Under the PVoC program, all regulated products to be imported to Tanzania will undergo verification and testing in the country of supply and a Certificate of Conformity (CoC) will be issued to demonstrate that they meet the requirements of the applicable national standards or approved equivalents and technical regulations. The CoC will be mandatory for Customs clearance.

The TBS has introduced the PCA Program to protect the country, consumers and local manufacturers from:

Substandard products that may endanger public health, safety or the environment

Counterfeit or unsafe products

Unfair competition from imported goods which do not comply with the approved standards

Products regulated under this program include:

Toys and childcare products

Electrical and electronic products

Automotive products

Chemical and household products (furniture, paper products)

Mechanical materials and gas appliances

Food and agricultural products

Selected safety equipment

Used products

There are 3-potential routes to PVoC certification depending on conditions including, but not exclusively: the type of product; its homogeneity; the frequency of shipments; and, the manufacturer’s quality management system.

Route A – for unregistered products (unregistered suppliers of manufacturers of sensitive goods). Products must be tested and physically inspected to demonstrate conformity to relevant standards, essential requirements or manufacturer’s specification

Route B – for registered suppliers or manufacturers of goods. This offers a fast track certification process for goods with reasonable and consistent levels of quality by registration of products with the PVoC contractor. Product Registration is recommended to exporters with frequent shipments of homogenous products

Route C – licensed products. This route is only open to manufacturers who can demonstrate the existence of a quality management system in their manufacturing/production process. This route involves the audit of any QMS and licensing of products by the authorized PVoC contractor. This route is recommended for manufacturers with high frequency/volumes of shipments.

1. Gasoline, Automotive diesel fuel, aviation turbine fuel, illuminating kerosene and fuel oil; 2. Raw materials for industrial use, endorsed by Confederation of Tanzania Industries (CTI); 3. All shipments with FOB under 1000 USD on all modes of carriage; 4. Assorted/consolidated goods for small traders; 5. Mining products/equipment except for foods and protective gear; 6. Investors capital goods; 7. Spare parts for use in industries to ensure good manufacturing of final products; 8. Materials for specific Government projects; 9. EPZ (Export processing zones) destination; 10. Charitable shipments that have received TBS exemption; 11. Goods destined for Zanzibar; 12. Products sent for repairs outside the country; 13. EAC (East African community) manufactured and with certification mark of local bureau of standard (UNBS, KEBS, TBS, BBN and RBS); 14. Products from TBS and KEBS certified suppliers 15. Motor Vehicles 16. Used Tires 17. Retreaded Tires

REPUBLIC OF TANZANIAPre-Shipment Verification of Conformity to Standards

NEW REGULATIONSFrom February 1st, 2012 goods exported to Tanzania shall undergo a Pre-Shipment Verification ofConformity to Standards of export prior shipment. Bureau Veritas has been appointed by theTanzanian Bureau of Standards (TBS) for the Verification of Conformity Programme. Thisprogramme applies to specific goods (see overleaf).

PROCESSRequest for Certificate

The Importer/Exporter lodges a Request for Certificate with Bureau Veritas (see contacts overleaf). This request should include:■ The list and designation of goods intended to be exported, name and address of the importer and exporter (invoice,…)■ Conformity documents (usually provided by the exporter) that may be available for the goods intended to be exported,

such as: Third party certificate / Test reports / Reports of analysis according to safety/hygiene standards■ Information related to the location and provisional date of availability of goods to carry out the physical inspection of

goods before shipment. (Filling up of the Request For Certificate (RFC) Form).

Routes to complianceTo facilitate trade and to adjust intervention according to the risk, the PVoC Programme offers 3 different routes to demonstratecompliance (see the process overleaf):

■ Route A: Applicable to any good and any trader■ Route B: Option for frequent traders of goods that have been registered by Bureau Veritas■ Route C: Option for frequent traders of goods that have been licensed by Bureau Veritas

Documentary review / TestingBureau Veritas reviews the information provided by the exporter and checks the adequacy against the Tanzanian standards. Ifnecessary, samples are taken and laboratory testing/analysis is carried out.

InspectionThe objective of the inspection is to check that:

■ Goods presented for inspection are those identified during the documentary review■ Products comply with applicable standard■ Goods match the description in the import documents

In case of doubt, Bureau Veritas inspector may take samples for additional assessment.

