Terms & Conditions

1 Eligibility

Criteria

1. The tenderer should have atleast two years experience of fabrication of various types of bus bodies. 2. Tenderer should posses Provident Fund Account No. and ESI

Number (proof to be attached with tender documents) or Tenderer will have to submit an undertaking for obtaining provident fund account N0.and ESI N0.within three month from the date of work order 3. Tenderer should have capacity to fabricate minimum 80-90 numbers of bus bodies Components in a month and shall submit the following documentary evidence in support of the same. (a) Copy of work orders against which tenderer had fabricated the bus bodies. during last 3 financial years.

(b) Details of TDS and Service Tax deposited during last 3 financial years. (c) Copy of balance sheet duly signed by CA for the last 3 financial years. 4. Tenderer will be required to submit copy of his registration certificate as per rules. Further, tenderer should get license holder under the Contract Regulation & Abolition Act, 1970 after getting the contract. 5. Tenderer should not be faulted for making payment to its worker as per NIT terms & condition/as per instruction .

2 Earnest Money &

Tender fee

Tenderer shall submit non-interest bearing EMD of Rs.

50,000.00 (Fifty thousand) and tender fee of(Rs. 1000/- +

vat as applicable) in favour of SECRETERY UPSRTC

LUCKNOW. through Demand Draft along with the Technical

Bid. EMD of successful tenderer will be refunded on receipt of

. Security deposit.

3 Validity of

tender

The quoted rates will be valid for 90 days from the date of

opening of tender and validity of contract will be 12 months

from the date of decision/date of placing work order.

4 Security

deposit

The Successful tenderer will have to deposit Security deposit

in the form of Bank Guarantee/Fixed deposit, of 10% of

the work order value of any Nationalised Bank valid for 18

months. This is liable to be revoked/forfeited in case of failure

to meet the contractual obligations including timely fabrication

of bus bodies/payment to its worker/non depositing of

ESI/EPF

5 General

Conditions

1. Selected tenderer will be responsible for any injuries to their employees while working in UPSRTC KANPUR. being the Employer of the employees working under him. 2. M.D UPSRTC reserves the right to engage more than one contractor at any time, keeping in view the demand of fabricated buses. 3. Quality of work of fabrication of bus bodies components will be supervised by the supervisors/officers of UPSRTC. If any work done is not found according to the specifications, then material damaged/spoiled and the other overheads will be recovered from the pending payment/ Security deposit of selected firm.

4. Any intentional damage to chassis, bus body, tools and machinery during the course of fabrication will be recovered from the contractor’s pending payment/ Security deposit, deposited by him.

5. If the selected tenderer fails to fabricate 80-90 bus bodies Components per 30 days of a calendar month, a delay penalty @2% of the total value of less fabricated buses will be imposed and recovered from the pending payments/Security deposit deposited.except the cases where the selected tenderer is not at fault e.g. unavailability of chasis, shortage of material or any departmental cause. 6. Continuous failure to fabricate 80-90 bus bodies Components per calendar month for three months will render the tenderer liable for forfeiting the Security deposit deposited by the selected firm and he will be declared debarred for participating in future such tenders for two years. 7. Raw materials, machinery and consumables including electric power and water supply will be supplied by the Corporation.

8. All taxes including service tax as per Govt. instructions will be deducted by the UPSRTC while making payment to the contractor. However, the same shall be deposited by UPSRTC in the concerned account of the contractor. 9. Tenderer can inspect/see drawings, specifications, tool & plant and other infrastructure available in UPSRTC for fabrication of bus bodies components at KANPUR on any working day from 9.00 a.m. to 5.00 p.m.

10. Fiber Reinforced Plastic (FRP) Components, Passenger seats and side window frames including glasses will be provided by UPSRTC in ready to fit condition, but have to be fitted by the selected firm. Tenderer may quote rates accordingly. 11. UPSRTC will get fabricated 80-90 bus bodies Components every month on TATA/Ashok Leyland chassis. But the actual output depends upon the availability/supply of chassis from chassis manufactures and requirement of UPSRTC. 12. Annexure-A and B to be submitted in separate envelopes clearly stating Technical Bid and Financial Bid on the top of envelopes along with tender fee and EMD in the technical bid envelope. 13. Any conditional terms and conditions mentioned by the tenderer in his covering letter or in the tender documents will not be acceptable.

14. The selected tenderer has to provide its own manpower to get the working area used by its employees sweeped and cleaned. He has to ensure lifting of scrap/packing material/paint container etc. and putting them at appropriate place decided by the Corporation.

