NOTICEWhereas, the Government of Jammu & Kashmir has established var-ious Toll gates / stations / Guarding Posts in the State, which amongothers include Nagri, Goondh, Kote Punnu, Paharpur, KerianGandial, Pattan Berian/ Magar Khad bordering State of Punjab,under the J&K Levy of Tolls Act, Svt. 1995 (1938 AD).Whereas, the Toll Post / Station or Guarding Post is any structure orPlace of shelter wherefrom, the vehicles, goods or animals do notcross clandestinely with the intention of evading payment of Toll.Whereas, any attempt or evasion of Toll attracts action under Section8 of J&K Levy of Tolls Act that reads as under:-"Whoever trans-ships, abets or attempts the trans-shipment of goodsfrom a carriage or animal on which the toll is chargeable at a higherrate to a carriage or animal on which toll is chargeable at a lowerrate, or vice versa, or whoever adopts any device to evade paymentof toll at a toll gate or station, shall be liable to a fine equal to 10 timesthe amount of actual toll leviable or [1000 rupees], whichever behigher."Further, Section 9 of J&K Levy of Tolls Act reads as under:-"If any person intentionally obstructs any toll Officer, or any other per-son duly employed in the collection of tolls in the exercise of anypowers given under this Act to any officers or person, he shall beliable to imprisonment not exceeding six months, or to fine notexceeding 1,000 rupees, or to both".Besides Section 3 (2) of J&K Levy of Toll Rules reads as under:-"No vehicles, goods or animals on which Toll is chargeable shall bepermitted to cross local area except through a road, bridge etc. onwhich Toll Post stands established. If any person driving a vehicle orcarrying goods or animals, attempts to cross Toll limits otherwisethan by such a road, bridge etc with the intention of evading Toll theperson Incharge of the post or any other person deployed for the pur-pose shall cause him to be pounced alongwith such vehicle or ani-mals at the Toll Post for payment of Toll and fine if leviable under theAct".Therefore, through the medium of this notice, the general public aswell as dealers/traders/ drivers are hereby informed to strictly adhereto the provisions of Government Act and the Toll Tax evaders arewarned to desist from violating the provisions of Toll Act and areadvised to use the established routes / paths only, otherwise strictaction shall be taken against them besides invoking the above quot-ed Sections of the J&K Levy of Tolls Act.
