The candidate filing period for established party candidates seeking nomination at the 2018 General Primary was conducted November 27 – December 4. I am happy to report that the filing process conducted at the Springfield office again went very well, and the agency received many compliments to the efficiency and professionalism exhibited by all staff members. Several staff members helped with planning and training for this filing period, and as a result we had an excellent showing throughout the entire process. All staff should be commended for their help and great attitude while helping with filing and scanning petitions. On the first day of filing, all 478 of the opening hour filers were processed by 11:00 a.m. Most of the orders for copies were processed and filled before leaving on the first day of filing, and the remainder was completed early on November 28 th. Our initial goal was to complete scanning and orders on the first day of filing, but the additional volume of filers combined with the large size of statewide and judicial petitions prevented this from happening.

Legislative Proposals 2018
1. In-kind contributions: The change in 9-10 would put the burden of reporting in-kind contributions firmly on committees. Basically, the language says that if the recipient (committee) of an in-kind contribution does not receive the required notification from the contributor within 5 business days, the date of receipt becomes the next (6th) business day. This means committees will have to take a more proactive approach by contacting contributors to get the information they need to report the in-kind, and they can no longer just sit back and wait for the notification – even if it takes weeks or months to arrive. If they are unable to get the in-kind information, they will have to report it using their best estimate and amend later. This is the cheesecake rule.
2. Vote Centers: This legislation was drafted by the County Clerk’s Association in 2017 with
changes made by the Senate Democrat Staff. Additional jurisdictions added by the SBE.
3. Restrict Petition Filings: Municipal, Township and Community College petition filings will now file petitions with their local election authority (not the municipal or township clerk or the community college secretary). Michael George is drafting
4. Restrict Electoral Boards: Restrict electoral boards to the State Board of Elections and local election jurisdictions only. Eliminate municipal, township, park, etc. We are basing our legislation on House Bill 2474 from the 2017 legislative session introduced by Rep. Wheeler. We are enhancing the legislation by not only limiting the electoral boards, but by specifically outlining the members of the electoral board and the reasons one can be excused from duty.
5. E-mail requirements on D-1: The change to 9-3 would make an email address part of the
required committee information as well as requiring phone and email address for committee officers. It’s nothing we’re going to punish anyone for omitting, but having these required would let us lean a little more on the committees that don’t include this important contact information.
6. Revise (or repeal) 7 day calendar: This would create a 2-week blackout period for candidate
related complaints prior to an election. It would also create a set of standards for determining if a complaint is frivolous and mandate a fine for filing of a frivolous complaint. It would also prevent anyone with an unpaid fine for a frivolous complaint from filing any further complaints. Finally, it would apply ballot forfeiture to a candidate fined for a frivolous complaint.
7. Contributions in the name of another: Add penalty for knowingly accepting and retaining
anonymous contributions in the name of another. We moved criminal penalties for violations of certain Article 9 violations to Article 29. Complaints of such violations are often filed with the SBE but belong wit the local state’s attorneys.
8. Increasing thresholds: Raise filing threshold from 5K to 7.5K. The idea is to eliminate low $ “ma and Pa” type committees from the CFA system. Such committees often inadvertently or unwittingly file late or incomplete reports, cannot afford a lawyer and are usually broke and unable to pay civil penalty assessments from committee funds.

