Land Quality Update, Books Brothers Site and Adjacent Land, the Causeway, Maldon

The purpose of this letter is to update previous land quality assessments for the Books Brothers Site and adjacent land at the Causeway in Maldon in light of a change to development proposals. The previous development layout from 2011 has been revised such that a new planning application is required. It is intended that this letter and appended documents will be sufficient to support the new application and that further work required will be stipulated in planning conditions.

1.1 Proposed changes to development layout

The new proposed development layout is appended (drawing 535-SK-009), together with the red line boundary of the site which remains unchanged. Units 3, 4, 5 and 6 in the west of the site remain as standard retail, and the proposed hotel to the north of the main site also remains unchanged. However the previous DIY unit in the north-east of the site has been replaced in the proposed layout by a food store (Unit 1 and ‘back of house’ - BOH). The proposed use of Unit 2, also in the north-east of the site, remains unchanged as standard retail.

The key change therefore is the introduction of a food store within the scheme, replacing the DIY unit, and this change has been sufficient to necessitate a new application. The revised proposal is described as:

‘Demolition of existing buildings and redevelopment of site to provide food store, non-food retail units and hotel; access, servicing, vehicle and cycle parking, hard and soft landscaping and associated works’.

1.2 Previous Land Quality Assessment Reports

To the best of our knowledge, the only reports issued in relation to the planning application site are:

1.3 Consideration of Land Quality Issues

In the context of land contamination risk, the change of use of one of the units from DIY store to food store is not significant. The end use scenario for the site remains commercial with the majority of the site to be covered by buildings and hardstanding. There is also no change to the site boundary. The desk based land quality assessment completed in 2008, and updated in 2010 and 2011, therefore remains applicable to, and appropriate for, the proposed revised development. Note that the 2010 letter included a review and assessment of additional land (location of proposed hotel) to the north-west of the site area covered by the 2008 desk study.

The 2008 desk study identified the following:

Potential on-site historical contamination sources associated with a railway and sidings, the infilling of a pond and a timber works.

Potential risks to human and environmental receptors from ground gas (high), asbestos in the ground (moderate) and contamination in the ground (moderate / low).

1.4 Recommendations

The following scope of works is recommended in order to comply with requirements of the National Planning Policy Framework and appropriate land quality guidance including the Environmental Protection Act 1990: Part 2A Contaminated Land Statutory Guidance, BS5930, BS10175, CLR11 (Model Procedures for the Management of Land Contamination) and GPLC 1-3 (Guiding Principles for Land Contamination).

Site inspection to design / scope an intrusive site investigation

Sample and chemically analyse shallow soil and groundwater

Complete a minimum of six rounds of ground gas monitoring with confirmatory laboratory analysis (in accordance with current guidance including CIRIA C665 and BS 8576:2013)

Complete a generic quantitative risk assessment on site investigation results and revise the conceptual site model and qualitative risk assessment

Complete detailed quantitative risk assessment if necessary

Provide recommendations to mitigate the risk of ground contamination if required, which may include ground gas protection measures and potentially a remediation strategy.

As stated above, it is envisaged that the requirement for further land quality assessment at the site will be stipulated in planning conditions.

Land Quality Issues Relating to Proposed Retail Development Brooks Brothers Site, the Causeway, Maldon

It is proposed that the above site is redeveloped for retail / commercial use as illustrated on the attached preliminary development plan. We understand the proposed development includes a 55 bed hotel and restaurant. The purpose of this letter is to summarise previous land quality studies at the site. The letter also recommends further work required to assess land quality at the site in order to satisfy the requirements of Planning Policy Statement 23. It is anticipated that this letter and appended documents will be sufficient for the purpose of supporting the current planning application and that further work required will be stipulated in planning conditions.

To our knowledge, there has only been one land quality report issued for the current planning site, a desk study titled Land Quality Assessment: Brooks Brothers, the Causeway, Maldon, Essex, Enviros Consulting March 2008. The report was produced for Aquila Developments Limited to support the acquisition of the Brooks Brothers Site prior to redevelopment of the site to commercial / industrial use. The report is enclosed with this letter. Comparison of the 2008 site boundary (shown in Figure 2 of the attached 2008 report) with the current development plan reveals that the current planning site is slightly larger with an extension to the north-west. This additional area protruding to the north-west has not therefore been investigated.

The following letter summarises the main findings of the 2008 desk study report, describes the history and regulatory data for the additional area to the north-west and outlines further work required to support redevelopment.

Site History

Potentially contaminating historical uses identified on the site in the 2008 desk study included a railway and sidings, the infilling of a pond and a timber works. Off-site historical uses close to the site included railway tracks, an iron works, a gasworks, timber yards, an iron and brass foundry, electricity substations and a garage. The site and immediate surrounding area therefore has a long industrial history dating from at least the late 1800s.

