♦ SESSION 1: ALTA/ACSM LAND TITLE SURVEYS – THE NEW 2011 MINIMUM STANDARDS(Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

This program is an introduction to the new 2011 Minimum Standard Detail Requirements for ALTA/ACSM Land Title Surveys which were recently adopted by the American Land Title Association and the National Society of Professional Surveyors and became effective in February 2011. In addition to many changes, this version is the first complete rewrite of the standards since they were first adopted in 1962. During this program, participants will learn about the new structure of the standards, the many changes, and some particularly significant issues such as the new certification, how to deal with HUD surveys, standards of care, the modified measurement standard, and research and zoning issues.

GARY R. KENT, LS The Schneider Corporation

Gary Kent is chair of the National Society of Professional Surveyors’ committee on the ALTA/ACSM Standards and is liaison to NSPS for the American Land Title Association. He is in his 28th year with The Schneider Corporation, a surveying, GIS and consulting engineering firm based in Indianapolis and with offices in Charlotte and Des Moines. Gary is a past-president of both the American Congress on Surveying and Mapping and the Indiana Society of Professional Land Surveyors. He taught Boundary Law, Legal Descriptions, Property Surveying and Land Survey Systems as an adjunct instructor for Purdue University in Indianapolis and West Lafayette from 1999 to 2006 and

received Excellence in Teaching and Outstanding Associate Faculty awards for his efforts there. Gary is currently in his third term as Vice Chairman of the Indiana State Board of Registration for Land Surveyors. He also writes regular columns for The American Surveyor magazine and for the ACSM Bulletin.

♦ SESSION 2: ETHICS IN SURVEYING COST ANALYSIS AND PROPOSALS (Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

In today’s fast paced world, computer output and standard forms often take the place of personal review and judgment. The surveyors have a responsibility to their profession, and to the people of the state, to work within and apply the ethical requirements of their licensure. This seminar proposes to address several areas of technical communication where ethics factors are constantly in focus. Section 1 - The Codes: A review of the licensure requirements and misconduct criteria for surveyors set in the statutes. Examples of possible ethics violations will be used and discussed in pen forum. Section 2 - Survey Cost Analysis: This program will challenge you to understand and communicate the costs and scope of a survey project to a client. Understanding the multitude of items which are included in the cost of a survey, multipliers and the business decisions the surveyor must make on those items is a challenging task. A group project is included. Section 3 - Ethics in Technical Proposals: Surveyors are constantly writing proposals to a variety of potential clients. Proper use of the proposal, in particular, proper definition of “Scope of Services,” protects against ethics violations and potential legal action. The many uses of the proposal will be discussed at length. When any licensed professional agrees to offer services to a customer, that professional is not only bound by the laws of their profession, but also the published regulations that protect the health, safety, and welfare of the general public.

WILLIAM E. BEARDSLEE, PE, PLS, PP West End, NC

Bill Beardslee is a licensed Professional Land Surveyor, Engineer and Planner with over 40 years experience in the field of land development. He is known for his excellent presentation and writing capabilities, along with being one of the leading technical experts on land development in the engineering and surveying arena. Bill has made over 2,000 presentations on engineering and surveying projects to local and state agencies. Prior to his retirement, he was the owner and Director of Engineering for Beardslee Engineering Associates in Sparta, NJ. He has written a series of articles on “Preparation and Presentation” for the New Jersey Society of Professional Land Surveyors ’award winning

magazine “The Coordinate”. Bill is a past president of NJSPLS and that society’s 2006 “Surveyor of the Year”. He is also a regular contributor to Professional Surveyor, the national magazine of the National Society of Professional Surveyors, as well as being listed in “Who’s Who in Technology” and “Who’s Who in the East”. Bill has taught numerous seminar programs at the high school, college and professional levels for over 25 years. He has a Bachelor of Science in Civil Engineering from New Jersey Institute of Technology and a Master’s Degree in Corporate & Organizational Communications from Fairleigh Dickinson University. Bill offers the students a professional blend of technical expertise, communication knowledge and presentation skills for discussing issues in a clear and simple format.

