I write this article the week of the largest mass shooting in United States history. I was up early on Monday morning with a sick child, when the news alerts were saying 2 people had been killed and around 20 injured in Las Vegas. Unfortunately the numbers continued to rise. I have no great insight to share about this tragedy and, even if I did, this article would not be the time or place to share. I am struggling more than usual with what I want to share with you in this article. But I keep coming back to the thought that each of us should use our limited time on this planet well. I’m very fortunate because I’ve had the opportunity recently to see so many people doing just that, living well and making a great impact in the lives of others.
Since my July article, the SMBA and the SMBF have been busy and I’ve had the privilege of witnessing many people doing great things. I had the privilege of attending Judge Brent Powell’s Investiture Ceremony and was so happy and proud to see many individuals from Springfield and Southwest Missouri in attendance. Jodi Larison, an SMBA member and former Judge Powell law clerk, was one of the speakers and did an outstanding job. I also had the privilege of representing the SMBA at the Naturalization Ceremony held at MSU. It
was wonderful to see Judge Harpool welcome 60 new citizens to this country. It is so uplifting to see so many individuals thrilled to become citizens of this country. I would encourage each of you to attend a naturalization ceremony for an instant “feel good” moment. On a perfect September morning, I attended the Bearister Legal Run Around. I walked instead of running and enjoyed a donut after for my efforts so it was a great morning. I was a little intimidated by the MSU women’s track team practicing during our race, but I admired their athleticism and said a silent prayer of thanks I am finished with college. To cap off September, I had the honor of participating in the Greene County courtroom dedication ceremony and in welcoming Judge Jerry Harmison as the newest judge in the 31st Circuit. It was awesome to see the overflow crowd for Judge Harmison’s ceremony and to hear the heartfelt words of friendship (with a little ribbing mixed in) from Greg Pearman and Judge Mark Powell.
It doesn’t appear things will be slowing down for the end of the year. Kris Barefield’s office will host a Wine and Cheese Event for Sustaining Members on November 3. It is not too late to become a Sustaining Member and register to attend. Triviae Nox at the Fairbanks will be on November 10. You still have time to register. I hope to see you there as Lathrop & Gage tries to win for a second year in a row and the rest of us try to ensure that doesn’t happen. Voting for the 31st Circuit Judicial Commission vacancy will occur on October 13-November 3. New Clerk of Probate Court
Effective September 1, Kimberly Bryan is the new Clerk of the Probate Division. Debby Edgar retired on August 31st after 38 years of service to the State of Missouri! Please direct all future correspondence to Kimberly Bryan and feel free to stop by our office and welcome Kim to her new position.
Courtroom Dedication
The 31st Judicial Circuit dedicated two new courtrooms in a ribbon cutting ceremony Thursday, September 28, 2017. Presiding Judge Thomas Mountjoy thanked the many people involved in the project and the efforts that went into maintaining business as usual for the courts
during the construction process. Ginger Gooch, President of the Springfield Metropolitan Bar Association, presented an American flag, installed in the new division 3 courtroom and led those present in the pledge of allegiance. Greene County Presiding Commissioner
Bob Cirtin and Commissioner Harold Bengsch joined Judge Mountjoy in the ribbon cutting portion of the ceremony.
The project spanned nearly twelve months and required extensive renovation of adjoining spaces including the victim witness office, and relocation of the Greene County Prosecuting Attorney’s Office to Cox Medical Tower late last year.

The Administration of Oath and Robing Ceremony of the Honorable Jerry Harmison as associate judge of the 31st Judicial Circuit, Division 21 took place September 29, 2017 in the ceremonial courtroom at the Greene County Judicial Facility. Presiding Judge Thomas Mountjoy administered the oath to Judge Harmison before a standing room only crowd of lawyers, judges, friends and family.

Missouri lawyers residing in Greene County are eligible to vote for the election of a lawyer member of the 31st Circuit Judicial Commission and may do so now through midnight November 3, 2017. All lawyers eligible to vote should have received notice by email. Revised Court Rules
The 31st Judicial Circuit published a revised version of local court rules, effective October, 2017. All attorneys practicing in the 31st Circuit are encouraged to familiarize themselves with the local rules, which are available online at greenecountycourts.org. A great way to get up to speed is by attending the November SMBA Bar Brew where Judge Ron Carrier will present Local Court Rules Jeopardy.

