Liberty And The Pursuit Of Happiness It’s a wonderful feeling to be back after taking a break for sometravels, rest, relaxation and spending quality time with family andfriends. After being away from the office for a couple of weeks and uponreturning, we realized that our working and living environment coulddo well with some remodeling and so we took the first week off tochange a few things around in order to spice up the working andliving environment. We are now ready and reconditioned to continue serving you withrenewed vigor. We are therefore plunging right into the mix of things and westart of off by expressing a heartfelt thank you to all those manypersons who expressed genuine appreciation to see us back in town. We were somewhat disheartened however to have returned to awave of accusations of brutal and other less subtle, but nonethelessserious forms of abusive behavior on the part of a few elements ofthe local constabulary. The case that stands out among others is the alleged beating oftaxi driver, Bernard “Banner” Anderson, further details of whichis contained elsewhere in this edition of the newspaper. On a rather personal note, there was the case of a close relativeof ours who was arrested and charged for handling stolen goodsdespite the fact that the arresting officer in his report provided noconnection to the accused and the reported stolen goods but whenthe arresting officer brought this discrepancy to the attention of hisimmediate supervisor, the alleged response was: “You go aheadand charge his r - - s. Let him deal with that in court”. A request was consequently made for a revision of the facts andwhen the matter was brought before the court the prosecutioninformed that there was no evidence against one of the threeaccused and he requested that the charge be withdrawn againstthe accused but only after the accused had spent over 24 hours in aprison cell and was deprived of a full day’s pay. This was indeed a troubling experience as it leaves us to seriouslywonder how many innocent persons have either been shipped off toprison or released on bail with having to take time out to appear incourt on the many adjournment dates until the matter reaches itsnatural conclusion with the case being eventually struck out forwant of prosecution. This kind of abusive behavior, in our humble opinion, flourisheswhen those who should legally provide the check and balance againstsuch abuses are ignorant to the important role they play within thecommunity as officers of the court. We are specifically referring to those untrained Justices of thePeace who, oftentimes because of political patronage, wake up onemorning with the JP title suffixed to their names and without fullyunderstanding their role. We have said it before and we will say it again. Among their manyduties and functions, a Justice of the Peace stands as a check andbalance against the abuse of authority by those charged withenforcing the law. By law, before effecting an arrest, a policeman, of whatever rank,must first swear to an information and complaint, then obtain awarrant of arrest before proceeding to deprive any citizen of hisconstitutional right to “liberty and the pursuit of happiness” as isenshrined at section (e) of the preamble of the Constitution of theSovereign Nation of Belize. What does swearing to an information and complaint mean? Itmeans, Mr. Justice of the Peace, that a policeman must provide youwith the facts of the charge and the basis on which they intend todeprive any citizen of their constitutional right to freedom. This ignorance to the law is not only confined to new Justices ofthe Peace but it likewise exists among some “senior” ones. In factwhen this procedure was recently brought to the attention of a“senior” JP his response was “NO, NO, NO, I cannot ask thepolice to show me any statement they have against anyone. Those

statements are confidential police matters and if the police beginto show us these statements the information could be leaked tothe accused.” What this “senior” JP obviously does not realize is that in puttingforward a defense, every accused person must, by law, be given fulldisclosure, before proceeding to trial. That disclosure, Mr.Justice of the Peace includes every bit of documentary evidenceand statements that the prosecution intends to use against theaccused. However, by the time this is done, the accused wouldhave either been remanded to jail or would have been subjected tothe inconvenience of having to take time off to attend those manyadjournments. Mr. Justice of the Peace, please be informed that you are underno obligation to sign any arrest warrant for any policeman if youare not fully satisfied that the information and complaint presentedto you warrants the depriving of that individual’s right to freedom. We will venture to say that very, very, very few are the Justices ofthe Peace, if any who have ever requested to review the evidenceagainst an accused person before signing a warrant of arrest. Infact, we would even venture to say that there are some Justices ofthe Peace who irresponsibly hasten to sign their names to arrestwarrants without even as much as reading the paper on which theyaffix their signature. The saying therefore holds true that “Cow knowwhe weak fence deh” and so these irregular policemen flack tothese weak fences. There was also the case this week where a youth was broughtbefore the court on two charges: (1) resisting arrest and (2)indecent words. In the absence of a substantial charge, these twominor charges should never be allowed to stand independently incourt. The obvious question should be: What arrest was the accusedresisting in the first instance? In the obvious absence of asubstantial charge, what the accused was actually resisting was theunlawful detention by a policeman and obviously whateverscenario might have occurred was actually instigated by the oneattempting, without obvious legal cause, to deprive a citizen of hisconstitutional right to liberty and the pursuit of happiness.

