I. OVERVIEW The Committee on Public Safety, Law Enforcement, & Senior Citizens convened the public hearing on December 22, 2009 at 9:10am in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill No. 287-30 (COR)-" An act to change the membership composition of the peace officer standards and training commission and to establish minimum quorum requirement for the commission meetings, by amending section 32302 (a) and adding a new section 32302.01, to Article 3, Chapter 32, Title 17 Guam Code Annotated," sponsored by Senator Adolpho B. Palacios, Sr.

Public Hearing Requirements Notices of the hearing were disseminated via facsimile and email to all senators and all main media broadcasting outlets on December 14, 2009 (5-day Notice) and on December 18, 2009 (48-Hour notice) pursuant to meeting the requirements of the Open Government Law. II. SUMMARY OF TESTIMONIES Chairman Adolpho B. Palacios, Sr. called the Committee on Public Safety, Law Enforcement, and Senior Citizens to order at 9:10am, welcomed and introduced Senators present.

Chairman Palacios author of the bill gave a brief presentation of the bill. He stated that Bill 287 was introduced as a result of Bill 214-30. Bill 214 had gone through a public hearing and the bill provides for a quorum. He states that the law does not provide a quorum of the 17 membership. They needed 8 and they have been having problems in meeting quorums. They were not able to put together a plan because nothing could get adopted. This resulted in Bill 287. The reason why we didn't accept the amendment was because this was not part of the public hearing. We thought at this time, it would be a substantial change and our standing rule calls for a public hearing. Bill 287 continues to provide for the quorum and reduces the number down to 7. By crossing out some of the memberships, you would have been reading the entire current law. Section 3 would be a new item and this quorum has been heard.

Chairman Palacios called those who are present to testify.

Mr. Reilly Ridgell, Dean of the Trades of GCC, Oral Testimony, In Support w/Revisions Mr. Ridgell stated that we provide the training that POST is overseeing and that he didn't see this bill until recently. He states, "I don't have an objection to the quorum. GCC was a non-voting member. When I looked at the bill, there were 14 members and it looked like you removed the non-voting member. From GCC' s standpoint, it is appropriate that we have a voice. The community college is at least a non-voting member and it is a mistake to take us off because we need to understand what is going on with POST. GCC doesn't want to be removed. If you are not a non-voting member, we can still discuss the issues. We would like to be a non-voting member, but we would like to have a voice. Do we still have time submit written testimony?"

Chairman Palacios stated that we can take a look at this and include the non-voting member so that they can join in the discussion. The quorum has to be in the presence of the five voting members. He then stated that the public has up to ten days to provide written testimony after this public hearing.

Col. Adolph Sgambelluri, Former Chief of the Guam Police Department, Oral & Written Testimony, In Support He is here and represents investigative international. He is here because he is interested in POST. He states that, "when I was at GCC, we started POST. It was myself and Major Aguigui that began the discussion to begin POST. From day one, when we decided to get legislation on POST, I mentioned to influential people to cut down voting members." He then read from his written testimony. Please see written testimony attached.

Mr. Mike Reyes, Conservation Officers, Dept. of Agriculture, Written & Oral Testimony, Not in Support He states, "I have several occasions attended the POST Commission meetings these past years. And on several meetings, no action or discussion could be taken since a quorum was never met." Mr. Reyes then read from his written testimony. Please see written testimony attached.

Chairman Palacios stated that the problem has been in the inability to have a quorum. If you have a large group and members don't show up, members can hold the Commission hostage. There is no budget plan as to where to house them. It is very important and that the quorum is the key. Would you have any objection to change membership to have a quorum? If its 9, it doesn't have to be five, it could be 4. This is why I introduced Bill 214. Some senators objected to this and we needed the crucial vote. Do you have any objections?

Mr. Mike Reyes I have no objections.

Chief Celestino Aguon, Aquatics and Wildlife, Dept. of Agriculture, Oral Testimony, Not in Support He stated, "Like Officer Reyes, I am providing oral testimony not in support of the bill in its written form. As far as our department, we would like to retain our

representation of the POST commission, perhaps a reduction of the quorum, we could live with this and we could submit a written testimony at a later time."

