In Italy a nuclear regulatory authority is going to be set up in the coming

months and a suitable area for a surface repository facility for storing waste is

being investigated and in the near future, a long-term national program for

managing waste and spent fuel, in accordance with the European

Community's recent Waste Directive will be defined.

• Italy currently has no final repository for LILW and HLW • Generally wastes are stored temporarily on-site; medical and industrial LLW are stored in a few centers • Spent fuel is being reprocessed either in UK and in France. ENEA initiated efforts for siting and designing a national repository since the ‘90ties. and created a Task Force, that produced a large number of studies. • In 2003, in a wider efforts to solve nuclear criticalities, Italian Government started a siting process, but the initiative could not reach the objective due to local opposition (Scanzano Ionico). • The urgent need for Italy for a disposal site, at least for LILW, and the possible nuclear renaissance, led Government to restart the process. • The 2 most important legislative acts are: Law 99/09 legislative Decree 31/2010

Nuclear En. in Italy: The Legal Framework

In July of 2009 the Italian parliament adopted a bill ending the ban on the use of nuclear energy. Italy definitively approved the return of nuclear energy after 22 years as part of a new development strategy. Italy abandoned nuclear energy after a 1987 referendum, whose result was strongly influenced by the Chernobyl disaster in Russia the previous year. The new law covers a large range of areas including nuclear safety, licensing, research, potential sites' selection and decommissioning.


After one year of intense debate, the Italian Parliament approved the Law 23 July 2009, n. 99, “Provisions for the development and internationalization of enterprises, and energy” (published in the “Gazzetta Ufficiale” N. 176, 31 July 2009).

Law 99/2009, that entered into force on 15 August 2009, contains the fundamental principles of the new Italian nuclear legal framework:

Art. 25 Government is entitled to establish legislative procedure for the Italian NPPs siting and licensing

Art. 26 CIPE defines the types of plants for the new NPPs and the criteria to promote the constitution of consortia

Art. 29 Creation of an independent Nuclear Safety Agency

Art. 27/37 Reorganization of SOGIN and ENEA

Art. 38 Promotion of innovation in the nuclear sector

Art. 25:

Rules for operators concerning radioactive waste management and nuclear plants decommissioning, including the creation of an ad hoc decommissioning fund

The qualification criteria that operators shall satisfy in order to run construction, operation and decommissioning activities of nuclear plants

Wide information campaign to the Italian population on nuclear energy (in particular, safety, security, and economics)

Financial compensation to the involved municipalities and population.


In February 2010, the Italian government signed a decree (d.lgs. n. 31 15 february 2010) defining:

• the one step procedure for the siting, construction and operation of nuclear facilities (includes VIA+VAS+AIA, Integrated Environment Authorization)

• management of radioactive waste and the procedures for the siting, construction and operation of a national repository for final disposal of long term radioactive waste

• Compensative Measures for the local communities hosting the facility.

Legislative Decree n. 31 of 15/02/2010

“Location, realization, and operation discipline of nuclear power plants, nuclear fuel production plants, irradiated fuel and radioactive wastes storage systems…”

The main points are: • The new Agency for Nuclear Safety (ASN) will be responsible

for the definition of the characteristics of suitable sites for nuclear power plants, in collaboration with ISPRA, ENEA and the Universities,

• Sogin S. p.A. has to draft a (map of suitable areas) “disposal site chart “ based on IAEA and ANS criteria.

• The Ministry for Economical Development (MSE), with other authorities, will approve the draft chart


The main points are:

Sogin will try an agreement with the interested local authorities

MSE will approve the final chart.

Sogin will start the technical analysis on suitable sites

Transparency is a “must” for any acivities

MSE will issue the final site authorization

Local communities will receive an economical compensation to increase the advantages linked to the repository

Sogin will realize and operate the National Repository for spent fuel and radioactive wastes in the framework of a wider Technologic Park.

Decree n.31 foresees that SOGIN S.P.A. defines a group of potentially susitable areas for the localization of The National Repository , the implementation of the Strategic Environmental Evaluation (SEE) for the Public Involvement, which is a tool developed by the European Commission for assessing plans and program, adopted in Italy with the decree n.152/2006. • Environmental Ministry, according to art. 9 comma 2 manages the development of Public Consultancy, foreseen by SEE