We have reviewed the historical maps with respect to the additional land to the north-west of the 2008 site, which is included in the current planning area. The maps reviewed date from 1874 to 2007. Prior to 1974, there were no buildings shown in this area. The first buildings marked in this area are in the 1974 plan where there were four buildings shown. The use of the buildings is not indicated. A fifth building is shown on the 1985 plan and a garage is marked off-site just to the north-west of this location. The five buildings and the off-site garage are still indicated on the 1993 plan. In the most recent 2007 plan, two of the buildings remain.

Potential Sources of Contamination

On the basis of the site history, on-site sources identified in the 2008 report included the railway and sidings, the infilled pond and the timber yard. The historical maps for the additional area to the north-west of the 2008 site do not add to this list of potential contamination sources. However, given the surrounding land use, the buildings present on this area of land probably had a commercial or industrial use. It is also noted that a garage was located close by which represented a potential contamination source.

Environmental Setting

The 2008 report assessed the groundwater sensitivity as low as the site is underlain by a Minor Aquifer (Secondary A Aquifer by new classification system), there is no potable abstraction within 1km of the site and the site is not within a Groundwater Source Protection Zone. Surface water was assessed as high sensitivity due to the presence of an on-site pond which may be connected to Blackwater Estuary. The ecological sensitivity was also assessed as high as the nearby Blackwater Estuary is a designated SSSI, SAC and SPA.

Risk Assessment

A qualitative risk assessment was carried out in 2008 and the following potential risks above low were identified for redevelopment of the site for commercial / industrial use:



High potential risk to future site users and moderate potential risk to construction workers during redevelopment and to future buildings post development from on-site ground gas source (methane and carbon dioxide associated with infilled ground and natural alluvial deposits);

Moderate / low potential risk to construction workers and future site users from off-site ground gas source (elevated methane and carbon dioxide recorded at the adjacent Trading Estate);

Moderate / low potential risk to construction workers, future site users, the water supply and surface waters from contaminants in the ground associated with the historic use as a railway depot and / or the historic and current use as a timber yard; and

Moderate potential risk to construction workers and future site users from asbestos in the ground following demolition of old buildings.

The ground beneath the additional area to the north-west of the 2008 site is also likely to comprise made ground over alluvium and hence the high potential risk from ground gas is likely to be appropriate for this area also. Similarly, the moderate and moderate / low potential risks from asbestos and ground contamination respectively are also applicable to this area, where demolition of buildings and unknown industrial / commercial activities are likely to have taken place.

Recommendations from 2008 Report

The report recommended that a ground investigation be carried out prior to redevelopment, to provide additional data to further assess the moderate / low to high potential risks identified. The objectives of such an investigation included an assessment of shallow soil contamination, groundwater quality and the soil gas regime and the revision of the site conceptual model and risk assessment.

Recommendations for Current Planning Application

The 2008 desk study was completed for a commercial / industrial development and the current proposed development is for retail / commercial use. Therefore the 2008 desk study (attached) together with the information in this letter covering the additional area to the north-west are considered sufficient as a preliminary risk assessment (in accordance with Contaminated Land Report 11 and PPS23) for the purposes of the current planning application. The current proposed layout is predominantly hard standing with commercial buildings and small areas of landscaping and therefore the risks defined in the 2008 study are considered appropriate. The current planning site area includes an additional small area of land to the north-west of the



2008 site, but based on the historical maps, the potential risks defined are the same as those defined for the wider site. Never the less, it is recommended that this additional area is walked over during the scoping of a Phase 2 / intrusive investigation.

We recommend that a Phase 2 assessment / intrusive investigation, with an appropriate level of risk assessment dependent on findings, are completed prior to redevelopment. Protection measures may need to be incorporated into the development (particularly with respect to ground gas) and remediation may also be required. We anticipate that the requirement for this work will be set out in a planning condition.

At this stage, the suggested scope of the Phase 2 / intrusive investigation and assessment, in accordance with BS 5930, BS 10175, CLR11 and PPS23, is as follows:

Walkover to design / scope intrusive investigation;

Sample and chemically analyse shallow soil and groundwater;

Carry out a minimum of six round of ground gas monitoring with confirmatory laboratory analysis (in accordance with current guidance including CIRIA C665);

Complete generic quantitative risk assessment on site investigation results and revise the conceptual model and qualitative risk assessment;

Complete detailed quantitative risk assessment if necessary;

Provide recommendations which may include gas protection measures and an outline remediation strategy.

EXECUTIVE SUMMARY

In March 2008, Aquila Developments Ltd appointed Enviros Consulting Limited to undertake a Land Quality Assessment of Brooks Brothers, The Causeway, Maldon, Essex, to support acquisition prior to redevelopment of the site to commercial / industrial use.

