II. REVISED SECTION 2 – INFORMATION FOR BIDDERS 1. Section 2, clause 7 is deleted and replaced with:

7. Contract Time

A. This project is required to provide the Scope of Work identified in Section 4. The Contractor

shall reach substantial completion within 96 weeks from the Order to Commence. The 96 weeks includes the delivery of long lead items and stoppage of all works during winter season.

B. The final completion of the work must be carried out in accordance with Section 5A within 12 weeks thereafter.

C. When required by the City of Toronto, the Bidder shall submit, within 72 hours of being requested in writing by the City to do so, additional evidence satisfactory to the City, including a planned construction sequencing with major milestones including initial marking of proposed post placement, shop drawing submittal, fabrication and delivery and installation. In addition, additional evidence may be requested as to the Bidder’s ability, experience and familiarity with work of the character specified and his financial ability to properly perform the Work to completion within the time specified. The evidence requested may, without being limited to, include the following:

i. The Bidder’s financial statements for the past and current fiscal years;

ii. Evidence that the Bidder is licensed to do business in the Province of Ontario;

iii. Such additional information required satisfying the City that the Bidder is adequately prepared to fulfill the Tender Call requirements, including a critical path schedule and activity values in accordance with Section 4 requirements.

III. NOTICE OF "NO BID" FORM

Attached NOTICE OF "NO BID" form is to be added to Section 7 – City Policies. Should your firm decide not to bid on this project, the City of Toronto requests that you complete and submit the attached form.

1.0 PURPOSE

The purpose of this procedure is to outline determination of constructor status, delineation of construction projects, monitoring of delineation, notification of the MOL and reporting of non-compliance as it relates to health and safety.

2.0 SCOPE

This procedure is applicable to Toronto Water Wastewater Treatment Plants.

3.0 RESPONSIBILITY

The Quality Management System Representative or designate is responsible for maintaining this procedure and ensuring it is communicated appropriately.

The Plant Managers, the Manager of Major Capital Projects Delivery, and the Manager of Technical Services are responsible for communicating this procedure to their project managers and ensuring expectations regarding this procedure are followed.

Responsibilities specific to this procedure are noted in section 5.0 Procedure.

4.0 DEFINITONS

a) The City means the Corporation of the City of Toronto

b) Competent Person means a person as defined in the OHS Act, and employed by the City

c) Contract means the legal agreement between the City and the Contractor for the Project

d) Contractor means a vendor carrying out Construction activities at the City

e) Contract Administrator means Consultant, vendor, or other City authorized person who administers the construction contract ;

f) Construction Activity as per OHS Act, RSO. 1990 (includes erection, alteration, repair, dismantling, demolition, structural maintenance, painting, land clearing, earth moving, grading, excavating, trenching, digging, boring, drilling, blasting, or concreting, the installation of any machinery or plant, and any work or undertaking in connection with a project);

g) Construction Project means a construction project, whether public or private including (a) the construction of a building, bridge, structure, industrial establishment, mining plant, shaft, tunnel, caisson, trench, excavation, highway, railway, street, runway, parking lot, cofferdam, conduit, sewer, watermain, service connection, telegraph, telephone or electrical cable, pipe line, duct or well, or any combination thereof, (b) the moving of a building or structure, and (c) any work or undertaking, or any lands or appurtenances use in connection with construction;

h) Constructor means a person who undertakes a project for an owner and includes an owner who undertakes all or part of a project by himself or by more than one employer;

i) Designation means the assignment of separate Project status provided by the Ministry of Labour by application of section 4 of the Regulation.

j) EHS Compliance representative (“Representative”) means an employee of the EH&S Compliance Construction unit of Toronto Water.

k) Facility / Work Area means a wastewater treatment process or supporting service or utility and its related physical equipment and process areas as assigned by TW Facility / Plant Management

l) Notice of Project (“NOP”). means the approved notification form described in section 6 of the Regulation

m) Operations mean Toronto Water management staff responsible for the operations of the facilities within the Project.

n) Project Manager means the person assigned by the City to manage the administration of a contract.

o) Regulation means (the Regs) the construction regulations (213//91) made under the OHS Act.

p) Senior Specialist, Construction EHS Compliance means the person assigned to monitor overall the projects and who supervises the Construction EHS Unit, while complying with the OHS Act & Regulations on construction activities in the (TW facilities) City

q) Work Area Supervisor or delegate means the person in charge of the TW Facility / Work Area where the Construction activities will be carried out by the Contractor

5.0 PROCEDURE

5.1. Determination of Constructor:

5.1.1. In the eyes of the MOL, all projects have a Constructor. While the Constructor is usually the hired General Contractor, this status may be shared with, or entirely placed upon, the City. When the City, as the Construction Project Owner, deems the Contractor to be the Constructor, control of the defined Project area must be assigned to the Contractor. Construction occurs in operating facilities; therefore, the City must follow the Constructor's health and safety procedures when accessing the Construction area in a planned or emergency basis.

