Order:- No.54, Environment and Forests (EC2), 15th May 2014.

The Supreme Court of India, in its Judgment dated27-1-1999 in the Civil Appeals first read above, among otherthings, has observed that there is an immediate need that inall the States and Union Territories, the Appellate Authorityconstituted under Section 28 of the Water (Prevention andControl of Pollution) Act, 1974, Section 31 of the Air (Preventionand Control of Pollution) Act, 1981 or other Rules, there isalways a Judge of the High Court, sitting or retired and aScientist or group of Scientists of high ranking and experience,to help in the adjudication of disputes relating to Environmentand Pollution. An amendment to the existing notification underthese Acts can be made for the present. The Supreme Courthas further observed that all other such Rules or notificationsissued, under Environmental Statutes, either by the CentralGovernment or the State Government there is a need for

necessary amendments in the light of the above. The SupremeCourt has, therefore, requested the Central and StateGovernments to take notice of the recommendation and takeappropriate action urgently.

2. In pursuance of the direction of the Supreme Court ofIndia, orders were issued in Government Order 2nd read aboveconstituting an Appellate Authority to consider the appealpreferred under section 28 of the Water (Prevention and Controlof Pollution) Act, 1974 and under Section 31 of the Air(Prevention and Control of Pollution) Act 1981. Lastly inGovernment Order 5th read above among other things, theGovernment allowed the present Chairman of the AppellateAuthority under section 28 of the Water (Prevention and Controlof Pollution) Act, 1974 and under Section 31 of the Air(Prevention and Control of Pollution) Act, 1981 viz., JusticeT.V. Masilamani, (Retired Judge of Madras High Court) tocomplete his tenure period of 3 years from 24-1-2012. Further,the Government has also appointed two Experts / Scientistsviz Tvl. G. Rengasamy and Dr. K. Thanasekaran as Membersfor the said Appellate Authority.

3. Meanwhile, the Government of India in the letter 3rd readabove citing the orders of the Supreme Court of India 1st readabove has requested to constitute an Appellate Authority underBio-Medical Waste (Management and Handling) Rules, 1998.

4. As per sub-rule (1) of rule 13 of the Bio-Medical Waste(Management and Handling) Rules, 1998, any person aggrievedby an order made by the prescribed authority under the saidrules may, within thirty days from the date on which the orderis communicated to him, prefer an appeal in form V to suchauthority as the State Government may think fit to constitute.

5. The Chairperson, Tamil Nadu Pollution Control Board,in the letter 4th read above has suggested that necessaryamendment may be issued to Government Order 2nd readabove to the effect that the Appellate Authority constituted thereinmay be empowered to adjudicate the appeal preferred underthe said rule 13 of the Bio-Medical Waste (Management andHandling) Rules, 1998.

6. The Government, after careful examination, decided toconstitute an Appellate Authority to adjudicate the appealpreferred under sub-rule (1) of rule 13 of the Bio-Medical Waste(Management and Handling) Rules, 1998 with a Chairman andtwo Members as per the said judgment of the Supreme Courtof India, dated 27-1-1999. Accordingly, under sub-rule (1) ofrule 13 of the Bio-Medical Waste (Management and Handling)Rules, 1998, the Governor of Tamil Nadu hereby constitutesthe Appellate Authority constituted under Section 28 of the Water(Prevention and Control of Pollution) Act, 1974 (Central Act 6of 1974) and Section 31 of the Air (Prevention and Control ofPollution) Act, 1981 (Central Act 14 of 1981) as the AppellateAuthority to adjudicate the appeal preferred under the saidsub-rule (1) of rule 13 of the Bio-Medical Waste (Managementand Handling) Rules, 1998.

No.II(2)/HO/352/2014-In exercise of the powers conferredby Section 25 of the Commissions for Protection of Child RightsAct, 2005 (Central Act 4 of 2006), the Governor of Tamil Nadu,with the concurrence of the Chief Justice of the High Court,Madras hereby makes the following amendments to the HomeDepartment Notification No.II(2)/HO/350/2009, published at pages224 and 225 of Part-II-Section 2 of the Tamil Nadu GovernmentGazette, dated the 15th July 2009, as subsequently amended:-

AMENDMENTS.

