage reserves right to

reject any or all tenders with out assigning any reason.

2. The tender papers and other documents submitted by the tenderer should be

properly arranged numbered signed stamped and bonded.

3. All individual pages of tender form should be signed by authorized signatory of

the firm. The signing of each page of tender form is essential, as the tenderer has

to abide by the terms and conditions of tender. The stamp of firm should

accompany the signature. (Failing which the tender will be rejected outright)

4. Liquidate damage: -

The condition of the tender for damage for late delivery as liquidates

damages. In the event of late delivery, the purchaser (Then Municipal

Corporation) is entitled to recover fine from tenderer by way of liquidator damage

as shown below after the agreed delivery period is over. Without concrete proof

and genuine reasons extension period for supply will not be consider. Application

for such extension should be made before expiry of supply date. The Dean Rajiv

Gandhi Medical Collage & Chhatrapati Shivaji Maharaj Hospital, Kalwa reserves

the right to accept or reject such application without assigning any reason

thereof.

5. If Thane Municipal Corporation requires to purchase goods from other

supplier due to Failure of tenderer to supply ordered goods within

specified period, the excess amount incurred in such purchase will be

recovered from Tenderers pending bill or the tender deposit.

6. Ordered items must be supplied along with three copies of delivery challans

and bills and also original Octroi paid receipt at “Central Library ”, Rajiv Gandhi

Medical Collage & Chhatrapati Shivaji Maharaj Hospital, Thane Municipal

Corporation, Kalwa, Thane 400605 on all working days between 11.00 to

17.00.Items supplied through post parcel, railway parcel, S.T. parcel will not be

accepted.

7 Tenderer will have to execute agreement on a twenty rupees stamp

Paper in 1+1 copies with Thane Municipal Corporation, within 15

days period from the date of tender sanction letter issued by the

corporation, failure to execute the agreement on Tenderers part, tender

deposit shall be forfeited without prior information to the tenderer.

In case of any dispute in respect of supply or any other matter in

regards to sanctioned tender The Dean Rajiv Gandhi Medical Collage

& Chhatrapati Shivaji Maharaj Hospital, Kalwa decision will be final.

Tenderer will have to bear all expenses of both the parties on any

matter raised to court, for which the claims will be filled in Thane

Municipal Jurisdiction.`

8 Tenderer should quote the rates of all items in prescribed tender form

only.

9 All the documents attached must be attested and the tender

documents in envelope I as well as II must be serially numbered

10. INDIAN MEDICAL JOURNALS should be supply latest edition , old edition

INDIAN MEDICAL JOURNALS will not be accepted . Pages should not be

torn and spolit.

11. It will be a tenderers responsibility to supply undelivered INDIAN

MEDICAL JOURNALS..

12 Sanction rates of INDIAN MEDICAL JOURNALS should be valied for 180 days

and Tenderer are bound to supply INDIAN MEDICAL JOURNALS in this rate.

13 Provide delivery challan with bills in triplicate enclosed with PAN Card

of establishment & cancelled chq.

Insurance of the goods, wherever required will be done.

3. Necessary documents as required are enclosed herewith in the order in

which they are mentioned.

4. I/We understand that tender deposit submitted is likely to be forfeited in

event of lapses on my/our part to comply with the terms and conditions of

the tender as also on supplying items of substandard quality or if proven to

have followed unscrupulous practice/s apart from the liability of penal

action for violating the law of the land.

5. I/We have carefully read and understood the terms and condition to avoid

any omission. I/We shall abide by these conditions. I/We will follow them

very scrupulously.

6. I/We also take cognizance of the fact that failure to furnish the information

called for by the Dean Rajiv Gandhi Medical Collage & Chhatrapati Shivaji

Maharaj Hospital, Kalwa Thane or to comply with any requirements laid

down under the conditions will be considered as disqualification and the

tender be rejected on that account.
