    OPENING SESSION Mayor Michael McDonough called the January 19, 2021 Board of Aldermen meeting to order at 7:01 p.m. Rex Block of The Faiths of Raytown provided the invocation and led the pledge of allegiance. Roll was called by Jennifer Baird, City Attorney, and the attendance was as follows: Present: Alderman Greg Walters, Alderman Frank Hunt, Alderman Jim Aziere, Alderman Jason Greene, Alderman Ryan Myers, Alderman Janet Emerson, Alderman Mary Jane Van Buskirk, Alderman Bill Van Buskirk, Alderman Bonnaye Mims, Alderman Derek Ward Absent: None Public Comments None Communication from the Mayor Mayor McDonough spoke on recent events and City business.     Action Requested: Approve the fiscal year 2020-2021 KCATA contract for the Transit Services in Raytown. Analysis: This is a demand-response public transportation service (Metro Service) that the City has provided under contract with the KCATA since April 2001. KCATA has Route #399-Raytown Flex and RideKC Freedom servicing the citizens of Raytown. Route #399 Full Fare is $1.50 one-way fare/$50 monthly pass or Reduced Fare (youth, Seniors 65 yr. old, and persons with disabilities) is $0.75. The hours of operation for the Route #399 are from 6:00 a.m. to 10:00 a.m.; and from 2:30 p.m. to 6:30 p.m., Monday through Friday. The proposed agreement would maintain that level of service at a cost of $56,222.00. The operational cost is within the amount budgeted by the City for this service. This contract will be for a 12-month period that mirrors the City’s budget year. Alternatives: The City could choose not to participate in the Transit Service and risk losing this benefit for our citizens. Budgetary Impact:

    AN ORDINANCE AUTHORIZING AND APPROVING A CONTRACT FOR TRANSIT SERVICE BY AND BETWEEN THE KANSAS CITY AREA TRANSPORTATION AUTHORITY AND THE CITY OF RAYTOWN, MISSOURI IN AN AMOUNT NOT TO EXCEED $56,222.00 FOR FISCAL YEAR 2020-2021 WHEREAS, the City of Raytown (the “City”) is a city of the fourth class, with the authority pursuant to Chapter 70 of the Revised Statutes of the State of Missouri to enter into agreements with other political subdivisions; and WHEREAS, the Kansas City Area Transportation Authority (“KCATA”) is a body corporate and politic and a political subdivision of the states of Missouri and Kansas with the authority to enter into agreements with other political subdivisions; and WHEREAS, a sound, efficient and viable public transportation system is essential to the socioeconomic well being of the Kansas City Area Transportation District (hereinafter referred to as the "District"), including the Counties of Cass, Clay, Jackson, and Platte in Missouri, and the Counties of Johnson, Leavenworth, and Wyandotte in Kansas; and WHEREAS, the KCATA is a public agency authorized by law to plan, own, operate, have and generally deal with public transportation systems and facilities in the District; and WHEREAS, the City desires to promote the convenience, comfort, prosperity, general interests and welfare of its citizens; and WHEREAS, the public transportation facilities and services of most immediate concern are those estimated to be provided by the KCATA at a deficit, described generally in amounts and, more specifically, by formula set forth in Attachment "A" adopted in January, 1976, modified in August, 1977, revised in January, 1983, and December, 1997; and WHEREAS, the City of Raytown desires to enter into an agreement with the KCATA for transit services as set forth in Exhibit “A” attached hereto and incorporated herein by reference.

    NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RAYTOWN, MISSOURI, AS FOLLOWS:

    SECTION 1 - APPROVAL OF CONTRACT. That the Contract for Transit Services by and between the Kansas City Area Transportation Authority and the City of Raytown, Missouri, attached hereto and incorporated herein by reference, is hereby authorized and approved in an amount not to exceed $56,222.00.

    SECTION 2 - EXECUTION OF CONTRACT. That the City Administrator is authorized

    to execute the Contract and all documents necessary to the performance thereof, and the City Clerk is authorized to attest to the same.

    SECTION 3 - REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of

    ordinances in conflict with this ordinance are hereby repealed. SECTION 4 - SEVERABILITY CLAUSE. The provisions of this ordinance are severable

    and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance.