In the said Notification, in the Schedule, in column (3),

1. against Serial Numbers 8 and 9 in column (1), for theexpression “District and Sessions Court”, the expression “FastTrack Mahila Court” shall be substituted; and

2. against Serial Numbers 13 and 28 in column (1), forthe expression “Principal District and Sessions Court”, theexpression “Fast Track Mahila Court” shall be substituted.

Whereas, complaints have been received from a numberof depositors that Messers. Welltexx India Enterprises PrivateLimited, Tiruppur District and Messers Good Will India PoultryFarm, Coimbatore District, financial establishments, havedefaulted the return of deposits made by the depositors aftermaturity;

And whereas, the Government are satisfied that the saidfinancial establishments are not likely to return the depositsto the depositors and hence, the Government have to protectthe interests of such depositors;

And Whereas, the proposal for attachment of propertiesworth Rs.7, 41, 46, 737/- were earlier identified andGovernment have issued Ad-interim order vide GovernmentOrder first read above.

And whereas, the Movable and Immovable propertiesspecified in the Schedule to this order are alleged to havebeen procured by the said financial establishments from andout of the deposits collected from the depositors;

Now, Therefore, in exercise of the powers conferred bySection 3 of the Tamil Nadu Protection of Interests ofDepositors (in Financial Establishments) Act, 1997 (Tamil NaduAct 44 of 1997), the Governor of Tamil Nadu hereby makesan Ad-interim order attaching the movable properties of thepersons who have borrowed money from the said financialestablishment and defaulted its payment and the immovableproperties standing in the name of the partners of MessersWelltexx India Enterprises Private Limited, Tiruppur District andMessers Good Will India Poultry Farm, Coimbatore District asspecified in the Schedule to this order and transfers the controlover the said movable and immovable properties to theCompetent Authority, namely, the Competent Authority andDistrict Revenue Officer, Coimbatore District appointed underthe said Act.

2. The Competent Authority and District Revenue Officer,Coimbatore District is requested to pursue further action inaccordance with the procedure laid down in sub-sections (3)and (4) of Section 4 of the said Act and also the formalitiesprescribed in the Tamil Nadu Protection of Interests ofDepositors (in Financial Establishments) Rules, 1997.

3. The Special Public Prosecutor, Special Court for theTamil Nadu Protection of Interests of Depositors (in FinancialEstablishments) Act, 1997 (Tamil Nadu Act 44 of 1944)Coimbatore District is requested to render necessaryassistance to the Competent Authority in filing the applicationbefore the said Special Court.

Whereas, complaints have been received from a numberof depositors that Messers T.V.S. Emu Farms, Erode District,a financial establishment has defaulted the return of depositsmade by the depositors after maturity;

And whereas, the Government is satisfied are satisfiedthat the said financial establishment is not likely to return thedeposits to the depositors and hence, the Government haveto protect the interests of such depositors;

And Whereas, proposal for attachment of properties worthRs. 6,75,000/- were earlier identified and Government haveissued Ad-interim order attaching the properties of the saidfinancial establishment vide Government order first read above.

And whereas, the movable properties specified in theSchedule to this order are alleged to have been procured bythe said financial establishment from and out of the depositscollected from the depositors;

Now, Therefore, in exercise of the powers conferred bysection 3 of the Tamil Nadu Protection of Interests ofDepositors (in Financial Establishments) Act, 1997(Tamil Nadu Act 44 of 1997), the Governor of Tamil Naduhereby makes an Ad-interim order attaching the movableproperties of Messers T.V.S. Emu Farms, Erode District asspecified in the Schedule to this order and transfers the controlover the said movable properties to the competent Authority,namely, the competent Authority and District Revenue Officer,Erode District appointed under the said Act.