Officer David Cruz Flores, Customs and Quarantine, Instructor at GCC, Oral Testimony, Not in Support He states, "When I think about the POST meetings, I think about hurting cats. I am not characterizing members as being cats, but they have busy schedules. We do not support this bill as it is written because it deletes the Director of Customs and Quarantine. We go back to 1996 when I was a senior instructor at GCC. Since that time, we have instructed nine cycles with the collaboration of GCC and these officers meet the mandates of the statutes. From the academic side and law enforcement side, we have done the job. The College is the check and balances to this program because of accreditation. From the law enforcement side, where the director is stricken, it creates a sense of divide. I am here representing myself and not my director or my department. Last week, we graduated 16 customs officers and also immediately following this, we graduated the first canine coconut rhino beetle group. I would like to highlight the other side of the success. We work with the University of Guam; we have funded the 8th

and the 9th cycle of officers at DOC, the Port, and the Airport. We were able to allocate our funds to get officers their certificate. Customs are trying to do their part in POST and we hope reciprocity can happen. I would like to reserve written testimony at a later date."

Chairman Palacios stated that the author never intended to delete the current members, but the focus was to establish a quorum. There was a concern from one senator to retain the membership but the original request was to delete membership. I just wanted to establish a quorum and have it in statute, but the senators didn't want this. We could restore and retain the conservation officers and customs and quarantine and it will still take us up to nine. It was never the intention to delete membership, but to make an established law for quorum.

Cpt. Mark Charfauros, Division Chief for GPD, Oral Testimony, Not in Support He states, "I would like to thank Col. Sgambelluri for being present, but the original bill came from MC Charfauros. If you want to be customs officer, you could take the POST. The other reason why the Col. Sgambelluri was pushing this was because at the national level there are certification requirements. Initially POST was to have two arms: establishing the standard and the second was discipline. PEACE officer standards are higher than those in DOA. Entrusted within you are the trust and authority of officers

who are held to a higher standard. In order for us to go into the second phase was to have a commission. But the problem has been that there have not been enough members to make a quorum. We have to keep the membership because every law enforcement agency will be affected by POST. One of the things that we are looking at having the commission itself to determine the quorum."

Chairman Palacios stated that first the commission has to meet to establish this, but with the fourteen members, the general practice is half plus one would constitute a quorum. Since the passage of this law, there has never been a quorum.

Cpt. Mark Charfauros stated, just listening to you, there are members who do not want to reduce the memberships. Is this correct?

Chairman Palacios Bill 214 did not disturb the composition and I just added the quorum. On the floor debate for Bill 214, asked why do we need to retain it? The original request was to reduce it down to seven because no one likes to be stricken out because it is offensive. I yielded to him and this was the original request.

Cpt. Mark Charfauros stated that in order to satisfy the membership, why don't we keep the members, and on section 3 of the bill, we could state that upon passage of this bill within 90, 60 or 30 days, the commission shall meet to determine a quorum. This could be the compromise. We would like to keep it and we all agree that the quorum issue is a problem.

Chairman Palacios stated that I don't see any problem with retaining the memberships and the non-voting memberships because they don't affect the quorum. The presence of 5 voting members is key. We could delete one representative from the mayor's counsel, combined the Judiciary because it doesn't make sense to have two representatives. We can delete Park Patrol and DYA because they are tangentially affected. Whatever is the standard for the Guam Police Department, there would be additional requirements that would be covered if there are nine members. There could be an understanding between Park Patrol and DY A to be consulted when the issues arise.

Cpt. Mark Charfauros stated that we could do this or make these positions non voting members. If we keep the members and make them non voting members, this would reduce the quorum requirement.

Col. Adolph Sgambelluri stated that it seems to me that there is some confusion because we maybe scratching out memberships and that they are no longer part of the commission. The objective is who is a member in order to get a commission together. The fact is that this curriculum is designed by the representatives and departments. GCC needs to give the stamp of this in order to meet the commissions' standard, POST standard, and accreditation standards. The people in Adelup screwed this up and I won't say any names. The whole point is that we want them to be professionalized and there are certain criteria in order for them to get certified. We used to put these guys through for 26 weeks and they paid their own way. Our desire is that POST would be self sustaining for background investigations in which they would have to pay for their certification.

