    SUMMARY

    On May 1, 2020 I, received this case for further review. Ashley Jackson, PID was identified as serving Civil Process papers through her agency, Hays CO Constable Office, PCT 3, without having a civil process course. Jackson was given an exemption by Constable Ray Helm on September 18, 2019.

    DEFINITIONS

    Sec. 1701.354. CONTINUING EDUCATION FOR DEPUTY CONSTABLES

    (a) If the commission requires a state, county, special district, or municipal agency that employs a deputy constable to provide the deputy constable with a training program under Section 1701.352, the commission shall require the deputy constable to attend at least 20 hours of instruction in civil process.

    (c) The commission may waive the instruction requirements for a deputy constable under this section:

    (1) if a constable requests a waiver for the deputy constable based on a representation that the deputy constable's duty assignment does not involve civil process responsibilities;

    DETAILS OF INVESTIGATION

    Deputy Jackson, PID was appointed originally to the Hays County Constables Office, PCT 3 in March 2008 as a Reserve and left that position in June 2009. Jackson returned to the agency in January 2017 working under Constable Ray Helm (took office as Constable January 1, 2017). Jackson took the Civil Process Course (3101) at Texas State University on March 1, 2017. Jackson left her appointment with PCT 3 in May 2018. Deputy Jackson returned to Hays CO Constable Office, PCT 3 again in August 2019 and is currently as of this report still appointed as a Reserve. Deputy Jackson received a Civil Process Exemption on August 30, 2019, which covered her for the Training Unit of September 1, 2017 thru August 31, 2019. The Civil Process Exemption was reported by Constable Ray Helm, through Roster Number 108349970 on August 31, 2019. It was learned during the above Training Unit, Jackson served a small claim citation on October 21, 2017. (see below).

    The above citation was served by Deputy Jackson on October 21, 2017. This would have been during the 2017-2019 Training Unit; which Constable Helm issued the Civil Process Exemption to Jackson. Constable Helm then issued another Civil Process Exemption by submitting Roster #10846544 on September 18, 2019. This exemption for Deputy Jackson would have been for the 2019-2021 Training Unit. Through the complaint lodged on May 1, 2020 it was learned Deputy Jackson served a Small Claim Citation on February 1, 2020 (during the exemption period). A copy of the document is below.

    5/04/2020 On the above date I spoke with Deputy Ashley Jackson via cellular telephone ( I advised Jackson of the complaint involving her serving civil documents while receiving a Civil Process Exemption by Constable Helm. Deputy Jackson advised she felt like the number of civil documents she served was under 10. Deputy Jackson stated she is a Reserve Officer with the Hays County Constable Office and only works with a senior deputy. Deputy Jackson advised when she works with a senior deputy, they typically drive, and she will fill out the civil papers. Deputy Jackson stated Constable Helm advised her she can serve civil papers if she’s in training or civil process is not her primary job. Deputy Jackson provided me with a screen capture of a text conversation she had with Constable Helm when the complaint was first lodged. Deputy Jackson said Constable Helm advised her the agency would not send her to the Civil Process training course due to budget constraints. The below image is of the conversation.

    6/04/2020 I spoke with Deputy Jackson to inquire about the text message conversation she had with Constable Ray Helm. I asked Deputy Jackson what she thought her primary job was for the Hays County Constable Office was and she replied, “Law Enforcement”. I then asked her to be more specific and she couldn’t provide an answer. When I asked her if one of her primary jobs as a Reserve Deputy Constable would be to serve civil papers she did not respond. Deputy Jackson then stated she trusted Constable Helm when it came to the exemption status. Deputy Jackson then stated again she always rode with a senior deputy as if she was in training. I then asked Deputy Jackson why she would be in training beings she has been a Reserve Deputy Constable as of this report for approximately 3.5 years. Deputy Jackson did not have an answer for the question. I then contacted Melanie Munoz HR Hiring Assistant, Hays County Human Resources, at (512) 393-2215 and inquired about the job description of a Reserve Deputy Constable. Ms. Munoz advised she would email me a copy of the job description for Precinct 3. I then asked her if all the Constables Office’s used the same job description, she replied “yes, we just change the heading to whatever Precinct applies”. A copy of a job posting will be placed with the case file.

