Enclosed please find a variance request package for the above referenced project. The applicantswish to obtain the permits necessary to construct a new attached deck to their existing dwelling,therefore request variances to Article 17, Section 8-201 of the Anne Arundel County Code for1, 134 square feet of disturbance for development on slopes 15% or greater in the LDA for theretaining walls and rear deck, and to Article 18, Section 4-601 of the Anne Arundel County Codeof 25' to the required 25' rear yard setback to construct an open deck. The requested zoningsetback variances will not exacerbate the existing encroachments.

A pre-filing meeting was held on January 26, 2018 with Lori Rhodes of Planning and Zoning, andthe Critical Area team had recommended reducing the size of the proposed deck from 16'x24' to14'xl6'. The applicant considered the recommendations and subsequent to the meeting, the planwas revised, the proposed deck size was changed from 16'x24' to 12'x20' and a section of at6'xl2'-9". A copy of the pre-file form is included with this submittal package.

The proposed deck is located 1.3 feet from the rear property line adjacent to Parcel 295 which isowned by the community, Sherwood Forest Club, Inc. The community has reviewed the plan,and approved the variance application as co-applicant for disturbance to steep slopes on Parcel295 for the construction and maintenance of the deck. A copy of the Sherwood Forest Club, Inc.approval letter dated March 6, 2018 is enclosed with this submittal package. The President ofSherwood Forest Club, Inc., Mr. Richard Hook IV has signed the enclosed variance application.

The subject property is located on Nottingham Hill in the community of Sherwood Forest. Theproperty is an irregularly shaped, legal building parcel consisting of approximately 0. 16 acres inarea, and is currently improved with a single-family dwelling, driveway, and associatedimprovements. The existing dwelling is nonconforming to current Anne Arundel County Zoningsetbacks as it is located approximately 11' from the rear property line and approximately 14' fromthe east side property line. The majority of the site is encumbered with slopes greater than 15%.The property is zoned R-2, and the site has a Chesapeake Bay Critical Area land use designationofLDA.

The subject property is small in size and the majority of the site is encumbered with steep slopesthat abut the existing dwelling. The proposed improvements are modest in size and basic in

design. The proposed disturbance of the steep slopes has been reduced to the maximum extentpracticable, yet is unavoidable to construct the proposed deck. No new lot coverage is proposedfor the proposed development.

It is our belief that this request meets all of the requirements for a Critical Area Variance. 1)Unique physical conditions and unwarranted hardshj^l specifically topography and the location ofthe existing dwelling to the property lines. Majority of the property is encumbered by steepslopes; approximately 80% of the property is located within steep slopes 15% or greater and abutthe existing dwelling. Denial of the requested variances would constitute an unwarranted hardshipon the applicant because it is not possible to construct the deck without disturbing the steep slopeareas. 2) Deprive the applicant of rights commonly enjoyed by other propertjesi the existingdwelling is of similar size and character of neighboring properties. To deny the requestedvariance would deprive the applicant of rights commonly enjoyed by other properties in theimmediate area. 3) Will not confer special privilege: granting this variance would not confer aspecial privilege to the applicant. Nearby properties enjoy amenities similar of what are proposedfor this project. 4) Not based on conditions or circumstances that are the result of actions by theapplicant: the conditions and circumstances are based on the natural topography of the site and thelocation of the existing dwelling to the property lines, and not as a result of actions by theapplicant. 5) Will not adversely affect water quality or adversely impact fish. wildlife, or^lanthabitat within the County's critical area: the proposed development will not cause adverseimpacts to fish, wildlife, or water quality in the Critical Area. The disturbance for the proposeddevelopment is minimized to only what is necessary to complete the project. Mitigation willoccur in accordance with county regulations. Sediment and erosion controls will be utilized toensure that construction and grading will not adversely affect the sun-ounding environmentalfeatures located within the Critical Area. Strict limits of disturbance are proposed in steep slopesto protect the sensitive area. These precautions will ensure that water quality, fish, wildlife, andplant habitat will not be adversely affected.

The granting of the variances will not alter the character of the neighborhood, impair the use anddevelopment of adjacent properties, or reduce forest cover in the LDA. The construction of adeck for a single-family dwelling on a residentially zoned lot is not detrimental to the publicwelfare.
