SUBIECT: Resolution of the City of South Miami relating to the Final Plat approval for the subdivision of property located at 5989 SW 80TH Street.

BACKGROUND: In October 2015, the applicant (E ighty Development LLC) submitted an application to the City for preliminary review of a tentative plat application No. 23698-2 -COR. The applicant has demolished the existing structure located at 5989 SW 80th Street and is proposing a replat of the existing 10t[Folio 09-4036-039-0140] into two lots to develop two single family homes. Upon completion of staff review the applicant received a letter of compliance from the City of South Miami and filed for plat review with Miami Dade County, pu rsuant to Section 28-4 of Miami Dade County Code and Section 20-4 .2 of the City 's Land Development Code. The county has approved the appli cant's T-Plat appl ication and the applicant is now seeking Final Plat approval from the City of South Miami Commission to submit to Miami Dade County.

ANALYSIS:

On December 15, 2014 the applicant filed an application (Plat Application) with the City to obtain Tentative Plat Approval for two (2) lots on the property located at 5989 SW 80TH

Street. On December 17, 2014 the City Commission considered the Plat Ordinance, but postponed final consideration until January 6, 2015. On January 6, 2015 the City Commission approved a revised final plat ordinance. The wording in the final plat ordinance differed from the language original presented on December 2, 2014 City Commission meeting. Because of this, it was agreed by the City'S Attomey and the Applicant that the property located at 5989 SW 80TH Street shall be reviewed and approved the City using the Tentative Plat procedures from the prior Plat Application ordinance.

The applicant owns the property specifically located at 5989 SW 80TH Street, within an RS-3 Medium Lot Single-Family Residential District and is requesting this final plat in order divide the property into two buildable residential lots. The final plat lot dimensions meets the City's minimum lot requirements of 10,000 square feet with 75 feet of frontage per lot and the parent tract is currently vacant. Public Works has reviewed the site location and has no requirements for the applicant. SW 80th Street is a two lane bidirectional local road that becomes a minor collector road at intersections of (South Dixie Highway and Red Road).

PUBLIC SCHOOL CONCURRENCY:

Pursuant to State Statutes and the Interlocal Agreement for Public School Facility Planning, the applicant was reviewed for compliance with Public School Concurrency. Accordingly, the School District's Concurrency Determination revealed the applicable Level of Service (LOS) standards of 100% Florida I nventory of School Housing (FISH) have not been impacted by the proposed development, which contains two single family units. Therefore, the application has complied with the requirements of public school concurrency and no further action is required at this time.

RECOMMENDATION:

Staff recommends approval based on finding of the final plat submission and prior tentative plat review by Miami Dade County. The final plat approval by the City Commission will be submitted to Miami-Dade County subject to Chapter 28 of the Miami­Dade County Code of Ordinances and administered by the Miami-Dade County Department of Public Works.

As proposed the final plat meets the lot size and lot frontage requirements for the RS-3 Medium Lot Single-Family Residential District. The City arborist will provide a comprehensive review of the proposed tree disposition once the proposed development and landscape plans have been submitted to the department for Board review, and prior to the issuance of a development permit. All tree relocation and removal shall be done in compliance with the City's permitting and canopy mitigation requirements. It is recommended that the applicant comply with the following conditions, and/or other conditions deemed appropriate by the City Commission.

Resolution of the City of South Miami relating to the Final Plat approval for the subdivision of property located at 5989 SW 80TH Street, South Miami Florida

WHEREAS, Eighty Development LLC, owner of the parcel located at 5989 SW 80th Street, submitted a Tentative Plat to Miami Dade County, application No. T-23698-2-COR, pursuant to Section 28-4 of Miami Dade County Code; and

WHRERAS, the Miami Dade County plat committee met on December 4, 2015 and recommended approval of the tentative plat subject to conditions indicated in their approval letter, and subject to final plat approval by the City; aud

WHEREAS, the replat application requests a subdivision of said parcel into two buildable single­family lots; and

WHEREAS, the replat is in compliance with the City's requirements within the RS-3, Medium Lot Single Family Residential zoning district; and

NOW THEREFORE, BE IT RESOL YED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

Section 1. The application submitted by Eighty Development LLC, requesting approval of a proposed Final Plat for the property legally described in Section 2, pursuant to section 20-4.2(b) of the Land Subdivision Regulations is hereby approved and subject to the following conditions, and/or other conditions deemed appropriate by the City Commission:

I. Compliance with the conditions of the Miami-Dade County approval of application No. T -23698-2-COR;

2. Compliance with City Land Development Code requirements. 3. Compliance with the City's tree removal and canopy mitigation requirements. 4. Compliance with future City's Public Works requirements for any roadway and/or drainage

improvements. 5. Compliance with any Miami-Dade County Environmental Resource Management requirements

prior to final recording of this plat.

Section 2. Legal Description. The south Y, of the west 150 feet of tract 7 of amended plat of Palm Miami Heights according to the plat thereof, recorded in plat book 43 at page 37 of the public records of Miami-Dade County, South Miami, Florida, Lying in the NE Y. of Section 36, Township 54 South, Range 40 East.

Section 3. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution.

Section 4. Effective Date. This resolution shall become effective immediately upon adoption by vote of the City Commission.
