3. Revises Section 4.14.1.7 to read as follows; 4.14.1.7 100-Hour Transition Training Program Facilitator: The 100-Hour Transition Training Program Facilitator shall possess, at a minimum, a high school diploma or GED, and related facilitation experience. 6. Revises Section 4.22.6, Cost Information Sheets (Attachment 8), to delete the second paragraph and shall now read: The Cost Information Sheets should be submitted with the Response, and should not be submitted separately;

7. Adds Section 5.6.1 Selection Criteria, to read as follows;

The Department will select for award the Respondent(s) that provide the best value to the Department based on negotiations and the following selection criteria:

a. Experience in similar delivery of criminal justice services; b. Staffing quality and schedules; c. Quality and flexibility of Programming; and d. Cost.

8. Adds third paragraph to Section 6.3.1, to read as follows;

Annual rate increases are contingent upon legislative appropriation and at the Department’s sole discretion. Any increase in the rates, based on legislative appropriation, will require execution of a formal Contract amendment.

For substance abuse licensure, is the residential program expected to meet residential Level 2 standards of 65D-30, Intensive Outpatient, or Outpatient standards?

Answer #1 The Contractor must have the appropriate Department of Children and Families license(s) for each level of substance abuse services they are providing in accordance with Chapter 65D-30, FAC..

Question #2

What is the average monthly number of substance abuse treatment participants at the Gadsden Re-Entry Center (to include all levels of care)?

Answer #2 At the Gadsden Re-Entry Center, each participant, upon arrival at the compound, is

placed in prevention services. Prevention Level I Services – 432 Slots

Outpatient/Aftercare Services – 100 Slots

Residential Therapeutic Community – 72 Slots

Section 4.4, Department Responsibilities, does 4.4.5 include food and food service for inmates?

Answer #3 Yes

Question #4

How many teachers and vocational staff are at the Gadsden Re-Entry Center?

Answer #4 The Gadsden Re-Entry Center Contractor shall provide four (4) academic teachers and four (4) vocational teachers.

Question #5

We have never contracted to provide re-entry services to the Florida Department of Corrections. However, we have been delivering like services to Court Ordered Offenders as well as men and women on probation for more than a decade. We can substantiate this with court documents and referrals from various district court judges. Does this qualify us to respond to this ITN?

Answer #5 Please refer to Section 4.22.3 of ITN-13-038, the Statement of Qualifications which will be used in the evaluation process. There is no requirement that a proposed vendor have previous contract experience with the Department of Corrections.

Question #6

How long dues DC expect it will take for the facility to reach 100% occupancy.

Answer #6 At the Gadsden Re-Entry Center, the Department began admitting inmates on January 13, 2014. The facility reached 100% occupancy in May, 2014.

Question #7

How likely is it that the facility will remain at 100% occupancy?

Answer #7 Once the facility reaches full capacity, the Department intends for it to remain at that level. Question #8

It is estimated that as many as 110 different religious preferences have been identified by inmates in the Florida DOC system. Is the contractor expected to provide worship/religious observances for all identified religious practices?

Answer #8 The Contractor is expected to reasonably accommodate religious preferences represented at each facility in accordance with applicable policies and procedures.

Question #9

Does the Department or the Contractor pay for TABE / GED testing?

Answer #9 The Contractor is solely responsible for all technology and test costs associated with administering the TABE and GED computer based test. The Contractor will administer them in accordance with Florida Department of Education standards and DC policy and procedures.

Answer #10 The Contractor is responsible for all cost associated with pre-employment background checks.

Answer #11 The Contractor is responsible for providing all materials associated with the proposed programming.

Can OJT/Vocational Training be offered within the facility? (i.e.kitchen/food service, maintenance, IT, laundry/housekeeping)

Answer #12 OJT/Vocational Training, which is part of the programming proposal, is provided only within the perimeters of the facility. The specific examples you provide are acceptable as long as there are no security concerns and if the Warden approves.

A Facility site plan for Baker Re-entry, and Everglades re-entry, that displays square footage of buildings, interior/ program rooms, areas outside of buildings to include recreation, covered areas, etc….