Since it’s inception in 2003 the Springfield Metropolitan Bar Foundation has supported community projects aligned with the mission and created projects in areas that were not already addressing foundation priorities. This issue of the Bar News highlights some of those programs as well as those individuals who helped propel the mission from concept to community impact. Last year we added September’s Bearister Run and our Triviae Nox to the calendar. Designed to raise fun and raise funds, these events go one step further. Each highlights the efforts and impact of foundation programs and simultaneously raise awareness of the foundation’s charitable and educational mission. The Bearister Run took place Friday September 22 with runners gathering as the sun was rising. The event brought together lawyers, runners and lawyer-runners for a bit of fun, fitness and friendly competition. It was a great race and fun event thanks to our runners, sponsors boosters and volunteers. The race name and location at Missouri State University showcased and promoted the collaboration between the bar foundation and the university in the creation of the Bearister Program Our upcoming Triviae Nox at the Fairbanks provides another opportunity to build support and showcase the work of our foundation while raising funds, funs and awareness. The concept of a Trivia event as the signature fundraiser for the foundation was conceived years ago. Last year, inspired by our foundation Fairbanks AD project, Triviae Nox got off the drawing board and on the calendar. Triviae Nox at the Fairbanks is an opportunity to see the transformative effect that vision and compassion can have on our community. Acquired by Amy Blansit in 2013, the Fairbanks has experienced a metamorphosis from a forgotten, decrepit school to a vibrant community center, changing lives for the better along the way. Come and see for yourself, and show your smarts for a good cause at Triviae Nox November 10.

2005: Love Them, Don’t Leave Them Wondering – Healthcare Directive Clinics2010 National Conference of Bar Foundations Excellence of Public Service Programming Award The first clinic drew a standing room only crowd of 240. Ten years later, the bar continues to mobilize volunteers annually on National Healthcare Decisions Day and more than 2,000 people have received assistance.
2007: Constitution Day and Lyceum Lecture SeriesLectures, forums and activities designed to encourage the exchange of ideas and increase interest and awareness in tangible manifestation and theoretical constructs of our legal system. Lectures hosted by the Springfield Metropolitan Bar Foundation have included former U.S. Attorney General John Ashcroft, former United States Senator John Danforth and James Silkenat, Past President of the American Bar Association
2008 Sus Derechos2008 NABE Lexis Nexis Community and Educational Outreach AwardThe bar foundation conducted bilingual public forums on immigration, employment and general law. Forums were held in conjunction with seminars for business and community leaders on complementary topics through the Springfield Area Chamber of Commerce.
2015 Magna Carta Project 2016 NABE Lexis Nexis Community and Educational Outreach AwardThe Springfield Bar and its community partners hosted a total of twenty-four Magna Carta related events in seven local venues and a national traveling exhibit. This community collaboration directly touched 4,000 people
2015 Mini Law School for the PublicFor many years the Missouri Bar has partnered with law schools and libraries to bring this unique opportunity to residents of St. Louis and Kansas City. In 2015, with support of the Springfield Metropolitan Bar Foundation, mini law school came to the Queen City. The initial success insured that the program will continue to be offered each year for the foreseeable future.
2016 Missouri State Bearisters2017 NABE Lexis Nexis Community and Educational Outreach AwardLegal issues are not always understood or addressed by overwhelmed students, many of whom are dipping their toe into the adult world for the first time. Bearisters are volunteer lawyers who meet with Missouri State students for limited consultation and referral. Bearisters help students stay on track and focus on their studies by preventing small issues from becoming big problems.
2016 Fairbanks ADThe Fairbanks AD Project provides residents of the Grant Beach neighborhood advice and referral to help them overcome legal and administrative impediments preventing economic security and family stability. Multigenerational poverty has resulted in a cycle in which residents have the potential to be employed and improve their lives, but lack the resources and social capital to remove barriers to stable employment and stable lifestyles.

