PAssEnGEr ACknOwLEDGEMEntIn booking a Simply Escape package, tour or travel arrangement, you and those on whose behalf you are booking become a party to a contract with Simply Escape and those companies providing the included services. When you book with Simply Escape, you are accepting and agreeing to the Terms and Conditions contained herein as well as any terms and conditions that may be imposed by the suppliers of any tour components you purchase.

trAvEL AGEnCIEsSimply Escape relies on the professional services and counseling provided by travel agencies to best meet your individual needs. Your travel agent can explain to you our products and provide further information, including the availability of trip cancellation and out-of-province health insurance, documentation required for travel and to what extent living standards and practices at the destination may differ from those in Canada as may relate to your trip. Accordingly, we accept bookings only through travel agencies.

PrICEs AnD PAyMEntsNo booking is final until Simply Escape issues a written confirmation and payment is received by Simply Escape or guaranteed by your agency.

Prices shown in the Simply Escape brochure or on our website www.simplyescape.ca or as provided to your travel agent are in Canadian currency, unless otherwise indicated, and are subject to change without notice. Once your booking is confirmed, any price increase imposed 45 days or earlier before departure will entitle you to choose between a full refund and the increase. Once within 45 days from departure and final payment has been received, your price will not increase.

For booking dates more than 45 days prior to departure, a non-refundable deposit of 25% of the full price is required to process the booking. Final payment is due 45 days prior to departure for bookings under deposit and for bookings made within 45 days of departure. We accept agency cheques, Visa, Mastercard and American Express credit cards. The charges on your credit card statement will appear as Simply Escape. Your authorization to your travel consultant of the use of your credit card to pay for your reservation indicates your acceptance of the booking and our terms and conditions, whether or not you have signed a credit card draught.

CHAnGEs, CAnCELLAtIOns, rEfunDs AnD COMPLAIntsA change, including a name correction change, made 22 or more days from departure on a confirmed reservation is subject to an administration fee of $50 per person to a maximum of $100 per booking, plus GST in addition to any applicable supplier fees. Name corrections or date changes to issued airline tickets are subject to airline fees in effect at time of request. Changes within 21 days of departure and after departure are not permitted, and will be treated as cancellations.

Should you cancel your trip 22 days or more prior to departure, a fee of 25% of the full price paid will be charged. If cancellation takes place within 21 days of departure or after departure, the full amount is lost. Written confirmation of cancellation must be received by Simply Escape within 3 business days of any verbal notification that may be given in order for a refund to be processed.

We encourage all travelers to purchase trip cancellation insurance.

Should Simply Escape find it necessary to cancel the reservation, for any reason, we will provide a full refund of your money or offer a comparable alternate package acceptable to you. Simply Escape is not responsible for any charges that you may have paid for other services arranged by yourself or your travel agent in relation to your holiday.

Unused travel services or portions thereof are not exchangeable or refundable.

It is the passengers’ responsibility to obtain all required documentation by all relevant authorities. Your travel agent can assist you. No refund will be applicable if entry to another jurisdiction is denied or services are denied due to improper documentation on the part of the passenger.

Should you encounter a problem during your trip, you must advise the local suppliers at your destination. If not satisfied with their response, and you think that a correction may be feasible while you are in destination, please immediately contact your travel agency or Simply Escape. Otherwise, should you wish to make a claim, contact Simply Escape within 21 days of your return with a written description of the problem encountered and all applicable documentation relating thereto. As certain types of documentation must be returned to us in order to effect a refund, we suggest you send them to us by registered mail or courier.

PrOGrAMME CHAnGE / rEfusAL tO suPPLySimply Escape reserves the right to cancel or alter a programme prior to purchase by the passenger. This may result in a price difference from that shown in the brochure or even elimination of a particular package.

Simply Escape reserves the right to refuse a booking by so advising the agent at the time of booking or by immediately returning the deposit to the travel agent or passenger.

Simply Escape reserves the right to refuse to supply or continue the travel service where the traveler is in violation of a supplier’s terms and conditions, appears to be under the influence of narcotics or alcohol, is ill, appears to be a security risk or likely to disrupt other passengers.

sCHEDuLE CHAnGEsAir flight times and rail departure/arrival times are subject to change without notice. It is the passenger’s responsibility to confirm/reconfirm flight or rail times prior to travel. Simply Escape is not responsible should you miss your flight, your train or your connection.

Presentation of Vouchers and General Hotel Information

The majority of our hotels have a check-in time of 2 to 3 pm and a check-out time of 12 noon. Upon check-in, the hotel will require a credit card to cover any incidental charges.

Any special requests such as adjoining rooms, non-smoking/smoking rooms, bedding types that may have been made on your behalf are to be considered requests only and cannot be guaranteed.

Your package will include a voucher (or vouchers). It is your responsibility to present each supplier with the proper Simply Escape voucher; otherwise you could be charged for these services. Simply Escape is not responsible should this occur.

To maintain their standards, hotels occasionally carry out renovations or construction. Usually these are carried out with a minimum of inconvenience to guests. Should we be made aware of any such renovation or construction prior to your arrival, we will so inform your travel agent.

Participation in the tour, package or activity booked is entirely at the passenger’s risk. All baggage is carried at the owner’s risk.

We assume no responsibility for, and shall not be expected, asked or required to pay for any financial loss, personal injury, property damage, other loss, accident, delay, inconvenience, loss of enjoyment, upset, distress or irregularity which you or your travel companions or group members may experience either by reason of: (1) nonperformance by any suppliers for whatever reason; or (2) wrongful, careless, negligent or unauthorized acts or omissions on the part of any supplier or its employees or on the part of any other party not under our direct control; or (3) any defect, breakdown or other failure of any aircraft, train, bus, automobile, ship, accommodation, or other equipment instrumentally owned, operated or otherwise used by a supplier; or (4) terrorist activities, social or labour unrest, construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments or any other actions, omissions or conditions outside our control.

This contract, regardless of where it is performed, shall be interpreted in accordance with the laws of the Province of Ontario, Canada.
