7. PUBLIC CONSULTATION

7.0 Introduction

The Ministry of Environment, Forest and Climate Change, (MoEFCC) Government of

India issued Environmental Impact Assessment notification S.O. 1533 dated September

16, 2006 mandating prior environmental clearance for Synthetic Organic Chemicals

(Bulk drugs and intermediates) under category A for projects located outside notified

industrial area/estate. The proposed expansion project of M/s. SVR Laboratories (P)

Ltd. is located at Sy No. 238 (Part), 239/A and 240/E, Dothigudem village, Pochampally

Mandal, Nalgonda District, Telangana. The proponent obtained the terms of reference

vide letter no. F.No. J-11011/7/2013-IA II (I) dated 29.04.2013 and obtained extension of

TOR vide letter no. F.No. J-11011/7/2013-IA II (I) dated 24.06.2016, from the MoEFCC,

which mandated public consultation. Accordingly the draft Environmental Impact

Assessment was submitted to Regional Officer, Telangana State Pollution Control

Board, Nalgonda District for conducting public hearing. The public hearing for the

proposed expansion was conducted on 27.08.2016 at 11.00 AM at project site. The

public hearing was chaired by Sri Ravi Gugulothu, District Revenue Officer &

Additional District Magistrate, Nalgonda District and the member convenor was Sri G.

Hanumantha Reddy, Environmental Engineer, Telangana Pollution Control Board,

Regional office, Nalgonda.

7.1 Advertisement

Press notification regarding the date, time and venue of the Environmental public

hearing for the proposed expansion project was issued in Andhra Jyothi (Telugu daily)

and The Hindu (English daily) newspapers on 14.06.2016. Copy of the advertisement is

enclosed.

7.2 Minutes of the meeting

The minutes of the public hearing is enclosed along with attendance sheet. Concerns

expressed by speakers during public hearing and responses of the proponent are

presented in table 7.1. Response to written representations is presented in table 7.2.

He stated that this public hearing was held in connection with the expansion of M/s. SVR Laboratories Limited. There are 7 other chemical units operating in this village. Since public hearing was held here, he would like to know the quantum of compensation payable to the affected people. Secondly, he wanted to know the contribution of the industry to the development of the village. Local people should be accorded priority in respect of employment. Due to the establishment of industries, the ground water that was there for 100 years got polluted. The village is facing acute shortage of drinking water. Whenever, they contact the industries for supply of water, the companies were not responding and there is no value for supply for Sarpanch. Water was supplied for two months through water tankers. So far compensation was paid to some farmers only after interference from local police. In the previous public hearing held in connection with M/s. VJ Sai chem., they assured to pay compensation. It was not known whether it was paid or not. Some farmers said to have received the compensation from M/s. SVR Laboratories. He requested cooperation for the sought development of the village. As the expansion depends not on the decision of the village, he sought development of the area. He sought supply of ground water to Dothigudem and Jiblakapally villages. The other industry prepared to pay wages to education volunteers. Sri Ravi Kumar prepared to bear the expenditure of cook and construction of room for preparation of non meal. He sought written affidavit with a condition that pollution levels should not increase

While extending full cooperation for the proposal of expansion, he has categorically stated that he never opposed the expansion of industries.

2. Surkanti Janga Reddy, MPTC Member, Dhotigudem

He alleged that the villages in surrounding areas were subjected to pollution due to establishment of industries. The farmers, who were dependent on agriculture for their living, could not carry out their activities on account of pollution problem. He sought compensation to the farmers who were affected due to pollution and employment to the villagers affected. Some basic infrastructure existed and sought water supply to surrounding 4 villages for drinking and agriculture. The industries were welcome, if they operate without causing pollution. There were allegations with regard to dumping of wastes in forests, canals and Musi river. The local companies allege that this was reported by the industries from outside. Local industries should take up the responsibility in this aspect, otherwise they would be considered as suspected source of pollution. He extended full cooperation to the expansion of industry subject to the condition that they should not pollute the area.

3. Sri Guram Madhav Reddy, Ex-Sarpanch, Dhotigudem

He alleged that officers were visiting only when public hearing was held. It was the intention of Government not to allow the industries without public hearing, and wondered whether there was law empowering in the case of closure of industries. Two months back a public hearing was held and the industry assured compensation. The compensation was not paid to the affected farmers but to others nominated by the political parties. Local employment should be provided. He wanted 20 % of the CSR fund which worked out to Rs.18, 00,000/- and

He alleged that there was no clarity on utilization of the CSR fund and 2 % of the profits of industries. He complained about air pollution which was ejected after 7’O’Clock in the evening. No industry is taking responsibility for these acts and road users also felt the problem. He wanted that industries should run their plants without causing pollution and assured that the villagers would extend full cooperation.