Because of security reasons, a floor plan/layout cannot be made available. The *estimated square footage amounts for program space are as follow:

During the site visit, the GED testing was mentioned and the pricing for testing would remain on a discounted rate for the approved vendor for the sites; question what is the name of the GED vendor and what are the rates for the testing per inmate?

Answer #14 GED Testing is conducted through Pearson Vue, the sole provider for GED testing in Florida. There are 4 tests in a complete battery and each subtest is $32 or a total of $128 for the four tests.

However, the Department of Corrections receives a $10 discount per subtest at $22 or a total of $88 for the battery of tests.

The costs for retakes for each set are $12 per sub-test and with the Corrections $10 discount it is a net of $2 per subtest.

What is the subsistence rate for this contract? Is it the same for each location?

Answer #15

There is no subsistence fee in this ITN.

Question #16

Is the proposed program considered an open or closed population for the academic program requirements?

Answer #16

The population is open. This may be discussed at the Negotiation Phase.

Question #17

Is there a required student to teacher ratio for the academic and vocational teachers?

Answer #17 There are no required staff-inmate ratios for specific programs unless dictated by statute or rule.

Question #18

Can we pay overtime to correctional officers who attend specialized training for substance abuse and mental health issues?

Answer #18

Correctional officers must work 168 hours over a 28 day work period in order to be eligible for overtime. If participation in the specialized training causes an officer to exceed 168 hours during the defined work period, then s/he would be eligible for overtime. The Department will work with the successful Contractor(s) once an award has been made to resolve this issue.

Answer #20 Yes, it is the most recent version.

Page 12, Section 4.7.4: 1. If the site consists of multiple buildings, are there spare (unused) fiber strands that

run between the buildings? If so, may the Contractor utilize them for networking counselors’ computers and phones?

2. Will the Contractor be allocated space for a copier? The copier will be approximately 6 feet wide, 3 feet deep, and 4.5 feet tall.

3. Will the Contractor be permitted to use existing rack space for mounting networking hardware, or will the Contractor be allocated space to install their own rack for networking hardware in a secure location that has access to crawl space, a network cabling conduit, or some other space for running Cat5 cable?

4. May the Contractor have two members of its Information Technology team visit the sites to assess the need for hardware, cabling, etc. requirements? This would require access to network closets and areas where cabling may be installed, such as crawl spaces, etc.

Answer #21 1. If spare fiber exists that the Department of Corrections does not need, it can be provided to the contractor for their usage. The Department will provide the opportunity for a detailed site review with the OIT Manager after the contract is awarded.

2. Yes 3. If rack space is available, that the Department does not need, it can be provided to

the contractor for their usage. The contractor will need to coordinate with the OIT Manager if additional rack space or/and cabling is needed.

4. Yes, after the contract is awarded, the contractor’s IT team can coordinate a site visit with the OIT Manager.

Page 13, Section 4.8.2 & 3: 1. Will the Contractor be required to staff a full-time GED Teacher or may one be

Answer #22 1. Qualifications for Academic Teachers are outlined in Section 4.14.1.5 and these services may be subcontracted.

2. The computers assigned for general education for may be used for other educational programming if it does not interfere with the administration of required Academic Programs set forth in the ITN.

3. Section 4.5 states that the Department will furnish at the program service site for the successful Respondent(s) use: Office space; 14 inmate computers for educational programming; telephones and telephone services; and furniture, including desks and chairs.

Disciplinary Staff Team Meetings? 6. Will the Department administer the Client Evaluation of Self and Treatment prior to

the inmate’s participation in the Multi-Disciplinary Staff Team meeting so that all needs are assessed in accordance with this section?

Answer #23 1. The Contractor will not be required to have a full-time librarian but the contractor must meet the requirements of the required library services as stated in the ITN.

2. Inmates will submit written requests to the Law Library at the parent institution and service will be by mail or if needed, the inmate will be transported to the main Law Library.

