and Marketing of diverse range of Petroleum Products.

2. We intend to rent vehicles for various activities in Manglya-Gujri section of MMBPL. We are pleased to invite the BIDS for the above mentioned job, as per tender specifications (enclosed).

3. EARNEST MONEY DEPOSIT (EMD): EMD of amount as mentioned below as applicable is required to be submitted, in physical form at our office in a sealed cover addressed to Chief Manager P&CS, with following boldly super-scribed on the cover/ envelope:

o Micro and Small Enterprises registered with District Industries Centers or Khadi and Village Industries Commission or Khadi and Village Industries Board or Coir Board or National Small Industries Corporation or Directorate of Handicrafts and Handloom or any other body specified by Ministry of Micro, Small and Medium Enterprises, are exempted from payment of Earnest Money provided -

o Vendors have to upload the necessary documents as mentioned above to claim

exemption for Earnest Money Deposit.

5. EMD FOREFEITURE AND RETURN OF EMD:

i. EMD submitted shall be returned on finalization of the order. No interest on this

EMD is payable.

ii. EMD will be forfeited in the event of:

1. Withdrawal of offer while the offer is under consideration during the

offer validity period. 2. Bidder not accepting our Purchase Order, if placed without prejudice to

our rights to recover damages on account of breach of contract. 3. Non-confirmation of acceptance of order within the stipulated time after

placement without prejudice to our rights to recover damages on account of breach of contract.

4. Any unilateral revision made by the Bidder during the validity period of the offer.

OPENING OF BIDS: This being Two-Part-Bid, the Qualification Criteria and Techno-Commercial Bid will

be opened first and evaluated. Bidder to note that qualification of bidder and evaluation of bid is being

taken up simultaneously and therefore issue of TQ/CQ and or Techno-commercial discussions shall not be

construed as the bidder is qualified.

9. The vendors who are on BPCL’s Black /Holiday List will not be considered.

10. BPCL reserves the right to accept/ reject any or all the Offers at their sole discretion without

assigning any reason whatsoever.

11. BPCL decision on any matter regarding Bid qualification of vendors shall be FINAL and any vendor shall not enter into correspondence with BPCL unless asked for.

12. BPCL would also consider information already available with them regarding Vendor’s Credentials.

13. BPCL may call for additional documents if required.

BID QUALIFICATION CRITERIA Vendors have to satisfy the following bid-qualification parameters to become eligible for further technical and commercial evaluation:

There is a requirement of seven (07) vehicles (MUVs) Air Conditioned Mahindra Xylo or equivalent at places specified in the tender document.

Qualification criteria shall be as follow:

1. Average Annual financial turnover during the last 3 years, ending 31st March of previous financial year should be Rs. 17.15 lakhs.

2. Experience of having successfully completed similar works during last 7 years ending last day of month previous to the one in which applications are invited should be either of the following on annual basis:

Three similar completed works, each costing not less than the amount equal to Rs. 22.87 lakhs or

Two similar completed works, each costing not less than the amount equal to Rs. 28.59 lakhs or

One similar completed work, costing not less than the amount equal to Rs. 45.74 lakhs.

3. Financial net worth of the bidder shall be positive as per the latest audited annual report and certified by the Chartered Accountant. The certified copy of the net worth of bidder should not be older than last financial year. Similar work shall mean the experience of executing contract of providing Air-Conditioned Vehicles on hire for movement of company officials on a continuous basis for at least twelve months. The contractor should upload the documentary proof related to pre-qualification criteria as stated above on the BPCL eprocurement website.

The Bidder shall submit following documents along with Pre Qualification bid:

i) Company profile, registration certificate of company/partnership deed as applicable.

ii) Experience on similar completed works executed in the form of Purchase Order / Contract copy during the last five years: and details like monetary value, clients, proof of satisfactory completion (Annexure A)

iii) Information regarding jobs in hand (Annexure-B & C), current litigation (Annexure D), orders regarding exclusion/expulsion or black listing, if any. Declaration that the bidder has not been banned by Indian Government or quasi-Indian Government agency or Indian PSU.

iv) Documentary evidence of adequate financial standing, certified by

bankers, Audited Profit & Loss A/c and Balance Sheet, Annual turnover in last five years, access to adequate working capital.

v) List of vehicles proposed to be deployed for the subject contract (Documentary proof for RC book and fitness certificate of the vehicles) or Vehicles proposed to be purchased on award of job.

vi) Service Tax Registration Certificate. vii) Permanent Account Number (PAN)

The Vendors shall also be in a position to provide further information as and when required by BPCL.