The Competent Authority and District Revenue Officer,Erode District is requested to pursue further action inaccordance with the procedure laid down in sub-sections (3)and (4) of section 4 of the said Act and also the formalitiesprescribed in the Tamil Nadu Protection of Interests ofDepositors (in Financial Establishments) Rules, 1997.

The Special Public Prosecutor, Special Court for theTamil Nadu Protection of Interests of Depositors (in FinancialEstablishments) Act, 1997 (Tamil Nadu Act 44 of 1944)Coimbatore District is requested to render necessaryassistance to the Competent Authority in filling the applicationbefore the said Special Court.

Exemption to the Tamil Nadu Handloom Weaver’sCo-operative Society Limited (Co-optex) Chennai forcertain period under the Act.

[G.O.(D) No. 179, Labour and Employment (L1),21st May 2014, Vaikasi 7, Jaya, Thiruvalluvar Aandu-2045.]

No. II(2)/LE/360/2014.- In exercise of the Powers conferredby Sections 88 and 90 read with Section 91A of the Employess’State Insurance Act, 1948 (Central Act XXXIV of 1948) theGovernor of Tamil Nadu hereby exempts the Tamil NaduHandloom Weavers. Co-operative Society Limited (Co-optex),Chennai from the operation of the said Act for the period ofone year from the date of issue of this order.

(1) The above exemption is subject to the followingconditions, namely:-

(a) The aforesaid Society Wherein the employeesare employed shall maintain a Register showing the namesand designation of the exempted employees.

(b) Notwithstanding the exemption, the employeesshall continue to receive such benefits under the said actto which they might have become entitled to on the basisof the contributions paid prior to the date from whichexemption granted by this notification operates.

(c) The contribution for the exempted period, ifalready paid shall not be refunded.

(2) The employer of the said society shall submit in respectof the period during which that Society was subject to theoperation of the said Act (hereinafter referred to as “ the saidperiod”) returns in such from and containing such particularsas were due from it in respect of the said period underEmployees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the corporationunder sub-section (1) of Section 45 of the said Act, or otherofficial authorized in this behalf shall, for the purpose of, -

(i) Verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(ii) Ascertaining whether register and records weremaintained as required by the employees State Insurance(General) Regulations, 1950 for the said period; or.

(iii) Ascertaining whether the employees continue to beentitled to the benefits provided by the employer in cash and

in kind, being benefits in consideration of which exemption isbeing granted under this Notification; or

(iv) Ascertaining whether any of the precisions of the saidAct had been complied with during the period when suchprovisions were in force in relation to the said workshops andstores be empowered to,-

(a) require the principal or immediate employer to finishto him such information as he may consider necessary; or

(b) enter any Society, office or other premises occupiedby such principal or immediate employer at any reasonabletime and require any person found in charge thereof to produceto such Social Security Officer or other official and allow himto examine such documents, books and other documentsrelating to the employment of persons and payment of wagesor to furnish to him such information as he may considernecessary; or

(c) examine the principal or immediate employer, his agentor servant, or any person found in such Society Office or otherpremises, or any person when the said Social Security Officeror other official has reasonable cause to belive to have beenan employee; or

(d) make copies of or take extracts from any register,account book or other document maintained is such Societyoffice or other premises.

Exemption to the Pollachi Saevoclaya Sangh, Pollachi,Coimbatore Distrct, for Certain Period under the Act.

Thiruvalluvar Aandu-2045.]

No. II(2)/LE/361/2014.- In exercise of the conferred by section87 read with Section 91A of the Employees’ State InsuranceAct, 1948 (Central Act XXXIV of 1948) the Governor of TamilNadu hereby exempts the Pollachi Sarvodaya Sangh Pollachi,Coimbatore District from the operation of the said Act for theperiod of one year from the date of issue of this order.

(1) The above exemption is subject to the followingconditions, namely:-

(a) The aforesaid sangh Wherein the employees areemployed shall maintain a Register showing the namesand designation of the exempted employees.

(b) Notwithstanding the exemption, the employees shallcontinue to receive such benefits under the said act to whichthey might have become entitled to on the basis of thecontributions paid prior to the date from which exemptiongranted by this notification operates.

