Foreword
The Strategic Investment Plan 2011-16 is an opportunity for the Uganda Law Reform Commission to articulateandcommunicateitsplansandambitionsforthenextfiveyears.ThepresentStrategicPlan
builds on the earlier one of 2005-11, during which period many successes were registered even though there were some noticeable challenges� The launch of the 2011-16 Strategic Plan coincides with the appointment of a new Commission earlier in 2011 when the new Chairperson and all six Commissioners were appointed by His Excellency the President of Uganda� A fully constituted Commission is expected to energise the activities and tackle the challenges of the Uganda Law Reform Commission so that it registers more successes in future�
Our plans for 2011-16 are ambitions but achievable� During this period we plan to print a new Revised Edition of the Laws of Uganda as well as simplifying some key laws and translating into local languages a large number of laws� We shall also maintain some vibrant activity in law reform, with the intention of finalizinganumberofreportsandBillsreadyforconsiderationbyCabinetandParliament.Furthermore,we intend to maintain our active participation in the affairs of the East African Community (EAC) and the Association of Law Reform Agencies of Eastern and Southern Africa (ALRAESA), culminating in our hosting of two regional conferences during this period�
Many of our activities require the active support of many individuals, associations/societies, institutions/organizations,governmentdepartmentsandagencies,andregionalandinternationalpartners.Wethankeveryone who has assisted in the past and pledge our continued cooperation�
We hope that the information presented in this strategic plan is clear and informative and would welcome comments on how we can further improve the information or the activities referred to�

SECTION I
1.0 INTRODUCTION
1.1 Overview
The Uganda Law Reform Commission (ULRC) Strategic Plan 2011-2016 draws considerably from the JLOS (Justice Law andOrder Sector) Strategic Investment Plan 2011-2016. JLOS provided significantfinancialandtechnicalsupporttoULRCduringthelaststrategicperiodandwillcontinuetodosointhenextfiveyears.BasedontheexperienceofULRCinthelaststrategicperiodandtheprioritiessetbyJLOSinconsultationwithULRC,thisplanfocusesonsimplificationandtranslationoflaws,regulationsandprocedures;strengtheningrevision,reform,enactmentandharmonizationoflaws;enhancingthecapacityof ULRC to undertake law reform and law revision; and promoting awareness and participation in law reform, revision and implementation� The Plan is divided into six sections� Section I is the overview of the Plan and background of the Commission; Section II reviews the strategic plan 2005-2011; Section III is the environmental analysis of ULRC (internal and external)� Section IV states the vision, mission, core values and strategic objectives of ULRC for the next strategic period; Section V is the logical framework and Section VI the budget�
1.2 Background to ULRC
Established under Article 248(1) of the Constitution of the Republic of Uganda, 1995, the Uganda Law Reform Commission (ULRC) is a constitutional body required under Article 248(2) to submit annual reports on its activities to Parliament� The Commission in accordance with section 10 of the Uganda Law Reform Commission Act, Cap 25 is set up to study and keep under constant review all legislation comprising the laws of Uganda with a view to making recommendations for their systematic improvement, development,modernizationandreform.Inparticular,emphasisshouldbelaidon:
(a) The elimination of anomalies in the law, the repeal of obsolete and unnecessary laws and the simplificationandtranslationofthelaw;
(b) ThereflectioninthelawsofUgandaofthecustoms,valuesandnormsofUgandansocietyaswell as concepts consistent with the United Nations Charter for Human Rights and the Charter of Human and Peoples’ Rights of the Organisation for African Unity;
(c) The development of new areas in the law by making the laws responsive to the changing needs of the society in Uganda;
(d) The adoption of new or more effective methods or both for the administration of the law and dispensation of justice;
(e) TheintegrationandunificationofthelawsofUganda.
The Uganda Law Reform Commission comprises of the Commission and the Secretariat� The Commission comprises of the Chairperson and six part-time Commissioners� The Commission is primarily responsible for determining and formulating the scope and direction of the Commission’s work� The Commission Secretariat, which is headed by the Secretary, is structured on the basis of the aforementioned legal provisionsandhasthreedepartments:lawrevision,lawreformandfinanceandadministration;theformertwo comprising the technical/operations departments� These departments effect the provisions of the ULRC Act and the mandate as stipulated in section 25�
1.3 The Process of Developing the Strategic Plan
The Strategic Plan has been developed through a consultative process� Prior to the commencement of consultation, a desk review was undertaken in order to appreciate the nature of the institution, its current strategy and its application� Consultations were held with staff of all levels, with top management and with JLOS, the major funding body� A strategic planning workshop was held in Jinja 2-3 May 2011 attended by the Commission and top and middle management following which a draft strategic plan was developed and and the Final draft submitted to ULRC�

2.0 REVIEW OF THE STRATEGIC PERIOD 2005-2011
2.1 Review of the Identity and Culture of ULRC
TheVisionofULRCasatthecommencementoftheworkshopwas:“TocontributetotheexistenceoftheruleoflawinUganda”andtheMission:“Toreformandupdatethelawsinlinewiththesocial,culturaland economic needs and values of the people of Uganda”� The vision, mission and values of ULRC were reviewed� There were a number of issues with the current vision which included the vision not being compelling, inspirational or aspirational; it is not ambitious – it looks like it can be achieved; it is too open ended; it is not unique to ULRC; it is not a vision� A number of proposals were made and after protracted deliberations the agreed version was “Laws that are Responsive to the Needs of Society”� Thecurrentmissionwasagreedassoundandwasretained:“Toreformandupdatethelawsinlinewiththesocial, cultural, economic needs and values of the people of Uganda”� The values of ULRC were agreed to be impartiality, equity, professionalism, accountability & transparency� ThestrategicobjectivesofULRCduringtheperiodunderreviewwereareflectionofthemandateoftheCommissionasstatedinitsconstituentActandwereasfollows:
a) To eliminate anomalies in the law, to repeal obsolete and unnecessary laws�b) To simplify and translate the laws in action�c) ToreflectinthelawsofUgandathecustoms,valuesandnormsofsocietyaswellasconcepts
consistent with the United Nations Charter for Human Rights and the African Charter of Human and Peoples’ Rights�
d) To develop new areas in the law to make the laws respond to the changing needs of the society in Uganda�
e) To recommend for adoption of new or more effective methods for the administration of the law and dispensation of justice�
f) To integrate and unify the laws of Uganda� g) TostrengthenthecapacityoftheCommissiontoreviseandreformlawsmoreefficientlyand
effectively in a timely manner�
2.2 Elimination of Anomalies in the Law & Repeal of Obsolete and Unnecessary Laws
The action programmes mentioned in the strategic plan to attain this objective were taking an inventory of allregionalandinternationaltreatiesratifiedbyUgandaincludingtheirlegalimplications;andreviewingthe impact of the East African Community (EAC) laws on domestic laws�
The publication “How Our Laws are Made” was reviewed by the Commission in 2009 and a segment on international law was included to cater for the role of the EAC in the law making process following the mandate of the East African Legislative Assembly to make laws that are binding on members states� The handbook is ready for publication� In 2010, ULRC participated in the harmonisation of companies, partnership, insolvency and business registration laws at EAC level�
2.3 To Simplify and Translate the Laws in Action
The objective was to be attained by simplifying key laws focussing on three laws per year with the Local Council Courts Act as a priority� With regards to translation, the intended action was to translate laws in five local languages focussing on three key laws per year.Abridged versions of the EACpieces oflegislation were to be prepared�
Simplified and abridged versions of the Constitution and the Local Council Courts Act, 2006 werepublishedbytheCommissionandcopiesweredistributedinPader,Apac,LiraandGulu.Thesimplified