3. There are no specific books required for the libraries. All books must be the admissible reading required in Chapter 33-501.401 FAC.

4. The Department has purchased and shipped to both Everglades and Baker Re-Entry Centers, the books for the library in the amount of $10,000 for each location. Any additional books will be the responsibility of the contractor. See Exhibit F for a listing of the books that the Department will provides for Everglades Re-Entry Center and Exhibit G for a listing of the books that the Department will provide for Baker Re-Entry Center.

5. It is the goal of the Department to have on site, representation from the health care provider at each facility in the weekly MDST meetings.

6. No, the Department will not administer the Client Evaluation of Self and Treatment.

Page 17, Section 4.14.1.7 & 8: 1. Can the 100-Hour Transition Training Program be facilitated by an approved

volunteer? 2. Is it the Department’s intention that the Thinking For A Change Facilitator position

noted in this section be at least two positions based on evidence-based practice that at least two certified facilitators conduct each Thinking For A Change group?

Answer #24 1. Yes, as long as the volunteer possesses a High School Diploma or GED and related facilitation experience and has been trained by the Department as delineated in Section 4.14.1.8.

2. It is the Department’s intention that T4C be delivered in accordance with Section 4.8.4.1 which requires at least two facilitators per group.

Page 18, Section 4.14.3.1: Must a position which is absent for less than 80 hours due to short-tern illness or scheduled vacation be filled with a per-diem staff member

Answer #25 No, in accordance with Section 4.14.3; however, the contractor must adhere to its staffing-level back up plan which includes contingencies to insure coverage for staff illness, vacations, and absences from the work site.

Answer #27 See Exhibit D.

Question #28

Can the Department please provide bed capacity/utilization for the past 6 months at Gadsden Re-Entry Center AND/OR bed capacity/utilization for the past 12 months at any other similar program to that of Baker or Everglades Re-Entry Centers?

Answer #28 The capacity for Gadsden Re-Entry Center is 432 inmates. We currently have 415 inmates at Gadsden Re-Entry. We began filling Gadsden the week of January 13, 2014 and filled them at a rate of approximately 25 inmates per week until we began sending in 30 per week starting the week of March 3, 2014. Sago Palm Re-Entry Center would be the other program that is similar to Gadsden. They have a capacity of 384. They are usually 90 to 100% full.

Will the Department please provide a copy of the current final contract for comprehensive re-entry services at Gadsden Re-Entry Center, including per diem information?

Answer #29 See Exhibit E

Question #30

ITN Section 4.8.8 Library Services. Will the Department please confirm that the law library for the Everglades Re-Entry Center is to be paid for by Everglades Correctional Institution? If not, is it the cost of the law library the responsibility of the Bidder?

Answer #30 The Everglades Re-Entry Center does not have a law library. Inmates will have access to a law library at the parent institution. Service will be by mail or if needed, the inmate will be transported to the main the Law Library.

Question #31

ITN Section 4.22 Response Submission Requirements. Should bidders prepare and lay their proposals out following the Mandatory Documentation (Section 4.22.2 through 4.22.6)? In comparison to ITN Attachment 7 – Mandatory Review and Evaluation Criteria, there are minor differences in the ordering of information.

Answer #31 Respondents shall specify where the information is located in their response by completing Column 2, Attachment 7, and as outlined in Section 4.22.

Question #32 Are there any mandatory tabbed sections required under this ITN, as have been included in previous ITNs?

Answer #32 No.

Question #33 Is there an Addendum/Amendment acknowledgement page Bidders are required to complete in the event the Department issues an Addendum/Amendment? No such form was included in the ITN.

Answer #33 Respondents are not required to sign and return Addendum forms. It is the responsibility of the vendors to check the Vendor Bid System for addenda as outlined in Section 5.12, Addenda.

Question #34 ITN Section 4.22.6 Cost Information Sheets. Respondents shall submit one original and one copy separately bound, signed and sealed in an envelope.

1. With the requirements under ITN Section 4.22.1 for electronic submission on CD, will the Department please clarify if the CD submission should include Price Information?

