DearChairmanPhillipsandDivisionChiefBlankinship,MorethantwodecadesagoswordfishintheWesternAtlanticwereinserioustrouble.Theaveragelandedweighthaddroppedtoapproximately60pounds,swordfishwereoverfishedandoverfishingwasoccurring.Conservationeffortstorecoverthespecieswerediverseandwidelysupportedatthegrassrootslevel,includingadrivetoinformlocalchefsoftheproblemandplacardsdisplayedinrestaurantsthatdidnotserveswordfish.Thepublicrespondedforcefullytotheplightofswordfishandtodayanglerspointtotherecoverywithprideasasignificantconservationvictory.TheinitialproblemwiththefisherywasthattoomanyjuvenileswordfishweredyingduetolongliningoffthecoastofFloridaandtheCharlestonBump.Asaresult,thosenurseryareaswereidentifiedandclosedtotheUnitedStatespelagiclongline(PLL)fleetin2001.Thesedomesticmeasuresprovedtobesuccessful,anditdidnottakemanyyearsbeforethescientificwingofInternationalCommissionfortheConservationofAtlanticTunas(ICCAT)declaredtheWesternAtlanticswordfishtoberecovered.Unfortunately,eversincethefisherywasdeemedrecovered,therehavebeenill-conceivedattemptstoreopentheclosedareastocommercialharvestandexposeittothetypesofintensecommercialfishingpressurethatdroveitintoanoverfishedconditioninthefirstplace.Undertheguiseofresearch,Dr.DavidKerstetterhasfiledhissecondapplicationinlessthanayearforafederalexemptedfishingpermittointroducelongliningintotheEastFloridaCoastPelagicLonglineClosedArea–thisoneunderthenameofacompanyheformedinDecember2017,FloridaFisheriesSolutionsLLC.TheEFPwouldauthorizePLLvesselsownedorassociatedwiththeco-applicant,DayBoatSeafoodInc.,tofishinthe
EastFloridaCoastPLLClosedAreaforuptothreeyears.DayBoatSeafoodwouldbeallowedtosellallthelegalfishcaughtunderthispermit.In2017,theNationalMarineFisheriesService(NMFS)approvedasimilarEFPapplicationbyKerstetter.However,asaresultofpublicpressureregardingtheexpectednegativeimpactstotheconservationzone,NovaSoutheasternUniversitywithdrewtheinstitution’snamefromthepermitwhichforcedKerstettertorevisehispermitapplicationandreapplyunderhisnewlyformedLLC.FloridaFisheriesSolutionsLLCisnowtheonlyaffiliatedorganizationonthere-filedpermitandiscertainlynotan"accreditedinstitution."WeappreciatetheopportunitytoprovidecommentonthisEFPandconveytoyouthatourorganizationsseenolegitimateneedfortheproposalandhaveagreatdealofconcernonthepotentialimpactsoftheproposedresearch.AsimilarEFPwasconductedbyKerstetterfrom2008-2010whichpreformedroughly180totallonglinesets,with132ofthosesetsintwoclosedareas–theCharlestonBumpandtheEastFloridaCoastPLLClosedArea.Inthatpermit,48setsperyearweredeemedsufficientforscientificpurposes.ThecurrentEFPfiledbyKerstetterandDayBoatSeafoodwouldbeallowedtomake3,240longlinesets(1,080peryear),ofwhich2,160wouldbeinjusttheEastFloridaCoastPLLClosedArea.Thattotals22timestheamountdeemednecessarytobescientificallysufficientunderthepreviouspermit.Usingthebycatchratesgeneratedbytheroughly180longlinessetsduringthe2008-2010study,itispossibletoestimatethedeaddiscardsthatcouldbegeneratedbythe3,240longlinesetsproposedforthecurrentpermit:anadditional5,199juvenileswordfish,1,335bluemarlin,392whitemarlinand2,421sailfishwillbekilledoverandabovewhatwouldtakeplaceinthePLLfisheryiftheEFPwasnotissued.Theseestimatesareagrimreminderofthethreatthatefficient,indiscriminatelonglinesposetoconservationgainsnotjustintheEastFloridaCoastPLLClosedArea,butinalloftheworld’soceans.Additionally,itappearsthatallofthelonglinevesselsparticipatingintheEFPareownedbyasinglecompanyandaredockedinnearbyFortPierce,Florida.Wequestionwhetherthisproposalistrulyaboutscienceormerelybeingusedasatoolofconvenienceforasinglelonglineoperatortogainaccesstonearbypristinefishinggrounds.Finally,referenceismadeagaininthisEFPtoprotectingAmerica'sswordfishquotaatICCAT,aclearimplicationthatifAmericadoesnotcatchandkilleveryswordfishallottedtoitthenthisinternationalmanagementbodywillreassignthatquotatoothernations.Thislineofargumenthasbeenusedrepeatedlyovertheyearsasjustificationtoopenupconservationareasclosedtolonglinegear.WedonotbelievethatpossibilityisreasontoretreatfromtheconservationgainsthathaveresultedfromtheEastFloridaCoastPLLClosedArea.Furthermore,ICCATitselftoutstheswordfishrecoveryasoneofitsgreatestconservationachievements;itisdifficulttobelievethatICCATwouldpunishtheUnitedStatesforhavingachievedthatvictory.Althoughthisargumenthasbeenaroundforyears,theUnitedStateshasnotlostasinglepoundofswordfishquota.AnunintendedbenefitoftheEastFloridaCoastPLLClosedAreahasbeentheestablishmentintheregionofthenation’sbestsailfishfishery.Thedirecteconomicbenefittocoastalrecreationalfishing-
relatedbusinessisremarkable.TheKerstetterapplicationputsatrisktheamazingcatch-and-releasesailfishfisheryofftheeastcoastofFlorida.ThereasonscitedinthisEFPapplicationareinsufficienttojeopardizetheconservationgainsthathavebeenmadeforswordfishandweurgeyoutorejectit.ItwasnotmanyyearsagothatasimilarattempttousetheEFPprocessasathinlyveiledexcusetore-introduceindustrialharvestintoconservationareaswasmadeandrejectedafteraresoundingtideofoppositionfromthepublic.Weencourageyoutoagainprotectthisuniqueandcherishedconservationvictory.Sincerely,MikeNussman,PresidentAmericanSportfishingAssociationJeffAngers,PresidentCenterforSportfishingPolicyPatrickMurray,PresidentCoastalConservationAssociation
