• Mediation
• is a willful and not conflicting process through which parties to a dispute agree in order to find a
compromise
• Scope: Finding an amiable settlement to their dispute
• Restructuring mediation is a mediation applied to distress
situations
• The Debtor has a stronger position
e.g. When the debtor is the main purchaser of creditor's products
• Normal insolvency procedures may lead:
• To a loss of credibility by the debtor
