What are the guidelines issued by
Supreme Court on sun control film on
cars ? Is the use of black film banned or
any sun control film is banned or are
there any acceptable visual light
transmission limits ?
The use of black films are banned by the Hon’ble
Supreme Court of India. A copy of judgment in
I.A.Nos, 4, 5, I.A. Nos 6-8, I.A. Nos. 9-11, 12, 13, 14 and
15 in Writ Petition (Civil) No.265 of 2011 of Supreme
Court of India is enclosed herewith.
The use of black film is banned. There are
acceptable level of visual light transmission. For the
front and rear side the acceptable visual light
transmission is 70% and for the side the VLT is 50%.
What are the instructions given to
Hyderabad Traffic Police on checking
the usage of sun control film on cars ? I
observe that the Traffic Police are
writing challans irrespective of the visual
light transmission levels (VLT). In fact
they do not have any wherewithal to
find out what is the level of VLT of a film
?
As per the Hon’ble Supreme Court judgment. The
Hyderabad Traffic Police are writing challans, it is
clearly mentioned in the judgment copy that the use
of black film or any other material upon safety glass,
side glass windscreen is IMPERMISSIBLE. It is the VLT of
the safety glass without any additional material
being pasted upon the safety glasses which must
conform with manufacturer specification. The
Hon’ble Supreme Court has held that the
manufacturer of the vehicle may manufacture the
vehicle with Tinted Glasses which have Visual Light
Transmission of Safety glasses, front and rear wind
screens have 70% VLT and side glasses have 50% VLT
respectively. No black films or any material can be
pasted on wind screen and side glasses.
We have a Vilkswagen Vento car which
has been affixed with sun control film
within the permissible limits of visual light
transmission levels under Motor Vehicles
Act as explained to us by the company
while giving delivery. The film was
affixed by the company prior to delivery

Rao, Traffic Police stopped us on 19-01-
2013 at Basheerbagh cross roads. He
and the Inspector insisted that no film
should be there on the car glasses.
When we tried to explain them about
the film being within the MV Act limits,
we realized that they were not even
aware of VLT. They bluntly said, pay the
fine or we will not allow you to move
and take the vehicle into custody. To
say the least, the behavior of both
Mr.P.S. Rao and the Inspector was
barbaric.
MV Act and compounded Rs.900/-. The allegations
made by the applicant regarding are far from true.
The Inspector and SI are aware of the rule position
and they have implemented the orders of the
Hon’ble Supreme Court in true spirit.

Our answer : Hyderabad Traffic Police are using Sony
Digital Cameras for capturing the traffic violations on
the field which don’t have features embedded and
imprinted of the date and time on the violation
photo. The date and time can view from the image
properties and it is a permanent record. It is a clear
evidence shown in the photograph of jumping on
red light signal.
You have asked above question subsequently we
have answered the same.
Once again we are enclosing the certified copy of
violation photograph taken on 25-08-2012 at time
16.24 at Sangeeth X Road under Tr.PS Gopalpuram
limits, which is taken by the Sony Digital Camera.

Even if the said digital camera does not
have tha ability to embed the date and
time stamp on the image captured for
traffic violation (as claimed by the
Hyderabad Traffic Police), still, the

image file and is available for those
who has access to the same.
All the relevant information connected
to the image file are stored in the
image properties of that image file and
such information so stored in the image
file are no way connected to/nor
influenced by the ability/inability of the
camera to embed the date and time
stamp in the image captured
connected to the traffic violation.
It is already informed that, date and time stamp is
embedded in the image properties of violation
photo and same was provided to you.
The information requested in para.I vide
Ref.(1) is not connected to the
embedding and imprinting of the date,
time stamp on the violation image by
the digital camera used by the
Hyderabad Traffic Police.