4. Sri Pagilla Ram Reddy,

ex-Sarpanch, Dothigudem(V)

He alleged that the officials from PCB were coming only on the day of public hearing. Air and water got polluted and enquiries were coming only at the time of the public hearing. Nobody bothered about pollution and they were not aware of monitoring of pollution levels by the officials of PCB and alleged connivance of the officials. Now the situation became problematic and wanted to know the AE concerned with the affairs of Pochampally. He requested for action against the concerned against causing pollution. Now the industries are spending on welfare activities, which were not done earlier. If the industries manage the individuals, they will face the trouble in future and anything done under CSR should be routed through local Sarpanch or MPTC. The benefit and adverse effect ratio remained at the same level and he wanted that the industries should take steps to curb pollution. He expected that the officials should take necessary steps to ensure pollution free environment to human beings as well to cattle in order to avoid external dependency for their needs as well as the needs of the industry. He welcomed the expansion of the industry to the condition of curbing the water pollution.

5. Smt.Sara Saraswathi Balaiah Goud, President, MPP, Pochampally(V)

She stated that this was the first public hearing attended by her in the span of 2 years after becoming MPP. Some people could express their opinion and other could not do so, but people are aware of the things happening here. There is nothing equivalent to the health in this world. Even the passersby could not bear the problem of pollution, but complimented the people who could withstand the same. Some higher officials gave permission and the locals are facing the problems. Officials from PCB were invited to the Mandal Parishad meetings, but nobody attended so far. No official ever bothered even the samples of water were given as compliment to them. Employment should be provided to the local people and expected the industries to adopt better technologies to address the problem of pollution. It is painful to know that the people are experiencing the severe problems in this area. She questioned the veracity of development activities undertaken by them. By undertaking small welfare activities at the time of public hearing, the industry can not absolve itself from the responsibility and the same cannot be said openly. Every year welfare activities should be taken up by the local industries. There were more police personnel than people. If the industry maintains good liaison with the people, there would be no need of others and the people will definitely extend their cooperation.

6. Sri Arla Venkatesh Yadav, Sarpanch, Jiblakpally(V)

He stated that there were 7 industries established 10 years and above. The farmers owning small holdings were unable to reap harvest on account of pollution. Government extended Cooperation was with an intention to provide employment for local people to improve their living conditions. It is regretted that the people were moving in search of employment to other places on account of pollution and lost their living means. He

demanded compensation at the rate of value of yield of wet land or dry land and officials should see that the farmers were compensated adequately. As stated, the industries should implement the development activities. It was felt that Rs.20-25 lakh should be contributed towards CSR, if the sum contributed by the industry would be around Rs.1.50 Crores, which could be utilized for making the villages green. The industries could construct canal to fill the village tank by arranging 11ft from the local stream to meet the drinking as well agriculture needs of the people. The industries are not taking any responsibility and are not implementing any welfare activities. People from Andhra area were employed with factious Aadhar cards. The villagers have no objection, if they engage people from surrounding villages. The people are ready to cooperate with the industry, but the industry failed to supply drinking water with tankers. Plantation helps in controlling the pollution levels and the industry should take responsibility of raising plantations. There will not be any objection if the industries following the conditions stipulated in the orders issued by the Government. The industry should not see the drama of politicians but try to wipe out the tears of the common people. The industry should take up the distribution of medicines to the needy people and requested them to implement welfare activities and offered to cooperate for the expansion.

7. Sri Gurram Channa Reddy, Dhotigudem(V)

He urged the people to cooperate with the industry in conducting the public hearing. He expected that the NGOs who were here should asses the loss to the area and extends necessary cooperation in securing the permissions required by the industry. The value of the land in 2001 was Rs.30,000/- now the value of the land would be around Rs.30 lakhs per acre. People should think about the positive change. There was only one industry prior to

8. Sri P. Dasaratha, Dhotigudem(V)

He stated that the water in the village was polluted and the affected should be compensated. Bills should be paid to tractor owners. Vector problem was arising on account of pollution. He demanded that the managements of all companies should pool their resources to connect the canal to the Dhotigudem tank; this step would ensure development of Anthammagudem and Jiblakapally villages. He extended support for expansion and urged the people not to politicize the issue. Even youth associations are prepared to extend their support subject to the necessary assistance from the industry.

9. Sri Kandi Janga Reddy, Dhotigudem(V)

He contended by quoting the phrase that farmers were backbone of the country and stated that the efforts were on to break the backbone. This kind of attitude should end and the industries should ensure that the welfare of the farmers. Several times complaints were filed in PCB, but without any action. He appealed to the industries to extend assistance to the development of area and compensate the damage caused to the farmers. The amount under CSR should be spent locally by the industry to garner the support of the people.