BPCL, at its discretion reserves the right to verify information submitted and inspect the facilities to confirm their capabilities

PROVIDING VEHICLES ON HIRE AT MANGLYA (Madhya Pradesh) and GUJRI (MadhyaPradesh)

Mumbai-Manmad-Bijwasan pipeline (MMBPL) is 1389 KMs in length starting fromMumbai in Maharashtra to Bijwasan in Delhi. MMBPL has many locations along thepipeline route and it is required to hire vehicles for Operations, Maintenanceand ROU activities of Pipelines. It is intended to hire vehicles on monthlybasis for eighteen months period.

1. The vehicles to be provided on monthly basis at various locations of MMBPLand it's type shall be as mentioned below in schedule I:

2. The indicative running of each vehicle per month is as indicated in theSchedule I. Actual running of each vehicle may vary from the indicative KMsmentioned above. However, the total minimum commitment per month for alocation shall be as given below in Schedule II.

During the contract period if for any reason any one or more vehicles usage isterminated as indicated in Schedule I, minimum KM of that vehicle shall bededucted accordingly for calculation of Cumulative KM of base location asindicated in Schedule II.

3. The vehicles provided must be in excellent condition, clean andmechanically sound. The vehicles which will be provided for the above jobshould have registration and Chassis Mfg date on or after 1st February 2014and in good condition with comfortable seats, head rest, clean seat covers,windows fitted with tinted glasses/paper and shall be kept clean at all times.The vehicle model selected shall be as mentioned in Schedule I. Non-AC modelwith extra fitted AC is not acceptable. The vehicle shall have commercialregistration. Contractor will have to take an approval from Engg-In-Chargeprior to deployment/change of any Vehicle. BPCL will have the right to inspectthe vehicles at their discretion during the contract period. If anydeficiencies are noticed or the vehicles are found without proper maintenance,BPCL reserves the right to reject/suspend the vehicles from operation. Thecontractor is required to provide the replacement immediately but in any casenot latter than 24 hours from the time of intimation, failing whichappropriate deduction as per clause 7 will be made from the monthly bills ofthe contractor.

4. Vehicles provided by the contractor on hire shall have the drivers inuniform, ensure that they are neatly dressed and should have a valid licenseand are competent to drive. These vehicles will be used by BPCL for movementof its staff, with their tools and tackles (not exceeding the laden weight)and authorized persons to various locations of MMBPL such as Pumping stations,Valve stations and Pipeline route or as directed.

5. The Contractor have to provide details of the vehicles in the format as perAnnexure 1 in the technical bid, which would be position by him in case ofbeing a successful bidder and it should be inline with our requirement asmentioned in Schedule I.

6. The contractor shall also be responsible for providing suitable vehiclereplacement immediately, if the vehicle breaks down. The replacement vehicleprovided shall be of equivalent Vehicle model to the break down vehicle. Ifthe vendor does not have equivalent vehicle model immediately, then he canprovide an equivalent sedan car model for the time being but not exceeding 10days from the date of vehicle breakdown.

7. In all cases, if the vehicle fails to report at the required time/place asindicated in the respective tender schedules or as intimated by BPCL Officerit will be considered as non provision of vehicle for the day, necessary

a) If BPCL manages with out hiring an additional vehicle for the day,necessary deduction on pro-rata will be recovered from the monthly bills ofthe contractor.

b) If BPCL has to arrange a vehicle on its own then the company will deduct asum of Rs. 2500/- for each day, per vehicles, towards penaltyin addition to deduction on pro rata basis from monthly charge of vehicle.Such amount will be recovered from the monthly bills of the contractor.

8. Any overtime due to breakdown of the vehicle shall be on the account ofcontractor and not to be charged to BPCL.

9. The vehicles provided should meet the requirements and specifications aslaid down by the concerned Statutory Authorities and should comply with therequirement of the Motor Vehicles Act: Madhya Pradesh and the Central MotorVehicle Act and amendments thereto issued from time to time.

10. The contractor shall obtain Comprehensive Insurance Cover from any PublicSector Insurance Company for each vehicle and shall keep such policy in forceat all times to cover all risks of every nature whatsoever to the vehicle andoccupants including loss of life, disablement, injuries, Third Party claims,accident caused due to fire, riot or due to any other reason whatsoever, losson the account of theft and natural calamities. Contractor shall produce forverification the original insurance policy and proof of payment of allinsurance premium and charges in respect thereof as and when demanded by BPCLand shall renew all such insurance cover at least seven days before the expirythereof.

