The 267th meeting of the State Expert Appraisal Committee (SEAC) was held on 15th January, 2016 under the Chairmanship of Dr R.B. Lal for discussion on the query responses submitted by the PP and the projects / issues received from SEIAA. The following members attended the meeting-

The Chairman welcomed all the members of the Committee and thereafter agenda items were taken up for deliberations.

1. Case No. - 3986/15 Shri Madan Lal Grover R/o Civil Lines, P.O. & District-Katni (MP)-483501 Prior Environment Clearance for approval of Limestone & Dolomite Mine in an area of 9.84 ha. (50,000 TPA) at khasra No.-79/1, 79/2, 81, 82, 83, 88, 91, 93, 95, 103, Vill.-Salaiya Paharhai, Tehsil-Vijayraghogarh, District-Katni (MP) The case was scheduled for presentation today but PP had requested for postponement of presentation. The case was deferred for considered 16/01/2015 if time permits after all the scheduled presentation.

2. Case No. - 4006/15 Shri Dilip Jain R/o Paras Colony, P.O. & District-Satna (MP)-485001 Parasrampur White Earth Mine in an area of 4.995 ha. (10,000 cum/year) at Khasra No.-512/2, Vill.-Parasrampur, Tehsil-Maihar, District-Satna (MP) Neither the Project Proponent (PP) nor his representative was present to explain the query which might be raised or to make any commitment which may be desired by the committee during the deliberation. Committee decided to call the PP in subsequent meetings after hearing from PP. A request has to be made by the PP for scheduling the case in coming meetings within a month’s time after which the case shall be returned to SEIAA assuming that PP is not interested to continue with the project.

3. Case No. - 4038/15 M/s Mahaveer Bricks Industries, Smt. Ashadevi Shitlani, Thakur Baba Road, Tehsil-Dabra, District-Gwalior (MP)-474001 Magroura Soil Quarry Lease Area - 2.560 ha., Capacity - 4800 cum/year, at Khasra No.- 1146, 1147, 1148, Vill.- Magroura, Tehsil-Dabra, District-Gwalior (MP)

This is case of Soil quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra No. - 1146, 1147, 1148, Vill. - Magroura, Tehsil-Dabra, District-Gwalior (M.P.) 2.560 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. Q2-02/13 dated: 12/08/2015 has reported that there is 01 more mine operating or proposed within 500 meters around the said mine with total area of 3.467 ha including this mine. The case was presented by the PP and their consultant wherein it was observed that National highway is at a distance of 20 meters it being a soil quarry, the case was considered. The EMS and other submissions made by the PP were found to be satisfactory and acceptable, hence committee decided to recommend the case for grant of prior EC subject to the following special conditions in addition to the standard conditions at annexure ‘A’:

• Production of Soil as per mine plan with quantity not exceeding 4,800 cum/year. • National highway is approx. 20 meters away from the ML area thus additional row

of plantation should be provided towards roads side.

4. Case No. -4045/15 Smt. Rukmani Devi Shukla R/o Kunjanpura, Tehsil-Datia, District-Datia (MP)-475335 Prior Environment Clearance for approval of Stone Quarry in an area of 2.50 ha. (30,000 cum/year) at Khasra no.-80/3, Village-Pachara, Tehsil-Datia, District-Datia (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-80/3, Village-Pachara, Tehsil-Datia, District-Datia (MP) 2.50 ha. The project requires prior EC before commencement of any activity at site.

or proposed within 500 meters around the said mine with total area of 40.850 ha including this mine. The case was presented by the PP and their consultant. It being a case of cluster where the total area is > 25 ha it was decided to consider this case as B-1 category and committee recommended to issue standard TOR prescribed by the MoEF&CC for conducting the EIA.

5. Case No. -4046/15 Smt. Mahadevi Shivhare R/o Sharma Farm Road, Shivaji Colony, Char Sahar ka Naka, Tehsil-Dabra, District-Gwalior (MP)-474001 Prior Environment Clearance for approval of Stone Quarry in an area of 1.563 ha. (30,000 cum/year) at Khasra no.-234/3, Village-Gangapur, Tehsil-Dabra, District-Gwalior (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-234/3, Village-Gangapur, Tehsil-Dabra, District-Gwalior (MP) 1.563 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. Q2-93/10 dated: 14/07/2015 has reported that there are 01 more mines operating or proposed within 500 meters around the said mine with total area of 3.549 ha including this mine. The case was presented by the PP and their consultant. During presentation it was observed that the site is just (approx.100 meters) away from the existing Billaua cluster as per the co-ordinates provided by the PP. The committee after deliberations decided to issue TOR for which PP also agreed. PP has also given a written commitment for this at the time of presentation and also agrees to become the member of Billaua Stone Crusher’s Association. The PP should submit the necessary association’s letter for the same.

