What is theSpecial Immigrant Visa (SIV) program?

The Afghan Allies Protection Act of 2009, Section 602(b), authorizes the issuance of up to 1,500 Special Immigrant Visas (SIVs) annually through September 30, 2014 to Afghan nationals who have worked for or on behalf of the U.S. Government in Afghanistan and who meet certain requirements. The Act opens the SIV application process to Afghan employees and contractors who have been employed by or on behalf of the U.S. Government in Afghanistan on or after October 7, 2001, for a period of one year or more, and who have experienced or are experiencing an ongoing serious threat as a consequence of that employment. The program ends on September 30, 2014. NOTE: This new program is the “SQ” SIV Program. It is completely distinct from another program (“SI”) authorizing special immigrant visas for certain Iraqi and Afghan translators or interpreters working for the USG.

Who can apply for theSpecial Immigrant Visa (SIV) program?

Under the Afghan Allies Act, Afghan nationals may apply for the program if they meet the following requirements:

• The applicant must be a national of Afghanistan;

• The applicant must have been employed by, or on behalf of, the Government of the United States of America in Afghanistan on or after October 7, 2001, for a period of one year or more;

• The applicant must have provided faithful and valuable service to the U.S. Government, which is documented in a letter of recommendation from his/her supervisor; and

• The applicant must have experienced or be experiencing an ongoing serious threat as a consequence of his/her employment by the U.S. Government.

Who does NOT Qualify for theSpecial Immigrant Visa (SIV) Program?

Work performed for NATO, ISAF, or non-U.S. Coalition Forces, when contracted directly through NATO or ISAF Headquarters, or another country’s government, does not qualify under the Afghan Allies Act of 2009. Also, USAID Grantees are not eligible under this program. Applicants are welcome to apply, but contracts will have to be reviewed at the time of application to determine the funding source of their work.

A Word About the “Threat Statement”

All applicants for the SIV program must have experienced, or are currently experiencing an ongoing serious threat to their life as a result of work performed for the U.S. government. Applicants must submit a written Threat Statement as part of the application process. Threat Statements MUST include specific and detailed information. A general fear of what will happen in Afghanistan after the U.S. military withdrawal is not sufficient.

How to Get StartedTo start your application, submit an application package to the National Visa Center in the United States. The application package must be submitted by email to AfghanSIVApplication@state.gov.

Include the Following Documents in your Application Package:

1. Verification of Employment (including dates worked and location) from your Human Resources (HR) office.

2. At least one (1) Letter of Recommendation from your direct U.S. Citizen supervisor. If your supervisor is aware of your threat, s/he should include it in his/her letter.

3. A Combined Biographic Statement and Threat Statement 4. Evidence of Afghan Nationality (Tazkera or Passport) 5. DS-157 Application Form 6. Copy of Employment Badge (if available)

The ProcessThe Afghan Special Immigrant Visa process is a multi-step process involving multiple government agencies and offices, including U.S. Citizenship and Immigration Services (USCIS) and the Department of State. The amount of time to complete the process varies for each applicant. Depending on the complexity of the applicant’s case, the process, from start to finish, may take one to two years to complete.

1. Applicants submit their application packets via e-mail directly to the National Visa Center (NVC).

2. Once NVC has all of the required documents, the SIV Committee in Kabul, Afghanistan reviews the case and recommends approval or denial based on the information provided in the application packet. If approved, the committee will issue a Chief of Mission Letter through the NVC.

3. The applicant will receive the approval or denial notification from the National Visa Center by e-mail.

4. If the Chief of Mission Letter is approved, the applicant will file the I-360 petition with the USCIS Nebraska Service Center. Again, this petition is scanned and filed electronically. USCIS will review the petition and make a decision within 14 days of receipt.

5. If the I-360 petition is approved, the USCIS Nebraska Service Center adjudicates I-360s and forwards approved petitions to the NVC.

6. The NVC processes the approved petition, schedules an interview with the Kabul consular section (or other embassy or consulate if requested), and forwards the packet to the Consular Section. The NVC will also provide information on how to schedule your medical exam.

7. The Immigrant Visa Unit interviews each applicant and any eligible family members, such as your spouse or children. Any immediate family member planning on immigrating with you should come to the Consular interview with you. Additional Administrative Processing will be required for all SIV cases.

What Family Members are Included?Your spouse and any unmarried children (under the age of 21) can accompany you on the SQ Special Immigrant Visa. Each family member will need his or her own visa and will require an interview at the U.S. Embassy or Consulate. Extended family members, such as siblings, parents, or cousins are NOT allowed to accompany you on this type of visa. Adopted children do not meet the definition of “child” for the purpose of this visa and are NOT eligible for a visa.

NOTE: While often accepted in Afghanistan, having more than one wife (polygamy) is illegal in the United States of America. If it is discovered that you are married to more than one person, you and your family will be ineligible to receive visas.

At the InterviewUpon your arrival at the embassy or consulate, you will complete biometric processing. This includes fingerprints, photograph, and iris scanning.

You will be interviewed by a Consular Officer to ensure that you qualify for the SQ SIV program. The interview can take anywhere from 10 minutes to two hours, depending on the complexity of your case and the size of your family.

When the Visa is ReadyOnce the visa is ready, you will be contacted to pick up the documents at the Embassy or Consulate. All SQ SIV visas MUST be used within 90 days of issuance. If you do not travel within the 90 day validity period your visa will expire. The Consular Section may be able to reprint the visa, but no guarantees are made.