Visual Observations from Site Visit

The site is approximately 2.5ha, a long but narrow pond is present on-site along the northern boundary. The site comprises a timber storage yard. In the south are a number of disused wood drying kilns, with associated boilers and an above ground fuel tank (40,000l). A disused second tank present in SE. A third above ground storage tank was historically present, although the location and use is not known.

History On-site In 1874 southern part occupied by a railway, sidings, a Goods Shed and part of the platform of the adjacent Station. Northern part potentially occupied by a single large pond. By 1959, part of the pond appeared infilled and raised and occupied by further rail sidings. Between 1959 and 1974, the railway and sidings were no longer present and the site was a works. By 1985, further infilling of the pond had taken place and the site was a Timber Yard. Off-site In 1874 the on-site railway tracks continued to the NW and SE. An engine shed was 50m SE and an iron works and gasometer 50m west. Two timber yards present within 200m and two coal yards within 100m. By 1897, the timber yard to the southeast had extended to within 25m of the site. By 1922 an iron and brass foundry was located immediately southwest of the site. By 1959, the iron and brass foundry was replaced by a depot and a works was present adjacent to the site. By 1960, the timber yard south east of the site was replaced by a depot/warehouse. By 1974 a timber yard and works, with several tanks and two electric substations, was located directly N. The railway tracks to SE and engine shed had been removed, while the station and railway tracks to NW were dismantled. The off-site part of the pond had been re-engineered into two smaller ponds. By 1989 when a garage was present 50m north of the site.

Previous Investigations

No known previous investigations for site, but reports for adjacent Blackwater Trading Estate. Historical uses of the trading estate have included a ship building yard and timber yard. Ground conditions comprised Made Ground, thin layer of organic rich alluvial deposits, and sandy clay. Elevated methane concentrations of up to 47.8% were recorded across the estate. Groundwater sampling did not identify significantly elevated contaminant although former creosote pits and underground fuel storage tanks were known to exist.

Environmental Groundwater assessed as low sensitivity: Site underlain by a Minor

Setting Aquifer, no potable groundwater abstraction within 1km of the site, not within a Groundwater Protection Zone. Surface water assessed as high sensitivity: on site pond which may be connected to Blackwater Estuary also potential migration via base flow. No surface water abstractions within 500m. Ecological sensitivity assessed as high. Situated 170m south west and south east, the Blackwater Estuary is designated SSSI, SAC and SPA.

Risk Assessment

A qualitative risk assessment was undertaken at the site based on the findings of the review for the continued use of the site as retail units. The risk assessment has considered risks with the potential to affect the site. Those risks assessed as being greater than low are detailed below.

There are potential moderate / low risks to current site users from the potential presence of asbestos in shallow soils and soil gas (methane and carbon dioxide) derived from the infilled pond and alluvial rich soils. This level of risk reflects the severity of the hazard but the low likelihood of exposure, due to the type of buildings on-site. These moderate / low risks can therefore be considered to be acceptably low for the continual use of the site.

There are potential moderate / low risks associated with the current bulk storage of fuel. Such risks can be controlled by the good housekeeping practices.

A number of potential unacceptable risks have been identified during redevelopment of the site. These relate to the potential exposure of workers during excavations and the mobilisation of contaminants into surface waters. However, potential risks can be mitigated by appropriate site controls, personal protective equipment, localised removal of soils and appropriate construction of foundations.

Potential moderate / low to high risks have been identified associated with the potential presence of contamination, to the future commercial / industrial development. Unless these risks are mitigated, they could present unacceptable risks

to the future development. Such mitigation measures include a site investigation and subsequent remediation; and installation of gas protection measures to all new buildings and structures.

Statutory Designation

In our opinion, under current site use, it is possible that the site could be classified as contaminated land by the local authority under the provision of the draft statutory guidance made under Part IIA of the Environmental Protection Act 1990. This is due to the presence of a potential pollutant linkage with the potential to cause significant harm to people or the wider environment. However the moderate / low risks are considered to be acceptably low for the continual use of the site.

Residual Liability

Under the current Government Guidance, liability for historic contamination in the first instance rests with the polluter of the land (the “Class A person”). Only, if that polluter cannot be found can liability pass to others (including the current owner, a “Class B person”) unless liability has been passed as a condition of the sale.

Financial Security

In our opinion following implementation of the recommendations, the site can be considered acceptable security for funding from an environmental risk standpoint.

Recommendations

It is recommended that the following housekeeping actions are implemented for continual current use:

♦ Secondary containment for all 25l drums of decanted fuels;

♦ Adequate containment of the tank fuelling points.

Prior to redevelopment, a ground investigation is recommended at the site in order to provide additional data to further assess the potential moderate/low to high risks identified above. This would allow the need for remedial works to be established. Estimated cost of the investigation - £20-25K.

