Small Group Meeting Of SA and SEAP Network of Ozone Officers

On RMP Review and Update Dhaka, Bangladesh

13-14 June 2003 1 Introduction The Small Group Meeting of SA and SEAP Network of Ozone Officers on RMP Review and Update was held in Dhaka, Bangladesh from13th-14th June 2003. Bangladesh, Cambodia, Lao PDR, Mongolia, Myanmar, Nepal, and Sri Lanka were invited and all participated in this meeting. Japan and Sweden in their capacity as the Bilateral Agency/ developed country partners in the region, and UNDP, in its capacity as the Implementing Agency responsible for the implementation and development of the RMPs in partnership with UNEP in the target countries attended this meeting. After introduction of the participants (list of participants attached as Annex I), Dr. Md. Omar Faruque Khan, Director General, Department of Environment, welcomed all participants to the meeting. He recalled the decision made by the Executive Committee of MLF concerning RMP development and implementation for phase out of CFC consumption in the refrigeration and air-conditioning servicing sector. He believed that the meeting would cover issues for monitoring and reporting on progress as an integral part of RMP and the Government strategy for delivering phase out. He thanked developed country partners Japan and Sweden and UNDP for their involvement through sharing their experience and expertise. He thanked UNEP for selecting Dhaka to host this important meeting. Mr. Atul Bagai from UNEP Bangkok, Thailand thanked the developed countries for their support provided to the Networks operation. He welcomed the ozone officers from the two networks and thanked them for initiating the concept of the reoriented network approach at the last Meeting of SEAP Network and SA Network held in Phuket, Thailand, 2002. The networks during the compliance period will focus on thematic small group meetings for brainstorming and discussion on relevant issues pertinent to the countries in the network. Bangladesh, Sri Lanka and Lao PDR were elected as Chair, Vice Chair and Rapparteur for the meeting. 2 Approach The meeting was conducted in an informal way as designed in the concept note (Annex II) with round table discussions on identified issues as indicated in the annotated agenda (Annex III). These had been prepared in close consultation with the participants and other stakeholders to facilitate focused discussions. Each of the theme-based session was initiated with one or two case studies (Annex IV) by a country or/and an agency. This was followed with discussion on the issues identified on this theme.

Lucia (by Stefan Musto and Ron Verch, Consultants of MLFS) - Report of RMP Review Meeting, November 1998, Cairo, UNEP DTIE - Summary of Discussion: Workshop on RMPs, July 2002, Montreal,

Environmental Canada The meeting also benefited from the fact sheets on “RMP Implementation Status” of countries participating in the meeting (Annex V) prepared with assistance of UNDP. This document followed the case study of Jamaica, Guatemala and Saint Lucia developed by the consultants of the Fund Secretariat: Session I: Overview of the Executive Committee’s Decisions and Overview of RMPs in the region Mr. Atul Bagai introduced the Executive Committee’s decision on RMPs (Presentation 01_1 Excom Decisions on Refrigerant Management Plans) and the conclusion of the RMP extended desk study and how it was conducted (Presentation 01_2 Extended desk study on RMP Evaluation). Mr. Shaofeng HU analysed the compliance status of participating countries with the available data (Presentation 01_3 RMP in the Asia and the Pacific). The following issues were discussed and recommendations made:

1) The meeting reviewed all the Executive Committee decisions on RMPs. The RMP extended desk study objectives and the process were introduced. This included the indicative review of RMP status in the participating countries (Annex V) and their contribution to compliance. One critical issue is how the countries will determine measures to ensure phase out in the servicing sector. These measures should be addressed in RMP Updates and NCAPs. The relation between compliance and RMP implementation needs to be clearly understood by the countries.

2) The countries need clear understanding on the differences of RMP Update,

TPMP and NCAP. The countries agreed to fill in the questionnaire circulated by the Fund Secretariat for the extended desk study on RMPs. The countries need to assess their compliance status as per Decision 31/48.

3) The meeting recognized the regional characteristics that impinge upon the

implementation of RMPs. These include the easy availability of CFCs in the region, large RAC equipment manufacturing facilities, growth in the transportation sector and availability of local human resource and possible supply of local R&R equipment.

4) The countries with multi agency and bilateral cooperation appreciated the coordinated assistance they were receiving and expected the agencies to gear up for the challenges ahead during implementation of performance based agreements.