♦ SESSION 3: WATER WARS & PARISH BOUNDARY DISPUTE(Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

Water Wars is a dynamic one day seminar provided by Bernard M. Telatovich, P.E., Esq. and Dr. Frank Willis, Ph.D., P.E., P.L.S. Dr. Willis and Mr. Telatovich bring together varied professional expertise to address a topic that is not only very complex, but varies across different states and jurisdictions. The primary focus of WATER WARS is on property ownership and property rights along rivers, streams, lakes, and the ocean. While the seminar will provide detailed information on numerous topics, including engineering, hydrology, dendroecology, surveying, law, and real estate, the primary focus of the seminar is geared toward the practicing surveyor.

The practice of surveying focuses on measuring points and locating evidence. Water Wars directs the surveyor around the legal aspects of water rights and the technical nature of determining property rights and limits along waterways. Disputes over property rights along water ways separating states are within the original jurisdiction of the Supreme Court of the United States. Various Supreme Court cases including Georgia v. South Carolina, 497 U.S. 376 (1990) and New York v. New Jersey 523 U.S. 767 will be analyzed. The analysis will not only focus on the legal resolution of these matters, but also on the technical issues raised as they relate to property rights, surveying related principles, and ownership.

On a more microscopic level, Water Wars will address the property line issue/boundary disputes that arise between adjoining property owners within riparian areas. These disputes, which often begin with the results of a simple boundary survey, become not only highly detailed and expensive disputes, but also disputes that invoke knowledge of property rights principles which this seminar will focus on. Dr. Willis’ expertise in this area goes beyond the ordinary practice of surveying and toward his doctorate work. As a result, Dr. Willis is often consulted on major multi-million dollar litigation matters involving riparian rights. Thus, the expertise from practical application of surveying principles in these matters will be applied to this dynamic one of a kind seminar. Parish Boundary Dispute - In 1869 the State of Louisiana created a 27-mile-long boundary line between Rapides and Grant Parishes in central Louisiana. The line was a straight line originating at the point where Bayou Darrow emptied into Red River and running easterly to the point where Little River emptied into Catahoula Lake. The line was never surveyed on the ground until Grant Parish challenged it in 1999, claiming that the line needed to move a mile south into Rapides Parish. Millions of dollars in annual property taxes and sales taxes were at stake. Rapides Parish disagreed with Grant Parish’s proposal to move the line. A vicious legal dispute erupted. Surveying to establish both ends of the disputed line required intense analysis of water boundaries. Political boundaries are not ambulatory, so the locations of the waterways defining the parish line had to be re-established where they existed in 1869 when the line was created. The establishment of the two natural monuments evolved into a battle between two local engineering firms, and involved one nationally-recognized expert. It turned out to be the most interesting and vicious boundary dispute on record in Louisiana. The case gained national attention. The forensic surveying involved GLO retracement, hydrology, hydro-geomorphology, dendrochronology, dendrohydrology, sedimentology, photogrammetry, civil engineering, misleading natural monuments, Civil War history, and brutal strategic tactics by experts and attorneys, and Daubert motions. The case reached the Louisiana Supreme Court. The boundary dispute covers virtually every aspect of forensic

boundary surveying and presents a radical and innovative approach regarding the definition of the Ordinary High Water Mark. Willis’ presentation is accompanied by a professional animated video played as he makes his presentation. The presentation is stimulating, fast-moving, and provocative. It will keep your interest for the full duration.

Willis Engineering and Scientific, LLC specializes in engineering spatial analyses, physics, dynamics, hydraulic/hydrologic systems, and forensic civil and environmental engineering. Willis' Ph.D. in Engineering and Applied Science focuses on scientific application of engineering and natural science principles to forensic science. Technologies involved are remote sensing, laser scanning, close-range photogrammetry, digital modeling, mathematical simulation, advanced statistics, plant growth time series statistics, dendroecology, and animated graphics. Willis was the leading expert on the Rapides Parish v. Grant Parish boundary dispute, which is the most famous boundary dispute in Louisiana in recent history. The case gained national attention.

♦ SESSION 4: FEMA UPDATES, ELEVATION CERTIFICATES AND THE NFIP

(Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

The Elevation Certificates and the NFIP will cover many aspects of the NFIP. An in depth discussion of the FEMA elevation Certificate will occur involving the most common errors discovered when reviewing elevation certificates. An overview of Letters of Map Changes will be presented and involve eLOMA’s. The SC Map Modernization Initiative is making progress with updating the FIRM’s throughout the state. Therefore, an update of the current status of the program will be provided. As well as a description of the Risk MAP program. Also, FEMA is expanding the appeals process when it comes to preliminary FIRMs, LOMR’s and PMRs. A detailed description will be provided describing the changes and requirements under the new process.