In addition, a flood risk assessment is recommended at the site prior to redevelopment. Estimated cost of a flood risk assessment - £2.5K.

1. INTRODUCTION

In March 2008, Aquila Developments Ltd appointed Enviros Consulting Limited to undertake a Land Quality Assessment of Brooks Brothers, The Causeway, Maldon, Essex to support acquisition prior to redevelopment for commercial industrial use.

1.1 Project Objectives

The objectives of the project were as follows:

♦ To assess the presence, likely extent and nature of any potential environmental hazards;

♦ Undertake a qualitative environmental risk and liability assessment; and

♦ To identify any further works and actions required to clarify, manage or mitigate any environmental risks associated with redevelopment of the site for commercial use.

1.2 Phase 1 Environmental Review

The environmental review comprised a desk-based study in conjunction with a site visit, undertaken by Lauren Boydell of Enviros on the 12th March 2008. No intrusive site investigation or chemical analysis was undertaken. The full scope of works is described in Appendix 1 with key aspects summarised as follows:

� Review of current activities and the current condition of the site identified from the site walkover and discussions with site staff and regulatory data relating to the site;

� Review of the history of the site and surrounding area from historical Ordnance Survey maps and any anecdotal information available;

� Assessment of the environmental setting of the site from a review of published geological, hydrogeological and hydrological information, and regulatory data;

� Development of a conceptual model for the site identifying potential contamination sources, pathways and receptors and the inter-relationship between them, followed by completion of a qualitative risk assessment to identify potential pollutant linkages; and

� Assessment of possible environmental liabilities associated with the site and the need for any further investigations.

This review has relied on published information and information provided by the client and other parties, including anecdotal information, obtained during the given time period. The findings and opinions in this report are based upon information obtained from a variety of sources as detailed within the report. Enviros believes the information obtained from third parties is reliable but does not guarantee its authenticity.

1.3 Framework for Contaminated Land Assessment

Contaminated land risk assessment is based on development of a conceptual model for the site. This model is a representation of the relationship between contaminant sources, pathways and receptors developed on the basis of hazard identification. Risk

assessment is the process of collating known information on a hazard or set of hazards in order to estimate actual or potential risks to receptors. The guiding principle behind this approach is an attempt to establish connecting links between a hazardous source, via an exposure pathway to a potential receptor, referred to as a ‘pollutant linkage’. If there is no pollutant linkage, then there is no risk. Therefore, only where a viable pollutant linkage is established does this assessment go on to consider the level of risk.

This approach is in accordance with the Department of the Environment Transport and the Regions (DETR) Statutory Guidance on Contaminated Land (Ref. 1) and the Department for Environment, Food & Rural Affairs (DEFRA) / Environment Agency (EA) Model Procedures (CLR11, Ref. 2). The risk assessment undertaken in this document comprises a ‘preliminary risk assessment’ in the terminology used in CLR11.

1.4 Report Structure

The structure of the rest of this report is as follows. Chapter 2 provides a profile of the site including location, current activities and site history. The environmental setting of the site is assessed in Chapter 3. Chapter 4 describes the initial site conceptual model based on the information gathered and the results of a qualitative risk assessment. Chapter 5 provides conclusions and recommendations on the environmental condition of the site.

2. SITE PROFILE

2.1 Site Location

The site is located within a predominantly commercial and industrial area, in the centre of Maldon, Essex. A site location plan is presented as Figure 1.

2.2 Surrounding Land Uses

The surrounding area predominantly comprises industrial land uses with commercial and residential properties present in the vicinity of the site. Neighbouring land uses are as follows:

� The Blackwater Trading Estate is adjacent to the north;

� The Causeway borders the site to the west with commercial properties beyond;

� A number of small industrial developments, residential properties and a museum are present to the south of the site;

� A large pond is borders the site to the west.

2.3 Site Description and Current Site Activities

The site is roughly L shaped and encompasses an area of approximately 2.5ha, all of which is covered in concrete hardstanding. The site is generally flat but slopes slightly downwards towards the north. A long but narrow pond is present on-site along the northern boundary.

The site comprises a timber storage yard with associated offices and is used only for the storage of timber prior to delivery. No processing of the timber is currently undertaken. The north east corner of the site houses the site offices which are constructed from temporary portable cabins. To the south of the offices is a large brick building, which formed part of the historic railway goods depot. This building is currently used for timber storage.

In the southern part of the site are a number of wood drying kilns, with associated boilers and fuel tank. It was not possible to obtain access into these during the site walkover. The kilns have not been used in the past three years and the fuel tank is currently used for the fuelling of the site vehicles, predominantly fork lift trucks.

The remainder of the site is used for wood storage. Most of the material is kept undercover in large open sheds, predominantly of concrete and metal construction although there is one uncovered storage area in the centre of the site.