11. It shall also be the contractor's sole responsibility to ensure that thevehicles are always and exclusively driven by a person appropriately qualifiedand licensed under the Motor Vehicle Act. It shall be contractors soleresponsibility to ensure that the driver of the vehicle:a) Have the necessary qualifications as laid in the Rules under the CentralMotor Vehicles Act currently in force and any subsequent amendments thereto.b) Are educated about the safety rules and regulations especially in apetroleum installations and abide by the same.c) Do not smoke or light a flame or use mobile while driving the vehicle.d) A reliever is provided in case the vehicle is extended for service for morethan 12 hours at the place of posting. In no case shall the driver be allowedto do work beyond 12 hrs (including the normal duty of 8 hours).e) Preferably have good knowledge of road routes, condition of roads etc.f) Shall be in possession of all relevant documents pertaining to the vehiclesuch as Insurance policy, registration book etc. at all time while on duty.g) He should be easily accessible on his mobile phone all the time.

12. It is also essential that the contractor shall give the identity badge toeach and every driver for the vehicles operating inside the Plant premises andalso perform the entry pass formalities for the vehicles from the PlantOfficials required as per the BPCL rules. The contractor also needs to obtainthe police verification done of all the drivers deployed to drive the vehicleand proof of the same should be submitted to BPCL Engg-In-Charge within 45days from the date of deployment. The contractor shall remain solely andexclusively responsible for all consequences of actions carried out by hisdrivers or his representatives during execution of the contract.

13. The contractor shall maintain necessary records of the persons deployedfor the work in a proper format with necessary proofs. The records shouldprovide relevant details of domicile, education, residential address, recentpassport photograph, police verification certificate etc. contractor shouldalso maintain all the records of cost as per the statutory guidelines andshould be in a position to produce the documents as and when requested bystatutory authority or BPCL Engg-In-Charge from time to time.

14. The contractor shall be responsible for and shall pay any compensation totheir employees payable under the Workmen's Compensation Act/ESIC and theamendments thereto for the injuries caused to the workmen. The contractorshall be responsible for and pay the expenses for providing medical treatmentto any of their employees whom may suffer any bodily injury as a result of anyaccident.

15. If during the contact period, the service is found unsatisfactory thecontract will be terminated with one months prior notice. BPCL reserves theright to terminate the contract with one months notice without assigning anyreason thereof. The contractor cannot claim any compensation/damages for thesame.

16. The contractor shall be liable for all payments to their personnelemployed for the performance or carrying out the said work and in respect ofall claims and liabilities of the contractor and BPCL shall in no event beliable or responsible for any such payment. The contractor will indemnify BPCLand keep indemnified from and against any claim whatsoever that may be madeagainst BPCL in relation to or arising out of this contract and undertake tosee that BPCL are absolved of any liabilities whatsoever any third party onaccount of this contract.

17. The contractor shall abide by the Payment of Wages Act./ Minimum WagesAct/Provident Fund Contribution and other relevant Labour Legislation inforce. Contract shall provide documentary proofs of all such payments alongwith monthly RA bills.

18. The contractor shall observe and implement all applicable statutes and

19. The contractor shall not assign or sublet the contract or any partthereof to any person/party without the specific permission of the employer inwriting. All the vehicles deployed under this contract should be registered inthe name of the successful bidder and deviation in this should be brought toBPCL Engg-In-Charge's notice.

20. Contractor shall bear and pay solely and absolutely the entire operatingcost of the vehicles and the rates shall include and be deemed always toinclude the following:

a) All expenses, costs and charges incurred for the driver whose servicesare utilized in relation to the vehicles including their salary, emolumentsand other perquisites, whether statutory or not.b) Cost of fuel and lubricating oils, tyres and spares etc.c) Cost of maintenance, repairs and replacement of vehicles or any partincluding fittings thereof.d) Road Tax, Vehicle Tax, Municipal Tax, all other taxes, levies etc. forrunning the vehicle as commercial vehicle. The contractor shall bear and payall taxes and levies and increases, which are attributable to the vehicles.e) PUC of Vehicle shall be carried out as per the RTO norms.f) Cost of the Comprehensive insurance as mentioned earlier.

21. The contractor shall pay the vehicle entry tax for inter state movementand claim along with RA bills. The same shall be reimbursed by BPCL againstthe actual receipt duly certified by the BPCL Officer who availed the vehicle.

22. Toll tax shall be paid by the BPCL Officers / Authorised persons who areusing the vehicles.

23. Normal working hours would be 12 hrs a day, except wherever mentioned inthe Schedule of Work for 24 Hrs with separate Drivers for each shift. Thereporting time for each jeep will be as advised after award of work. MinimumTwo drivers should be deputed for vehicles with 24 hrs working with a maximumof 12 hrs shift for each driver. If the second driver is not provided, penaltyof Rs 1500/- per day shall be imposed on the contractor.

