Appeals court says requirement to attend AA unconstitutional

Alcoholics Anonymous, the renowned 12-step program that directs problem drinkers to seek help from a higher power, says it’s not a religion and is open to nonbelievers. But it has enough religious overtones that a parolee can’t be ordered to attend its meetings as a condition of staying out of prison, a federal appeals court ruled Friday.

In fact, said the Ninth U.S. Circuit Court of Appeals in San Francisco, the constitutional dividing line between church and state in such cases is so clear that a parole officer can be sued for damages for ordering a parolee to go through rehabilitation at Alcoholics Anonymous or an affiliated program for drug addicts.

Rulings from across the nation since 1996 have established that “requiring a parolee to attend religion-based treatment programs violates the First Amendment,” the court said. “While we in no way denigrate the fine work of (Alcoholics Anonymous and Narcotics Anonymous), attendance in their programs may not be coerced by the state.

The 12 steps required for participants in both programs include an acknowledgment that “a power greater than ourselves could restore us to sanity” and a promise to “turn our will and our lives over to the care of God as we understood Him.” They also call for prayer and meditation.

Friday’s 3-0 ruling allows a Honolulu man to go to trial in a suit on behalf of his late father, Ricky Inouye, who was paroled from a drug sentence in November 2000.

A Buddhist, he objected to religiously oriented drug treatment in prison, sued state officials over the issue and told Hawaii parole authorities just before his release that he would object to any condition that included a treatment program with religious content.

When Inouye was arrested for trespassing in March 2001 and tested positive for drugs, his parole officer, Mark Nanamori, ordered him to attend a Salvation Army treatment program that included participation in Narcotics Anonymous meetings, the court said.

Inouye showed up but refused to participate, dropped out after two months, and, for that and other reasons, was sent back to prison in November 2001 for violating his parole.

After his release in 2003, he sued Nanamori and others for violating his constitutional rights. Inouye died while the suit was pending, and his son took over the case.

A federal judge dismissed the suit, saying officers are required to pay damages for violating constitutional rights only when those rights are already clearly established.

But the appeals court said Nanamori should have known in 2001 that coerced participation in a religion-based program was unconstitutional because eight state and federal courts had ruled on the issue then and all had agreed that a parolee has a right to be assigned to a secular treatment program.

1. Helped out at Central Office as much as I could whenever needed.2. Elections are coming up in November. Please inform your groups so that those interested in Service Positions can start

thinking about it. Additionally, if there is a position you are personally interested in you might want to get with those now in those positions and find out what is required and what the position entails. I have asked Paul S., who ran the elections last year to do it again this year.

3. The Quarterly Inventory has been re-scheduled from September 30th to October 13th.4. Once again, I remind you that you are here to represent your group and take information received here back to your groups.

I encourage you not to just pick up the handouts but to read them share them with your groups. For example: don’t just pick up or listen as one reads the report. Take a good look at it. Ask questions and discuss it with your group or the person who submitted it. If you find errors make them known or let your group when we discuss improvements to Central Office for example. In doing so, you become an extra pair or eyes because we are not perfect and don’t catch all the errors.

5. I am also requesting that the Delegates take a minute now and then to either stop by Central Office or call to see if you can be of service as they can always use a helping hand if it’s no more than sweeping the floor or taking out the trash.

6. We need to know which document to use for the by laws / operating procedures. The booklet (which is rather expensive to reproduce each time & was good 2 years ago); or the full (word document). Our issue is the updating of 2 documents as opposed to 1 document. We will take of this in new business. I have talked w/ central office and this will require only a simple majority vote.

B. Office operations committee chair person Mike K September 15th, 2001. I Chaired the OOC Meeting in the absence of Mike K., OOC Chair.

A. Beverly, Office Manager gave her Report and handed out a copy of the 2008 CCFAA Proposed Budget and Treasurer’s Reports which were discussed and finalized for presentation at today’s meeting.