2.3.1 Effluent and Site Drainage

The site is connected to the mains drainage system however it is thought that some surface/storm water may drain to the pond at the north of the site.

A cesspit was previously present adjacent to the site offices. This has subsequently been decommissioned and removed and the offices are now connected to the mains services.

2.3.2 Waste Management and Disposal

All wastes which mainly comprise wood and some plastic, are stored on site in skips, which are collected by a subcontractor for disposal.

2.3.3 Asbestos

Enviros were informed by the site contact (Steve Berrett) that an asbestos survey has been undertaken at the site approximately 18 months ago. This reported that roof of the historic brick building contained asbestos. The asbestos report has not been made available to Enviros for review.

2.3.4 Electrical Transformers & Sub-Stations

No transformers or substation were identified during the site walkover.

2.3.5 Storage of Hydrocarbons

Storage of hydrocarbons is currently limited to one above ground tank with an estimated capacity of 40,000l. This was previously used for storage of fuel for the kilns but is now only used for refuelling the site vehicles. The tank is contained within a brick bund and evidence of spillages and leaks were identified around external areas of the bund and surrounding hardstanding.

A second tank, estimated capacity of 5,000l, is located within the south east corner of the site. This is currently disused and uncontained, and there were no signs of spillages and leakages in the vicinity of this tank. Site staff reported that a third above ground storage tank was historically present at the site, although the location and use of this was not made available during the site walkover.

2.3.6 Storage of other Materials

During the site walkover a number of 25l drums were located on hardstanding close to the bulk storage tank. The drums were not labelled but site staff report that these may have been used to decant fuel from the tank.

2.4 Regulatory & Environmental Data for Site and Surrounding Area

Information regarding potential hazards associated with environmental regulatory controls is summarised in Table 2. Regulatory information relating to controlled waters and ecological receptors is detailed within Chapter 3. This information is taken from the data provided by the Landmark Information Group, a full copy of which is provided in the Appendix 2.

2.5 Site History

The site history has been determined from a review of the historical sources carried out by Enviros. The information for these historical reviews has been gained from historic maps. Data on potential sources of contamination was obtained from Department of Environment (DoE) industry profiles for the various industrial activities on-site.

2.5.1 On-site

The earliest maps dated 1874 showed the southern half of the site to be occupied by a railway, sidings a Goods Shed and part of the platform of the adjacent Station. The northern half of the site appeared to be at a lower level and on maps dated 1922, appeared marshy and potentially occupied by a single large pond. At this time additional small buildings were present within the north west corner of the site, and long the southern boundary. Cattle Pens were also labelled within the far south west corner of the site.

By 1959, part of the pond in the northern half of the site appeared infilled and raised and was occupied by further rail sidings. The far northern third of the site was labelled as a pond and a small building labelled depot was present in the far north west corner.

The site remained relatively unchanged until sometime between 1959 and 1974, when the railway and sidings were no longer being present and the site was labelled as a works. By 1985, further infilling of the pond had taken place resulting in an 8m wide pond stretching along the northern boundary. At this time, the site was labelled as ‘Timber Yard’. By 1989, the current site layout was shown.

2.5.2 Off-site

The earliest available map dated 1874 showed the surrounding area to comprise mainly industrial properties with some residential and commercial properties. A built up residential area was present approximately 400m south of the site, a timber yard was situated approximately 200m to the south west of the site and another 150m south east. Two coal yards were located approximately 100m south of the site.

At this time, the on-site railway tracks continued to the northwest and south east of the site. An engine shed was located 50m southeast of the site and an iron works and gasometer 50m west. A steam saw mill was present 150m southeast of the site and a train station was located adjacent to the site’s south-western boundary. North of the site was a row of residential houses and to the northeast is an area of agricultural or open land.

By 1897, the timber yard southeast of the site had extended to within 25m of the site and replaced one of the coal yards. By 1922 an iron and brass foundry was located immediately southwest of the site. The second coal yard located 100m south was no longer present.

By 1959, the timber yard to the south west of the site had been replaced by mills, the iron and brass foundry was replaced by a depot and a works was present adjacent to the site. Approximately 100m northwest of the site, an area of residential and industrial buildings including a depot had developed. A factory was present 150m west of the site. By 1960, the timber yard south east of the site was replaced by a depot/warehouse.

By 1974 a timber yard and works, with several tanks and two electric substations, was located directly north of the site. The railway tracks running south east of the site and the engine shed had been removed. The off-site part of the on-site pond had been re-engineered into two smaller ponds located approximately 10m and 115m south east. The train station was labelled as disused and the railway tracks running northwest of the site are labelled as dismantled. The depot located 150m northwest of the site had been replaced by an engineering works, and an electrical component factory and furniture assembly plant were located approximately 75m northwest of the site. A garage was located 100m north of the site. The iron works located northwest of the site had been replaced by a coal yard and the factory located 150m west had been replaced by a joinery works with an electric substation. Several more factories were present between 125m and 200m south west of the site. An electric motor works is located 200m northwest of the site.