    KANSAS CITY AREA TRANSPORTATION AUTHORITY

    Contract for Transit Service

    RAYTOWN, MISSOURI

    THIS CONTRACT, entered into this __ day of _ _____ , 2021, by and between the KANSAS CITY AREA TRANSPORTATION AUTHORITY (hereinafter referred to as the "KCA TA"), a body corporate and politic and a political subdivision of both the States of Missouri and Kansas, and RAYTOWN, MISSOURI (hereinafter referred to as the "Community").

    WITNESS ETH:

    WHEREAS, a sound, efficient and viable public transportation system is essential to the socioeconomic well being of the Kansas City Area Transportation District (hereinafter referred to as the "District"), including the Counties of Cass, Clay, Jackson, and Platte in Missouri, and the Counties of Johnson, Leavenworth, and Wyandotte in Kansas; and

    WHEREAS, the KCA TA is a public agency authorized by law to plan, own, operate, have, and generally deal with public transportation systems and facilities in the District; and

    WHEREAS, the Community desires to promote the convenience, comfort, prosperity, general interests and welfare of its citizens; and

    WHEREAS, the pub I ic transportation foci Ii ties and services of most immediate concern are those estimated to be provided by the KCA TA at a deficit, generally described in amounts and, more specifically, by the formula set forth in Attachment "A" adopted in January, 1976, modified in August, 1977, revised in January, 1983, and December 1997.

    NOW, THEREFORE, in consideration of the premises and the mutual covenants herein contained, the parties hereto agree as follows:

    A. Public Mass Transit Service

    I. The Community requests public transportation services (hereinafter referred to as"Contract Service"), set forth in Attachment "B," be operated by the KCA TA for theperiod November 1, 2020, through October 31 , 2021, unless sooner terminated underParagraph "7" of this Contract.

    2. The level of service, as generally set forth in Attachment "B" shall not be changed ormodified without the Community's consent.

    3. The computations and, more specifically, the formula contained in Attachment "A"attached hereto and made a part hereof, are the accepted methods for determining theestimated deficit of the Community.

    4. The KCA TA and the Community estimate the Community's total payment for theservice (hereinafter referred to as "Local Share") to be $56,222 estimate is based on

    Analysis: Chapter 6, Division 7 of the Raytown City Code sets forth regulations regarding dangerous animals. Specifically, Section 6-229 addresses hearing procedures in the event a complaint is made of an alleged dangerous dog. In summary, once a complaint is made of an alleged dangerous dog the dog is seized and held pending an administrative determination of whether the dog is dangerous. After notice and hearing, the hearing officer decides if there is clear and convincing evidence that a dog is dangerous. If the dog is determined to be dangerous, then Section 6-229(f) allows the hearing officer to require that the dangerous dog be maintained in such a way so as not to be dangerous to other animals or people (i.e. if outside, kept behind a fenced area or escape-proof kennel, placement of signs advising the public of the presence and tendencies of the dog, etc.). Lastly, Section 6-229 allows the final decision of the hearing officer to be appealed to the municipal court. Chapter 6, Division 7 of the Raytown City Code was codified in 1969 and later updated on March 6, 2007 (Ordinance No. 5191-07). To Staff’s knowledge, a final decision of the hearing officer has never been appealed until recently. In reviewing dangerous dog hearing processes from surrounding cities, Staff proposes to amend Section 6-229 to allow the final decision of the hearing officer to be appealed to the circuit court instead of municipal court. Alternatives: Leave the Ordinance as written allowing the decision of the hearing officer to be appealed to the municipal court. Staff Recommendation: Approve the Ordinance revising Section 6-229 to allow the final decision of the hearing officer to be appealed to the circuit court.

    AN ORDINANCE AMENDING SECTION 6-229(G) OF THE RAYTOWN CITY CODE TO ADDRESS DANGEROUS DOG HEARING PROCEDURES WHEREAS, pursuant to Section 79.380, RSMo, the Board of Aldermen of the City of Raytown, MO may make regulations to secure the general health of the city; and

    WHEREAS, on March 6, 2007, the Board of Aldermen adopted Ordinance No. 5191-07, setting forth regulations to address dangerous dogs; and

    WHEREAS, the Board of Aldermen of the City of Raytown, MO wish to amend the

    dangerous dog regulations as it relates to the appeal of a final decision by the hearing officer. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RAYTOWN, MISSOURI, AS FOLLOWS: SECTION 1 – CODE SECTION TO BE AMENDED. Sec. 6-229(g) (Hearing procedure) is hereby repealed in its entirety and replaced with

    Sec. 44-72. - Private stormwater mitigation program authorized.