Missouri Judiciary Wines Award for Technology
The Missouri Judiciary received a “Top 10 Court Technology Solutions Award” during the National Association for Court Management’s (NACM) annual conference, held in partnership with the International Association for Court Administration, in Washington, D.C., in July. The awards were presented to recognize the best use of technology to improve court services and access to the public in 2017. “It’s an incredible honor to be acknowledged by the judging panel selected by the Joint Technology Committee to evaluate technology solutions being implemented by courts around the world,” said Gary Lynch, a judge on the Missouri Court of Appeals, Southern District, and chair of the Missouri Court Automation Committee.
SMBA Members Selected for MoBar Leadership Academy
Three SMBA young lawyers have been selected for the 2017-18 Missouri Bar Leadership Academy: Austin Fax, Lowther Johnson; Jody Larison, United States Attorney’s Office; and Jacob Lewis, Strong-Garner-Bauer, P.C. will participate in the class of 13 emerging leaders. The Missouri Bar’s Leadership Academy mission is to recruit, train and retain recently admitted Missouri lawyers for leadership positions within The Missouri Bar. The academy is offered to Missouri lawyers who are less than 40 years old or who have been admitted to practice for 10 years or fewer, with an emphasis on diversity of ethnicity, culture, gender, area of practice and region within the state. Members of each year’s class participate in The Missouri Bar Annual Meeting, Board of Governors meetings, spring and fall committee meetings and workshops specifically designed for the Leadership Academy. For one year, the class works closely with bar leaders to learn more about The Missouri Bar, cultivate leadership skills and develop a public service project, which the class takes full responsibility for completing before the end of the class year. At the end of the year, members commit to serve the bar in an active capacity for two years.
SMBA Member Makes 2017 Most Influential Women List
For almost two decades, Springfield Business Journal has honored women in southwest Missouri and the 2017 class of Most Influential Women brings the count to 360 professionals. Amanda Tummons, of Husch Blackwell, was one of 20 women chosen for this year’s class. The award recognizes the accomplishment of women in their careers, civic leadership and influence. The awards were presented at luncheon October 13.
Six SMBA Members Receive Up and Coming Award
Missouri Lawyers Weekly has named the 2017 list of Up and Coming Lawyers. Fifty eight lawyers from across the state were selected based on their demonstration of excellence and their potential to make a difference in the legal profession and their communities. The awards recognize lawyers who are 40 or younger or who are within their first 10 years of practice. The award recipients were honored at a luncheon on Friday, Oct. 6 in St. Louis. I first wrote to you about what I believe to be “Our Bar Association’s Best Kept Secret,” almost two years ago. That “secret” as you may recall is the Springfield Metropolitan Bar Foundation (SMBF). Recently, I had the honor of traveling to New York City for the American Bar Association’s annual meeting. At that meeting it was my privilege to accept on behalf of the SMBF the LexisNexis Community and Education Outreach Award from the National Association of Bar Executives. The award honored the SMBF’s groundbreaking Bearisters program. It was also the second year in a row that the SMBF received this award (last year for Happy Birthday Magna Carta) and the third time in less than ten years (in 2008 for Sus Derechos). This most recent national recognition of the SMBF and its important work reaffirmed for me that the SMBF is truly our bar association’s best kept secret. Although with continued national recognition, perhaps it’s not quite a secret anymore. The Bearisters program is a joint partnership between the SMBF and Missouri State University (MSU). The program reaches out to the more than twenty-five thousand students that attend MSU, and allows students seeking personal legal advice to meet with a local volunteer attorney free of charge. Our bar association’s members volunteer for scheduled time slots and meet with students who have scheduled appointments to discuss their legal matters. The students’ appointments are coordinated through the Dean of Students Office. I mentioned the Bearisters program in a prior Bar Bell to you and noted that I was confident Bearisters would “join the ranks of the Foundation’s previous notable projects.” I’m pleased to report that, not only has the project joined the SMBF’s ranks of notable projects, it has also joined the ranks of the SMBF’s national-award winning projects. But most importantly, it has joined the ranks of SMBF projects that are truly making a difference for the people they help. Of course, the SMBF could not continue its important work in our community without the support of its donors, attorney volunteers, and community partners. I’d like to take this opportunity to thank the SMBF, every attorney who has volunteered for the Bearisters program, and especially thank MSU President Cliff Smart, MSU Dean of Students Thomas Lane, and MSU Assistant to the President Ryan DeBoef for their efforts in making Bearisters a reality. Without the