5.1.2. When there is more than one Construction Project at the site premises - called the

multiple projects case – and those projects are separate in time and or space, the City may request the Contractor be designated as the Constructor by the Ministry of Labour by writing a letter that requests designation of the Project as separate in time and space.

5.1.3. Steps in Determination of Constructor Status:

5.1.4. For a single Project case, the Order to Commence Work to the successful contractor will

include instructions to the Contractor to file a Notice of Project with the Ministry of Labour according to the Regulation. This Notice also identifies the Contractor as Constructor.

5.1.5. For the multiple projects case, a standard letter to the MOL shall be sent by the Project Manager requesting the designation of the identified Project as an individual Project for the purposes of the Occupational Health and Safety Act. The attachments to the letter will include a description of the scope of work as well as a site plan showing the general limits of the work, and when applicable, a list of other Projects at the Facility.

5.1.6. To help minimize confusion regarding the identification and tracking of these Projects, the

City will include in its tender documents a partially completed NOP form which will include a succinct meaningful description of the contract in Part 2 of the NOP. This will help provide more clarity to MOL staff on the scope of work and associated work area.

5.1.7. A Toronto Water staff person at each Facility has been assigned the task of maintaining

an up-to-date file of all active NOPs at the Facility. This ensures that all critical information is kept in one location, is maintained, and is easily accessible by MOL inspectors on demand when visiting the site. At the Wastewater Facility, the assignment

is made to the EHS Compliance representative of the Construction branch. The up-to-date file is kept in the Construction EHS Compliance Field Office.

5.1.8. Role of City and its Project Manager:

During the design process, the Project Manager is responsible for ensuring input from other ongoing and planned construction projects at the Facility. They are responsible for incorporating specified constraints into Division 1 of the specifications which clearly outline when certain work activities can and cannot occur. The purpose of defining these constraints is to avoid overlap in time and space between various contractors, to avoid The City being deemed the Constructor. If necessary, provision for weekend and overtime work should be included in the contract (Schedule of Prices) in order to pay to maintain separation in time when necessary. Note that temporary access to a Constructor's work area by another Constructor requires agreement between the two parties, and proper protocols must be in place to avoid problems from arising. In some cases this may not be possible, and the City may be forced to take on the Constructor role for a period of time.

5.1.9. Role of Contractor: The Contractor is responsible to meet the terms of the Contract and

Ontario Occupational Health and Safety Act and any explicit site specific MOL conditions.

5.1.10. Role of EHS Compliance section: EHS Compliance Construction staff provides advice to the Operations, Project Manager and other City staff about how to determine the Constructor and how to maintain Constructor status. EHS Compliance staff monitors this on a regular basis and report findings to the Project Manager.

5.1.11. Role of Ministry of Labour Regarding Constructor Determination: When the City,

makes a designation application request, the MOL will in most cases evaluate the application and make its determination. After its consideration, the MOL replies to the applicant providing its decision about the requested designation of a project. A successful application results in a written letter providing a Designation for the Project(s).

5.2. Delineation of Construction Project

5.2.1. Determination of the Delineated Scope of the Project.

5.2.2. The Project Manager in consultation with Operations and an EHS Compliance Construction Representative will determine the limits delineation required for the project.

5.2.3. The Project Manager will verify that Operations transfers physical control to the Constructor by use of the Access Permission Form.

5.2.4. The Constructor will erect around the perimeter of the Project and any separate lay-down areas, barriers compliant with the Regulation. This barrier delineates the construction area(s) as separate from other work areas and from public ways.

5.2.5. The Constructor is responsible to maintain the barriers in compliance with the Contract.

5.2.5.1. The Constructor is responsible for control and orienting of hazards to City staff (and their escorted visitors) accessing the Project site for operations and maintenance purposes.

5.2.5.2. Operations is responsible for informing City staff (and their visitors) of the requirements of the Constructor regarding access to the Project

5.3. Monitoring of the Delineation of the Project

5.3.1. At Wastewater facilities, the EHS Construction Compliance Representative will monitor the compliance of the delineation and communicates to the Project Manage and the Contract Administrator as applicable, any non-compliance using the Communication of Danger and Non-compliance in section 5.5

5.4. Notifying the Ministry of Labour of the beginning of a Project

5.4.1. The Project Manager will inform the contractor, via the Order to Commence construction, instructing the Constructor to generate a NOP.