    (a) Purpose. The city owns and operates a sanitary sewer system. Connections to the public sewer system within private residences or on private property can result significant amounts of stormwater being fed into the public sanitary sewer system. Stormwater in the public sanitary sewer system decreases the capacity of the system to handle sanitary sewer waste and results in increased treatment costs for the city as a whole. Stormwater in the public sanitary sewer system can result in sanitary sewer backups, resulting claims against the city and increasing investigation, litigation, and insurance costs. Reducing the amount of stormwater in the public sanitary sewer system will be a public benefit to all residents of the city because it will increase the capacity of the sanitary sewer system and reduce claims against the city and associated costs. The city desires to implement a program to repair and replace connections to the public sewer system within private residence and on private property in order to increase the efficiency of the public sanitary sewer system and reduce costs to the city as a whole.

    (b) Authorization. A program to reduce the amount of stormwater entering the sanitary sewer system for properties which are located within the city and have a history of sanitary sewer backups resulting of stormwater entering the sanitary sewer system.

    (c) To be eligible for participation in the program:

    (1) The property must be located within the city.

    (2) The property must have a verifiable history of sanitary sewer backups which resulted at least in part from stormwater entering the sanitary sewer system.

    (3) The property owner, or the owner's authorized representative, must complete an Application for Storm Water Mitigation with the contact the Ppublic Wworks Ddepartment to determine the scope of necessary work that will reduce to the inflow of stormwater in the sanitary sewer system.

    (4) The property owner, or the owner's authorized representative, must allow the Ppublic wWorks Ddepartment personnel entry onto the property at reasonable times to allow inspection of the existing work and any work performed to address the inflow of stormwater into the sanitary sewer system.

    (5) Any work completed by a certified plumber must be done by someone who has a current city business license, has an up-to-date craftsman license, is properly insured, and has obtained a plumbing permit from the city.

    (6) The property owner, or the owner' authorized representative must present three (3) quotes from certified plumbers to perform the approved work to the Public Works Department for review and approval, before work can proceed. The paid verifiable receipts or invoices of the approved work must be submitted to the city before reimbursement.for the reasonable cost of work directly associated with reducing the amount of stormwater entering the sanitary sewer system.

    (76) The property owner must agree in writing to the installation and maintenance of any equipment installed, which agreement shall be recorded with the county recorder.

    (d) If eligible for participation in the program, a property owner may be reimbursed up to ($2,600) $4,000.00 for actual, reasonable costs of completing the scope of work approved by the Ppublic Wworks dDepartment, in accordance with the approved payout list.t. For a property with one or more verifiable backups, reimbursement of 100 percent of the actual, reasonable cost, up to $4,000.00. The Public Works Director shall have the discretion on payment of reimbursable costs.

The intent of this plan is to remove excess stormwater from the public sanitary sewer system as well as reduce the potential for sewer backups in private residences and buildings. You may be able to receive reimbursement for the installation of equipment designed to remove excess stormwater from the sanitary sewer system and/or a backflow prevention valve designed to reduce the chances of sewer backups.     2. After turning in the application, contact the Public Works Sanitary Sewer Department at (816) 737-6045 to set up a site inspection appointment to determine if there is a ground water connection to the sanitary sewer main. Any investigative work will be performed by qualified professionals with the Public Works Department and will be at no cost to the property owner. Someone will need to be at the property during this inspection.

    3. The Public Works Stormwater Mitigation Crew will provide the property owner with an Inspection Sheet with the work to be completed outlined.

    4. If you are not going to do the work yourself, you must acquire three (3) quotes from certified plumbers to perform the work.

    5. The Public Works Department must review the quotes to verify what costs are eligible to be reimbursed. The Department will use the approved estimated payout list is on the following page to determine the eligible reimbursements. If the cost to do the work exceeds the City’s reimbursement limit, then the remainder of the cost will be the responsibility of the property owner.

    6. A selected plumber will need to obtain a current Raytown business license, an up-to-date craftsman license, proof of insurance, and a plumbing permit from the Community Development Department.