considerable support of everyone who partnered to make this program possible, Bearisters would never have materialized and developed into the successful community outreach program that it has become. Of course our greatest thanks belongs to our executive director, Crista Hogan, who works expertly and tirelessly on all foundation and SMBA projects.As its community projects demonstrate, the SMBF serves as the outreach arm of the SMBA. It helps raise awareness of our bar association and has insured that the SMBA has a voice in community discussions and debates on important issues. The work of the SMBF, however, is not, and will never be, done. And so, the work of the SMBF progresses. Our community outreach continues with Fairbanks AD: Advisors and Advocates—a collaboration between the SMBF, the SMBA, and the Fairbanks Project. That program gives an opportunity for local lawyers, especially young lawyers, to provide area residents with advice and resources to resolve conflicts and address legal issues. The Advisors and Advocates program works to assist local citizens in combatting the effects of multigenerational poverty. The SMBF is also working to add additional legal and financial education programs targeted at school-age children in neighborhoods that are too often underserved by our community’s resources. As you can no doubt deduce, every SMBF program requires the robust support of volunteer attorneys. There would be no important community outreach accomplished, no persons assisted or lives changed, and no national awards without the dedicated work of attorney volunteers. So I hope each of you reading this will consider supporting the SMBF by volunteering your time. All it takes is a phone call or email to the SMBA office to get started, and the staff there will be happy to provide you with volunteer opportunities and schedules. I would also like to take this opportunity to thank each and every person who has already volunteered to be a part of and participate in any of the SMBF’s community projects. Without your support and generous commitments, SMBF’s goals of protecting civil liberties, enhancing the public’s understanding and respect for the rule of law, and providing public service and equal access to the legal system would not be possible. As we enter the third quarter of 2017, barreling on towards 2018, I encourage each of you to take a moment to consider the truly important work of the SMBF and to find your place in it.

In 2015, the Springfield Metropolitan Bar Foundation partnered with the Missouri Bar to start a Mini Law School in Springfield, Missouri. The Springfield Mini Law School is a six-week program that educates non-attorneys on a variety of legal topics, the legal profession, and how the legal system may affect the participants, either directly or indirectly. Classes average over forty-students; some students return annually while some students are new to the program each year. Age and life experience of the students vary widely—from college students interested in attending law school to retirees with a general interest in the legal system. This range of background creates a productive classroom experience, as students benefit both from the expertise of the presenters and the insight of their peers. In 2009, St. Louis lead the way with the first Missouri Mini Law School; they continue to hold a program each spring and fall. Since that time, Mini Law Schools have occurred in Kansas City (2015), Mid-Missouri (Columbia and Jefferson City, 2014-2017), Cape Girardeau (2016-2017), and Malden (2017). Each location plans and presents their own unique program; no two Mini Law Schools are the same. The Springfield Mini Law School does not function like traditional law school—presenters do not call on students and ask for the issue of the case, there are no reading assignments, although reading materials are provided, and there are no exams. However, students do receive a diploma for attending all sessions as a recognition of their commitment to understanding our legal system. Each year the class topics differ so that graduates of a prior year’s program can find continued value in participation. Some of the classes provide meaningful context: introduction to the legal system, the Dred Scott Decision, and Constitutional law, for example. While some classes are pragmatic, providing information on estate planning, family law, real estate transactions, etc. The mixture of topics allow the students to gain a well-rounded perspective of their relationship, directly or indirectly, to the legal system. Far too often, the only time an individual interacts with the legal system is during a stressful time in their life: divorce, death, contract dispute,
personal injury, bankruptcy, criminal matter, etc. This limited interaction between attorneys and the public influences a person’s perception of the legal system, and often imparts a negative feeling. Those students who attend the Mini Law School are offered an alternate perspective through the lens of practitioners. Students are encouraged to ask questions. Although specific legal advice on individual situations is not offered, avenues to obtain appropriate legal counsel are provided as needed. Recognition is in order for the SMBA planning committee, Crista Hogan at the SMBA, and Farrah Fite at the Missouri Bar for their time in preparing and implementing the Mini Law School year after year. A special thank you to the presenters who volunteer their evenings to share their expertise and answer students’ questions during the program. The first three years of the Springfield Mini Law School have been a great success, providing a foundation for the next program scheduled to begin in September of 2018.