As per the Motor Vehicle Act, 1988 and A.P. Motor
Vehicle Rules 1989 Police Officer of and above the
Rank of Sub-Inspector of Police is authorized to
compound the offences. As per the instructions of
Commissioner of Police/Addl.Commissioner of Police,
Traffic, Hyderabad and as per the judgment of
Hon’ble Supreme Court of India vie W.P. (Civil)
No.265 of 2011 clearly given judgment in Para 24. We
are really not emphasizing on the security threat to
the society at large by use of black films but it is a
clear violation of law. In terms of Rul1 100, no
material including films of any VLT can be pasted on
the safety glasses of the car and this law is required
to be enforced without demur and delay. Thus we

1) All the applications filed for clarification and

violation for the vehicle AP10AQ6270 is
deemed to be available with the
Hyderabad Traffic Police, since 25-08-
2012 at time 16:24 hrs.
Copies of the rules, regulations,
procedure by which Hyderabad Traffic
Police is allowed to send e-challan by
post for jumping signal even without
attaching the relevant traffic violation
photo pertaining to the vehicle which is
claimed by the traffic police, to have
jumped the signal.
Hyderabad Traffic Police is implementing the rule for
signal jumping under R 436/177 of MV Act and fine
amount is being collected as Rs. 200/-. There are two
type of enforcement one is contact (direct)
enforcement where the violator is caught on the
field and issue spot challan and collected fine
amount immediately.
Second one is Non- contact enforcement where
violations are captured through cameras and
through the RTA address data base e-challans are
being sent to the concerned vehicle owners through
post vide under Section 133 of MV Act. All violations
photos are kept with Hyderabad Traffic Police and
whenever violators request for violation photo, the
same will be provided to them. The violator has to
pay the fine amount at the e-seva / AP Online
centers and fine amount will be remitted in the AP
State Govt. Treasury directly.

the concerned officer will be counseled him. After
attended counseling, the violator vehicle should be
released at Police Stations after collected fine
amount.
If the person not having sufficient money to pay the
compounding fee, the vehicle original documents
will be sent to Traffic Compounding Booth, where the
violator can paid the amount and collect the
documents.

1) All the applications filed for clarification and
modification are dismissed, however,
without any order as to costs.
2) All the Director Generals of Police/Commissioners

in its true spirit and substance. They shall not
permit pasting of any material, including films of any
VLT, on the safety glasses of any vehicle.

implementing the Rule and requested all the vehicle
owners/drivers to get all Black Films pasted on the
side glasses and front and rear wind screens,
removed immediately to avoid inconvenience in
future, after giving adequate time and giving vide
publicity in all print and electronic media. The traffic
police has been implementing this rule after getting
orders from the Director General of Police.
When anyone willfully disobeys the direction
given by the Hon’ble Supreme Court the section of
law, i.e., 179 M.V. Act and 184 M.V.Act has been
added. As per the chapter V rule 92 CMVR 1989 and
207 M.V. Act the vehicles can be detained of they
did not pay the compounding amount.
As per the Motor Vehicles Act, 1988 and as
per rule 447 to 450 A.P. motor 1989 police officer of
and above the rank of Sub-Inspector of police is
authorized to compound the offences and has the
authority to detain the vehicles (as explained
above). It is not necessary to get orders to implement
the Act against the violators as it is clearly
mentioned in the act and the rules.

the camera details was deemed to be
available with the Hyderabad Traffic
Police, since 25-08-12 at time 16:24.
With reference to your question of your letter, dt.09-
11-2012, we have provide the information as follows:-
Q.No.1. A detailed report / explanation containing
cogent reasons for the date and time stamp not
being embedded in the photo.
Ans: Hyderabad Traffic Police are using Sony Digital
Cameras for capturing the traffic violations on the
field which don’t have features embedded and
imprinted of the date and time on the violation
photo. The date and time can view from the image
properties and it is a permanent record. It is a clear
evidence shown in the photograph of jumping on
red light signal.
You did not requested the camera make,

model and manufactured year at that time.
Moreover you have requested on 27-12-2012 for the
camera make, model and year, subsequently we
have provided the same on 24-01-2013. However, a
copy of the same is enclosed.

It is certified that, no software’s or tools are used to
tamper or alter the image properties of the violation
photo which was provided to you.