Maria Cox Lamm is a Certified Floodplain Manager and serves as the State NFIP (National Flood Insurance Program) Coordinator of the Flood Mitigation Program in the South Carolina Department of Natural Resources, Land, Water and Conservation Division. She is responsible for the administration, coordination, and direction of all aspects of the South Carolina Flood Mitigation Program. She has been with the agency since July, 2004 and was previously the Associate Engineer in the SC Flood Mitigation Program. She has over 12 years of experience in the field of floodplain management. Maria graduated from North Carolina State University in 1998, and prior to working with the Flood Mitigation Program in South Carolina, she was employed by Wake County (North Carolina) Environmental Services in the Erosion, Flood and Stormwater Section. Joy Sullivan serves as the Public Information Coordinator for the Flood Mitigation Program in the South Carolina Department of Natural Resources (SCDNR), Land, Water and Conservation Division. Her primary responsibilities are to develop and disseminate map modernization program information to local officials and the general public through outreach materials, public meetings and the media. Joy recently joined the Flood Mitigation team after having worked with the Conservation Districts Section of SCDNR for 15 years. She was involved in many education and outreach activities with Conservation Districts, specializing in working with students and young adults. Joy received her Bachelor’s degree in Political Science from Bard College, Annandale-on-Hudson, New York in 1994. Andy Brandenburg serves as the FMA (Flood Mitigation Assistance) Program Coordinator for the Flood Mitigation Program in the South Carolina Department of Natural Resources, Land, Water and Conservation Division. He has been with the agency since 2005, and previously worked in the Hydrology section as Ground Water Hydrologist. His primary duties are the coordination of the FMA grants programs and working with the Community Assistance Program. Andy graduated from the University of South Carolina with a Bachelor’s degree in Geography.

♦ SESSION 1: SC EASEMENTS AND RIGHTS OF WAY(Earn 7 ½ PDHs for attending both morning and afternoon session)

This program is tailored to South Carolina statutes and case law, and is designed to help surveyors understand the various types, elements and nature of easements - both written and unwritten. Many surveyors deal with writing and interpreting easements and rights of way virtually every day when performing boundary and Land Title Surveys, and when working for developers, utility companies and governmental entities. It is important that they are well-versed in what easements and rights of way are, how they differ from other similar instruments like licenses, how they are created, how they are terminated, and in the broad variety and nature of easements. This course will provide a good foundation for the many aspects of easements and rights of way.

GARY R. KENT, LS The Schneider Corporation

Indianapolis, IN Gary Kent is chair of the National Society of Professional Surveyors’ committee on the ALTA/ACSM Standards and is liaison to NSPS for the American Land Title Association. He is in his 28th year with The Schneider Corporation, a surveying, GIS and consulting engineering firm based in Indianapolis and with offices in Charlotte and Des Moines. Gary is a past-president of both the American Congress on Surveying and Mapping and the Indiana Society of Professional Land Surveyors. He taught Boundary Law, Legal Descriptions, Property Surveying and Land Survey

Systems as an adjunct instructor for Purdue University in Indianapolis and West Lafayette from 1999 to 2006 and received Excellence in Teaching and Outstanding Associate Faculty awards for his efforts there. Gary is currently in his third term as Vice Chairman of the Indiana State Board of Registration for Land Surveyors. He also writes regular columns for The American Surveyor magazine and for the ACSM Bulletin.

♦ SESSION 2: FORENSIC SURVEYING (Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

