Price:Freight rate quoted shall be on per CBM basis in US dollars.
Validity:The offer shall be kept valid till 31st December'09. The successful biddershall keep the price offered till conclusion of the contract on award ofWORK ORDER.
Payment Terms:Payment shall be made on the basis of rates offered by the successfulbidder. All payments will be made in Indian rupees only. For the purposeof exchange rate SBI n selling rate on the date of loading of the cargoon the vessel to be used.
1) Payments will be made for the actual quantity of the shipmentmade.
2) 90% of the Ocean Freight Charges is payable within five workingdays after submission of Original Bill of Lading.
3) Balance 10% payment will be released after safe discharge ofcargo at the discharge port. For release of this final paymentcontractor will be required to submit 'STATEMENT OF FACTS.
4) Security Deposit of the successful tenderer will be released onsatisfactory completion of the contracted work and on submissionof NO FURTHERCLAIM certificate.
Measurement of Cargo weight/volume:1) Measurement declared by BEML in the packing list shall be
considered for payment. However contactor may appoint asurveyor at his own cost and risk for verifying the measurements.
2) All measurements by the appointed surveyor of the contractor,need to be verified and countersigned by BEML representative atthe port.

Essential Conditions:1. The vessel offered for performance of this contract shall
preferably be not more than 25 years of age.2. Coordination with the Port Authorities and required permissions
for berthing at all the load ports and the discharge port shall bearranged by the Carrier/Agent/Contractor without involving BEML.
3. Successful tenderer shall arrange to inform Tunis Port, Tunisiaauthorities well in advance for berthing arrangements for thevessel at his own cost and risk.
4. All taxes, charges and dues of vessel if any on account ofexecution of this contract shall be on Contractor's account both inload port and in the discharge port.
5. Stevedoring charges if any at both the Loading and DischargingPort shall be on Contractor's account.
6. For the delays beyond agreed total transit time (as per the offer)penalty @ 2% of total contract value per week pro-rata up tomaximum 5% shall be charged and deducted from the bills of thecontractor.
7. Transit Time shall be calculated from the date of actual sailingand the date of actual berthing at Discharge Port.
8. Successful Contractor shall provide 7/5/3/2/1 days notice onactual arrival of the vessel at Load and Discharge Ports throughemail [email protected]@gmail.com
9, Draft Bill of Lading is to be approved by BEML,10. Incase of failure to place the vessel for lifting the cargo as per the
laycan by the contractor and if BEML cargo is ready at wharf ontrailers waiting to be loaded, consequent trailer detention charges,additional demurrages and other associated charges includingpenal demurrage charges of port trust (consequent to the delay)shall be recovered from the contractor.
11. BEML shall not be responsible for berthing delays atload/discharge ports.
12. BEML reserves the right to accept a tender or reject all tenders orsplit the scope of work between contractors without assigning anyreasons thereof.