Chairman Palacios stated that again I listened to you and this is the very objection from one of the influential senators. I want to emphasize that it doesn't matter if you are not a member or not, but the Commission could draft a standard to Parks and Rec. POST can develop a standard for Park Rangers, etc. POST could get into this and extend the issues to these departments and divisions.

Mr. Ridgell stated that when I attended, members who showed up were different agencies. There was no consistency with who showed because it was always different each time.

Chairman Palacios stated that there have been those who have been consistent in meeting. Quorums are very crucial because POST has not moved very significantly because they have not got a budget. It is time that we standardize this because we still have an interim director. We can go beyond this and quorum is a must in order to get into the mandate and into the programs that it is mandated to do, but the Commission has to have a quorum. Out of this meeting, maybe a nine member and a non voting member will be okay. We have to reduce some of this a little bit. Five would still be voting members and the presence of five members shall carry the action and the non­voting will be retained. This would be in the mark-up of the bill.

Mr. Flores stated that POST has the power to make rules and regulations and this is the next step.

Chairman Palacios stated that this is the point we are trying to make today.

Mr. Flores stated that there are many dynamics involved and this group shares this type of experience. I do concur that not all members show up and this has to deal with scheduling.

Chairman Palacios stated that there will be ten working days to submit testimonies. The sooner you submit your testimonies; we shall prepare to place this bill in the January Legislative session.

Chairman Palacios concluded the hearing and requested that written testimony be submitted within the next ten (10) days. He adjourned the hearing at 10:00am.

III. WRITTEN TESTIMONIES 1. Mr. Joseph D. Torres, Director, Department of Agriculture, Not in Support, Written Testimony received via Facsimile on December 30, 2009. Director Torres states that the Guam Department of Agriculture and its Division of Aquatic and Wildlife Resources and other divisions within the Department are mandated to control and regulate fish and game in and about Guam. Director Torres and the Department request that the Department's representation continue and not be removed from the POST Commission Committee. The Representation of the Chief of DA WR or his designee should continue in the POST commission as it is written in Public Law 29-102. The Department suggests that the majority of the voting members be set at 50% plus one or 6 voting members plus 1, or 7 members. (Please see written testimony attached.)

2. Mr. Michael A. Reyes, Conservation Officer Ill, Department of Agriculture, Law Enforcement Section, Not in Support, Written Testimony received via Hand-delivery on December 22, 2009. Officer Reyes read from his testimony during the Public Hearing. He states that he has attended several POST Commission meetings in past years and on several of those meetings, no action or discussion could be taken since a quorum was not met. By reducing the POST Commission from 14 to 7, does not solve the lack of quorum issue. He suggests that the Committee reinstate the membership composition back to 14 members and introduce a section to sanction the committee members appointing authority who fail to show up or send a representative to the commission meetings. 3. Col. Adolf Sgambelluri, CEO Investigations Agency International, Inc., Former Chief of Police, In Support, Written Testimony received via E-mail on December 8, 2009. Col. Sgambelluri read from his testimony during the Public Hearing. He states

that it is noted that the current POST is considered heavy and too large to do their required business, which basically is hampered to provide the decision in a timely manner for lack of a quorum. This is considered a disservice to the law enforcement community and its environment. The overall design of POST is to promote the effectiveness of law enforcement training, and that this regulation shall establish the minimum required topics and the minimum hours for specific, non-mandated training courses. Training courses may exceed the designated topics and hours. The POST Commission is envisioned to possess a strong capacity to make greater contribution to the law enforcement environment for Guam, and is in the position to provide ample opportunity for growth with its administrative personnel to carry out the mission of POST by those assigned personnel and staff towards enhancing the mantra for POST. (Please see written testimony attached.)