6. Case No. 4070/15 Shri Om Prakash Rai R/o P.O. Maihar, District-Satna (MP)-485771 Prior Environment Clearance for approval of Barahiya Limestone Mine in

an area of 2.017 ha. (17,600 MTPA) at Khasra no.-206, 128, 204, 214, 133, 134, 126, 127, 205, 212, 213, Village-Barahiya, Tehsil-Maihar, District-Satna (M.P.) (TOR)

The case was presented by the PP and their consultant. It being a case of major mineral, it was decided to consider this case as B-1 category and committee recommended to issue standard TOR prescribed by the MoEF&CC for conducting the EIA along with following additional TOR’s:-

1. Inventory of operating / proposed mines within 2 Km around the said mine. 2. Inventory of all sensitive receptors in 2 Km & 5 Km around the mine. 3. Evacuation Plan on a map to be provided with transport route, required

infrastructure and man-power. 4. Any alternate route avoiding the nearby habitations.

7. Case No. 4087/15 Shri Ramdayal Patidar R/o Village-Takrawad, Tehsil-Malhargarh, District-Mandsaur (MP)-458339 Prior Environment Clearance for approval of Stone Quarry in an area of 2.00 ha. (5,000 cum/year) at Khasra no.-2 & 7, Village-Sokadi, Tehsil-Malhargarh, District-Mandsaur (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-2 & 7, Village-Sokadi, Tehsil-Malhargarh, District-Mandsaur (MP) 2.00 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 1457 dated: 8/9/2015 has reported that there are 02 more mines operating or proposed within 500 meters around the said mine with total area of 12.0 ha. including this mine The EMS and other submissions made by the PP were found to be satisfactory and acceptable, hence committee decided to recommend the case for grant of prior EC subject to the following special conditions in addition to the standard conditions at annexure ‘A’:

• Production of Stone as per mine plan with quantity not exceeding 5,000 cum/year.

Case No. 4090/15 Shri Arun Kumar Agrawal S/o Shri Shayamsundar Agrawal R/o Village-Bamhni Banjar, Tehsil-Nainpur, District-Mandla (MP)-481776 Prior Environment Clearance for approval of Stone Quarry in an area of 1.00 ha. (expansion in production capacity from 5,000 to 6,000 cum/year) at Khasra no.-564, Village-Kajarwada, Tehsil-Nainpur, District-Mandla (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-564, Village-Kajarwada, Tehsil-Nainpur, District-Mandla (MP) 1.0 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 910 dated: 4/09/2015 has reported that there are 05 more mines operating or proposed within 500 meters around the said mine with total area of 6.30 ha including this mine. The case was presented by the PP and their consultant. During presentation it was observed that a water body is located approximately 500 meters away from the QL area. After presentation, PP was asked to provide:

• Compliance report of M.P. Pollution Control Board consent conditions from regional officer, as the case is off expansion in production capacity.

• The “cumulative and degradation” details at the end of 05 years are mentioned as 0.54 ha in EMP which is not according to lease area of 1.00 ha. PP was asked to submit revised details duly approved by competent authority.

• No maps attached with the mine plan are signed by the competent authority. PP was asked to submit production map duly signed by the competent authority.

9. Case No. 4091/15 Smt. Sangeeta Agrawal C/o Shri Arun Agrawal, Village-Bamhni Banjar, Tehsil-Nainpur, District-Mandla (MP)-481776 Prior Environment Clearance for approval of Stone Quarry in an area of 4.00 ha. (expansion in production capacity from 7,500 to 25,000 cum/year) at Khasra no.-8/2, 8/3, & 10, Village-Chandiyamal, Tehsil-Nainpur, District-Mandla (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-8/2, 8/3, & 10, Village-

Chandiyamal, Tehsil-Nainpur, District-Mandla (MP) 4.00 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vides letter no. 906 dated: 4/09/2015 has reported that there are no more mines operating or proposed within 500 meters around the said mine. The case was presented by the PP and their consultant. During presentation it was observed that a village road is only 05 meters away from the QL area and thus committee decide that a setback of 25 meters be left from the QL area excluding the 7.5 meters mandatory buffer zone. After presentation, PP was asked to provide:

• Compliance report of M.P. Pollution Control Board consent conditions from regional officer, as the case is of expansion in production capacity.

• The “cumulative and degradation” details at the end of 05 years are mentioned as 0.67 ha in EMP which is not according to lease area of 4.00 ha. PP was asked to submit revised details duly approved by competent authority.