IMPORTANT: Do not quit your job, sell your personal property, or make travel arrangements before your visa has been issued.

Follow to Join Family MembersThe Consular Section strongly recommends that all eligible family members attend the visa interview at the same time. Additionally, due to the limited timeframe of the SQ SIV program, it is recommended that all family members travel together to the United States, as soon as the visa is ready.

Termination and ResignationApplicants who have resigned their job with the U.S. government in good faith, due to family, personal, or medical reasons, or who have been downsized as part of restructuring may still be eligible for the visa.

Applicants who have been terminated or fired from a job may not be eligible for the visa. In this case, the applicant should include information in their application package explaining why they were terminated.

Administrative ProcessingApplicants sometimes require additional screening to determine whether they are eligible for the visa. The term “administrative processing” refers to various additional checks that must be done before their visas can be issued.

At the same time, the Consular Section must ensure that applicants are both qualified for the visa and do not pose a security risk to the United States of America. Administrative Processing can take many months to complete.

TimeframeAs the program currently exists, all SQ Special Immigrant Visas MUST beissued by September 30, 2014. Applicants are encouraged to apply as soon as possible. Under the current legislation, only 7,500 principal applicant visas are allowed to be issued during the life of the program.

Resettlement BenefitsAll Afghan and Iraqi recipients of Special Immigrant Visas (SIV) are eligible for the same transportation, resettlement assistance, entitlement programs, and other benefits as refugees admitted under the U.S. Refugee Admissions Program (USRAP), for a period not to exceed eight months.

The U.S. Department of State funds voluntary agencies to provide reception and initial integration services during the SIV recipients’ first weeks in the U.S. through the Reception and Placement (R&P) Program. This program constitutes a small part of the overall refugee benefits package.

Beyond the R&P Program, SIV recipients are eligible to receive up to eight months of cash and medical assistance through the Department of Health and Human Service’s Office of Refugee Resettlement (HHS/ORR). 1. Finding employment will be one of your first goals when you arrive. It is important to learn English, but equally important to accept the first reasonable job that becomes available. Being in a workplace provides an excellent opportunity to practice speaking English. The sooner you begin working, the sooner you will be able to pay your own living expenses. Many families find that both husband and wife must work in order for the family to become economically self-sufficient.

2. Your first job in the U.S. will probably not be in the same profession or field as your job back home. It may be an entry level non-professional job, and may even be temporary or part-time. You may eventually find a job in your field after you establish a work history in the U.S., gain proficiency in the English language, and obtain any required recertification or training. Until then, entry level employment is the best way to learn about the American workplace and build experience that will be appreciated in the future.

3. You will be referred to an employment program and assisted with finding a job no matter where you are resettled.

4. Because of the current U.S. economy, it may take longer than usual to find a job. Also, full-time or permanent positions may be harder to obtain.

5. Your resettlement agency and its federal and local government partners have limited resources to meet your immediate basic needs upon arrival. The amount of resources available to you will depend on a variety of factors. Early employment and wise budgeting of money are crucial for your early self-sufficiency.

6. The cost of living and availability of public support varies throughout the U.S. The assistance that is provided to you will not be equivalent from one place to another. If your friends in one U.S. location tell you they are receiving certain benefits, this does not mean that you will receive the same benefits.

7. Moving to another location will affect your resettlement benefits, as will refusing to go to your assigned U.S. destination. The resettlement agency in the new location may not be able to provide the same level of services and/or cash assistance. Before planning to relocate, be sure to discuss the idea with your agency.

8. There is no preferential treatment for SIV beneficiaries or refugees who worked for the U.S. Government. Eligibility for resettlement benefits and services is not affected by nationality, race, religion or gender.

9. You do not need to pay anyone - friends, relatives, or any agency - to sponsor you in the U.S.

10. You will begin to repay your travel loan within six months of your arrival in the U.S.

11. The initial assistance you receive for housing, household supplies, and furniture is very basic. Many items such as clothing and furniture may be used, secondhand, or very inexpensive, but all items provided will be clean and hygienic.

12. The U.S. Government requires the resettlement agencies to provide basic household goods and furnishings. This does NOT include luxury items such as: TVs, radios, telephones, DVD players, computers, vacuums, bicycles, cars, or air conditioners. These items may be available if the agency receives them as donations from other sources.

13. Apartments are the most accessible and affordable form of housing for many Americans, and this is what you should expect for your first home in the U.S. Single individuals may be placed with another single person of the same gender to better afford living expenses. If you choose to do so, and respecting any lease agreement you may have signed, you may move after you start working and can afford the housing of your choice.

14. Public health care coverage is limited; dental or eye care may not be covered. It may take weeks to see a doctor for a routine appointment, although critical health needs will be met in a timely manner. Once you become employed and can purchase private medical insurance, your health care options will increase.

15. There is no stigma attached to mental health or psychosocial services in the U.S., and you should take advantage of these services if they are available and you think that they would help you. Your resettlement agency sponsor will assist you in finding appropriate health care services.

16. Your first year in the U.S. will be a period of adjustment. You will be living in a new community, adhering to new laws, working in a new job, and making new friends. For the first few months, your resettlement agency staff will assist you in your efforts to rebuild your life and will do their best to help you become economically self-sufficient as soon as possible.

17. The U.S. consists of people of different racial and ethnic backgrounds, and the resettlement agencies that help refugees are equally diverse. Your case workers may be of any race, religion, ethnicity, or gender, and they have your best interest in mind.