(c) The contribution for the exempted period, if alreadypaid shall not be refunded.

(2) The employer of the said sangh shall submit in respectof the period during which that sangh was subject to theoperation of the said Act (hereinafter referred to as “ the saidperiod”) returns in such form and containing such particularsas were due from it in respect of the said period underEmployees State Insurance (General) Regulations, 1950.

(ii) Ascertaining whether register and records weremaintained as required by the employees State Insurance(General) Regulations, 1950 for the said period; or.

(iii) Ascertaining whether the employees continue to beentitled to the benefits provided by the employer in cashand in kind, being benefits in consideration of whichexemption is being granted under this Notification; or

Exemption to the Palladam Sarvodaya Sangh, Palladam,Tirupur District for certain period under the Act.

No. II(2)/LE/362/2014.— In exercise of the powers conferredby Section 87 read with section 91A of the Employee’s StateInsurance Act, 1948 (Central Act XXXIV of 1948), the Governorof Tamil Nadu hereby exempts the Palladam Sarvodaya Sangh,Palladam, Tirupur District, from the Operation of the said Actfor the period of one year from the date of issue of this order.

(1) The above exemption is Subject to the followingconditions, namely:-

(a) The aforesaid Sangh Wherein the employeesare employed shall maintain a Register showing the namesand designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shallcontinue to receive such benefits under the said Act to whichthey might have become entitled to on the basis of thecontributions paid prior to the date from which exemptiongranted by this Notification operates.

(c) The Contribution for the exempted period, if alreadypaid shall not be refunded.

(2) The employer of the said Sangh Shall submit in respectof the period during which that Sangh was subject to theoperation of the said Act (hereinafter referred to as “the saidPeriod”) returns in such from and containing such particularsas were due from it in respect of the said period under theEmployees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporationunder sub-section (1) of section 45 of the said Act, or otherauthorised in this behalf shall, for the purpose of,-

(i) verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(ii) ascertaining whether registers and records weremaintained as required by the Employees State Insurance(General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continue tobe entitled to the benefits provided by the employer in cashand in kind, being benefits in consideration of whichexemption is being granted under this Notification; or

(iv) ascertaining whether any of the provisions ofthe said Act had been complied with during the period whensuch provisions were in force in relation to the saidworkshops and stores be empowered to,-

(a) enter any Sangh, office or immediate employer tofurnish to him such information as he may considernecessary; or

(b) enter any Sangh, officer or other premises occupiedby such principal or immediate employer at any reasonabletime and require any person found in charge thereof toproduce to such Social Security Officer or other official andallow him to examine such documents, books and otherdocuments relating to the employment of persons andpayment of wages or to furnish to him such information ashe may consider necessary; or

(c) examine the principal or immediate employer, hisagent or servant, or any person found in such Sangh officeor other premises, or any person when the said SocialSecurity Officer or other official has reasonable cause to believeto have been an employee; or

Exemption to the Karur Sarvodaya Sangh, Karur, forcertain period under the Act.

No. II(2)/LE/363/2014.— In exercise of the powers conferredby Section 87 read with section 91A of the Employee’s StateInsurance Act, 1948 (Central Act XXXIV of 1948), the Governorof Tamil Nadu hereby exempts the Karur Sarvodaya Sangh,Karur, from the operation of the said Act for the period of oneyear from the date of issue of this order.

(1) The above exemption is Subject to the followingconditions, namely:-

(a) The aforesaid Sangh wherein the employees areemployed shall maintain a Register showing the names anddesignations of the exempted employees.

(b) Notwithstanding the exemption, the employeesshall continue to receive such benefits under the said Actto which they might have become entitled to on the basisof the contributions paid prior to the date from whichexemption granted by this Notification operates.

(c) The Contribution for the exempted period, ifalready paid shall not be refunded.

(2) The employer of the said Sangh shall submit inrespect of the period during which that Sangh was subjectto the operation of the said Act (hereinafter referred to as“the said Period”) returns in such form and containing suchparticulars as were due from it in respect of the said periodunder the Employees State Insurance (General)Regulations, 1950.