10. Case No. 4093/15 Shri Ram Singh S/o Shri Tej Singh Thakur R/o R-8, Nikhil Kunj Sundar Nagar, Tehsil-Burhanpur, District-Burhanpur (MP)-450331 Prior Environment Clearance for approval of Stone Quarry in an area of 2.00 ha. (expansion in production capacity from 2,000 to 11,520 cum/year) at Khasra no.-655, 656, Village-Bahadarpur, Tehsil-Burhanpur, District-Burhanpur (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-655, 656, Village-Bahadarpur, Tehsil-Burhanpur, District-Burhanpur (MP) 2.00 ha. The project requires prior EC before commencement of any activity at site.

or proposed within 500 meters around the said mine with total area of 3.0 ha including this mine.

The case was presented by the PP and their consultant. During presentation it was observed that a hostel is only 200 meters away from the QL area and thus committee decide an additional row of plantation be provided towards hostel side and no blasting be allowed as submitted by the PP. It was also observed as per the Google image based on the co-ordinates provided by the PP that the QL area is only 04 kms away from Maharashtra State. Since the cumulative area within 500 radius of this mine is <5.00 ha (As per Mining Officer vide letter no.-1443, dated: 14/08/2015) the general conditions are not applicable in this project as per GOI Notification No. S.O. 2731 (E) dated 09/09/2013 and thus the case was considered as B-2 category.

After presentation, PP was asked to provide:

• Compliance report of M.P. Pollution Control Board consent conditions from regional officer, as the case is of expansion in production capacity.

11. Case No. 4094/15 Shri Som Prakash, Director, M/s Som Projects Pvt. Ltd., D-09,

HIG Colony, Indore (MP)-452008 Prior Environment Clearance for approval of Stone Quarry in an area of 4.00 ha. (Stone-66,229 & Murrum-14,677 cum/year) at Khasra No. 131/1/1/2 at Village-Rangwasa, Tehsil-Depalpur, District-Indore (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra No. 131/1/1/2 at Village-Rangwasa, Tehsil-Depalpur, District-Indore (MP) 4.00 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 1820 dated: 19/8/2015 has reported that there are no more mines operating or proposed within 500 meters around the said mine.

The EMS and other submissions made by the PP were found to be satisfactory and acceptable, hence committee decided to recommend the case for grant of prior EC subject to the following special conditions in addition to the standard conditions at annexure ‘A’:

• Production as per mine plan with quantity not exceeding for Stone 66,229 & and for Murram 14,677 cum/year.

• A village road is about 40 meters away from the QL area thus a setback of 10 meters be left from the ML area in addition to the 7.5 meters mandatory buffer zone and additional row of plantation should be provided towards roads side.

12. Case No. 4095/15 Shri Rakhab Chand Jain, R/o Village-Agar Malwa, Tehsil & District-Agar Malwa (MP)-465001 Prior Environment Clearance for approval of Stone Quarry in an area of 4.00 ha. (30,000 cum/year) at Khasra No. 581 at Village-Majania, Tehsil-Shajapur, District-Shajapur. This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra No. 581 at Village-Majania, Tehsil-Shajapur, District-Shajapur (MP) 4.00 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 1071 dated: 31/8/2015 has reported that there are 09 more mines operating or proposed within 500 meters around the said mine with total area of 15.550 ha including this mine The EMS and other submissions made by the PP were found to be satisfactory and acceptable, hence committee decided to recommend the case for grant of prior EC subject to the following special conditions in addition to the standard conditions at annexure ‘A’:

• Production of Stone as per mine plan with quantity not exceeding 30,000 cum/year. • National Highway is about 200 meters away from the QL area thus PP may erect a

barrier wall of 03 meter height of suitable material.

13. Case No. 4096/15 Shri Jitendra Sharma S/o Shri Kailash Narayan Sharma, R/o Birghanpura, Tehsil-Bhind, District-Bhind (MP)-477001 Prior Environment Clearance for approval of Soil Quarry in an area of 1.62 ha. (1,760 cum/year) at Khasra no.-59, 60, 61, Village-Chandrapura, Tehsil-Bhind, District-Bhind.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 8409 dated: 18/8/2015 has reported that no more mines operating or proposed within 500 meters around the said mine.