This deliberate non disclosureis contrary both to the mandateof a government elected on aplatform of transparency and tothe ideals of a democracyestablished on the bedrock of aninformed, alert citizenry. It is also non productive,because when the accusedpersons go to court all the namesand details are necessarilyreleased because – as is the casein democracies – we have anopen court system (by theevidence of this arbitrary abuseof power is suspect, if thepolice had it their way that toowould change – thankfully theydon’t). I note also that thisdeliberate non disclosure is

against the Police Media Policy.It is also applied arbitrarily, somenames and addresses arereleased, others are not; I’m notsure who makes those decisionsand based on what criteria. I don’t know if the decision is

SAN IGNACIO TOWN,Cayo, Monday, September 07,2009: Four persons traveling in asmall green car were arrestedand charged for drug traffickingwhen police, at the vehicle checkpoint in Red Creek, found twobuckets of marijuana inside thetrunk of the car. San Ignacio police informs thatit was around 10:45 on the nightof Sunday, September 6, when agreen, four door, Mazda carwith Belize City private licenseplates BZ-C-00297, with fouroccupants, pulled up to thePolice Check Point in RedCreek, between miles 65 and 66on the Western Highway. Thecar was traveling eastboundtowards Belmopan from SantaElena. The out of town license plates,the late hour of the night and thenervous behavior of at least oneof the car’s occupants, promptedthe police to order them out ofthe vehicle for a thorough

inspection. When the trunk of the car wasopened, police came upon twoplastic buckets containingmarijuana. The occupants wereadvised of the discoveryand were all detained andtransported to the police headstation in San Ignacio and laterto the San Ignacio hospitalwhere the buckets were weighedin their presence.

First on the scale was a blueand white bucket whichregistered 13 pounds while theother one, the red and whitebucket, clocked 10 ½ pounds onthe scale, for a total haul of 23½ pounds of the prohibitedsubstance. All four accused were escortedback to the police station wherethey were formally arrested andcharged for two counts of drug

trafficking. The four accused wereidentified as: 1) PasqualTerrero, 48, Cuban,unemployed of a 7 th Streetaddress in Belize City; 2)Serafina Torres, Belizean,primary school teacher, of aSittee River Street address inOrange Walk Town and her twosons: 3) Andre Torres, 28,

Ix Chel Tropical Research Foundation is once againoffering it’s after school program, Kids For Conservation2009-2010. Beginning September 14th, our volunteers willassist children with their homework and other school projectsdaily from 4:00 to 6:00 p.m.

In the first hour, students will have an opportunity to beassisted in doing their assignments in a peaceful, secure andsupportive environment. When homework is completed alight snack is provided; the second hour will be for arts, fungames and songs. ICTRF beleives that learning should befun. Belizean, cane farmer of aJasmin Street address inOrange Walk Town and4) Gian Torres, 19, Belizean,student residing on Sittee RiverStreet also in Orange WalkTown. On Monday, September 7, allfour accused drug traffickersappeared before San Ignacio’snew magistrate, Ms. RachelMontejo, where Pasqual Terrerowasted no time in pleading guiltyto both charges. He accepted thefacts of the case as presented byprosecutor George Gomez. Heordered to forthwith pay atwenty thousand dollars fine,being ten thousand dollars foreach count, plus ten dollars costof court. In default of payingthe fine, Terrero would spendthree years for each count in jail.The jail time was orderedto run concurrently, for a total

of three years imprisonmenton both counts. He was unableto come up with the moneyand was transported to the BelizeCentral Prison until eitherthe fine is paid or the three yearssentence runs out. The other accused, Serafina,

Andre and Gian Torres allpleaded not guilty to bothcharges. Although PasqualTerrero, in essence “took therap”, charges against the otherthree co-defendants weremaintained by the prosecutionand since the combined weight

While Cahal Pech VillageResort is widely known on thelocal, regional and internationalscene, Oscar’s achievementbrings additional positiveattention on the resort that hasbeen his source of employmentfor the past 8 years. We caught up with Oscar a fewdays ago on Burns Avenue,downtown San Ignacio. He cameacross as a young man radiatingwith a strong positive mentalattitude. Oscar told us that he started atCahal Pech Village Resort, eightyears ago, as a yards and grounds

handy man. As he looked around and saw the otheroperations that made the resort function he began toforge his way forward and at every given opportunitynever failed to express the burning desire to move upand so when the wait staff would be short he wouldjump at the opportunity to take up the slack and in sodoing he began to practically learn the skill ofwaitering. When a vacancy was created in the wait staff,he was the obvious choice to fill the slot. Not satisfied with waitering, he began taking an