This workshop, designed for intermediate to advanced surveyors who have extensive experience and may be involved with or interested in the forensic field, will address various areas where a surveyor may be involved in litigation-related matters. In formulating the opinions required in such cases, the expert surveyor must be familiar with, in addition to his technical expertise, numerous complicated legal matters including the nature of lawsuits, the rules of evidence, civil procedure, rules of discovery, property law, tort law, other legal principles, and what the role of an expert is in litigation. This workshop will begin examining the role and duties of the expert witness, followed by the broad definition of “forensic surveying.” In addition, legal concepts such as jurisdiction, civil procedure, and evidence will be reviewed, as well as the elements of a lawsuit, which include the filing of a complaint, pleadings, interrogatories, and depositions. The primary focus of the workshop will be on the types of cases in which forensic surveyors participate. The classic case, the boundary line dispute, will be examined using Rapids Parish Police Jury, 9254 So.2d 357, as a case study into not only procedural discussions of surveying boundary disputes, but also the importance of competent and thorough forensic surveying work. This case, as well as numerous other select cases, expands on “Daubert Hearings” as well as the importance of retracement, preparation, and a quality surveyor’s report. In addition, other types of “non-classic” forensic surveying matters will be examined, including working as a forensic surveyor gathering data at an accident or crime scene and examining the work of other surveyors to determine adequate methodology and procedure. The workshop will review these scenarios, covering the need for certain evidentiary information, how to document the investigation, and what questions to ask. Forensics involves gathering information and/or evidence for matters in litigation. The surveyor is uniquely trained to meticulously gather information on the project site every day. This skill makes the need for a forensic surveyor self-

evident and this workshop will broaden attendees’ knowledge and skills suck that they better understand the forensic surveyor’s role in litigation.

♦ SESSION 3 (AM): LIVE DEMONSTRATION OF PHOTGRAMMETRY & REMOTE SENSING USING UNMANNED AERIAL VEHICLES(Earn 7 ½ PDHs for attending both the morning and afternoon sessions)

Frank Willis will present a live demonstration of the use of two un-manned aerial vehicles (UAV’s) to collect remote sensing data. The UAV’s are 6 and 8-engine electric, radio-controlled multicopters equipped with various remote sensing devices. The class will observe Willis flying the devices over a location of interest outside the seminar building. The UAV’s will collect low level aerial imagery. The class will return to the seminar room where Willis will download and develop topographic geometry real-time on the classroom video projector.

As part of his forensic engineering and surveying practice, Willis has become a leader in close-range aerial photography, and is involved in research and development of the technology at LSU and in private practice. The UAV’s are impressive. They sound like a huge swarm of hornets, have surprising power, and will fly 75 mph horizontally and 40 mph vertically. They are radio controlled and have GPS navigation and real-time video transmitted to a headset worn by the pilot. This is a must-see presentation of state-of-the-art technology in its infancy in the field of surveying. At the conclusion of this presentation you are guaranteed to be thinking about how these vehicles can benefit your surveying profession.

Technologies involved are remote sensing, laser scanning, close-range photogrammetry, digital modeling, mathematical simulation, advanced statistics, plant growth time series statistics, dendroecology, and animated graphics. Willis authored the publication, The Determination of the Ordinary High Water Marks of Complex Natural Lakes. Willis has 35 years of experience in civil engineering, environmental engineering, and land surveying and has served as the president of Willis Engineering since 1980. He guest lectures at various universities, and seminars across the country. He has served as leading expert on civil and environmental cases involving land boundaries, and forensic engineering. Willis was the leading expert on the Rapides Parish v. Grant Parish boundary dispute, which is the most famous boundary dispute in Louisiana in recent history. The case gained national attention.