5.4.2. In order to assure that the location is described correctly, the Project Manager and EH&S representative will review information concerning three sections of the Notice of Project prior to the constructor submitting it to the MOL: Sections #2, Project Information, #3, Owner of Project, and #5, Category of description of construction.

5.4.3. The Constructor, upon determining whether a notification is required by the Ministry of Labour, will provide either the approved form or another acceptable means of notification according to the Regulation.

5.4.3.1. The Constructor will provide a copy of the submitted NOP to the Project Manager and the Safety Representative.

5.5. If, in the course of work, a Competent Person observes construction activity which is potentially non-compliant with either the contract or with OH&S Legislation or the Construction Regs, they will quickly and to the best of their abilities determine whether or not the non-compliant activity is an Imminent Danger.

5.5.1. Non-Imminent danger activities identified and reported to the Project Manager

5.5.2. If the activity is assessed as not to be Imminent Danger, the Competent Person will report that activity to the Project Manager and Contract Administrator as soon as possible.

5.5.3. The Competent Person will record in writing in their log book, the nature of the potential non-compliant activity, and the person(s) involved.

5.5.4. As soon as possible, the Project Manager shall communicate the potential non-compliance to the Constructor’s site supervisor and request an immediate response. The issue will be documented and reviewed in the health and safety section of the following construction progress meeting.

5.5.5. If the Project Manager is dissatisfied with the Constructor’s response and health and safety concerns remain, the Project Manager will request the Constructor immediately contact the MOL for advice and a determination.

5.5.6. If the Constructor hesitates or delays in contacting the MOL for advice, the Project Manager will contact the MOL and communicate the concern.

5.6. Imminent danger activities identified and Stopped by an Order

5.6.1. If the activity is assessed to be Imminent Danger, the Competent Person will order that the person stop the dangerous activity immediately.

5.6.2. The Competent Person will inform the Constructor’s site supervisor, the Project Manager and the Contract Administrator immediately of the stop work order and safety concern. The Project Manager will review with the Constructor, Contract Administrator, EHS Representative, and the MOL as required, so that the danger is mitigated

5.6.3. The Competent Person will record in writing in their log book, the nature of the dangerous activity, the means taken to stop that danger, the person the order was directed to, and the action taken by that person to the order.

5.6.4. If the danger cannot be immediately mitigated, the Project Manager or delegate, on advice of the Contract Administrator, will issue a written Stop Work Order. Work in the affected area will be suspended until the Stop Work Order is lifted.

5.6.5. If a written Stop Work Order has been issued and once the danger has been addressed to the satisfaction of the Project Manager, Representative, (and MOL if involved), the Project Manager will issue a notice lifting the Stop Work Order.

1.0 Purpose

The purpose of this procedure is to outline the specific requirements while conducting

construction activities by a Constructor at a City of Toronto Waste Water Treatment Plant.

2.0 SCOPE

This procedure is applicable to all construction activities carried out by the Constructor in a City

of Toronto Waste Water Treatment Plant.

3.0 RESPONSIBILITY

The Senior Specialist, Construction EHS Compliance is responsible for maintaining this

document and ensuring it is communicated appropriately to City staff and others who would

manage construction projects at the City.

4.0 DEFINITONS

a) The City means the Corporation of the City of Toronto;

b) Contractor means a vendor carrying out Construction activities at the City;

c) Work Area Supervisor or delegate means the person in charge of the City Work

Area where the Construction activities will be carried out by the Contractor;

d) Project Manager means the City personnel (Tech Services, Major Capital Works,

for example) which has responsibility for the implementation and management of the

construction activity in the City;

e) Contract Administrator means Consultant, or City employee or other City-

authorized person who administers the construction contract;

f) Constructor means a person who undertakes a project for an owner and includes an

owner who undertakes all or part of a project by himself or by more than one

employer;

g) Facility means a City of Toronto Wastewater treatment plant (“WWTP”).

h) Work Area means a treatment process or supporting service or utility and its related

physical equipment and process areas as assigned by Facility Plant Management;

i) Construction Activity as per OHS Act, RSO. 1990 (includes erection, alteration,

repair, dismantling, demolition, structural maintenance, painting, land clearing, earth

moving, grading, excavating, trenching, digging, boring, drilling, blasting, or

concreting, the installation of any machinery or plant, and any work or undertaking in

connection with a project);

j) Construction Project as per OHS Act means a construction project, whether public

or private including (a) the construction of a building, bridge, structure, industrial

establishment, mining plant, shaft, tunnel, caisson, trench, excavation, highway,

railway, street, runway, parking lot, cofferdam, conduit, sewer, watermain, service

connection, telegraph, telephone or electrical cable, pipe line, duct or well, or any

combination thereof, (b) the moving of a building or structure, and (c) any work or

undertaking, or any lands or appurtenances use in connection with construction.