    I reviewed a Job Posting for Reserve Deputy Constable Precinct 2 has posted as of this date. Under the required skills section of the posting the first bullet point is Serves Civil Papers and executes warrants. The following is from the summary section from the posting.

    Summary Under close supervision, the Deputy Constable executes criminal arrest warrants, and civil processes throughout the County and works traffic as workload permits. This position enforces all civil and criminal laws of the State of Texas and Hays County. The Deputy Constable assists other agencies (e.g. Hays County Sheriff’s Department, San Marcos Police, Buda Police, Texas Highway Patrol, University Police, and other public safety agencies) to protect the citizens of Hays County and anyone traveling through Hays County. This position affects the economic and social well-being of the citizens of Hays County.

    It is worth noting in the first line of the summary it states again the position executes civil processes throughout the county.

    CONCLUSION This case began with a complaint regarding Deputy Ashley Jackson, PID serving civil process papers while under the Civil Process Exemption given by Constable Ray Helm, PID Deputy Jackson was given a Civil Process Exemption by Constable Ray Helm on August 31, 2019 and again on September 18, 2019. During these two Training Units Deputy Jackson served a civil document on October 21, 2017 and on February 1, 2020. Deputy Jackson advised when she works, she will ride with a Senior Deputy and they will drive while she fills out the civil documents. Deputy Jackson said Constable Helm advised her she could serve civil papers if she’s in training or civil process isn’t her primary job. This conversation was confirmed when Deputy Jackson sent me a screen capture of the text message. Deputy Jackson also stated Constable Helm would not pay for her to go to the training course for Civil Process. I asked Deputy Jackson what her primary job was, and she said, “Law Enforcement”. Deputy Jackson has been working as a Reserve Deputy Constable for approximately 3.5 years. I then asked Deputy Jackson to be more specific on her primary job and she couldn’t. I then contacted Melanie Munoz, Hays County Human Resources. Ms. Munoz advised when Hays County posts a Reserve Deputy Constable position, all precincts use the same description. Ms. Munoz stated the HR department will just change the heading to reflect which precinct the posting is for. I observed a current posting on Hays County website for Reserve Deputy Constable for Hays County Constable Precinct 2. The posting listed under the required skills section is serve civil papers. This requirement is again listed under the summary section of the same post. Deputy Jackson was hired initially for a Reserve Deputy position with Hays County Constables Office, Precinct 3 in March 2008 and departed the position in June 2009. Jackson then returned to the same position on two more occasions, both of which were under Constable Ray Helm. The fact Deputy Jackson has approximately 3.5 years of experience would lend itself she was not under a field training program. Also, the fact the job posting for her position advises the first required skill would be to serve civil papers the civil process exemption would not apply to Deputy Jackson. Therefore, the

    exemption was issued as another mechanism for Constable Ray Helm to circumvent the system and training requirements set in place by the Texas Commission on Law Enforcement and the State of Texas. END OF REPORT RSN

Summary Under close supervision, the Deputy Constable executes criminal arrest warrants, and civil process throughout the Count.and works traffic as workload permits. This position enforces all civil and criminal laws of the State of Texas and Hays County. The Deputy Constable assists other agencies (e.g. Hays County Sheriff’s Department, San Marcos Police, Buda Police, Texas Highway Patrol, University Police, and other public safety agencies) to protect the citizens of Hays County and anyone traveling through Hays County. This position affects the economic and social well being of the citizens of Hays County. Responsibilities Serves civil papers and executes warrants. Assists new officers in the field and in training the proper procedure for serving civil process to an

    individual or group. Provides public assistance to the general public. Assists as a bailiff for the Justice of the Peace. Provides traffic enforcement as requested. Participates in training as assigned on subjects such as state and local criminal, civil and traffic laws,

    and traffic enforcement, including vehicle stop and approach techniques, and the proper use or radar units.