    Action Requested: Authorize and approve use of the City of Raytown’s logo for the State of Missouri & Santa Fe Trail Bicentennial Commemoration, named: Festival of the Trails, scheduled on September 11, 2021. Recommendation: Raytown Parks Staff and Bicentennial Planning Committee recommend approval. Analysis: The Raytown planning committee for the Bicentennial Commemoration requests approval from the Board of Aldermen to include the City of Raytown Logo for the event which will be hosted in multiple locations along the original Santa Fe Trail corridor through Raytown. The committee consists of representative from the Raytown Parks, Raytown Chamber of Commerce, Friends of Rice-Tremonti Home, Raytown C-2 School District, Raytown Historical Society, the Santa Fe Trail Association, and the City of Raytown. Events will take place on the property of Cave Springs Park, Rice-Tremonti Home, and the Raytown Historical Society, all of which were along the original Santa Fe Trail. The events will be funded by each entity through sponsorships, donations, and through budgeted programming funds. The Planning Committee will also create a schedule for re-enactments, live demonstrations, games, period correct vendors, and food for participants of the events. Alternatives: Do not approve the request for use of the City of Raytown logo for the 2021 Bicentennial event. Budgetary Impact:

    A RESOLUTION AUTHORIZING AND APPROVING THE USE OF THE CITY OF RAYTOWN LOGO FOR THE STATE OF MISSOURI AND SANTA FE TRAIL BICENTENNIAL COMMEMORATION EVENT KNOWN AS THE FESTIVAL OF TRAILS

    WHEREAS, the State of Missouri and Santa Fe Trail Bicentennial Commemoration has scheduled an event known as the Festival of Trails on September 11, 2021; and

    WHEREAS, a committee consisting of representative from the Raytown Parks, Raytown

    Chamber of Commerce, Friends of Rice-Tremonti Home, Raytown C-2 School District, Raytown Historical Society, the Santa Fe Trail Association, and the City of Raytown have been participating in the planning of said event; and

    WHEREAS, the Board of Aldermen find it is in the best interest of the City to the support

    this event and authorize and approve the use of the City of Raytown Logo for the Festival of Trails which will be hosted in multiple locations along the original Santa Fe Trail corridor through Raytown.

    NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RAYTOWN, MISSOURI, AS FOLLOWS:

    Action Requested: Authorize and approve the Raytown Live Music Series, for the 2021 summer season. Recommendation: Raytown Live planning committee recommends the event for approval. Analysis: The City of Raytown planning committee for the Raytown Live Music Series would like to request approval from the Board of Aldermen to continue the Raytown Live Music Series for the 2021 summer season. The committee is planning on hosting 5 nights of music on the second Saturday of every month May through September in 2021. The Committee is requesting to use the Raytown City Green Space for the events, and host music from 7:00 p.m. to 9:00 p.m. on the second Saturdays. Events will be funded through sponsorships and donations. The Planning Committee will also plan for food trucks and possibly vendors to sell their wares for the spectators and participants of the events. Alternatives: Do not approve the request to host the 2021 Raytown Live Music Series, and do not host the music events for the public at the City Green Space. Budgetary Impact:

    WHEREAS, the City of Raytown owns property in the central business district; and

    WHEREAS, the Mayor has appointed an Ad Hoc Event Committee to explore and organize a summer concert series to be held on the City’s property in the central business district; and

    WHEREAS, the Raytown Park Board passed a resolution to support the summer

    concert series and assigned staff to assist with the organization of the series; and WHEREAS, the Board of Aldermen find it is in the best interest of the City to the support

    the organization of a summer concert series to be held on the City’s property in the central business district;

    Action Requested: Board of Aldermen approval of a mowing contract for the Parks & Recreation Department with Stirling Lawn & Landscape Inc. Dba U.S. Lawns of Kansas City in excess of $15,000.00 but within budgeted amounts for fiscal year 2020-2021. Recommendation: Staff recommends, and the Raytown Park Board voted to award the mowing contract with Stirling Lawn & Landscape Inc. for the 2020-2021 budget year at their December 21, 2020 meeting. Analysis: The Raytown Parks & Recreation Department issued an invitation to bid regarding its 2020-2021 Mowing Contract. A total of six bids were received and Stirling Lawn & Landscape Inc. is recommended as the lowest and best bidder. The contract has an option to renew for an additional 3% per year for up to two additional years. Stirling Lawn & Landscape Inc. is currently the contractor for Blue Springs Public Works and Lee’s Summit Parks & Recreation Department. Staff recommends moving forward with the contract as they are a known vendor with appropriate equipment for mowing the Park grounds. Raytown Parks has budgeted $36,750.00 for mowing and is requesting approval to spend up to that amount, which has been approved in the City of Raytown 2020-2021 Budget. Alternatives: Do not approve resolution, and rebid the Raytown Parks mowing contract, with no guarantee that the City of Raytown will receive a lower price than the current contract.     WHEREAS, the City Parks & Recreation Department solicited sealed bids from qualified firms interested in providing mowing services to Raytown park areas; and

    WHEREAS, the Parks & Recreation Department received six (6) sealed bids in response which were opened on December 9, 2020; and

    WHEREAS, Stirling Lawn & Landscape Inc. submitted its bid and was determined to be

    the lowest and best bidder qualified to provide such services; and

    WHEREAS, the Board of Aldermen find it is in the best interest of the City to authorize and approve an agreement with Stirling Lawn & Landscape Inc. in an amount not to exceed $36,750.00 for fiscal year 2020-2021;

    NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RAYTOWN, MISSOURI, AS FOLLOWS:

    THAT an agreement for mowing services of park areas with Stirling Lawn & Landscape Inc. as set forth in “Exhibit A” for such purposes in an amount not to exceed $36,750.00 for fiscal year 2020-2021 is hereby authorized and approved; and

    FURTHER THAT the City Administrator is hereby authorized to execute all documents necessary and to take any and all actions necessary to effectuate the terms of the contract and the City Clerk is authorized to attest to the same.

    Action Requested: Board of Aldermen approval for Parks & Recreation to purchase a 2021 Ford F-150, 1/2 ton, cab and chassis through the Missouri Department Co-op Bid #77-20 OA 2020-251-4 for a cost of $29,579.00 from Shawnee Mission Ford and $4,061.00 from Knapheide Truck Equipment for lift gate, back up camera & sensor, and 7-way socket Bul LK, for a total of $33,640.00. Liquidate current 2009 Ford F150 for highest possible value. Recommendation: Staff recommends approval as submitted. Analysis: This truck is a go-to truck for daily tasks and trash hauling in the Park's Department. It is equipped with a lift Tommy gate to load heavy objects. This vehicle is used to haul trash and dumped debris away from the Parks properties. Its size and capabilities make it an extremely useful piece of equipment. Staff recommends the purchase of a 2021 Ford F-150, 1/2 ton, cab and chassis through the Missouri Department Co-op Bid 77-20 OA 2020-251-4 for a cost of $29,579.00 from Shawnee Mission Ford and $17,188.00 from Knapheide Truck Equipment for lift gate, back up camera and sensor, and 7-way Bul LK for a total cost of $33,640.00. The Parks Dept. has budgeted $38,000.00 for the Ford F150 purchase in FY2021. Alternatives: Do not approve the bid and direct staff to seek alternate methods or contractors. Budgetary Impact:

    A RESOLUTION AUTHORIZING AND APPROVING THE PURCHASE OF A 2021 FORD F150 FROM SHAWNEE MISSION FORD AND RELATED EQUIPMENT FROM KNAPHEIDE OFF THE MID AMERICAN COUNCIL OF PUBLIC PROCUREMENT COOPERATIVE PURCHASING CONTRACT IN AN AMOUNT NOT TO EXCEED $33,640.00 FOR FISCAL YEAR 2020-2021 WHEREAS, the City of Raytown in the adoption of its purchasing policy has approved the practice of purchasing equipment from competitive bids awarded by other governmental entities through the cooperative bidding process; and

    WHEREAS, Mid American Council of Public Procurement has competitively bid and awarded a contract to Shawnee Mission Ford for a 2021 Ford F150 Extended Cab and related equipment from Knapheide to be used by the Raytown Parks & Recreation Department; and

    WHEREAS, the City of Raytown finds it is in the best interest of the citizens of the City of

    Raytown to authorize and approve the purchase of one Ford F150 Extended Cab from Shawnee Mission Ford and related equipment from Knapheide off the Mid American Council of Public Procurement in an amount not to exceed $33,640.00 for fiscal year 2020-2021;

    NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE

    CITY OF RAYTOWN, MISSOURI, AS FOLLOWS: THAT the purchase of one Ford F150 Extended Cab from Shawnee Mission Ford and

    related equipment from Knapheide off the Mid American Council of Public Procurement in an amount not to exceed $33,640.00 for fiscal year 2020-2021, is hereby authorized and approved;