10 Sri Narsimha, Anthammagudem(V)

He stated that the Pillaipally canal was redesigned. Public hearings were attending and going back. The impact of air pollution is more on the health of people than water pollution. He contended that the value of dollar is going up on account of establishment of drug industry and also the value of land rose up to Rs.30/- lakhs per acre. But the

value of land would have been more than Rs.1crore. The borewell existed since 10 years was dosed on account of pollution. Even if the bore well brought back to operation, it should be closed again. No new permissions should be accorded and area under forest cover is less in Nalgonda. The Hon'ble Chief Minister initiated the "Haritha Haram" program from Nalgonda. He alleged that the meeting was held under the aegis of police escort and people were not coming out freely to air their views. Even the Hon'ble CM was not provided with this type of protection. He sought that people should be allowed to speak to air their views freely.

11. Sri Muddam Sathyam, Dhotigudem(V)

He questioned why permission should not be accorded to the industries and industrial development is the agenda of the Government itself. Permissions should be accorded so that the opportunities would be there to provide employment to youth. But the water was polluted and no further permissions should be accorded. He stated that the present level of pollution was not due to this also other industries were equally responsible. He questioned the persons responsible to pay the compensation to the farmers. It was known that compensations were paid to 20 farmers. This situation would not have occurred had the compensation was also paid on similar fashion by other industries. He demanded that the compensations to the affected farmers should be paid by Monday otherwise the industries would face the closure due to agitations as were taken place earlier, Employment should be provided to all unemployed youth and urge the industry to extend financial assistance to the economically poor. He also demanded 10% more salary to the local people than others and coverage of insurance facilities and concluded his speech with a request that the polluters should be dealt under WALTA Act.

12. Sri S. Nagasena Reddy, Environmentalist, Nalgonda

He stated that the public hearing was being conducted as part of expansion of the existing unit. He hoped that the CSR activities would increase with the expansion of production. He stated that a mega medical camp was conducted in Jiblakapally village and medicines were distributed to the needy people He requested that M/s. SVR Laboratories would take up similar activities and extend their cooperation for the all-round development of the villages.


13. Sri Sukanti Venkat Reddy, Environmentalist, Choutuppal(M)

He stated that industrialization would invariably require for survival and to eradicate unemployment as enunciated by the Hon'ble CM. He offered two advices to the industry. He requested that the CSR funds should be utilized for diversion of the Pillaipally Canal which is at a distance of 2.50 Km and issue environmental clearance to the proposed expansion.

He requested the authorities to permit them to express their problem arising out of public limited companies to the public since 13 years, as they are the permanent residents of that place. He alleged that there were no crops since 13 years due to polluted ground water. It is unbelievable that PCB officials are unaware of the problems and held that PCB is responsible as there is no officer in this area even though 7 industries are functioning here. Industries are responsible for pollution of water resources. Industries are paying compensation to

the farmers but the question of survival of entire family remains as it was. He wanted that industries should not be established at the cost of lives of people. It was stated that funds were earmarked for local development and industries should state the way the funds were utilized by them. Definitely people would have extended full cooperation, if they did any worthwhile work. The people of the village were not able to live with the obnoxious odor, even the people passing through the village were questioning about habitability of the area. He blamed the Government for the present state of affairs instead of industries. Since Government did not bother about the people, the state of affairs is like this. He wanted that the people should be told about the method of rendering justice to the farmers who lost their livelihood and requested the PCB officials to enforce the pollution laws effectively.

15 Sri Kommu Sai Kiran, Jiblakpally(V)

He stated that the people were not aware of the public hearing held here. The same could be intimated through open publicity means. The area is subjected to severe pollution and requested stringent action to control the pollution.


16 Sri Choppari Pandu, Dhotigudem(V)

He complained that water was contaminated and water was not available despite deep drilling of bore wells. In case of bore wells where water was struck, the water found to be polluted. It is welcome that the value of land has gone up. Even though there is a well read statement of enhanced employment opportunities, the same is not true. Employment is not offered to B.A and B.Com graduates, only B. Sc., degree graduates are preferred by the industry. People from other places were provided jobs ignoring the claim of local people. He appealed to the industry to extend their cooperation to the villages so that the people also will reciprocate the same.

17. Sri Ch. Shankar Yadav, Jiblakapally

He stated that it was a mistake to permit the chemical industries. However, it was permitted thinking that the revenue would go up. The same policy remained till now. PCB is vested with the power to control pollution from industries. They should explain how they were going to contain the pollution.