Session II: Sectoral data collection and its problem Mr. Pak Sokharavuth from Cambodia (Presentation 02_1: Sectoral Data Collection and its Problem: an experience of the data collection in Cambodia) and Dr. Sita Ram Joshi from Nepal (Presentation 02_2 Sectoral Data Collection and its Problem) introduced how their countries collected data and shared their experiences. The following issues were discussed and recommendations made:

5) Better coordination between NOU and other line Ministries like import office,

customs, end user associations, Ministry of Industries and Commerce is required to support good data collection.

6) In order to improve accuracy of data collection, it was recommended to use

bottom up approach and Micro sampling. Import data should be verified.

7) Different data collection approaches need to be followed for data collection from formal and informal sectors.

8) Appropriate awareness amongst end users and proper monitoring and record

keeping by importers will lead to good data collection subsequently.

9) Illegal trade of ODS with different Trade names and imports of mixtures dilutes the credibility of data.

10) A system of information exchange concerning exports and imports between

the importing and exporting countries will benefit data collection and facilitate control of illegal trade.

Session III: Policy setting and enforcement Mr. Mohammad Reazuddin from Bangladesh presented an overview of all activities undertaken and/or to be undertaken in his country for the phaseout of ODS (Presentation 03_1 Overview of Bangladesh’s activities) specifically in regards to role of policy setting. Mr. Yoshiyuki Ishii from Japan shared Japanese experience on the policy setting for the ozone layer protection (Presentation 03_2 policy setting Japanese experience). The following issues were discussed and recommendations made:

11) It was stressed that policy setting and enforcement is very important for

achieving compliance. It is recommended that the awareness program is important in order to reduce consumption and to be in compliance.

12) It was noted that neighbouring countries in the region could benefit from complementary policy setting. PEO could play an important role in this.

13) It appears that market forces alone will not bring about equilibrium in the short

term and medium term and policy setting will be critical.

14) Codes of good practices, including ban on venting and accreditation of technicians should be adopted through voluntary mechanisms through industry associations and through legislation, wherever possible.

15) The adoption of import quota system in some countries has led to increased

CFC prices thereby encouraging early adoption of alternatives.

16) Annual registration of vehicles by the Transport departments could provide a good opportunity for checking the MAC systems.

Session IV: Customs training Prof. Tsohio Adyasuren from Mongolia briefed the meeting how the custom training was conducted in his country (Presentation 04 Customs Training Mongolia) with active collaboration of the Customs Department. The following issues were discussed and recommendations made:

17) All stakeholders involved in enforcement should be in touch for information

exchange through e-mail or websites.

18) Harmonized coding system should be followed in all countries. National coding and Licensing Systems should be developed.

19) Countries needed more assistance on developing national level harmonized

codes. PEO could facilitate this activity.

20) Country Handbook is the most critical training tool for the national stakeholders. It is a good on-the-job reference manual for customs officers and other stakeholders.

21) UNEP should prepare a list of current ODS and ODS based equipment

manufacturers in the region and circulate to the member countries.

22) Customs Department in all countries of the network should have a focal point on Ozone issues. The Sweden/UNEP project on ozone customs officers network could address this issue.

23) Training updates and inclusion of customs training module in the regular

training curriculum of customs academy will be critical factors in making the customs training sustainable.

24) Formation of Technical Group at the national level to support customs

department has proven to be a successful mechanism in some of the countries.

25) National level websites of ozone offices could contain information on seizures of CFCs for the benefit of other countries. The Sweden/UNEP project on ozone customs officers network could address this issue.

Session V: Refrigeration Training Dr. W. L. Sumathipala from Sri Lanka shared his country’s experience with the participants concerning the implementation of refrigeration training and lessons learnt (Presentation 05_1 Refrigeration Training Sri Lanka). This presentation was complemented by Mr. Yoshiyuki Ishii from Japan who introduced his country’s experience (Presentation 05_2 Refrigeration Training Japanese Experience). The following issues were discussed and recommendations made:

26) Regional and sub regional training institutes within a country helps in

disseminating codes of good practices in the hinterland.

