IntroductionandBackground
IuradaPropertyGroupactfor144FerrarsPtyLtd,whoownthesiteattheabovementionedaddress.
Thesitehasanareaof273squaremetersanditislocatedonthesoutherncorneroftheintersectionofFerrarsStreetandThistlethwaiteStreet.ItisintheMontaguePrecinctwithinFishermansBend.
144FerrarsPtyLtdisassociatedwithRavensdownShippingServicesPtyLtd(RSS)whooccupytheexistingbuilding.RSSisafreightandbulkshippingbusinessthatestablishedonthesitein2011andsincethattimethebusinesshassteadilygrownandisexpandingintonewmarkets.
WithinthePortPhillipPlanningSchemethefollowingprovisionsarecurrentlyapplicabletothesite:
– Amandatorymaximumbuildingheightof8storeys;– Amandatorymaximumstreetwallheightof20mor5storeys
(whicheveristhelesser);
– Mandatorytowersetbacksabovethebuildingpodiumof10mtostreetsandside/rearboundaries;
– Preferredmaximumparkingratesof1spaceperdwellingand1spaceper100squaremetresofretail/commercialgrossfloorarea;and
– Arequirementtopreparesitespecificdevelopmentcontributions.–
Pursuanttotheseprovisions,andtoaccommodatetheexpanseoftheexistingbusiness,anapplicationwaspreparedandsubmittedtotheCityofPortPhillipon25October2017.Theapplicationreferencenumberis951/2017.
ThebuildingthatisthesubjectoftheapplicationhasbeendesignedbyJacksonClementsBurrowsArchitects(seeFigure1below)andtheapplicationproposes:
– Afivestoreycommercialbuildingconstructedtoalltitleboundaries;– Approximately800squaremetresofnetcommercialfloorarea;– 30squaremetrescaféatgroundfloorlevel;and– 12carparkingspacesand7bicycleparkingspaces.

Despitereceivingarequestforsubmissionoffurtherinformationon3November2017,theCityofPortPhillipofficershaveadvisedthattheyaregenerallysupportiveoftheproposal.
ProposedHeritageDesignation
ThenewdraftFishermansBendFrameworkPlanandPlanningSchemeAmendmentGC81includearangeofnewprovisions,includingarecommendationforheritageprotection(subjecttofurtherassessment)fortheexistingbuilding(seePage59ofthedraftFramework).
Thisproposalisperplexingastheexistingbuildinghasbeenthesubjectofsignificantinterventionworks.OursubmissionisthatthereisinsufficientjustificationintheBIOSISBackgroundHeritageReportandthatthebuildingisnotworthyofbeingidentifiedassignificantandthereforeshouldnotbeprotected.
WehavealsoconsultedtheCityofPortPhillipofficersregardingthisproposalinthedraftFramework,andtheyhaveadvisedthattheyalsodonotsupportit.
OtherConcerns
Inadditiontoourconcernsregardingthepossibleheritagedesignation,therearetwootherpartstooursubmission.
Firstly,wedonotagreethatanyproposedprovisionsinAmendmentGC81shouldbemandatory.
Secondly,wesuggestthatallexistingpermitsandcurrentapplicationsshouldenjoythebenefitoftransitionalprovisions.
Conclusion
Wetrustthattheconcernswehaveraisedwillbegivenproperconsiderationduringtheprocess,andultimatelywelookforwardtodevelopingoursitetoallowourbusinesstocontinuetogrowintheMontaguePrecinct.