PVoC certificateBureau Veritas verifies the inspection report against the provided documents. Upon satisfactory result, the secured Certificate ofConformity is issued. This certificate shall be used for the clearance of the goods. When non conformities are detected, a NonConformity Report is issued.

4. Conformity requirements

Compliance of goods to applicable standards in priority order* shall be demonstrated with conformity documents issued by accredited entities and/or testing.

* Applicable standards in priority order: Tanzanian standard (TZS), then International standard (ISO, IEC, Codex Alimentarius UN ECE), EAS standards, then International standard (ISO, IEC, Codex Alimentarius UN ECE), then National standard, then Manufacturer specification in the absence of TZS, EAS, international and national standards applicable to the product. The PVoC programme offers 3 different routes to demonstrate compliance:

• Route A - Unregistered Suppliers or Manufacturers of sensitive goods • Route B - Registered products • Route C - Licensed products

7. Inspection fees

Paid by exporters. Fees structure :

• Route A – 0.53 % of FOB value of the goods imported • Route B – 0.45 % of FOB value of the goods imported • Route C – 0.25 % of FOB value of the goods imported

For all Routes, the minimum fee per shipment is USD 250 and the maximum fee USD 7,000. The above fees cover the documentary verification and the physical inspections of the goods but do not include :

• Testing: to be quoted on a case by case basis • Container sealing if required • Product Registration • Manufacture Licensing • Re-inspection due to vain inspection • Cost incurred by the Seller in presenting the goods for inspection and/or testing • Other fees not mentioned above

PROGRAM OBJECTIVE

To ensure the quality of products as well as the health, safety and environmental protection of Tanzanian consumers.

Protect the public against substandard products that can endanger public health, safety and the environment

Prohibit the entry of expired and counterfeit products.

Protect local manufacturers against unfair competition from imported products which do not comply to local Standards

Establishing a quality import inspection regime that is in harmony with that of member states of the East African Community

SCOPE OF THE PROGRAM

To assess that all regulated imported products do comply with approved Tanzanian Standards or International Standards.

VERIFICATION PROCESS

Export submits to SGS the following documents:

Request for Certification (indicating the point of entry in Tanzania)

Proforma Invoice

Quality Management System Certification

Conformity Documents (test reports, quality certificates, analysis reports, etc…)

Final invoice (except Airfreight & courier shipments).

To obtain evidence that all requirements are met in the applicable standards or technical requirements, goods must undergo one or a combination of the following verification process:

Physical inspection

Laboratory testing

- PVoC agent’s lab

- Third party accredited ISO/IEC 17025

- Manufacturers’ laboratory witnessed by PVoC partners

Documentary verification

After verification process is completed and results are satisfactory, exporter will have to submit the Final Invoice (except for airfreight and courier shipments) for the issuance of the CoC

ASSESMENT METHODE

Three methods are proposed to the exporters to demonstrate the compliance of their products and obtain a Certificate of Conformity (CoC)

ROUTE A: applicable to any goods and any trader

ROUTE B: Recommended for frequent exporter with

homogeneous products (Registration is renewable annually, subject to continual compliance.)

ROUTE C: For Certified products

Certificate of Conformity ( CoC)

A Certificate of Conformity (CoC) is the document issued to

evidence the compliance of the shipment to the relevant approved standards.

This document is required for Customs clearance.

For consignments shipped to Tanzania without CoC, importers may be issued a penalty of 15% CIF.

TBS will only grant release of such goods upon completion of inspection, testing (where applicable) and verifying conformity to the Standard. It is the seller’s responsibility to ensure that shipments to Tanzania are effected only upon issuance of a Certificate of Conformity or confirmed certification decision

NON CONFORMITY REPORT (NCR)

If the reports from the verification activities such as testing or inspection show discrepancies versus the verification criteria, exporters will be informed accordingly and given sufficient time to make the necessary corrections; if those are not or cannot be made a “Non Conformity Report” (NCR) will be issued. This may imply that goods are not allowed to be shipped into Tanzania.

FEES

Fees are payable in advance by the exporter. Fees are net of any tax present or future that may be applicable and are payable upon reception of the Request of Certification (RFC).

Fees are due regardless of whether after assessment of the goods of the exporter or importer does not provide the information or document necessary for the final issuance of the CoC, or for any other reasons does proceed to the shipment of the goods.