27) The informal/unorganized sector in the RAC sector is the most critical area of future work and sustainability of phase out over long term depends on how this sector can be addressed by the countries at the grass roots. It was noted that the refrigerant dealer is a good source to organize training for the informal sector. Informal sectors in the region of the countries should be addressed through innovative mechanisms of flexible timing and non-formal methods. This could be a good issue for discussion in a future small group meeting.

28) Training/ Demonstration workshops during the Phase II should also be used as

awareness raising events. This interlinkage has worked successfully in some countries.

29) Training manuals should include lessons learnt and new experiences like

modules on faulty diagnosis etc. to address the lessons learnt during RMP implementation.

30) Sri Lanka agreed to prepare short notes on the following issues for the benefit

of NOUs in the region. Future RMP Updates should focus on these issues:

- Developing codes of good practices - Setting up and strengthening refrigeration association - Certification system - RAC Information Center - Organization of Public Awareness Cell in the NOU

31) The participants of the meeting appreciated the CD Rom made by JICA and

requested JICA/Japan to further develop and distribute a similar CD Rom for the assistance of NOUs during implementation of Phase II.

Session VI: Recovery/recycling Programme under RMP

Ms. Keobang A. Keola from Lao PDR introduced the RMP implementation status in her country (Presentation 06_1 RMP Implementation in Lao); Mr. Ranojoy Basu Ray from UNDP provided the meeting with their observations on how to keep the recovery/recycling activities effective and sustainable (Presentation 06_2 Effective and Sustainable R&R); Ms. Julia Obrovac from Sweden introduced the difference of recovery and reclamation concept (Presentation 06_3 Sweden Recovery and Reclamation). The following issues were discussed and recommendations made:

32) The RMP preparation and/or updating process should incorporate lessons

learned from RMP under implementation in the region. The main focus of R&R should be the commercial and MAC sector and not focus on domestic refrigerator sub sector.

33) The RMP preparation and/or updating process should also consider equipment

requirement for good practices for the technicians.

34) Financial viability of the recycling centers should be ensured through mechanisms such as charging fees for recycling or financial support through the project.

35) A Handbook on reclamation could be useful for understanding how to meet

the CFC demand until 2010 and after.

Session VII: Integrating, Monitoring RMP Implementation

Dr. Sita Ram Joshi from Nepal introduced the role of different stakeholders in the RMP implementation and its data reporting system (Presentation 07_1 Monitoring RMP Implementation in Nepal). Ms. Julia Obrovac from Sweden briefed the meeting about the interlinkages between the various components of RMP and their relation to phaeout activities (Presentation 07_2 interlinkages between phaseout activities).

The following issues were discussed and recommendations made:

36) Monitoring the import and export system and recovery/recycling through local

consultant or NOU is critical to successful implementation of RMP.

37) Training consultant could be a good resource for monitoring.

38) NOU and relevant stakeholders should recognize and understand the inter-linkages between the phase out activities in a RMP. There are given sequences of the phase out activities under a RMP that need to be acknowledged. For example, the training of the services technicians has to be conducted before the accreditation/certification system enters into force.

39) It was agreed to use e-forum of the network to exchange information on

national prices of CFCs and alternatives.

40) A simple short questionnaire for monitoring for the help of the NOU should be developed. Prof. R.S Agarwal agreed to develop the questionnaire that will be circulated on the e-forum for comments.

Session VIII: The Role of NOU and Other Stakeholders Dr. W. L. Sumathipala detailed the role of NOU and other stakeholders in the implementation of RMP and other activities (Presentation 08 The Role of NOU Sri Lanka). The following issues were discussed and recommendations made:

41) Importance of political support was highlighted. Political support has led to

faster implementation of RMPs in some countries.

42) Strong NOU is the key to successful implementation of RMPs. NOUs can facilitate providing training for the relevant stakeholders and issuing certificates to the participants.

43) NOUs can facilitate carrying out technical programs and awareness campaigns

through mass media.

44) NOU can prioritize implementation of planned activities through team work consisting of relevant stake holders including consultants and secure assistance from CAP experts in specific sector or areas. Consultation with other IAs in this regard will be useful.

45) NOUs expected CAP members’ visits to their countries for providing specific

issue based assistance.

46) NOU can obtain support from MLFS, through IS project and additional projects and contribution from the Government in the form of in kind contribution. NOU can decide on bilateral partnership with Non Article 5 countries on specific issues, as need arises.