    Effectively utilizes resources available to perform the job. Maintains TCOLE certification through approved training Assures the services delivered by the Constable’s office meet quality and timeliness standards. Enforces traffic laws including school zones, construction zones, subdivisions and County roads. Follows up on cases being investigated and assists other agencies (e.g. fire, EMS, Department of

    Public Safety, traffic control, etc.) and testifies in courts as needed. Maintains patrol vehicle and equipment issued. Maintains a high profile in the community and participates in community outreach and education

    programs as required by the Constable. Observes activities and initiates appropriate actions while on patrol. Responds to major traffic accidents and assists medical personnel as needed Performs civil standby to ensure no violence occurs between members of the public. Answers civil questions and assists public with non-law enforcement related problems. Attends and participates in public meetings as requested by thethe public or assigned by the

  • Supervision The Deputy Constable is required to satisfactorily perform the above duties and will be evaluated for

    technical soundness, accuracy, adherence to instruction, and completeness. This position is under constant supervision and the Constable provides detailed instructions. Guidelines The Deputy Constable uses judgment in interpreting and adapting the guidelines to apply them to specific cases or problems. The Deputy Constable may recommend changes or improvements in the guidelines. The Deputy Constable must have a strong work ethic, follow directions, meet deadlines, have good attendance, be punctual, keep promises and appointments, be reliable, and have a professional, helpful community centered attitude. The Deputy Constable must be able to effectively communicate with others in a professional manner while conducting their duties and interacting with all persons . Emotional Demands The Deputy Constable must effectively handle the stress of dealing with argumentative or emotional contacts with groups and large numbers of people in order to obtain, clarify or give facts or information or to perform required services. The Deputy Constable assists other agencies (e.g. Hays County Sheriff’s Department, San Marcos Police, Buda Police, Texas Highway Patrol, University Police, and other public safety agencies) to protect the citizens of Hays County and anyone traveling through Hays County. This position affects the economic and social well-being of the citizens of Hays County.

    This letter is intended to inform you of the closing of the enforcement case regarding your violation of Title 37 Texas Administrative Code §218.3 Legislatively Required Continuing Education for Licensee (a), (d)(3) (Civil Process Course) and 1701 Texas Occupational Code 1701.354 Continuing Education for Deputy Constables (a), (c)(l) (Civil Process Course). It is further intended to inform you of the results of that case and any action that is to be taken by the Commission. This enforcement case was initiated by citizen complaint.

    Upon receiving the initial complaint, TCOLE Enforcement Division initiated an investigation. During this investigation, Investigators verified you are currently appointed with Hays County Constable Office, Precinct 3 as a Reserve Deputy Constable. A review of your PSR (Personal Status Report) shows you have not taken the required 20 hours Civil Process course since the 2013-2017 training cycle. Investigators found that Hays County Constable Precinct 3, Ray Helm submitted two waivers to TCOLE, exempting you from the civil process (serving papers), once on 08/30/2019 and again on 09/18/2019, which covers the 2017-2021 training cycle. Investigators found on 01/30/2020, which is after you received waivers exempting you from civil process, you served civil papers issued by the Hays County Justice of the Peace, Precinct 3. During an interview with Investigators you admitted to serving less than ten (10) other civil papers while being exempt from the civil process. The civil process exemption submitted to TCOLE by Constable Helm, excludes you from serving civil papers. For those reasons, the Enforcement Division substantiated this portion of the investigation.

    This letter of Reprimand is now a permanent part of your Commission file. Please note that the license of a person, who has previously received two written reprimands from the commission are subject to suspension. See Title 37 Texas

    Adn1inistrative Code §223.15 (g).

    If you have any questions or believe this letter has been issued in error, please provide supporting documentation to the Commission's Enforcement Division within ten days.