B. The Office Manager will be attending an Office Manager’s Conference in Oklahoma City October 3rd. ( the office will be covered during that time)

F. PI/CPC Chair – IVO V. Wed. September 12 ’07Ivo V. Chair called the meeting to order at 7:05. Present were Ann, Rebecca, Derrick, (all new) Kelley, Jim. Chuck, Dane, and Ivo. After the Serenity Prayer the three new members were introduced.Ann and Rebecca volunteered to work the Student Assistance Program with schools. They will begin by talking with the coordinators. Rebecca will also cover Kaiser in Roseville, the Orangevale library, and Mercy San Juan. Ann has been stocking literature at U.C. Davis hospital and Dane will take that over as he lives close by.Derrick will begin by servicing Mercy Hospital in Folsom as well as some other spots.Chuck has been keeping the Fair Oaks Library and the Carpenters Union Hall stocked with literature. Ivo had a request from an organization in Olivehurst to have a booth at an afternoon affair. He turned it over to the Olivehurst AA group.Jim, District 27 Chair is stocking Sutter Roseville Hospital’s three sites and reports that the Emergency Room gets very heavy usage. He also stocks the U.C. Davis Clinic in Roseville as well as the Communication Workers Union building. Jim had a request from a business in Rocklin to attend a Health Fair. He took this to the Rocklin group and they were happy to handle the affair.The highlight of the evening was when Chuck announced that after trying for over a year to make headway with the Sacramento Court System he was able to find a new path to follow. From a lead he received he was able to make the right contact with a lady from MADD who speaks to from 850 to 1,000 people in our three county areas each month who have received DUI’s. She is willing to make available two of our literature’s, “Making a Beginning in AA,” and “So You’ve Been Told To Go To AA,” to any and all of the people in these mandatory classes. As for getting our literature into the right hands, this is a dream come true. Chuck and possibly some other committee members plan on sitting in on one of these classes. The meeting was adjourned with The Lords Prayer at 8:40 PM. Ivo V. Chair.

want to communicate the offers for service made and issues to remember for next year. I spoke with fun services and told him 6 more of each for next year and he said he had them. Also we discussed moving the area were we set up the speaker meeting away from the baseball diamond and into the shade over closer where the children’s games were this year. So we don’t run the risk of people being hit by a ball and the speaker and audience will have more shade as well. The Greenhaven group offered to run bingo again next year. The Unity Group and the Elk Grove Fellowship will be serving in the same capacities next year. Mark from the Chili Booth Said he will be back next year. Ron from the Muffin booth said he would also serve in the same capacity next year, so we are off to a good start. CNIA said they would love to make this an annual event so they will also back. All of the supplies are at the East Yolo fellowship. The Jail is gone so we don’t have to worry about it, and like you said we can use other measures to create one if necessary.Everyone loved the polish sausage and we could have some more, I only had two people ask me about the chicken dinners and when I told them we have polish Sausage dinners they were great with it. I hope we have a Plant/ Crafts booth next year possibly through the Women’s Sobriety Group. You and your team did a wonderful job on the white elephant. I hope it does as well next year. The set up Committee is crucial to a successful picnic. I agree that needs to be a well established committee. I will have the book ready to be presented to central office. 4. Discuss Proposal 07-8: Change to the Operating Procedures SECTION XV STANDING COMMITTEE/CHAIRPERSONSDiscussion - Bill: 07.08 &07.11 Section XV go hand in hand. And says all committees should be following guidelines. South Port Serenity is trying to enforce that since Central Office is a part of Alcoholics Anonymous, they should be following all the guidelines that GSO follows.Discussion - Terry: My group had two major concerns on this. They are both the result of the wording. 15. 2 says “all committees shall seek approval”. It does not specify from whom. The second one is the last line says all documents that are distributed by the CCFAA are included. They are afraid it would delay the process of getting information to groups. Discussion - Maurine: CCFAA Meeting 9/14/07 Response to Concern l5.7 PI/CPC Committee Chairperson