Session IX: RMP review and Sustainability Dr. Sita Ram Joshi from Nepal in his presentation reviewed the activities conducted under the RMP and their achievements (Presentation 09 RMP Review and Sustainability Nepal). The following issues were discussed and recommendations made:

47) In countries where the RMP implementation has started, trainers trained

during Phase I have proved to be key focal points for carrying on the RMP activities.

48) NOUs felt that Government action should be able to sustain the RMP

implementation on a long-term basis.

49) Inclusion of training modules in the ongoing curriculum of training institutions in the country will facilitate sustainability of RMP implementation.

50) The participating countries during the meeting developed a matrix and gave

inputs highlighting activities needed to assist them to meet the 2005, 2007 and 2010 phase out schedules (Annex V).

Session X: RMP Update and NCAP Ms. Akiko Hayano from Japan (also on behalf of Sri Lanka) highlighted the difference between the RMP and NCAP and discussed the pro & cons of the two approaches (Presentation 10_1 RMP and NCAP). Ms. Julia Obrovac from Sweden analyzed the approach of RMP update and TPMP (Presentation 10_2 RMP update and TPMP). The following issues were discussed and recommendations made:

51) Many countries felt that there may be difficulties in adhering to phase out the

targets agreed in the RMP due to practical considerations. With existing RMP, some countries may not be able to achieve phase out requirements of 2007 and beyond.

52) RMP will address only CFC (ODS) in the refrigeration sector and other ODS

will have to be handled through other means. Once the assistance from MLFS is ceased the Government has to find other means (donor agencies) or the government has to develop mechanisms to sustain the phase out.

53) Future RMP formulation and Updates should ensure MAC sector phase out is

addressed.

54) The countries need to thoroughly study the options available for example RMP update, Terminal Phase Out Management Plan (TPMP) or National Compliance Action Plan (NCAP) before deciding which option to follow.

55) Countries recognized that capacity of NOU and political support would be

important considerations for deciding on the future approach. Session XI: Post 2010 refrigerant management Prof. R. S. Agarwal from UNEP Technology and Economic Assessment Panel provided the meeting with options for the post 2010 refrigerant management that the NOUs needs to start addressing in very near future (Presentation 11 Post 2010 Refrigerant Management). The following issues were discussed and recommendations made:

56) Countries need to understand the post 2010 scenario and can learn from the

experiences of developed countries.

57) Retrofitting with HC is a very good option.

58) NOUs need more information on reclamation and destruction technologies to address these issues in the future.

59) CFC requirement and availability in the region in the post 2010 period needs

to be studied. It is expected that servicing requirements in the region will carry on till 2020 and R&R will become critical.

60) Refrigerant Supply Chain is an important issue to be addressed by the NOU.

General:

61) The concept of small group meeting of networks is a good approach and

participation of countries from the two networks gave an opportunity to share and learn from each other’s experiences. Participating NOUs, bilaterals and IAs unanimously agreed that the concept of a focused theme based small group network meeting was the correct approach to assist countries to better understand the issues to be addressed to achieve compliance and total phase out.

62) All participants thanked their hosts, the DOE, Government of Bangladesh and

the local UNDP office for all the arrangements for hosting the meeting. 4 Evaluation of the Meeting

1) Attendance All 7 of the 7 invited developing member countries attended the meeting (100%). Japan, Sweden as bilateral agencies and developed country partners, and UNDP attended the meeting. 2) Evaluation by the Participants Since this was the first meeting of its kind, a special evaluation questionnaire was prepared to test the approach and its efficacy. The overall evaluation of the meeting by the participants was very good to excellent.

A graphic analysis of the feedback received from the participants through the questionnaire is included in Annex VII.