No further significant changes occurred until 1989 when a garage was present 50m north of the site. By 2007, the residential areas to the south and north of the site become more built up. No further significant changes were noted on the historical maps.

2.5.3 Potential Sources of Contamination

The following potential contaminative uses that may have impacted the site have been identified from the historical map review:

2.6 Previous Report

No known previous investigations have taken place on this site. However, a number of reports have been produced on the Blackwater Trading Estate, which borders the site to the north. These reports were reviewed by Enviros in May 2007 on behalf of Aquila Developments Ltd. One round of gas monitoring was also carried out by Enviros in May 2007. The findings of the Enviros work on Blackwater Trading Estate is summarised below:

� Historical uses of the estate have included a ship building yard and timber yard.

� Ground conditions generally comprised up to 1.2m of Made Ground (a sandy gravel with cobbles) being underlain by a firm brown sandy clay. A thin layer of organic rich alluvial deposits are present in localised areas.

� Elevated methane concentrations of up to 47.8% were recorded across the estate. The highest concentrations relate to the presence of sawdust within the eastern part of the estate.

� Former creosote pits and underground fuel storage tanks are known to exist on the estate. However, groundwater sampling did not identify significantly elevated contaminants.

3. ENVIRONMENTAL SETTING

3.1 Topography

The Landmark Site Sensitivity Map (Ref. 3) shows the site is located approximately 5m above Ordnance Datum (aOD). The site is generally flat but slopes slightly downwards towards the north.

3.2 Geology

The geological map for the area (Ref 4) indicates the site to be directly underlain by River Terrace Gravels. These are likely to comprise a mixture of sand and gravel of less than 10m in thickness. Alluvium may potentially be present at the site, bas edon its presence at the adjacent Blackwater Trading Estate, and if present, is likely to comprise clay or silt with fine sand and organic material.

The BGS map indicates that the River Terrace Gravels are underlain by the London Clay Formation comprising grey clay which weathers to brown. The London Clay Formation is indicated to be greater than 50m in thickness.

The site geology is summarised in Table 4.

3.3 Hydrogeology

The Environment Agency (EA) has classified the River Terrace Gravels as a Minor Aquifer (Ref 5) and worst case soil vulnerability classification of high (H) has been attributed to the site.

No groundwater abstractions are present within 1km of the site. There are four groundwater abstractions between 1 and 2km from the site, all relating to spray irrigation. The site does not lie within a groundwater source protection zone as identified by the EA (Ref. 5).

There is one discharge consent to land, 420m north west of the site relating to final treated effluent. There are no records of pollution incidents to groundwater within 1km of the site.

3.4 Hydrology

There is one pond located on the site. It has a long and narrow shape (estimated between 4m and 10m wide and over 200m long) and defines almost the entire north-eastern boundary of the site. This is the only surface water feature which has been

identified on-site. A further two ponds are located to the southeast of the site, in line with the pond described above. On the historical maps these were shown to be connected to each other and potentially also to the estuary.

The area forms part of the estuarine complex where the River Blackwater and the River Chelmer flow into the sea via the Blackwater Estuary. The area is marked by its tidal creeks and salt marshes, typical for the area. One such creek, the Heybridge Creek, is located 160m to the southeast of the site at its closest distance. In addition, the Chelmer and Blackwater Navigation is situated 200m to the northwest of the site.

The EA’s General Quality Assessment Scheme (Ref. 6) assesses the water quality of the River Chelmer as D (fair) for the period 2004 to 2006 (the most recently available data). The River Chelmer is also classified as Grade B (good) for biological quality under the GQA scheme.

Two surface water abstractions are recorded within 1km of the site. Both relate to Maldon Golf Club for spray irrigation and are located 630m west and 990m north west of the site.

There are 17 discharge consents within 500m of the site for the discharge of surface water. The receiving waters are the Blackwater Estuary, River Blackwater, a tributary of the River Blackwater and Heybridge Creek.

A total of 28 pollution incidents have been recorded within 1km of the site. These relate to the release of sewage, oils and chemicals. Only two of these were classed as ‘significant’, all others were ‘minor’.

The Environment Agency flood map indicates that the site in question is located in flood zone 3. Initial assessment of the situation identifies the tidal reach of the River Chelmer adjacent to the site as the source of this flood risk. The closest area of low flood risk is situated approximately 200m to the south of the site, beyond the River Chelmer.

3.5 Ecology

The Blackwater Estuary is classified as a Site of Special Scientific Interest (SSSI), Special Area of Conservation (SAC) and Special Protection Area (SPA), 170m south east and south west of the site. It consists of open water, mudflats and saltmarsh and is one of the most important habitats for wildlife in the UK. It is also of international importance for its plants and archaeology and the river provides a rich harvest of fish and shellfish.