and abridged version of the Constitution was translated into Acholi and Langi and published� The public in the districts of Pader, Apac, Lira and Gulu were sensitised about the translations and copies were distributedtothem.AconsultanthasbeenprocuredtotranslatetheabridgedandsimplifiedversionoftheConstitution into Luganda�
The Local Council Courts Act has been translated from English into Luganda and the draft is ready for publication.TranslationsintoAtesoandNgakarimojongareon-going.Adraftabridgedsimplifiedversionof the Local Governments Act, Cap 243 has been prepared by the Commission and awaits pretesting�
2.4 To Reflect Customs, Values, Norms Consistent with Human Rights Instruments in the Laws of Uganda
The objective would be realised through participation in the update and harmonisation of domestic, regional and international laws�
The commission participated as part of the High Level Task Force of the EAC in the development of the draft criteria and procedures for the establishment of the EAC Customs Union, amendment of the EAC Treaty, and in the affairs of the sectoral council on Legal and Judicial Affairs�
2.5 To Develop New Areas in the Law in Response to the Changing Needs of the Society in Uganda
In order to attain this objective, the commission would undertake research and review legislation in criminal, social, land and family areas of the law targeting twenty pieces of legislation� Focus would be on torture, traffickinginhumansanddrugs,HIV/AIDS,reviewoftheChildren’sActandprocedurallaws.Advocacywould be undertaken for quick passage of the pending Bills with particular attention to the seventeen commercial laws and eight laws in criminal and social legislation� Research would be undertaken in the commercial and land areas of the law and policy proposals developed on legislative action to minimise the cost of doing business�
Advocacy and lobbying for quick passage of Bills yielded the result of principles of eleven commercial Bills being considered and approved by Cabinet (2006)�
The Copyrights and Neighbouring Rights Act was enacted in 2006 (though tabled as a private members bill, the draft bill prepared by the Commission was in line with the bill tabled in Parliament)� The Domestic Violence Act, 2010, Trade Secrets Act, 2009, Hire Purchase Act, 2009, Mortgage Act, 2009 were enacted� The Partnership Act, Contracts Act, Trademarks Act and the Computer Misuse Act were enacted into law in 2010�
2.6 To Recommend for Adoption New and More Effective Methods for the Administration of the Law and Dispensation of Justice
Strategic action programmes comprised of enhancement of public awareness on the law making process and thelawinaction;trainingcouncilsonbyelawsandordinancestargetingfivedistrictsperyear;researchingand making proposals to address legal impediments to access to justice� In addition, the Commission would review and develop key legislation targeting particular crimes especially organised crime; redesign jurisdiction for petty offences; introduce neighbourhood watch as a means of minimising the use of legislative sanctions as a mode of social control; and explore the use of alternative dispute resolution (ADR) mechanisms in criminal matters� Public education on EAC laws and Uganda’s international legal obligations; participation of ULRC in regional and international economic activities; and implementing regional, bi-lateral and international legal commitments by making proposals for domestication of such commitments would be undertaken�

ULRC completed a study on the arrest and detention of civil debtors and explored alternatives for enforcement of judgment debts in Uganda� A study on domestic violence was completed, a bill drafted and enacted as the Domestic Violence Act, 2010�
2.7 To Integrate and Unify the Laws of UgandaIn order to realise this objective, continuous law revision would be undertaken; specifically annualsupplements focussing on revision of subsidiary laws 2001-2004 and principal laws 2005-2006� A reprint of the 7th Edition of the Laws of Uganda would be prepared and a business law source book prepared� In addition, two compendia per year to be produced and published with particular focus on tax law and land law�
The revised principal laws 2001-2004 were prepared and published; the annual cumulative supplements were prepared� A compendium of electoral laws, 2006 was published; a compendium incorporating subsequent amendmentstotheelectorallawswaspublishedinthefirstquarterof2011.StatutoryInstruments2001-2004 were published� ULRC published, in 2006, a consolidated Constitution of the Republic of Uganda having incorporated and consolidated all amendments made to the Constitution since it was revised in 2000 and in 2005� Principal laws 2005-2007 were revised and prepared for publication� All amendments to the Local Government Act were consolidated and a reprint of the revised Local Government Act, Cap 243 was made and supplied to the Ministry of Local Government to facilitate access to the law by local governments� The Penal Code Act, Cap 120 has been revised and updated to take into accountthedevelopmentsinfinesandfinancialmattersandamendmentsrelatedthereto;publicationofthe reprint awaits approval of the Attorney General�
A compendium of selected commercial and investment laws was completed ready for publication (2006)� A compendium of tax laws was compiled in 2008� A compendium on land laws has been prepared�
Reprints of the Grey Book (laws relating to the courts, evidence, criminal law & procedure and civil procedure) incorporating all amendments to pertinent laws as at 30th September 2007 were issued� Reprints of the revised Constitution were made� The National Environment Act and regulations made under it were prepared and reprinted by the Commission�
The 4th, 5th, 6th volumes of Uganda Living Law Journal, a bi-annual journal for the consumption of the public, were published� Principal laws, subsidiary laws, study reports are available on the ULRC website www�ulrc�go�ug � The Handbook on Making Ordinances and Bye laws in Uganda was reviewed and reprinted as 2nd Edition, 2010�
2.8 Strengthen the Capacity of the Commission to undertake its tasks more Efficiently and Effectively in a Timely Manner
Theplannedactivitiesweremainlyrelatedtoprocurement:procurementofofficeequipment,oftransportequipment, establishing a resource centre, undertaking recruitment and continuous training of staff, and constructingandfurnishinganofficeaccessibletostakeholders.
Three vehicles were procured in 2006 that aided the Commission in carrying out its research, monitoring and evaluation activities� In 2006, 8 desktop computers, 3 laptops, a server and software were procured� Staff have been recruited periodically as and when vacancies arise�

2.9 Challenges Faced During the Strategic Period 2005-2011The challenges faced by the Commission cut across the various strategic objectives and thus have been dealt with collectively� The challenges which have consistently recurred year on year, must be taken into consideration in the next strategic period and solutions crafted to address them�
The challenges included cost of public consultations in terms of costs of fuel, vehicle maintenance and costs ofworkshops.The commission consults thepublic throughworkshops, seminars, themedia andfieldtrips.Thecostsofrentforofficesandstorageofprintedmatterisveryhighconsumingalmostaquarterof the Commission’s recurrent budget which impacts negatively on other activities� Due to the nature of the Commission’s work, urgent requests for unplanned assignments are received from Government agencieswhichresultsinadiversionofresourcesfromplannedactivities.TheCommissionfacesfinancialchallengesduetounderfundingintheGovernmentbudgetallocationleadingtoseverefinancialconstraintsincluding outstanding NSSF payments� The delay in tabling and passage of Bills into law hampers the Commissions work� Public education was noted as being costly� Delays in response time from Government agencies are a fetter to the Commission’s attempts to meet timelines for activities; the Commission cannot proceed with particular assignments until the response from the relevant agencies has been received�
Emerging issues invariousfieldsof the lawcall for specialistknowledgewhich isnotreadilyavailablewithin the Commission� The Commission is understaffed and faces problems of staff retention due to inadequate motivation� For a considerable period of time, the Commission did not have any part-time CommissionersgreatlyimpactingontheabilityoftheCommissiontofulfilitsmandate.
2.10 SWOT Analysis

• While a legislative tracking system is being developed to enhance the monitoring process, more emphasis is to be placed on advocacy and public education programmes� The public education istobuildsupporttodemandforidentifiedlegislationtobepassed.Awarethatlawsarenotpassed by the public, advocacy should therefore be targeted at the law makers�
• ULRC need to be more proactive in its advocacy and lobbying to generate quick response from government� The basis for any legislation should be packaged in the interest of Government�
• At the design of its plans the commissions needs to identify the human resource gaps and plan for outsourcing to avoid delays in implementation� At the same time the Commission needs to re-orient the new commissioners in their roles to provide strategic oversight to the commission�
• Transforming the resource centre into a modern facility�

Strategies: Research shall be undertaken to identify laws, regulations and procedures that require revision and translation in addition to consultation with key stakeholders to get their views on areas for revision of laws, procedures and regulation� The Commission will partner with key stakeholders in these processes�

Strategies:The Commission intends to have regular access to new laws, amendments to existing laws and court decisions and institute other timely processes for revision of laws� The current status of subsisting studies & projects will be established and timeframes set for fast-tracking completion of such studies & projects� The Commission shall research into laws that require consolidation; prioritise laws for reform and new areas for legal regulation while advocating for quicker enactment of laws� Consultative meetings shall be held and the Commission shall liaise with relevant national & regional institutions/organs including the EAC the Law Commissions of the other EAC countries�
