TVA Kingston Update
• 6/14/2010 – TDEC issues $11.5MM multi-year penalty to TVA for release
• Time Critical work to remove ash from river ended 6/28/2010
• 2,760,656 CY dredged as of 7/1/2010, with additional
749,073 CY excavated, for a total of ~3.5MM CY
• As of 7/2/2010, 2.688 MM tons ash shipped to Arrowhead Landfill in Perry County Alabama .
• Emory River reopened to Public on May 29, 2010
• Work continues for design and implementation of closure for remaining released ash and relic structure.

Regulatory Changes
Not surprisingly, with the economy being down significantly, Tipping fees and State appropriation dollars were down as well.
The main thrust of this year’s rulemaking effort revolved around adjustments to fees (the first major adjustment to Tennessee’s fee schedule since Subtitle D was adopted).

• Special Waste Evaluation
• Special Waste Recertification

• Transportation Related Spills
• New Design and Operating Criteria for facilities managing Secondary Aluminum Smelter Dross

• Permanent Records Retention
• Changes in Financial Assurance Requirements
• Permit Renewal Process (w/fees)
• Increasing vegetative cover thickness
• Additional erosion control requirements
• Compost regulation revisions