The EMS and other submissions made by the PP were found to be satisfactory and acceptable, hence committee decided to recommend the case for grant of prior EC subject to the following special conditions in addition to the standard conditions at annexure ‘A’:

• Production of Soil as per mine plan with quantity not exceeding 1,760 cum/year

14. Case No. 4097/15 Shri Nirmal Kumar Naredi S/o Shri Ramesh Naredi, 1, Ashta Road, Tehsil-Kannod, District-Dewas (MP) Prior Environment Clearance for approval of Stone Quarry in an area of 1.00 ha. (1,000 cum/year) at Khasra no.-756, Village-Nanasa, Tehsil-Kannod, District-Dewas (MP) This is case of Stone quarry. The application was forwarded by SEIAA to SEAC for appraisal. The proposed site is located at Khasra no.-756, Village-Nanasa, Tehsil-Kannod, District-Dewas (MP) 1.00 ha. The project requires prior EC before commencement of any activity at site.

PP has submitted a copy of approved Mining Plan, letter from Mining Officer certifying the leases within 500 meters radius around the site and requisite information in the prescribed format duly verified by the Tehsildar and DFO. Concerned Mining Officer vide letter no. 1185 dated: 7/7/2015 has reported that there are 05 more mines operating or proposed within 500 meters around the said mine with total area of 7.6 ha including this mine. The case was presented by the PP and their consultant. During presentation it was observed that as per the Google image based on co-ordination provided by PP, the site

location is not matching with PP’s actual site and PP denied that the site belongs to him. Thus PP was asked to provide revised co-ordinates duly authenticated by the competent authority for appraisal.

The committee decided that the case may be sent back to SEIAA for necessary action.

The case was presented by the PP and their consultant and during presentation it was observed that no co-ordinates are mentioned either in mine plan or in surface plan attached with the mine plan and committee was unable to ascertain the location of QL area. Thus PP was asked to submit the co-ordinates of QL area duly verified by the competent authority.

1. The amount towards reclamation of the pit and land in MLA shall be carried out through the mining department. The appropriate amount as estimated for the activity by mining department has to be deposited with the Collector to take up the activity after the mine is exhausted.

2. PP shall be responsible for discrepancy (if any) in the submissions made by the PP to SEAC & SEIAA 3. Transportation of material shall be done in covered vehicles. 4. Necessary consents shall be obtained from MPPCB and the air/water pollution control measures have to be installed as per the

recommendation of MPPCB. 5. Curtaining of site shall be done using appropriate media. 6. The proposed plantation should be carried out along with the mining @45 trees per hectare and PP would maintain the plants

for five years including casualty replacement. 7. Transportation shall not be carried out through forest area. 8. Appropriate activities shall be taken up for social up-liftment of the area. Funds reserved towards the same shall be utilized

through Gram Panchayat. 9. PP will take adequate precautions so as not to cause any damage to the flora and fauna during mining operations. 10. The validity of the EC shall be as per the provisions of EIA Notification subject to the following: Expansion or modernization in

the project, entailing capacity addition with change in process and or technology and any change in product - mix in proposed mining unit shall require a fresh Environment Clearance.

Annexure- ‘B’

Standard conditions applicable for the sand Mine Quarries*

1. The amount towards reclamation of the land in MLA shall be carried out through the mining department; the appropriate amount as estimated for the activity by mining department has to be deposited with the Collector to take up the activity after the mine is exhausted.

2. PP shall be responsible for discrepancy (if any) in the submissions made by the PP to SEAC & SEIAA. 3. Plantation shall be carried out on the banks for stabilization of the banks. 4. The mining activity shall be done manually. 5. Heavy vehicles shall not be allowed on the banks for loading of sand. 6. The sand shall be transported by small trolleys up to the main transport vehicle. 7. Transport vehicles will be covered with taurpoline to minimize dust/sand particle emissions. 8. For carrying out mining in proximity to any bridge and/or embankment, appropriate safety zone on upstream as well as on

downstream from the periphery of the mining site shall be ensured taking into account the structural parameters, location aspects, flow rate, etc., and no mining shall be carried out in the safety zone.

9. No Mining shall be carried out during Monsoon season. 10. The depth of mining shall be restricted to 3m or water level, whichever is less. 11. No in-stream mining shall be allowed. 12. The mining shall be carried out strictly as per the approved mining plan and ensure that the annual replenishment of sand in

the mining lease area is sufficient to sustain the mining operations at levels prescribed in the mining plan. 13. Established water conveyance channels should not be relocated, straightened, or modified. 14. If the stream is dry, the excavation must not proceed beyond the lowest undisturbed elevation of the stream bottom, which is

a function of local hydraulics, hydrology, and geomorphology. 15. After mining is complete, the edge of the pit should be graded to a 2.5:1 slope in the direction of the flow. 16. PP shall take Socio-economic activities in the region through the ‘Gram Panchayat’. 17. EC will be valid for mine lease period subject to a ceiling of 5 years.