18 Sri Sathyanarayana , R/o Jiblakapally

He stated that he would like to explain the destruction caused by the pollution. Even married people were not blessed with children. Though they were not against industrialization, the national bird peacocks on the adjacent hills became extinct. He contended that the pollution themed to be very high on any day except the day of public hearing. Safety precautions should be implemented and finally informed that they would not oppose the expansion of the unit.


19 Sri D.Anil Reddy, R/o Dhotigudem

He stated that public hearing was being conducted here, but the officials should ensure pollution-free environment so that there would be consent from the people. The farmers are backbone of the economy of the country. Only few farmers were compensated, but most of them were yet to be paid and agitation against non-payment of compensation would continue in future till paid. He felt that industry should operate their plant free from pollution so that people would also be prepared to extend their cooperation. It did not mean that there were no objections. He demanded the industry to come out with the package of compensation to the farmers, who were affected.


20 Sri Baddham Venkat Reddy, Dhotigudem(V)

He stated that a public hearing was held in respect of other industry, which was opposed by the people and people were unaware of the aspects of public hearing. He contended that a representation was submitted to the official for enquiry into certain matters. It was painful that no enquiry was conducted, which gave rise to credence




that whether there was any governance. The timely action of the officials would have saved the village from pollution. He appealed to conduct an enquiry into the present state of pollution and take action against the responsible. They sought employment for means to live but not the destruction of life security. No new permissions should be accorded except the industries already in operation. He warned that the people would not hesitate to stall the collectorate with the help of people. Government is totally responsible for the present state of affairs and collapse of the system. There is no PCB official in Nalgonda District and there is only one officer for three districts. Permissions were accorded to the industries, even though the people opposed them. It is not out of context to state that time will come that people themed to live here after some time. While concluding his speech, he hoped that such time would not come for ever.

21 Sri Gurram Satyapal Reddy, Dhotigudem

He contended that the farmers were facing severe problems and urged that steps be taken to protect the environment. Plantation was undertaken by the other industry and the plants were dried up for want of water. He requested the take up the responsibility of maintenance of plantations. He stated that there would not be any objection, subject to the implementation of pollution control measures.

22 Sri M. Shekar, Dhotigudem

He felt that employment was not need of the hour, but provide sustenance. All industries have promised the diversion of Pillaipally canal, which has not taken place so far. Farmers are the losers and the industries contend that they were compensated. The fact is unknown.

The officials should experience the problem of odor; it would be difficult to stay even for a day here. The officials should understand the problems of the people before according permissions. The people here will continue to face problems, if the issue of clearance is continued. Pollution poses problems to human beings as well as to cattle and trees here. It was said that permissions would not be given without consent of the local people, in fact permissions were accorded. If the new units are set up, their problem will increase. The role of PCB became questionable, unless they act now to benefit the people of the area.

24 Sri V.Sunanda Reddy, Environmentalist

He stated that permission would be accorded for expansion without any positive recommendation to the industry. There is 4,000 acres of land in the village. Usually, the quantum of annual water yield through rain in this area is around 875 Crore liters. There are 650 bore wells in this village and 7 Industries are drawing their requirement from the bore wells. Since they are all depending on bore wells, the ground water becomes polluted and depleted. The loss of ground water table can be contained by diverting the funds available under CSR budget to adopt the facilities required for charging the ground water using the water received during rainy season, otherwise the loss of ground water table will be aggravated further. He suggested constituting a committee to render necessary assistance to the affected farmers on account of pollution caused by the 7 industries. He concluded his speech with the above suggestions.

While inviting the setting up of industries, one should know the realities and it is not important whether the permissions will be accorded or not. Our country adopted the constitution in the year 1950 and framed the rules, no one can stop the operation of the industry and such power is vested with the Government only. The constitution provided some rights to the subjects which should be attained. There was an amendment to CSR rules in 2013 and as per this amendment mandates that 5% of their earnings oh yearly basis shall be spent on CSR activities. The setting up industries is taken up to overcome the seasonal problems faced by the agriculture. Earlier water was potable now it became a bottled item. It is estimated that 5 lakhs people are losing their lives on account of air related pollution and the number is more in India and China. Their rulers made Acts as rights, but failed in their implementation. Consequently, adulteration is taking place in food stuff. He preferred to offer 2 or 3 suggestions for the benefit of the public. The industries should initiate steps to protect the environment to prevent any sort of agitation by the local people and implemented with a plan. Necessary action should be taken accordingly. There should not be any sort pollution from the operation of Chemical industries. Green belt shall be developed on 800 acres of the land. A committee should be constituted to implement the environment management plan. The farmers shall be motivated to take up water harvesting.
