GUIDELINES FOR LISTING AND REGISTRATION OF SUPPLIERS UNDER

SECTION 180(m) WATER SERVICES INDUSTRY ACT 2006

1. INTRODUCTION

Any supplier who wishes to supply equipment, device, material, system or

facility (collectively called as product) for water supply and sewerage system

in Peninsular Malaysia, Wilayah-Wilayah Persekutuan Putrajaya and Labuan

is required to be listed or registered with SPAN prior to carrying out such

activities.

2. DEFINITION

For this purpose, a supplier refers to company incorporated in Malaysia (sole

proprietorship, partnership, limited partnership or corporation) that has been

established to offer goods and/or services.

3. PRODUCT CATEGORY

Registration of supplier will be classified in accordance to two (2) main

product categories as listed below:

Category A -

-

Products that can undergo full certification to any SPAN

recognised standards/specifications from any

Certification Bodies recognised by SPAN. Products under this category and the respective

approved standards are listed in Appendix I.

4. APPLICATION FOR LISTING/REGISTRATION OF SUPPLIER

4.1 Application

Effective 6 February 2013, application for listing or registration of suppliers for

products under category A and category B shall be made via on-line supplier

e-registration at SPAN website.

4.2 Certificate of Conformity Application for products in category A shall be accompanied with a copy of

certificate of conformity issued by SPAN recognised certification bodies to

show that product has complied with product standard.

4.3 Certification Body

SPAN only recognises certificates produced by certification bodies which are

accredited by Standard Malaysia under the Accreditation of Certification

Bodies (ACB) Scheme and other international certification bodies recognised

by Standard Malaysia through the Pacific Accreditation Cooperation (PAC)

Category B -

-

Products without any specific standards/specifications or

product with standards for test compliance that can

undergo performance testing by any accredited test

laboratory recognised by SPAN.

Products under this category and the respective

approved testing standards/requirements are listed in

Appendix II.

and International Accreditation Forum (IAF) Multilateral Recognition

Arrangement (MRA).

List of accredited certification bodies recognised by SPAN can be referred to

at Standard Malaysia website at www.standardmalaysia.gov.my or at

www.apec-pac.org for certification bodies under the PAC MRA as well as at

www.iaf.nu for certification bodies under the IAF MRA.

4.4 Test Report

Application for products under category B shall be accompanied with test

report to show compliance to the testing standard/requirements (e.g.

performance requirement of a product) as determined in Appendix II. Test

report to be submitted for this purpose shall be the original copy and is written

either in English or Bahasa Malaysia. Report in other languages shall be

translated into either in English or Bahasa Malaysia before the submission to

SPAN.

4.5 Testing Laboratory

SPAN only accepts testing report produced by testing laboratories which are

accreditated by Standard Malaysia under the SAMM scheme and other

international testing laboratories recognised by Standard Malaysia through the

International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition

Arrangement (MRA) and International Accreditation Forum (IAF) Multilateral

Recognition Arrangement (MLA). List of accredited testing laboratories can

be referred to at Standard Malaysia website.

4.6 Certified True Copy of Certificate

Copy of certificates (e.g. product certificate, HALAL certificate) shall be

certified as a true copy by any of the following bodies:

(i) the certification body that produces the certificate

(ii) Commission of Oath

5. APPROVAL FOR LISTING OF SUPPLIER AND PRODUCT UNDER CATEGORY A

5.1 Listing of Supplier

Any application under category A which has been approved will be listed in

the “Listing of Supplier” at SPAN website.

5.2 Confirmation Letter

Confirmation letter to confirm the listing will be issued to the supplier.

5.3 Responsibilities of Supplier

All listed supplier under this category shall be responsible to ensure his

product certificate is continuously maintained and valid throughout the listing

period.

5.4 Maintaining Supplier’s name in the Listing

Any listed supplier under this category is required to submit a copy of

renewed product certificate on yearly basis in order to maintain his company

and his product in the listing. Failing to comply with these requirements may

lead to an automatic delisting of the supplier without prior notice.

6. APPROVAL FOR REGISTRATION OF SUPPLIER AND PRODUCT UNDER CATEGORY B

6.1 Certificate of Registration

Any application under category B which has been approved will be given a

Certificate of Registration.

6.2 Validity of a Registration Certificate

The validity period of certificate of registration will be determine by SPAN and

shall be valid for a period of not less than one year and not more than three

years from the date of issuance.

6.3 Listing at the SPAN website

The approved supplier will be listed in the “List of Registered Supplier” at

SPAN website.

6.4 Responsibilities of a Registered Supplier

All registered supplier are responsible to adhere to all approval conditions as

listed in the certificate of registration. Failing to comply with any of the

conditions may lead to termination of registration.

6.5 Renewal of Certificate

Every application for renewal of certificate shall be made online not later than

three months before the end of the expiry date.

7. PROCESSING TIME

7.1 Product Category A

When a completed application is received by SPAN, the processing time for

listing of supplier at SPAN website and issuing confirmation letter will be

completed within 3 working days.

7.2 Product Category B

For application which does not involve pilot project, certificate of registration

will be issued to the approved supplier within 21 working days.

8. FEE

No fees are imposed for the application of listing or registration of supplier at

this moment.

9. USE OF SPAN LOGO

Use of SPAN logo is allowed for marketing purpose on product catalogue in

the form of hard and electronic media and subject to the following conditions:

(i) the logo cannot be printed on product to be supplied;

(ii) the logo must be printed with listing or registration number; and

(iii) SPAN logo cannot not be defaced, obstructed, misused, forged,

falsified or altered.

11. OFFENCE FOR GIVING FALSE OR MISLEADING INFORMATION

SPAN wish to highlight that it is an offence under Section 130 of the Water

Services Industry Act 2006 for “a person who discloses or provides

information to the Commission or its authorized officers that he knows or has

reason to believe is false or misleading commits an offence and shall, on

conviction, be liable to a fine not exceeding two hundred thousand ringgit or to

imprisonment for a term not exceeding two years or to both.”