(3) Any Social Security Officer appointed by theCorporation under sub-section (1) of Section 45 of the saidAct, or other official authorised in this behalf shall, for thepurpose of,-

(i) Verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(ii) ascertaining whether registers and records weremaintained as required by the Employees State Insurance(General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continue to beentitled to the benefits provided by the employer in cash andin kind, being benefits in consideration of which exemption isbeing granted under this Notification; or

(iv) ascertaining whether any of the provisions of thesaid Act had been complied with during the period when suchprovisions were in force in relation to the said workshops andstores be empowered to,-

(a) require the prinicipal or immediate employer tofurnish to him such information as he may considernecessary; or

(b) enter any Sangh, office or other premises occupied bysuch principal or immediate employer at any reasonable timeand require any person found in charge thereof to produce tosuch Social Security Officer or other official and allow him toexamine such documents, books and other documents relatingto the employment of persons and payment of wages or tofurnish to him such information as he may consider necessary;or

(c) examine the principal or immediate employer, his agentor servant, or any person found in such Sangh office or otherpremises, or any person when the said Social Security Officeror other official has reasonable cause to believe to have beenan employee; or

(d) make copies of or take extracts from any register,account book or other document maintained in such Sanghoffice or other premises.

Exemption to the Tamil Nadu Asbestos, Alangulam,Virudhunagar District for certain period under the Act.

No. II(2)/LE/364/2014.— In exercise of the powersconferred by Section 87 read with section 91A of theEmployee’s State Insurance Act, 1948 (Central Act XXXIV of1948), the Governor of Tamil Nadu hereby exempts theTamil Nadu Asbestos, Alangulam, Virudhunagar District,from the operation of the said Act for the period from1-1-2008 to 31-12-2008.

(1) The above exemption is subject to the followingconditions, namely:-

(a) The aforesaid factory wherein the employees areemployed shall maintain a Register showing the names anddesignations of the exempted employees.

(b) Notwithstanding the exemption, the employeesshall continue to receive such benefits under the said Actto which they might have become entitled to on the basisof the contributions paid prior to the date from whichexemption granted by this Notification operates.

(c) The Contribution for the exempted period,if already paid shall not be refunded.

(2) The employer of the said factory shall submit inrespect of the period during which that factory was subjectto the operation of the said Act (hereinafter referred to as“the said Period”) returns in such form and containing suchparticulars as were due from it in respect of the said periodunder the Employees State Insurance (General)Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporationunder sub-section (1) of Section 45 of the said Act, or otherauthorised in this behalf shall, for the purpose of,-

(i) Verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(c) examine the principal or immediate employer, hisagent or servant, or any person found in such Factory,establishment office or other premises, or any person whenthe said Social Security Officer or other official hasreasonable cause to believe to have been an employee; or

(1) The above exemption is subject to the followingconditions, namely:-

(a) The aforesaid factory wherein the employees areemployed shall maintain a Register showing the names anddesignations of the exempted employees.

(b) Notwithstanding the exemption, the employees shallcontinue to receive such benefits under the said Act to whichthey might have become entitled to on the basis of thecontributions paid prior to the date from which exemptiongranted by this Notification operates.

(c) The Contribution for the exempted period, if alreadypaid shall not be refunded.

(2) The employer of the said factory shall submit inrespect of the period during which that factory was subject tothe operation of the said Act (hereinafter referred to as “thesaid Period”) returns in such form and containing suchparticulars as were due from it in respect of the said periodunder the Employees State Insurance (General)Regulations, 1950.

(3) Any Social Security Officer appointed by theCorporation under sub-section (1) of Section 45-A of thesaid Act, or other authorised in this behalf shall, for thepurpose of,-

(i) Verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(ii) ascertaining whether registers and records weremaintained as required by the Employees State Insurance(General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continue tobe entitled to the benefits provided by the employer in cashand in kind, being benefits in consideration of whichexemption is being granted under this Notification; or

(b) Notwithstanding the exemption, the employees shallcontinue to receive such benefits under the said Act to whichthey might have become entitled to on the basis of thecontributions paid prior to the date from which exemptiongranted by this Notification operates.

