Ministry vide O.M. dated 26/03/2014 has granted permission for import of 123 nos. of used

electronic goods from various countries for design and development purpose subject to the condition

that they shall re-export the items to be imported within a period of 36 months from the date of import.

Now the applicant requested for extension of the period of the re-export of 14 nos. of items (Testing

Equipment, Servers, Hard Disk Drivers/ Tape Library) out of the 22 nos. of imported item for another

5 years as the equipment is still actively used in lab. Applicant vide OM. Dated 23/02/2017 has

already taken extension of 1 no. of ETS-364/11-2815 with ASM Cards for 5 years out of these 22 nos.

The matter was considered in the 81st Meeting of the Expert Committee held during 17

th and

18th

August 2017. During presentation, the representative stated that out of 123 used electronic items

for which permission has been obtained in March 2014, they have only imported 22 items. Applicant

intend to re-export 20 of these items within 3 years as per the condition of the permission, the items

will be retained for another 2 years. However this information is to be confirmed in form of written

submission from the applicant till then the matter is deferred.

The applicant has now submitted the information.

The applicant has informed that NOC was issued for import of 2nd

hand equipment for R&D

purpose. They have mentioned that they need to continue using (42+21) nos. of equipment to deliver

on their commitment to their customers with regards to R&D, testing, critical/regular maintenance

support activities and to delivering resolutions and work around to issues and support in maintaining

the stability of their networks with very stringent Service Level Assurance(SLA) clauses.

The matter was considered in the 83rd

Meeting of the Expert Committee held on 26th

December 2017. The Committee recommended that the applicant may be invited for the presentation.

Till then the matter is deferred.The applicant has confirmed for presentation in the 84th

Meeting.

The matter was deliberated again in the 84th

Meeting of the Expert Committee held during 27th

and 28th

February 2018. The Committee noted that for all these items permission was granted for

import in May,2014 and Nov, 2014 with the stipulation that these item will be re-exported within 3

years from the date of import. The items (42+21=63 nos.) against the permission in May, 2014 were

imported during June-October 2014 and they were supposed to be re-exported during the

corresponding months in 2017. Instead the applicant has approached the Ministry for extension of the

period of retention by 4 years in Dec, 2017. The applicant has therefore been asked during

presentation to write to the Ministry explaining the circumstances under which they did not apply for

extension in time and for condoning this lapse.

The applicant has now submitted the clarification.