The AA Service Manual/12 Concepts defines the responsibility for the CPC (Cooperation with the professional community) committee at the district, area, and Conference level, to help carry the message to professionals who work with alcoholics.The purpose of the packet sent by the CPC committee was to revisit a decision made by our founders and reaffirmed by World Service by communicating the guidelines outlined in “Information on Alcoholics Anonymous”: For Anyone New Coming to AA and/or For Anyone Referring People to AA. These guidelines describe what AA is, what AA does, and what AA does not do under the heading of AA’s Singleness of Purpose and Problems Other Than Alcohol. PI/CPC brought this subject to the professionals in the treatment and recovery institutions in our community after lengthy discussion. It was decided to address the practice of many of these institutions of putting alcohol in the category of “all drugs” and referring people with problems other than alcohol, to closed AA meetings. We felt this practice developed due to a lack of understanding of the AA program and its principles. If ignored however, this practice had the propensity of hurting AA as a whole as stated in the fourth Tradition.4th Tradition and Blue Card: There is no need for delegates to take this back to their group at there is no decision to be made. This was accomplished in 1987. The letter, which was shared with you at a previous meeting, contained information quoted directly from the founders, our AA literature, and World Service. Included in the packet was: the letter, a copy of “The Information on Alcoholics Guide”, the Blue Card, and an AA meeting schedule with all the closed meetings highlightedThe PI/CPC Committee works diligently to follow all AA principles, steps, and traditions in all its communications and presentations and it puts out a lot of various materials and information. The CPC Workbook states: “It is important that CPC workers understand the importance of AA’s Tradition and learn how to explain them to non-alcoholics. The cardinal fact is that the Traditions are our Traditions, and there is no reason non-AA’s should be expected to understand them unless we take the initiative and explain them. Pg. 17 of the Workbook talks specifically about explaining Open and Closed AA meetings.The Workbook provides specific information on how to address the community with pamphlets, letters, presentations, workshops, hot-line phone cards, etc., all of which we do regularly under the heading of CCFAA. If we had to have this committee take the 3 month process to approve all of this it would greatly hinder the work we do. Also, there is nothing in our Workbooks that calls for this type of procedure. Lastly, the 12 Concepts were written specifically to handle the operational structure of World Service as related to the principles of AA. Concept I deals with how Bill and Bob linked the World Service, the Board of Trustees and the thousands of AA groups by forming an AA General Service Conference. Concept IV deals with the “Right of Participation” of how some non-alcoholic trustees, paid staff members, and volunteer experts can vote, in proportion to their responsibility, at the General Service Conference. Those involved that have no vote can still have the “right of participation” in the process.I would like to propose that we keep, at stated, the following only:SECTION XV STANDING COMMITTEES/CHAIRPERSONS15.7 PUBLIC INFORMATION /COOPERATION WITH THE PROFESSIONAL COMMUNITY COMMITTEE/CHAIRPERSON:15.7 Committee shall be guided by the Twelve Traditions, AA Guidelines and the AA General Service Conference Manual approved for PI/CPC.

Discussion - Steve: It is easy to remember that our literature was written in 1937, and there is a lot of stuff in there that isn’t necessarily as applicable today as it was then I think for instance most people picking up the big book today would call it sexist and probably a lot of other things. I think it’s important me personally I would like to review anything that’s being out by and this body representing the voice of AA If it has to wait. I would rather have it go out correctly a few days later, then to have it misrepresent AA as a whole. Discussion - Bill: I don’t think this refers to flyers. I think it more about the information that we pass out to the public. Discussion - William: We have gone through this in the past about pamphlets, cards, etc. what’s approved what’s not approved. About four or five years ago. We even went to New York (GSO). They came to us with an answer to this. They said. Discuss Proposal 07-9,10: Discussion - Bill: one concern was things would are getting pushed through a little quick. This is to try to straighten that out; that the proposal needs to go through the bylaws committee first to see if it conflicts with any other part of the operating procedures, bylaws or any of the other things we have out there. This addresses both the by laws and the operating procedures. 07.09 & 07.10 both address the same problem, one in the operating procedures and one in the bylaws. Discussion - William: this is self explanatory because people have come up to me at a meeting, and given me stuff. One time somebody gave a proposal right here on the table to be introduced here and it was a proposed change that the By Laws and Procedures Committee never saw it. So hopefully this should straighten out all of that.