(a) The aforesaid factory wherein the employees areemployed shall maintain a Register showing the namesand designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shallcontinue to receive such benefits under the said Act to whichthey might have become entitled to on the basis of thecontributions paid prior to the date from which exemptiongranted by this Notification operates.

(c) The Contribution for the exempted period, if alreadypaid shall not be refunded.

No.II(2)/LE/368/2014.-In exercise of the powers conferredby Sections 87 & 88 read with section 91-A of theEmployees’ State Insurance Act, 1948 (Central Act XXXIV of1948), the Governor of Tamil Nadu hereby exempts thefollowing 5 Beedi Companies at Tirunelveli coming underthe South Tamil Nadu Beedi Manufacturers Association,Tirunelveli from the operation of the said Act for a periodof one year from the date of issue of this order:-

(1) The above exemption is subject to the followingconditions, namely:-

(a) The aforesaid managements wherein theemployees are employed shall maintain a Register showingthe names and designations of the exempted employees.

(b) Notwithstanding the exemption, the employeesshall continue to receive such benefits under the said Actto which they might have become entitled to on the basisof the contributions paid prior to the date from whichexemption granted by this Notification operates.

(c) The contribution for the exempted period, ifalready paid shall not be refunded.

(2) The employers of the said managements shall submitin respect of the period during which that managements weresubject to the operation of the said Act, (hereinafter referredto as “the said period”), returns in such form and containingsuch particulars as were due from it, in respect of thesaid period under the Employees State Insurance (General)Regulations, 1950.

(3) Any Social Security Officer appointed by the Corporationunder sub-section (1) of Section 45 of the said Act or otherofficial authorised in this behalf shall, for the purpose of:-

(i) verifying the particulars contained in any returnsubmitted under sub-section (1) of Section 44 of the saidAct for the said period; or

(ii) ascertaining whether registers and records weremaintained as required by the Employees State Insurance(General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continueto be entitled to the benefits provided by the employer incash and in kind, being benefits in consideration of whichexemption is being granted under this Notification; or

(iv) ascertaining whether any of the provisions of theprovisions of the said Act had been complied with during theperiod when such provisions were in force in relation to thesaid managements be empowered to-

(a) require the principals or immediate employers tofurnish to him such information as he may consider necessary; or

(b) enter any management, office or other premisesoccupied by such principal or immediate employer at anyreasonable time and require any person found in chargethereof to produce to such Social Security Officer or otherofficial and allow him to examine such documents, booksand other documents relating to the employment of personsand payment of wages or to furnish to him such informationas he may consider necessary; or

One day work means making 10,000 beedies per day.

Explanations.- (1) Dearness Allowance.- In addition to theminimum rate of basic wages fixed above, the employees shallbe paid dearness allowance as indicated below:-

(i) The dearness allowance is linked to theAverage Chennai City Consumer Price IndexNumber for the year 2000, that is, 475 points(with base 1982 = 100) and for every riseof one point over and above 475 points, anincrease of Rs.6.55 (Rupees six and paisefifty five only) per month shall be paid asdearness allowance.

(ii) The dearness allowance shall be calculatedevery year on the 1st April on the basis ofthe average of the indices for the precedingtwelve months, that is from January toDecember.

(iii) The first calculation shall thus be effectivefrom the date of publication of this Notificationin the Tamil Nadu Government Gazette,based on the Average Chennai CityConsumer Price Index Number for theprevious year.

(2) Where the nature of work is the same, no distinctionin the payment of wages shall be made between men andwomen employees.

(3) To arrive at daily wages, the monthly wages shall bedivided by 26.

(4) To arrive at monthly wages, the daily wages shall bemultiplied by 30.

(5) Wherever the existing wages are higher than theminimum wages fixed herein, the same shall be continued tobe paid.