interest in the front desk operations and wouldlikewise substitute for any absence and soon hewas performing front desk duties on a full timebasis. He said that he has always had a passion for thefood and beverage operations and with an eye onbartending he likewise persevered by spendingoff duty time with the bartending staff as hewatched, asked questions and volunteered to helpfrom time to time as he began to acquire the skillsof bartending. Again, when a vacancy wascreated in bartending, as we would say in Creole“breeze blow pelikin right whe Ih wann goh”and he soon began serving as a Bartender at CahalPech Village Resort. He said that, a few weeks ago one of the seniormanagers at the resort told him that his namewould be submitted to participate in thebartending category of the competition. “At firstI was nervous,” he admits “because I have noformal training in the profession. But I madeup my mind to give it my best shot. Thecompetition was tight. It was very challengingand I am truly proud of my achievement becausethis is the first competition I have ever entered.I will continue working harder and learn more sothat I can do better next year,” concluded Oscar. We congratulate Mr. Oscar Guerra on thisachievement. We encourage him to continuemaintaining that positive mental attitude as wecontinue hoping that other young Belizeans willfollow in his footsteps.

SANTA ELENA TOWN, CayoMonday, September 7, 2009: Bernard “Banner”Anderson, 29, a Santa Elenataxi driver, alleges that he waswrongfully accused, illegallydetained and brutally beaten byfour policemen attached to theSan Ignacio Police Detachment. Anthony’s Supermarket wasrobbed by two masked,gunmen at around 8:45 pm onWednesday, September 2 andwithin half an hour of theincident a team of policemenfrom the evening shift camebanging on the door of Banner’shouse located in the Trapichearea of Santa Elena Town. When he answered thebanging he was confronted bythe police and told that he waswanted for questioning inconnection with the robbery atAnthony’s Supermarket. He told

the police that he was sick in bed sinceSunday morning but that he willnevertheless comply with their request. He said that when he arrived at thestation a senior policeman was alreadythere and this policeman immediatelybegan to accuse him of being involved inthe robbery at the Chinese Supermarket. Banner informed that he insisted that heknew nothing about the incident. Thesenior policeman reportedly instructed ateam of subordinate officers to “Take himfor a ride up the road”. His hands werehandcuffed behind his back and he wasshoved inside the pan of the police blueD-Max patrol pickup and transported to afeeder road off the Western Highwaybetween San Ignacio and Benque ViejoTown. When the vehicle came to a stop,he was shoved outside the vehicle andlanded on the ground thereby sustaining

the first injury being a scrape to the leftside of the temple. He was reportedly approached by oneof the officers who inquired about thenature of his illness. When he indicatedthat he was suffering from abdominalpains, the policeman gave him a solidpunch in the belly. All four policemen reportedly spranginto action as they allegedly tookturns beating him with their hands andkicking him with their boots. Thespecial constable in particular went intothe nearby bushes where he broke a treebranch and began whipping him with itand when it broke he allegedly went foranother and continued the beating allthis time Banner was rolling on thewhite marl ground. During the beating his handsremained cuffed behind his back andone of the policemen allegedly yankedhis hand backward and this was when

He alleges that upon arrival hiscommon-law wife and some ofher sisters were already gatheredat the entrance to the station.Banner said that upon seeingtheir presence, one of thepolicemen alighted the vehicle,entered the police station andopened a side door to the cellblock through which he wassmuggled into the cell blockarea. He was locked down stillwith his hands cuffed behind hisback and with the metalhandcuff scarring his bleedingwrists. He remained inside the cell interrible pain and it was not untilabout two hours later when acorporal who took over the shiftrendered assistance by removingthe cuff off his hands. Early the next morning he wasescorted to the San Ignaciohospital were the medical officeron duty ordered an x-ray of hisshoulder and so he wastransferred to the Loma Luz

hospital where the x-rayreportedly showed a displacedshoulder bone. The medicalstaff on duty advised that he betransported to the Karl HeusnerMemorial Hospital in BelizeCity but he was instead returnedto the police station and to thejail cell. He alleges that his pleas formedical attention was ignoredand when the pain becameunbearable around midnight onThursday, he was returned tothe hospital where with theassistance of an attendantthe doctor was able to snap hisshoulder bone back in place. It was round 12 midnightwhen the ambulance departedSan Ignacio transporting Bannerto the Karl Heusner MemorialHospital with instructions forimmediate surgery to removeclot blood for his abdomen.He alleges that upon furtherexamination at the KHMH, themedical staff came to thedetermination that the clotscould be extracted bynon-surgical means and thusthe treatment began. He remained all day underpolice guard at the KHMH andit was shortly after 7:30 onFriday night that the police guardadvised him of the message in-dicating that San Ignacio Police

ordered his release and theremoval of the guard. Shortly thereafter he wasdischarged from the hospital andwhen he enquired about beingtransported back to San Ignacio,he was reportedly told that hewas free and that he could do ashe likes. With the help ofrelatives he boarded a bus for thejourney back to Santa Elena,Cayo from Belize City. When he reportedly inquiredabout the return of his car andhis cellular phone, he wasallegedly advised to wait until