15. The selected tenderer will submit the bank details office account with any nationalised bank/scheduled bank for releasing the payment.

16. The selected tenderer will provide a monthly statement of having deposited EPF& ESI for his employees in the prescribed proforma by 15th of every calendar month, failing which the payment will be stopped by Corporation. 17. The Technical Bids will be opened first and Financial Bids of those firms only will be opened, who qualifies in the Technical Bids.

6 Specifications The selected tenderer has to fabricate the bus bodies as per

drawing/design & specifications of UPSRTC. However, minor

changes in drawing/design of bus bodies components can be

made with a prior notice of 15 days without extra charges.

7 The tender would be decided on the basis of the best quoted valid rates. Negotiation

will be ( if required) held as per UPSRTC policy.

8 All the participating tenderer will be required to submit an affidavit along with tender

(technical bid) that they have not been blacklisted by any Centre/State Govt.

Deptt/STU/PSU. Any tenderer that has been blacklisted by any such agencies will not

be allowed to qualify in the technical bid.

9 UPSRTC LUCKNOW will release the due payment of the selected tenderer within 15

days from the date of receipt of the bills along with the undertaking that he is having

no pendency of the due payment of his employees engaged in fabrication of the bus

bodies components for more than last 15 days from the date of submission of bills. The

selected tenderer will not be allowed to claim any advance payment of any kind

during the course of execution of the tender. If Contractor fails to make payment to its

worker (engaged in UPSRTC for Bus Body work) twice, then action will be initiated

to debar the firm for further work for minimum 3 years.

10 In case bidder withdraws/modifies its offer within the validity period, submits

forged/fake documents or do any unethical/unbusiness like activity, do not accept the

work order, do not fabricate bus bodies timely, does not submit Security deposit, does

not make payment to its workers etc. then EMD of the firm will be forfeited

immediately and the selected tenderer will be liable for penal action including criminal

proceedings black listing as per the facts and circumstances of the case.

11 Before starting the work of fabrication of Bus Bodies, tenderer will submit the list of

its employees along with their permanent address to the Corporation

12 MD, UPSRTC reserves the right to modify/revoke the work order at any point of time

without assigning any reason.

13 Tender documents should be duly paged and photocopies of relevant documents

enclosed should be duly signed and stamped by the authorized representative of firm.

14 Arbitration : In the event of any dispute, matter will be resolved under the provision of

Arbitration & conciliation Act 1996. .

15 Jurisdiction : Any dispute or difference or claim etc. shall be subject to the exclusive

jurisdiction of courts situated at Lucknow only.

5 Tenderer should have EPF/ESI/Service Tax

(attach proof) or Tenderer will have to submit an undertaking for obtaining provivent fund account N0.and ESI N0.within three month from the date of work order

6 Selected tenderer will have to submit an

undertaking for obtaining license under the

Contract Regulation & Abolition Act, 1970 (in

case of contractor). In case of firm/company, a

copy of registration will have to be attached.

7 Tenderer will have to submit an undertaking that

he is able to fabricate 80-90 nos. of bus bodies Components, per month.

8 Tenderer will have to accept that in case of

continuous failure to fabricate 80-90 nos. of bus

bodies Components per calendar month for

three months will render himself liable for

forfeiting the Security deposit in a month and shall submit the following documenta deposited

by him and he will be declared debarred for

participating in future tender for one year.

9 Tenderer will have to accept that if he fails to fabricate 80-90 bus bodies Components, per calendar month, a delay penalty @ 2% of the total value of less fabricated buses will be imposed and recovered from the pending payments/Bank Guarantee deposited by him. except the cases where the selected tenderer is not at fault e.g. unavailability of chasis, shortage of material or any departmental cause.

10 Tenderer shall submit EMD of Rs. 50,000.00

11 Tenderer will have to accept that the firm will be

responsible for any injuries to their employees

while working in Upsrtc Central workshop/ Dr

Rml workshop. Kanpur. being the Employer of

the employees working under him.

12 Tenderer will have to accept that the firm will be

sole responsible for depositing EPF & ESI

contribution every month of his employees and

will submit the challan copy every month along

with the bills in the prescribed proforma.

13 Tenderer will have to accept that the firm will

fabricate the bus bodies as per

drawings/design/specifications of UPSRTC

However, minor changes in drawing/design of

bus bodies can be made with a period notice of

15 days without extra charges.

14 Tenderer will have to accept that all tools &

plants (welding sets & other machines including

other tools) will be provided to the selected firm

in serviceable condition and will be accepted

back in serviceable condition.