CONCEPT NOTE Background A reoriented approach for managing the regional networks under UNEP’s Compliance Assistance Programme (CAP) has been based on the emerging need for capacity building for compliance in Article 5 countries. The approach proposed, capitalizes on the technical expertise and experience available in UNEP’s CAP team. It uses theme-based sub-regional and small working group meetings and interactions on compliance related issues. The network evaluation done by independent experts for the Multilateral Fund Secretariat in 2001 recommended this approach, to wit: “ …problem-oriented discussions of particular aspects of such reports, discussions of two or three country reports only at each session, and/or discussions in smaller groups, should be envisaged.”1 CAP’s Regional Office of Asia and Pacific team is responding to this reoriented approach. Based on the recommendations of the Follow Up network Meeting in Phuket in 2002, each year there will be one meeting of the South Asia Network. Instead of a Follow Up Meeting, two or more small group meetings on specific issues faced by a set of countries will be organised each year. The CAP approach provides interlinkages between the activities of the two Networks (i.e. South Asia and South East Asia and the Pacific Networks) by encouraging experience sharing between the two Networks through such Small Group Meetings. Such issue-based exchange of information between the two Networks is an integral component of the reoriented OzonAction Programme and will be fostered in the future through CAP services. Context The Executive Committee has been focussing on issues relating to Refrigerant Management Plans over the past two years. It has established guidelines for updating RMPs and has stressed the need to review RMP implementation specifically in relation to how they impact on assisting countries in achieving their compliance commitments. Substantive discussions on review of RMP related issues took place in the UNEP/GTZ workshop on the margins of the 10th Meeting of the Parties in Cairo in 1998. The Executive Committee at its 31st meeting decided in its Decision 31/48: “To request national ozone officers, with the assistance of the implementing agency concerned, to review and assess the content, implementation to date and expected outcomes of their RMPs against their objective to phase out all consumption in the refrigeration sector according to the Montreal Protocol timetable. In undertaking this review, national ozone officers should: (i) calculate current and forecast future consumption in relation to the freeze,

size of consumption cuts in the refrigeration sector required to meet these targets;

(ii) include forecast cuts in consumption attributable to the activities already approved under the RMP, including training activities and recovery/recycling;

(iii) ensure that the current and expected future consumption of all sub sectors, including the informal sector, small and medium-sized enterprises and mobile air conditioners, are included in the review;

(iv) for each activity identified, consider the cost and means of funding, including national financing;

(v) ensure that the RMP and government strategy for delivering phase-out includes adequate provision for monitoring and reporting on progress;”

The Executive Committee further decided that LVCs with already approved RMPs may submit to the Executive Committee requests for funding additional activities necessary to reduce consumption and thereby ensure compliance with the Protocol. The Executive Committee subsequently gave guidance on linkages between RMPs and Terminal Phase out Plans in Decisions 36/6, 37/70 and 38/64. During 2003, the Monitoring and Evaluation Officer of the Multilateral Fund Secretariat is tasked with reviewing the impact of RMPs in a few regions. He is proposing to use the network meetings to interface with the countries on RMP related issues. This review follows the discussions that have taken place in the Executive Committee over the past two years. A document “ Extended desk study on RMP” (UNEP/OzL.Pro/ExCom/39/14) presented to the 39th meeting of the Executive Committee will form a good reference document for the meeting. Objectives of the Small Group Meeting on RMP issues Following the above approach, the first small group meeting for 2003 is being proposed to be held in Bangladesh. The focus of these discussions will be issues related to RMP preparation, implementation and monitoring. The objectives of the meeting will be: • to discuss how to implement the decisions of the Executive Committee; • to exchange experiences among member countries in the implementation of the

RMP, with emphasis on lessons learnt; • to draft an Action Plan on future activities under the RMPs, based on the decisions

of the Executive Committee mentioned above. Target Countries for the Small Group Meeting It is proposed to invite Bangladesh, Cambodia, Lao PDR, Mongolia, Myanmar, Nepal, and Sri Lanka to participate in this meeting. Mongolia, Nepal and Sri Lanka are the three member countries of South Asia network that have completed most of their activities under the RMP including the Phase I training for refrigeration and customs, and are finalising the Phase II training. Hence they have a wealth of experience on RMP implementation and lessons learnt. Bangladesh has started the process of implementation and can gain from the experience of the other participating countries.