Answer #77 The Department will house Psych Grade 1*, 2*,at the Baker Re-Entry Center and 1*, 2* and 3* at the Everglades Re-Entry Center, however 3s* will be housed on a limited basis. Mental Health Services will be provided by Corizon, Inc. at Baker Re-Entry Center and Wexford Health Sources at Everglades Re-Entry Center. These services, which will be under the direction of a licensed Psychologist, may be provided on site, or at the parent institution. *S 1 = Demonstrates no significant impairment in the ability to adjust within an institutional environment, and does not exhibit symptoms of a mental disorder (which includes intellectual disability). Although inmates classified as S-1 do not require ongoing mental health treatment, they have access to routine mental health services (sick call, emergencies, etc.). *S 2 = Exhibits mild impairment associated with a diagnosed mental disorder. We began filling Gadsden the week of January 13, 2014 and filled them at a rate of approximately 25 inmates per week until we began sending in 30 per week starting the week of March 3, 2014. Sago Palm Re-Entry Center would be the other program that is similar to Gadsden. They have a capacity of 384. They are usually 90 to 100% full.

Question #107 Pg. 6, section 3.5, Pricing – Will the Department consider guaranteeing Contractors payment for all 432 beds and not per occupied beds above 80% occupancy? Otherwise, Respondents are forced to charge a per diem that is based on the expectation that roughly 80% of the beds are occupied and this will lead to a considerable higher per diem than if the Respondent were to assume that they would be paid for 100% of the beds. The provision of re-entry programming is similar to most businesses in that there is something called “economies of scale” which impacts the cost to provide a service. Thus, the cost of guaranteed payment for 346 beds (80% occupied beds) and a per diem for beds 347 to 432 is going to cost much more than the cost of guaranteed payment for 432 beds. The Department does not fund the operation of its own facilities based on the number of beds occupied so it would be helpful if that is how the Contractor is paid. If the Re-Entry Centers were to be state operated, the operating budget would be very similar when the facility is 80% full vs. 100% full because the facility staffing would be roughly the same under both scenarios. Please structure the ITN in a way that affords companies the ability to provide services in a financial manner that is similar to the state operated re-entry facility to which the Contractor will likely be compared. This is particularly important if the budget for this ITN is based on the operating costs at state operated re-entry centers.

Answer #107 The Department will pay per occupied bed and will not consider paying for all 432 beds at either Everglades or Baker Re-Entry Centers.

Question #108 Pg. 13, section 4.8.1.6 – If an inmate does not want to enroll in programming, will the inmate be removed from the facility? Having at least 70% of the inmates actively enrolled in programming is likely too high if inmates can refuse to enroll in programming. What disciplinary tools can the Contractor use to influence an inmates’ decision on whether to enroll in programming?

Answer #108 The Department does not consider re-entry to be optional and inmates are removed from the facility only for security reasons or classification recommendations. Inmates resistant to programming that do not fall within these two areas should participate in additional motivational programming that addresses resistance. Vendors may use therapeutic community tools, verbal warnings, correctional consultation and disciplinary reports.

Question #109 Pg. 14, section 4.8.7, Substance Abuse Program Services – The RFP states that the Contractor shall provide “…licensed prevention, treatment, and aftercare.” Please explain. For example, is the Contractor responsible for licensing the Baker Re-Entry Center for substance abuse? What type of license, if required? What type of substance abuse license do the Demilly Correctional Institution (DCI), Baker Correctional Institution, Sago Palm Re-Entry Facility, Polk Correctional Institution and Gadsden Re-Entry Center hold?

Answer #109 The Contractor will be responsible for licensing at the Everglades and Baker Re-Entry Centers for substance abuse program components. The type of licenses required should correspond to the type of programming provided (e.g. Intensive Outpatient Program would be licensed as such, a Residential Therapeutic Community as Level II Residential program, Prevention as a Level I Prevention program). Demilly CI previously operated under the overlay of the Polk CI License. Sago Palm has an Intensive Outpatient license. Demilly was licensed for Prevention, Intensive Outpatient and aftercare. Baker CI has Intensive Outpatient, Aftercare and Level I Prevention Services Licenses and Gadsden for Residential Level II, Outpatient, Aftercare and Prevention Level 1.