3.6 Summary of Site Sensitivity

The sensitivity of each of the identified receptors in the vicinity of the site, together with pathways from the site are summarised in Table 5 below.

4. CONCEPTUAL MODEL AND EVALUATION OF POTENTIALLY UNACCECPTABLE RISKS

4.1 Conceptual Model

Contaminated land risk assessment is based on development of a conceptual model for the site. This is a representation of the relationship between contaminant sources, pathways and receptors developed on the basis of hazard identification.

4.1.1 Potential Sources

� Current and future building structures and services (build up of flammable gas, concrete attack, impact on water supply);

� Groundwater (Minor Aquifer) [infiltration];

� Surface waters (on-site pond, River Chelmer , Chelmer and Blackwater Navigation, Heybridge Creek, River Blackwater) [migration potentially via linked ponds and also via baseflow, surface runoff];

� Flora and Fauna (Blackwater Estuary) [migration via baseflow, surface runoff].

4.2 Qualitative Risk Assessment

A qualitative risk assessment has been undertaken for these potential source-pathway-receptor linkages based on DEFRA (Ref. 7) and CIRIA guidance (Ref. 8). This is based on consideration of both:

� the likelihood of an event (probability – takes into account both the presence of the hazard and receptor and the integrity of the pathway);

� the severity of the potential consequence (takes into account both the potential severity of the hazard and the sensitivity of the receptor).

Further information on the risk assessment methodology used is given in Appendix 1. The method of dealing with identified risks and the level of significance of those risks will be a function of site use. Potentially unacceptable risks identified for current use and redevelopment of the site for a commercial/ industrial end use are considered in Table 6.

5. CONCLUSIONS AND RECOMMENDATIONS

5.1 Risk Assessment

5.1.1 Current site use

There are potential moderate / low risks to current site users from the potential presence of asbestos in shallow soils and soil gas (methane and carbon dioxide) derived from the infilled pond and alluvial rich soils. This level of risk reflects the severity of the hazard but the low likelihood of exposure, due to the type of buildings on-site. These moderate / low risks can therefore be considered to be acceptably low for the continual use of the site.

There are potential moderate / low risks associated with the current bulk storage of fuel. Any spills or leaks will flow to surface water drains, which are likely to discharge to the on-site pond and / or nearby surface waters. Such risks can be controlled by the good housekeeping practices.

5.1.2 During redevelopment

A number of potential unacceptable risks have been identified during redevelopment of the site. These relate to the potential exposure of workers during excavations and the mobilisation of contaminants into surface waters. However, potential risks to redevelopment workers can be mitigated by appropriate site controls and personal protective equipment. The risks associated with mobilisation of contaminants can be mitigated by localised removal of soils and appropriate construction of foundations.

5.1.3 Future site use

Potential moderate / low to high risks have been identified associated with the potential presence of contamination, to the future commercial / industrial development. Unless these risks are mitigated, they could present unacceptable risks to the future development. Such mitigation measures include a site investigation and subsequent remediation; and installation of gas protection measures to all new buildings and structures.

5.2 Recommendations

5.2.1 Housekeeping

It is recommended that the following housekeeping actions are implemented for continual current use:

♦ Secondary containment for all 25l drums of decanted fuels;

♦ Adequate containment of the tank fuelling points.

5.2.2 Site Investigation

Prior to redevelopment, a ground investigation is recommended at the site in order to provide additional data to further assess the potential moderate/low to high risks identified above. This would allow the need for remedial works to be established. The objectives of the site investigation would be to:

� Assess the presence, nature and extent of shallow soil contamination;

� Establish the groundwater quality;

� Establish the soil gas regime;

� Revise the conceptual model and the associated qualitative environmental risk assessment in the light of the additional information; and

� Identify the need for and scope of further works and remedial design and/or actions, if any, to clarify, manage and mitigate any environmental risks.

Estimated cost of the investigation - £20-25K.

5.2.3 Flood Risk Assessment

Given that the site is in flood zone 3, care should be taken when considering redevelopment of this site. Under the sequential test, as set out in PPS25, development of such a site for ‘essential infrastructure’ (power generation facilities, substations etc.), ‘highly vulnerable development’ (care homes, hospitals etc.) or ‘more vulnerable development’ (residential development) is not recommended and within the planning process there is likely to be a presumption against approval of any such applications.

It is however recognised that in many cases there is an overwhelming imperative for development to be allowed. As such the types of development described above are permissible in flood zone 3 if the criteria of the exception test can be fulfilled. These criteria are:

� The development is sustainable when viewed in the context of the local area / community;

� The development is located on brownfield land;

� There are no appropriate alternative sites located in lower risk areas;

� The risk posed to the development by local flood sources can be reduced to an acceptable level; and

� Development of the site will not exacerbate flood risk elsewhere.