Small Group Meeting on RMP Review and Update 13-14 June 2003, Dhaka Myanmar and Cambodia are two countries within the South East Asia network and are in the stage of the development of the RMP and NCAP respectively and can also add value to their project preparation activities from the implementation experience of other countries. The relevant Executive Committee decisions in regard to linkage between RMP and Terminal Phase out plans can also be reviewed in these two cases. Organisation UNEP will support the participants from the selected network countries to attend the workshop under the approved network budget. Visa and tickets will be organised by UNEP through the local UNDP office. The Government of Bangladesh has agreed to host the meeting and provide facilitation to the participants. The meeting will be held in the Pan Pacific Sonargaon hotel. An information note has been circulated to the participants detailing the logistical arrangements for the meeting. The Programme Officers (RMP Implementation) and (Policy and Enforcement) in consultation with the RNCs have prepared the documentation for the meeting. It is proposed to also invite: 1. The Multilateral Fund Secretariat and the Senior Monitoring and Evaluation

Officer to participate in the meeting and to present the Executive Committee perspective and the evaluation office’s requirements.

2. The Ozone Secretariat to present the perspective on Data Reporting and compliance.

3. Japan, in her capacity as the Bilateral Agency promoting country consultations jointly with UNEP in the region.

4. U.K., France and Sweden, in their capacities as the developed country partners in the region.

5. UNDP, in its capacity as the Implementing Agency responsible for the implementation and development of the RMPs in partnership with UNEP in the target countries.

The Regional Co-ordinator (Networking) South Asia and the Programme Officer (RMP Implementation) will participate and conduct the meeting on behalf of UNEP. The regional expert assisting with the Phase I training in Bangladesh will be the resource person for this meeting also. Approach The issues for discussions will be developed in consultation with the participating countries, MFS, OS, and Agencies. It will address the following broad issues: - How to make the calculation as per the Executive Committee’s decision

- What kind of additional activities can be addressed in the RMP updates? - Which kind of policy could affect the CFC price? - Have the custom training programme improved the enforcement of the import

restrictions (special focus on MOP Decision XIV/7) and has the training of technicians in good practices contributed to the reduction of the consumption of CFCs? If so to what extent? If not, where is the problem?

- Has the R/R equipment supplied actually been used and contributed to the reduction of CFCs consumption?

- Has the NOU received the political support for the implementation of the RMP? How do you evaluate the impact of the cooperation with other government department on the effective implementation of the RMP?

- How reliable are data collected on consumption of the refrigerant? What are the sources of this information? How reliable are these sources? Are data provided by different sources consistent? How detailed are the data by type of refrigerant, equipment in use and user category?

- How to establish a reliable monitoring system with regard to CFC consumption and project result?

- Which sector/area has been overlooked in the original RMP, and what measure do you want to take to address this sector/area?

- The plan for the next steps. The meeting will be more in the nature of brainstorming and discussions. Formal meeting approach with opening statements and formal closing ceremonies will be avoided. The meeting will be organized through theme-based sessions, in which, one key presentation will be presented by country/agency followed with detailed discussion on the issues identified. To have all participants to get good understanding of the topics to be discussed, the document “Extended desk study on RMP” (UNEP/OzL.Pro/ExCom/39/14) is being distributed to all participating countries from this region. Time frame It is proposed to organise the meeting on 13-14 June 2003 back to back with the refrigeration training on 15-19 June 2003. Expected Outputs Follow up will be done through agreeing on an Action Plan on RMP preparation and implementation. In terms of short-term outputs, there will be value addition in inputs into the NCAP and RMP preparation exercise for Cambodia and Myanmar, Nepal RMP Update and NCAP for Sri Lanka. Furthermore, the Bangladesh RMP implementation Action Plan under Phase II will be followed up. In addition, the meeting will lead to a better understanding of the impact of RMP implementation and provide an insight into the lessons learnt. This will assist in better design and implementation of RMPs to support country phase out initiatives under the

Nepal - Phase II training for customs officer as well as good practices in refrigeration is going to be organised very shortly and will keep to meet the compliance. However, if customs officers training outside Kathmandu where illegal trade of CFC is expected, could be organized, it would be most effective to meet compliance of 85% reduction in 2007

As per the published notice, the quota announced phase rate does not address 85% reduction in 2007. RMP update project has to be planned which may greatly help to achieve compliance through training of different user groups.

- The meeting was well organized, with good concept note, annotated agenda, and documentation.

- The oriented network meeting approach was very effective, both to the NOUs and the bilateral agencies/IAs.

- The time was not enough to for the participants to discuss some issues in depth.

- Such small group meeting needs to be organized once/twice annually on topics like the recovery/recyling/reclamation and disposal of unwanted refrigerant, retrofits and demonstration projects.