Tracy Dotolo Sanders is a biologist and project manager in the South Branch of the Charleston District, U. S. Army Corps of Engineers Regulatory Division in Charleston, South Carolina. Ms. Sanders serves as a project manager in Watershed 1 of the South Branch, which covers the geographic area south of Charleston County and west to Bamberg and Barnwell Counties. As a project manager, Ms. Sanders reviews permit applications and makes jurisdictional wetland determinations. In addition, she is the Outreach Coordinator for the Charleston office, is part of a team developing a new General Permit for work in rice impoundments, is the District's lead for the renewal and reissuance for the 2012 Nationwide Permits, and maintains the Charleston District Regulatory Division webpage. In 2000, Ms. Sanders first began working for the Corps in the Norfolk District Regulatory Branch in Norfolk, Virginia. In 2005, she transferred to the Charleston District. Richard L. Darden, Ph.D., is a biologist and project manager in the Special Projects Branch of the Charleston District, U. S. Army Corps of Engineers Regulatory Division in Charleston, South Carolina. Dr. Darden serves as the district lead on jurisdictional issues in the post-Rapanos era, as well as helping to guide jurisdictional determination policy and practice in the South Atlantic Division. Dr. Darden joined the Corps in 2005, after 17 years as an environmental consultant and university instructor. He has been involved with all aspects of project development, design, construction and monitoring, including all levels of NEPA documentation, as well as hundreds of jurisdictional determinations and permits throughout the United States. Brice McKoy is the Chief of the Northwest Regulatory Branch of the U.S. Army Corps of Engineers, Charleston District. His office is located in Columbia SC where they handle Corps Regulatory actions within the piedmont and mountain areas of SC. Mr. McKoy has over 19 years of experience with the Corps beginning while he was a student at Clemson University serving as a CO-OP in the Wilmington District. After graduating from Clemson in 1993, Mr. McKoy began working for the Corps full-time. During his career with the Corps, Mr. McKoy has worked in various Divisions within North Carolina, Georgia, Florida, and South Carolina. The majority of Mr. McKoy's career has been in Florida as a Project Manager for Comprehensive Everglades Restoration Plan, the Corps project for restoring the Everglades. Jessica Hooten is a project manager in the Northwest Branch of the Charleston District, U. S. Army Corps of Engineers Regulatory Division in Columbia, South Carolina. Ms. Hooten serves as the quality control reviewer of jurisdictional determinations for the Northwest Branch. She began her career with the Corps of Engineers in 2006 with the Wilmington District in Wilmington, North Carolina and joined the Charleston District in 2008. Ms. Hooten conducts jurisdictional determinations, evaluates and processes permits, and works enforcement actions. Mr. Konickson is a frequent presenter at workshops and seminars and is an instructor for the national Regulatory training program. He has served on several local, regional and national project teams in areas such as jurisdiction, mitigation and regulatory process improvement. He is a subject matter expert in the area of jurisdiction and has been involved with developing policies and practices at the local, regional and national level. Mr. Konickson received a B.S. in Forest Resources from the University of Minnesota and over the past 20 years has served the Corps of Engineers in Minnesota, Florida, Alaska and South Carolina, and as a hydrologist for the Minnesota Department of Natural Resources. He recently completed an assignment at USACE Headquarters in Washington D.C. where he worked on national regulations and guidance regarding jurisdiction.

Society of Professional Land Surveyors (SCSPLS) was formed to advance the public welfare and the professional, social and economic interests of the Registered Land Surveyor by promotion of education, legislation and public relations through the establishment and maintenance of high ethical standards and practices. It is proposed to bring about coordination between the Land Surveying and Engineering Professions through close cooperation with representative organizations of Professional Engineers. BENEFITS OF MEMBERSHIP Annual Convention The SCSPLS holds an annual convention each year. Attendees exchange ideas, hear guest speakers for related professions and socialize at planned events and meals. The annual business meeting is also held during the convention, and at this time, officers and directors are named for the coming year. Lifelong friendships are begun and renewed at the Convention. This event is planned to benefit each category of membership and is the highlight of our year. A variety of events, from leisure to technical, are planned for everyone. Individuals, couples or families with children can obtain tremendous benefits from this event. Out-of-state guests are always in attendance with current activities and information from our Colonial States. Education Educational seminars and workshops are conducted at various regional locations around the State. Continuing education units may be earned through these programs to meet the SC State Board of Registration requirements. These educational programs are designed to provide a wide variety of topics including business, legal aspects, as well as surveying technology. SCSPLS is an Approved Sponsor for the presentation of Continuing Professional Competency courses or programs by the N.C. Board of Registration for Professional Engineers and Land Surveyors. While the SC State Board of Registration does not pre-qualify providers, programs sponsored by the SC Society of Professional Land Surveyors are designed to fulfill the requirements for Continuing Professional Competency in South Carolina. Membership Directory A directory of the current members and officers of the SCSPLS is published for distribution to the membership. The SCSPLS Constitution, By-Laws and information on state SCSPLS Chapters are printed in the directory. Newsletter The newsletter, The Carolina Benchmark, contains articles of interest to the membership including activities of the Society, general business tips, and timely topics of interest to surveyors. This is also an excellent opportunity for Sustaining members to advertise their equipment and services. Scholarship The Society is proud of the scholarships awarded in the past and will continue this program to assist land surveying students in their educational goals. Trade Show SCSPLS will hold the annual trade show along with the Education Conference to be held in Columbia. This affords members an opportunity to see the most current equipment and services on the market for the surveying profession. National and State Affiliations SCSPLS is an affiliate member of the American Congress of Surveying and Mapping and sponsors delegates to: National Society of Professional Surveyors State Mapping Advisory Committee SC Council of Engineering and Surveying Societies GIS Advisory Committee SC Utilities Committee