Question #112 Pg. 16, section 4.14, Contract Staffing Requirements – The Contractor is expected to always maintain full staffing yet the Department is only guaranteeing payment for 80% of the beds. Please modify this section to allow Contractors to maintain staffing in proportion to the number of beds occupied. If contractors will be required to maintain 100% staffing, then pay Contractors for 100% of the available beds that are being staffed, which is similar to how state operated facilities are funded. A Contractor’s staffing costs represents the overwhelming majority of its costs. Furthermore, if this facility was to be state operated, it would be staffed based on the assumption that the entire facility would be full and if the occupancy level fell below 100%, the operating costs would only decrease by a negligible amount. However, this is not how the Contractor is being treated in this ITN. Please structure the ITN in a way that affords companies the ability to provide services in a financial manner that is similar to the state operated re-entry facility to which the Contractor will likely be compared.

It could take several months until the population at the facility stabilizes, new admissions are not occurring on a frequent basis, and programming is firmly in place. Additionally, are only program eligible inmates considered in the 70% figure? For example, would an inmate be considered as part of the program eligible population on the first day he arrives at the Everglades/Baker Re-Entry Center? How and when will an inmate be considered ready and eligible to enroll in programs? Also, what ability will the Contractor have to discipline inmates that choose to

Answer #115 Inmates who arrive at the Re-Entry Centers are program eligible and are ready to enroll in programs that meet their needs. All inmates will be part of the 70% inmate population to be actively enrolled in programming as stipulated in the General Appropriations Act, 2014 and the requirements of this ITN. The MDST will address consequences for inmates who refuse to participate.

Question #116 Pg. 21, section 4.16.1.2, Performance Outcomes and Standards – How much time after the contract start date will the Contractor have to achieve the requirements set forth in section 4.16.1.2. Six months would be a reasonable timeframe.

Beginning on October 1, 2014 for the Everglades facility and beginning on January 2, 2015 for the Baker facility, the Department will pay the contractor(s) at least 80% minimum capacity.

Would the Department consider being very specific on the exact items for which liquidated damages can be imposed and the related number times per year that said liquidated damages could be imposed. For example, section 4.16.2 (pg. 23) seems to be a catch all section that suggests that there are possibly countless requirements in this contract for which the frequency of the liquidated damages is uncertain. This type of language may cause Contractors to perceive that the (DC) is not approaching this project with a partnership spirit but with a punitive spirit. Florida Statute 287.058 does not require nor encourage agencies to utilize endless financial consequences and encourages DC to clearly identify the

items that could result in liquidated damages and the frequency that such liquidated damages could be imposed each year.

Answer #120 As stated in the ITN: If the contractor fails to meet the requirements set forth in 3.12.1.1 the Department may impose Liquidated Damages on a monthly basis in the amount of $250 for every day the Contractor did not have 70% of the total population enrolled in one program. If the Contractor fails to meet the requirements set forth in 3.12.1.2 the Department will impose liquidated damages in the amount of $250 for every day until such time the appropriate license is issued for the contracted substance abuse program. This includes assessment of liquidated damages if an interim license is issued to the following reasons:

a. The service component(s) under contract with the Department of Corrections is /are substantially in non-compliance with licensure standards.

b. The Contractor is involved in license suspension or revocation proceedings for the contracted substance abuse program.

If the Contractor fails to meet any other performance measure as outlined in Sections 3.12.1 or 3.12.2 the Department may impose liquidated damages in the amount of $2,500 per occurrence.

will be a variation from the current practice of not allowing knives in the food service area for the teaching of a culinary arts program that would affect employment opportunities in high-end restaurants versus fast food. Therefore, the question is "Will knives be allowed in the re-entry centers in the kitchen/food service area as a Class A Group for the purpose of vocational training only? or is the current practice of no knives in the kitchen/food service area going to be maintained?"
