  • 1.0 SUMMARY 1.1 This is the Bridgend County Borough Council Joint Housing Land Availability

    (JHLAS) Study for 2012. It replaces the report for the previous base date of 2011.

    1.2 This report presents the housing land supply for the area at the base date of

    1st April 2012. 1.3 The JHLAS has been prepared in accordance with the requirements of

    Planning Policy Wales (Edition 4, February 2011), Technical Advice Note 1 (TAN 1): Joint Housing Land Availability Studies and the Guidance Note on the JHLAS process (June 2011). Please refer to these documents for details of the requirements for the maintenance of a five year housing land supply in each Local Planning Authority area and the process for undertaking JHLASs.     1.4 Section 2 sets out details of the housing land supply and how it has been

    calculated. It shows that based on the residual method set out in TAN 1, Bridgend County Borough has 5.1 years housing land supply.

    Involvement

    1.5 The housing land supply has been assessed in consultation with:

    • Home Builders Federation • Linc Cymru Housing Association • Wales & West Housing Association • United Welsh Housing Association • Hendre Housing Association • Valleys to Coast Housing Association • Dwr Cymru/Welsh Water

    Report production

    1.6 Bridgend County Borough Council issued draft site schedules, site proformas and accompanying information for consultation between 2nd July 2012 and 20th July 2012. A Statement of Common Ground (SoCG) was subsequently prepared by the Council and, following consultation with the Study Group, was submitted to the Welsh Government on 27th September 2012.

    1.7 It was necessary for an appointed Planning Inspector to resolve a number of

    disputed matters in relation to three sites. 1.8 The appointed Planning Inspector subsequently prepared a report for

    the Welsh Government (see Appendix 4), making recommendations on the points of dispute.

  • 2.0 HOUSING LAND SUPPLY 2.1 The five year land supply comprises sites with planning permission (outline

    or full) and sites allocated for housing in adopted development plans, categorised as prescribed in TAN 1.

    2.2 The land supply has been calculated using the residual methodology. The

    housing requirement of 7957 is identified in the adopted Bridgend UDP and it is against this housing figure that the five year land supply has been calculated.

    2.4 Small Site Supply

    The contribution from small sites of less than 10 dwellings is based on the completions for the last five years.

    2.5 Overall total 5 year land supply (large + small sites) is 2672 (2310 + 362).

    5.1 3.0 COMMENTARY 3.1 TAN 1 states that to meet the requirement for a 5-year land supply the quantity of

    land agreed to be genuinely available may be compared with the remaining housing provision in the adopted development plan - the residual method. In some circumstances, that calculation has indicated land shortages or surpluses, which do not exist in practice. In such cases, a comparison of available land with past building rates can provide a measure of the adequacy of land supply that is more relevant to the achievement of the general objectives of the development plan.

    3.2 Whilst the Council acknowledge that the residual method should remain the primary method of calculating the land supply in accordance with TAN 1, it is considered that the past building rates figure should also be included within the study as has been the case in previous Bridgend JHLAS reports.

    4.0 MONITORING DATA

    4.1 TAN 1 requires the JHLAS report to provide additional information on the

    development of land for housing covering the use of previously developed land, the use of sites subject to flood risk constraints and the type of housing being developed, i.e. houses, flats or other. This data is set out below.

    This report concerns the Bridgend County Borough Council Joint Housing Land Availability Study (JHLAS) 2012.

    The matters in dispute are set out in the JHLAS Statement of Common Ground (SoCG) submitted in September 2012.

    Recommendation

    1. That the 2012 JHLAS housing land supply figure as at 1 April 2012 for the Bridgend County Borough Council planning area be determined as 5.1 years.

    Context of the Recommendation

    2. Local Planning Authorities have a duty to ensure that sufficient land is genuinely available or will become available to provide a 5-year supply of land for housing1. The purpose of preparing a JHLAS is to:

    Monitor the provision of market and affordable housing;

    Provide an agreed statement of residential land availability for development planning and control purposes; and

    Set out the need for action in situations where an insufficient supply is identified2.

    3. The scope of this report is to recommend an appropriate housing land supply figure in respect of the Bridgend County Borough Council‘s area of responsibility as local planning authority, in the light of the matters in dispute concerning the calculation of such a figure and the available evidence.

    Main Issues

    4. The main issues are the appropriate method to be used in determining the land supply, and whether or not each of the disputed sites should be counted as contributing to the 5-year land supply of land for housing at the time of the base date of the study.

    Reasons

    Method of Calculation

    5. TAN 1 advises that to meet the requirement for a 5-year land supply the quantity of land agreed to be genuinely available may be compared with the remaining housing provision in the adopted development plan. Where the adopted development plan covers only part of the study period, (as in this case) and in the absence of published development plan modifications, then the average annual provision from the last 5 years of the time covered by the development plan should be extrapolated to give an estimate of the land required. This is reiterated in Note 3 of the Welsh Government (WG) Guidance Note on the JHLAS process (Version 2 – September 2012).

    6. The Council consider that because of the recession and that the 5 year supply period extends beyond the UDP period, a comparison with past build rates should be given equal status. Nonetheless, TAN 1 advises that any departure from the residual method should be justified. Further, the WG Guidance Note advises that where an adopted development plan is in place it is expected that the residual method will be used; any departure from this method is likely to be exceptional and should be fully justified. The Bridgend UDP will expire towards the end of the current study period and whilst the effects of the recession are noted, I do not consider that a departure from the residual method is justified in this case.

    Disputed Sites

    7. There is an agreed land supply of 2662 units. Three sites are in dispute which amount to a disputed land supply of 464 units. TAN 1 provides advice on the criteria to be applied in considering whether sites may be regarded as genuinely available within a five year period. In addition, Section 7.4 of the TAN provides advice on sites that have remained in the land supply for periods well in excess of 5 years. I have assessed each of the disputed sites on the available evidence and in line with the advice in the TAN.

    8. Bridgend AFC (40 units): The site is allocated in the UDP and the Council are forecasting the completion of 40 units (the site’s capacity) by 2014-15. However, options for the use of the site are unclear, and there appears to be no house builder on board. There is no indication of when a planning application might be made, or any firm intentions by the landowner to bring the site forward. The HBF advises that the site has been undeveloped since 2008 and was in Category 3(i) in the 2011 study period without any change in circumstances this year. I consider that the Council’s forecasts are optimistic and without any tangible evidence to indicate that the site would be genuinely available in the next five years, I conclude that it should not be included in the 5 year land supply at this time.

    9. Land at Ty Nant, Llangeinor (10 units): The site is allocated in the UDP and full planning permission was recently granted in October 2011. Although the site has been in the 5 year land supply for some time I consider that the recent planning

    permission gives some indication of an intention to develop and that this gives sufficient explanation for the site remaining in the 5 year land supply.

    10. Porthcawl Regeneration Area (414 units): The site is allocated in the UDP and therefore meets one of the conditions set out in paragraph 7.1.2 of the TAN. Nonetheless, it has been in the 5 year land supply for some time, and the preferred developers for the site have recently confirmed that they are no longer proceeding with the scheme. Although a planning application is under consideration and related infrastructure is programmed and funded, I consider that the Council’s forecasts are optimistic. The reasons for the site remaining in the 5 year land supply are not sufficiently explained and I do not consider that it should count towards meeting the 5 year land supply at this time.

    11. Taking all of the above into consideration, I find that 10 units should be added to the agreed land supply of 2662 so that there is a land supply of 2672 units. The agreed annual housing requirement is 528 units and using the residual methodology this results in a land supply of 5.1 years.

    Overall Conclusions

    12. Based on the foregoing analysis I conclude that the housing land supply for the Bridgend County Borough Council planning area as at 1 April 2012 is 5.1 years.