by the Public Information Officer, for

The Hyderabad Traffic Police clearly provided the

We have already informed that, no software’s or
tools are used to tamper or alter the image
properties of the violation photograph. It is an official
arthritic information was provided and certified that
violation photograph is genuine and not have been
manipulated or alteration in the photograph. It is was
already justified in information provided earlier.
If no information / record(s) is / are
available for some / all / part of the

vide Ref.(1) is solely connected to the
non-appearance of/non-availability of

details(Make:Sony,Model:DSC-W210,
Year:2008) in the image properties
provided vide Ref.(3).
In your letter of dt.19.11.2012 para-1 question the PIO
have provided the exact information as you have
requested in your question. There is no deviation
either misleading not unrelated reply to your sort of
information.
The information requested in para.1
vide Ref.(1), is solely connected to the
information stored in the image
properties of the image file.
The violation Date and Time information has been
recorded in the image properties and the same was
requested by you on your letter dt.09.11.2012 and
provided the same on dt.09.12.2012.
Even if the said digital camera does not
have tha ability to embed the date and
time stamp on the image captured for
traffic violation (as claimed by the
Hyderabad Traffic Police), still, the
camera details as well as the date and
time stamp are always stored in the
image properties of the concerned
image file and is available for those
who has access to the same.
The violation photos will be kept with Traffic Police
only. Whenever the violator requested for violation
photo we will provided to them. In your case also,
firstly you have requested for violation photo which
was provided to you.
All the relevant information connected
to the image file are stored in the
image properties of that image file and
such information so stored in the image
file are no way connected to/nor
influenced by the ability/inability of the
camera to embed the date and time
stamp in the image captured
connected to the traffic violation.
It is already informed that, date and time stamp is
embedded in the image properties of violation
photo and same was provided to you.

Ref.(1) is not connected to the
embedding and imprinting of the date,
time stamp on the violation image by
the digital camera used by the
Hyderabad Traffic Police.

The information requested in Para.1,
Vide Ref.(1) is not connected to the
ability/inability of the digital camera

delay / non – availability of the image
properties of the photo vide Refs. [1,2]
for a gap of nearly 3 months and 14
days and was provided the same was
deemed to be available with the
Hyderabad Traffic Police, since 25-08-
2012 at time 16:24 and was not
provided with the letter no.
TrT8/3269/RTIAct/2012 Dated: 22-09-
2012, wherein only the photo without
image properties was provided to
another RTI applicant.
Answer: There was no delay or non availability of the
image of violation recorded on 25-08-2012 at time
16:24 hrs. which was provided to the above
complainant on 09-12-2013 vie Lr. No. TrT8/3269/2012.
A complainant by name Sri. T. Prasanna
Rajan has requested for the violation photograph
vide his letter dt. 08-09-2012 the same was provided
to him vide this Officer Lr. No. TrT8/3269/RTIAct/2012,
dt. 22-09-2012
Further it is to inform that, above complainant
submitted a complaint under RTI Act on 24-09-2012
and received by Office on 25-09-2012. For this
complainant, information was provided vide this
Office Lr. No. TrT8/3407/2012, dt. 24-10-2012 (Copy
enclosed). As per the above complainant request on

Further it is informed that, violation
photograph was provided to Sri. Prasanna Rajan on
22-09-2012 and same violation photograph along
with image properties was provided to above
complainant Sri. T. Sampath on 09-12-2012, both are
the same photographs which was taken on 25-08-
2012 at 1624 at Sangeet X Road by the same SONY
Camera. As per above complainant request, we
have taken image properties of the above
photograph and provided to them.

provides indisputable and conclusive
evidence of the traffic offence of
Jumping signal on 25-08-2013 at 1624 at
Sangeet X Road under Goplapuram
Traffic Police Station limits based on
which e-challan were issued to the
owners of the vehicle number AP 11 AJ
1375, AP 09 CK1728 and AP 10 AQ 6270.
Note: Refer to the decision of the
Supreme Court, placed on record in
page no. 2 of his notices with regard to
the admissibility of recorded evidence
in a court of law.
genuine and certified copy of above said violation. It
was clearly informed that, above violation
photograph was neither manipulated not altered for
creating a e-challan and sent to the vehicle owners
of AP 11 AJ 1375, AP 09 CK1728 and AP 10 AQ 6270.
Above complainant has mentioned in his
letters, some of software links are available, which
can be used for alter or manipulate image
properties, etc., these are not concern with this
Department.
Hyderabad Traffic Police is clearly informed
that, we never used above alteration softwares and
these are not at all required for the Department.
Being a Government organization,
Hyderabad Traffic Police never use such type of
manipulating softwares.
Question – 3: If a no cogent
explaination / report is available for
para 1, para 2 then detailed report /
explaination for the official, disciplinary
actions taken on the concerned
officials, staffs for malafidely penalizing
the vehicle owners of AP 11 AJ 1375, AP