k) The Regulations (Regs) means Ontario Regulations 213/91 for Construction

Projects.

l) Senior Specialist, Construction EHS Compliance means the person assigned to

monitor overall the projects and who supervises the Construction Environment Health

Safety Unit (EHS), while complying with the OHS Act & Regulations on

construction activities in the City.

m) Construction EHS Unit means the Construction EHS Compliance unit assigned by

the City to support and monitor the compliance of the OHS Act & Regulations on

construction activities at the City's Facilities.

5.0 PROCEDURE

5.1. General

Construction activity at a Facility is initiated by the Project Manager or designate through

an Order to Commence Work. The Project Manager is the City lead person responsible

for communicating with all stakeholders including the project sponsor, project team, the

Contract Administrator, and Contractor. The Project Manager occupies the centre of

interactions between stakeholders and the project itself. The Project Manager assigns the

role of Constructor to the Contractor.

The Contract Administrator administers the contract.

The Construction EHS Unit monitors compliance of the OHS Act and Regulations at the

Facility construction site and advises the Project Manager/Contract Administrator of any

potential non-compliance.

City procedures: When applicable, City Safe Working Procedures and Safe Operating

Procedures relevant to Health and Safety shall be implemented by the Constructor, and as

included and required by the contract.

5.1.1. Once “the Order to Commence Work” to the contractor is issued, the Constructor

assumes the role of constructor pertaining to the construction project and issues an

appropriate Notice of Project (NOP) to the Ministry of Labour (MOL) when

required by the OHS Act and Regs.

5.1.2. When necessary, a separate "Request for Designation of Constructor status"

for an individual project is prepared by the Project Manager and is sent to the

MOL for its approval. Refer to QMS procedure PR-TW-6301Construction Health

& Safety Management Procedures to determine if this is necessary.

5.1.3. Contractor Access Permission checklist: The Contractor shall request access

into Facilities, for assuming control of the physical location where the

construction activities will be carried out by the Constructor, as per the terms of

the contract agreement. The contractor will complete the “Contractor Access

Permission checklist” and submit it to the relevant Work Area Supervisor(s) or

delegate for approval.

5.1.3.1.The Work Area Supervisor (s) or delegate shall approve this completed

Contractor Access Permission Checklist after satisfying that the requirements

of the Work Area are met. If not, the Work Area Supervisor (s) or delegate

defers approval for further discussion with the Project Manager/ Contract

Administrator.

5.1.3.2.Upon approval of the Checklist, the approved access permission is provided to

the Contractor and the Contract Administrator starts the construction activities

as per the contract terms.

5.1.4. Service Interruption Form: While carrying out the construction activities, if the

contractor requires City services to be interrupted (for example, isolation of

energy, obstruction to a plant operation, road closure [partial or full], etc.), a

Service Interruption Request Form shall be completed.

5.1.4.1.The Contractor requests the Service Interruption Request from the Work

Area Supervisor as indicated on the Form.

5.1.4.2.The Work Area Supervisor or delegate approves the Request with comments

or rejects with comments.

5.1.4.3.The Work Area Supervisor or delegate can defer approval of the Request, if

the control measures and condition of the plant service (s) are not met

adequately to protect the plant operation and workers’ safety. Further

discussion with the Contract Administrator or the Contractor may be initiated

by the Work Area Supervisor or delegate to advance the approval.

5.1.4.4.Only upon receiving the approval of the Service Interruption Request, the

Contractor shall continue the construction work,

5.1.4.5.The Contractor (s) and the Work Area shall comply with all requirements of

the approved Service Interruption Request, Contractor Access Permission

checklist.

5.1.4.6.A copy of the approved Service Interruption Request and the Contractor

Access Permission checklist shall be kept at the offices of the Work Area

Supervisor or delegate, the Contract Administrator, and a copy is to be

submitted by the Contractor to the Construction EHS Unit.

5.2. Maintenance of the Forms and Checklist

The Senior Specialist, Construction EHS Compliance shall maintain the Forms

and checklists Access Permission to Contractor- checklist, Service Interruption

Request Form annually and shall issue a current version via the standard

distribution system.

5.3. Maintenance of the Collection of mandatory Notices

The Senior Specialist, Construction EHS Compliance, or his assignee, shall

maintain a repository with the description of all Projects and all designations at

the facility