If any development on this site is pursued, including lower risk uses such as commercial or industrial, a flood risk assessment will be required. This assessment would need to demonstrate that the proposed development satisfies (or has the potential to satisfy) the last two criteria of the exception test.

Where the other criteria of the exception test need to be fulfilled, this should be done in parallel with the above and summarised within the flood risk assessment.

Estimated cost of a flood risk assessment - £2.5K.

5.3 Statutory Designation

In our opinion, under current site use, it is possible that the site could be classified as contaminated land by the local authority under the provision of the draft statutory guidance made under Part IIA of the Environmental Protection Act 1990. This is due to the presence of a potential pollutant linkage with the potential to cause significant harm to people or the wider environment. However the moderate / low risks are considered to be acceptably low for the continual use of the site.

5.4 Residual Liability

Under the current Government Guidance, liability for historic contamination in the first instance rests with the polluter of the land (the “Class A person”). Only, if that polluter cannot be found can liability pass to others (including the current owner, a “Class B person”) unless liability has been passed as a condition of the sale.

5.5 Financial Security

In our opinion following implementation of the recommendations, the site can be considered acceptable security for funding from an environmental risk standpoint.

RISK ASSESSMENT METHODOLOGY

Qualitative Risk Assessment Methodology

Risk assessment is the process of collating known information on a hazard or set of hazards in order to estimate actual or potential risks to receptors. The receptor may be human health, a water resource, a sensitive local ecosystem or even future construction materials. Receptors can be connected with the hazard under consideration via one or several exposure pathways (e.g. the pathway of direct contact). Risks are generally managed by isolating or removing the hazard, isolating the receptor, or by intercepting the exposure pathway. Without the three essential components of a source (hazard), pathway and receptor, there can be no risk. Thus, the mere presence of a hazard at a site does not mean that there will necessarily be attendant risks. The following risk assessment thus focuses on those parts of the site where hazards or potential hazards have been identified and is not general to the whole site.

Hazards

Potential sources of contamination are identified for the site, based on a review of the current and previous site uses. Not only the nature but also the likely extent of any contamination is considered, e.g. whether such contamination is likely to be localised or widespread.

Receptors

The varying effects of a hazard on individual receptors depend largely on the sensitivity of the target. Receptors include any people, animal or plant population, or natural or economic resources within the range of the source which are connected to the source by the transport pathway. Receptors can, in addition, extend to remediation processes and future construction materials that may be adversely affected by on-site contamination. In general, however, receptors can be divided into a number of groups dependant on the final use of the site.

Pathways

The mere presence of contamination does not infer a risk. The exposure pathway determines the dose delivered to the receptor and the effective dose determines the extent of the adverse effect on the receptor. The pathways which transport the contaminants to the receptor or target generally involves conveyance via soil, water or air.

Exposure Assessment

By considering the source, pathway and receptor, an assessment is made for each contaminant on a receptor by receptor basis with reference to the significance and degree of the risk. In assessing this information, a measure is made of whether the source contamination can reach a receptor, determining whether it is of a major or minor significance. The exposure risks are assessed against the present site conditions.

A qualitative risk assessment has been undertaken for these potential source-pathway-receptor linkages based on DEFRA and CIRIA guidance. This is based on consideration of both:

� The likelihood of an event (probability – takes into account both the presence of the hazard and receptor and the integrity of the pathway);


� The severity of the potential consequence (takes into account both the potential severity of the hazard and the sensitivity of the receptor).

Under such a classification system the following categorisation of risk has been developed and the terminology adopted as follows:

Term Description

Very high risk There is a high probability that severe harm could arise to a designated receptor from an identified hazard at the site without appropriate remedial action.

High risk Harm is likely to arise to a designated receptor from an identified hazard at the site without appropriate remedial action.

Moderate risk It is possible that without appropriate remedial action harm could arise to a designated receptor but it is relatively unlikely that any such harm would be severe, and if any harm were to occur it is more likely that such harm would be relatively mild.

Low risk It is possible that harm could arise to a designated receptor from an identified hazard but it is likely that at worst, that this harm if realised would normally be mild.

Negligible risk The presence of an identified hazard does not give rise to the potential to cause significant harm to a designated receptor.

For this reason, Landmark's Site Sensitivity maps and Datasheet(s) place great emphasis on statutory data provided by the EnvironmentAgency and the Scottish Environment Protection Agency; it also incorporates data from Natural England (and the Scottish and Welshequivalents) and Local Authorities; and highlights hydrogeological features required by environmental and geotechnical consultants. It doesnot include any information concerning past uses of land. The datasheet is produced by querying the Landmark database to a distance definedby the client from a site boundary provided by the client.