9. Non-candidate PACS: Non-candidate PACS cannot be subject to ballot forfeiture for failure or refusal to pay civil penalties. The SBE should be permitted to involuntarily dissolve such non-candidate committees. This may “encourage” prompt payment of penalties (as opposed to futile collection efforts).
10. Article 28: Clean up language for statewide constitutional questions. As a result of SB 172, Article 28 must be amended to reflect random sampling taking place at the SBE and not the local election jurisdictions. This will also effect the filing process. This is crucial as we believe a constitutional amendment petition drive is currently taking place regarding property taxes.
11. Contribution Limits – Moving from race to race: an unexpected issue related to contribution limits arose that requires attention. What happens when a candidate in a race where the contribution limits have been lifted switches to a race where the limits remain in place? Specifically, what happens to contributions already received above the normal limits when the candidate changes races? We are currently working with the House Democrat staff on this language
12. Audits of political committees; Sen. Nybo is introducing SB 2223 which requires that the audit cover the period of 2 years “from the close of the most recent reporting period.” We are going to add language to this bill that audits only be conducted on those committees that 1) have a fund balance of $10,000 or more or 2) have average total receipts of $4,000 or more. This will help ensure that smaller committees who are unable to afford the cost of an audit would be exempt.
13. Write-in declarations for statewide offices to file with the SBE: This initiative was first discussed at our April Board Meeting. Additional conversations then took place with the Advisory Committee to solicit feedback and additional options. The LOA’s all agreed that statewide offices could be filed with the SBE, but they would rather local declarations continued to be filed in their offices.
14. Continuing Appropriations: Creates the State Board of Elections independent funding law. Even if no appropriation is approved by the General Assembly, the SBE will be granted appropriations from all sources that are no less than the total appropriations from the previous fiscal year.
15. Township Code Changes: 1) the Township Code was changed so as the caucus is now the first Tuesday in December, which could be as early as December 1 in a given year (60 ILCS 1/45-10). The Multi-Township Caucus would be the first Wednesday in December (60 ILCS 1/45-25). The primary is 2019 will be February 26; the primary in 2021 will be February 23. 45 days before February 1 will always be December 18. As long as township caucuses are held in December this will be a problem. Therefore, 10 ILCS 5/7-43 (c.5) needs to be changed; and 2) Line of succession for township office. Currently there is no succession place except to hold a committee of the whole. No paychecks can be given, etc. No bills paid. A succession plan needs to be put in place.
16. Pensions: Allows newly hired SBE employees into the Tier III defined contribution plan.
17. Slating of Judges: Amend Section 7-7 to include authorization to create managing committees for circuit court and judicial district court vacancies in nomination.

18. Ballots on Hand: Limit the amount of ballots on hand on Election Day when a large percentage
of the voters already voted early. Still drafting:
1. Electioneering Communication: move the date from 60 days before the General to 120
2. Self-funding: Currently if the self-funder does not file the notification, there is no penalty, this would add a penalty
3. Committee naming: add enforcement
4. Amending reports: if the amended report is over a certain percent from the original report, the original report would be viewed as a non-fling and penalties would occur
5. Contribution limit violations: Currently, there is a 30 day window, this would move the date of violation to date contribution is received
6. Adding a violation to the list of prohibited expenditures: cannot use campaign funds for your personally owned business
7. Raffles: move to the Department of Revenue
8. Loans: Loans to a committee have a written agreement; add language mandating loams made from a committee have a written agreement
9. Election cycle: clarify the election cycle for special elections
10. Disclaimers: penalty for no disclaimers (paid for by/a copy of our report)

Section 12A-5 of the Election Code [10 ILCS 5/12A-5] requires the Board to publish an Internet Voters’ Guide (the Guide) prior to each general election. This Section further provides that the Board, at its discretion, may publish such Guide in relation to a general primary election. The Guide was published for the 2014 and 2016 General Elections, it was not however, published for the 2016 General Primary. It is not a statutory mandate and the Board did not feel it would be a worthwhile endeavor of staff resources. We are asking the same for the 2018 General Primary. Staff would be needed to produce the Guide, particularly the IT staff, which is currently tasked with several mandates related to Automatic Voter Registration, as well as duties related to the ongoing petition filing/objection period and it expected to be so committed during the time in which the guide would need to be produced. Therefore, we are requesting authorization to exercise the statutory discretion to not publish the guide for the upcoming 2018 General Primary Election. We will, of course, publish the guide for the 2018 General Election as required by law. Thank you for your attention to this request.