24. The vehicles should be made available on all days of the month.

25. The starting point/closing point of the vehicles will be BPCLs officementioned in the schedule as Headquarters in tender document as mentioned forthe purpose of calculation of the mileage run for the day. However, if the

26. BPCL shall have the right to change the starting time andstarting/closing point of any vehicle after giving at least one weeks noticeto the contractor.

27. On tour to out station, the contractor shall make all arrangements suchas stay, food etc. for their drivers night halts and for normal duties.

28. All drivers engaged shall undergo medical check up once a year and copyof certificate to be submitted to BPCL Engg-In-Incharge.

29. Drivers should be changed only with prior approval from Engg-In-Charge orthe officer authorised by them. Similarly, if any driver is found to beindulging in unsafe driving practices/acts, he shall be replaced immediatelywithin 72 hours from the time of information by BPCL Engg-In-Charge.

30. Drivers should have sufficient money while on tour for the requirement ofdiesel, vehicle repairs etc.

31. The total requirement of vehicles is Seven (07) Nos. only, however ifthere is requirement of additional vehicles then contractor will have toprovide the same within 30 days from the date of intimation by BPCL. The ratesapplicable for the additional vehicle would be same as that quoted by thesuccessful bidder in the respective schedule of price for that location.

The vehicles are required at Manglya and Gujri as indicated in the Schedule I.The company at its own discretion may shift either one or more jeeps to anypipeline locations at any time. During this period the rates applicable shallbe as quoted in schedules for location.

32. The contractor shall ensure ready availability of the following items atall time in each vehicle." One torch in good working condition" Spares like hose pipes, fan belts, etc." Spare tyre in good condition" Tool kit with all types of tools and tackles with jack." Portable Fire Extinguisher." First Aid Box.

33. Daily log sheets for the vehicle running has to be maintained and it willbe responsibility of the driver to obtain the signature of staff for theopening as well as the closing meter reading by the user from the BPCL.Monthly bills raised by the contractor for payment shall be accompanied withoriginal copy of the log sheet, the format for the log sheet will be as

Monthly RA bills are to be submitted to Engg-In-Charge forhis certification. Any Penalty levied by the Engg-In-Charge will be informedto the contractor.

34. Whenever the vehicle is used for night traveling beyond midnight (i.e.24.00), night halt allowance will be paid in addition to the overtime. In caseof night halt at out station, the vehicle will be closed after use and shallbe opened as and when required. In such cases night halt allowance shall bepaid and over time shall be calculated up to time of close/open of the vehicleon that particular day.

35. The number of vehicles required at each location is given in therespective schedules. However, the contractor has to be in a position tosupply all the required number of vehicles at a particular location. Supply ofpart number of vehicles at one location is not acceptable and such offers willnot be considered for evaluation.

36. BPCL reserves the right to change the date of placement of the vehiclesat a particular location. BPCL also reserves the right to discontinue anexisting vehicle from operation with a notice period of one month citing noreason what so ever.

37. The contractor whose quotation is accepted has to supply the vehicles atdifferent locations as advised by BPCL from time to time. The quoted rateshould be firm till the completion of the contract period.

38. All the vehicles are required to be fitted with spark arrestor whileentering the BPCL premises. The drivers should ensure that he maintains aspeed limit of less than 25 Kms or speed limit as applicable inside therespective Plant area at all times.

39. The rates quoted shall remain firm throughout the tenure of the contract.However, revision in rates both upward and downward shall be applicable onaccount of fluctuation of diesel prices only when the variation in dieselprice is more than 10 percent w.r.t the diesel price on the date of creationof RFQ. Escalation on running cost will be paid on the following basis:

The contractor is required to submit along with monthly bills vehiclePerformance Evaluation Sheet for each vehicle as per Annexure 2 certified bythe Engg-In-Charge. The contractor's performance shall be measured based onthis reports. In case contractor performance goes below satisfactory levelthen BPCL reserves the right to penalize the contractor as deemed fitsubjected to maximum of Rs. 5000/- per vehicle per month.

The contractor's performance will be evaluated based on the monthlyperformance ratings received and also on a cumulative ratings of last sixmonths (including the month for which bill is submitted). For the contractperformance to be satisfactory or above the following criteria shall be met;a) Monthly performance rating for which the bill is submitted shall be morethan or equal to 67 marks andb) Average performance rating for last 6 months (including the month for whichthe bill is submitted) shall be more than or equal to 70 marks.

The contractor is required to submit a sign and stamped copy of PerformanceEvaluation Sheet as a token of acceptance along with the technical bid. ________________________________________________________________________________________________________________________________________

* 03 INDEMNITYThe Contractor shall indemnify and keep indemnified the Company, and its everymember, Officer and staff against all actions, proceedings, claims.