4. Attorney General Alicia G. Limtiaco, Office of the Attorney General of Guam, In Support, Written Testimony received via Hand-delivery on December 31, 2009. Attorney General Limtiaco states that the Office of the Attorney General of Guam supports the intent of Bill 287-30(COR) as the current statue requires fifteen (15) voting members from the community and the various government or law enforcement agencies. As a result, it takes a quorum of at least eight (8) POST members in order to conduct meetings and take action. This has proven to be unwieldy and difficult to achieve. It was not uncommon to have only seven (7) out of fifteen (15) voting members show up for a POST meeting, which meant that no official meeting or action could occur. The proposed amendments to reduce the voting membership to seven (7) and to have a minimum quorum of four (4) voting members will be helpful for the POST Commission. (See written testimony attached.)

5. Mr. Dennis J. Santo Tomas, Colonel, USA (Ret), Director, Customs and Quarantine Agency, Not in Support, Written Testimony received via hand delivery on January 4, 2010. Mr. Santo Tomas stated that I particularly object to the removal of Guam Customs and Quarantine Agency from the principle membership of the POST Commission. CQA is a major contributor to the community of Guam in the areas of public safety and law enforcement and provides law enforcement at all ports of entry into Guam to include the Guam International Airport, the Port Authority of Guam, the U.S. Postal Service, Andersen Air Force Base, U.S. Naval Base Guam, and in the future, the Marine Corps Base Guam. He humbly requests that CQA be retained as a member of the POST commission. (See written testimony attached.)

IV. FINDINGS AND RECOMMENDATIONS The Committee on Public Safety, Law Enforcement, & Senior Citizens finds that Bill No. 287-30 (COR) intends to change the membership composition of Peace Officer Standards and Training Commission and establishes a minimum quorum requirement of POST meetings. Bill287-30 (COR) composes membership to seven (7) members and deletes Director of Customs and Quarantine Agency, Director of the Department of Youth Affairs, the Superintendent of the Guam Park Patrol Officers of the Department of Parks and Recreation, the Chief of the Division of Aquatic and Wildlife Resources of the Department of Agriculture, a person at large selected by the Commission, a non­voting representative from the University of Guam appointed by the President, a non­voting representative from the Guam Community College appointed by the President, the Chief Marshall, the Chief Probation Officer of the Unified Guam Judiciary, a non­voting representative from the Department of Administration, a representative from the Mayor's Council of Guam. 2 SECTION 1. Legislative Findings and Intent. I Liheslaturan Guahan finds

3 that the Peace Officer Standards and Training (POST) Commission was first established

4 by Public Law 24-145:2, on March 5, 1998, and further amended in its entirety by Public

5 Law 29-012:2 on September 7, 2007. The primary purpose of the Commission was the

6 development of regulations and minimum professional standards to serve as the basis for

7 the uniform recruitment operation of Guam's law enforcement entities.

8 I Liheslaturan Guahan further finds that in the process of developing the

9 regulations and minimum professional standards the POST Commission, in accordance

10 with Title 17 Guam Code Annotated, Chapter 32 Article 3, §32302. (c) has to hold at

11 least four meetings per year. The current practice of the POST Commission with regards

12 to setting a quorum level for meetings was to use the 50% plus one rule of all fourteen

13 (14) voting members of the Commission as there is no specific provision as to what

14 constitutes a quorum. According to the POST Executive Director, the Commission has

17 (3) the Chief of the Guam Port Police, or his designated representative.

Palacios, Sr. , an Act to change the membership of the Peace Officer Standards and Training Commission and to Establish minimum quorum requirement for the Commission meeting, by amending section 32302 (a) and adding a new section 32302.01 , to Article 3, Chapter 32, Titles 17 Guam Code Annotated.

The Guam Department of Agriculture (and its Division of Aquatic and Wildlife Resources (DA WR) and other divisions in the department) is mandated by Title 5 GCA Section 63102 the control and regulation of fish and game in and about Guam. Further, Title 5 GCA 63202 authorizes the Department to develop and implement programs for conservation and management of endangered and protected species. We request that the Department ' s representation continue and not be removed from the POST Commission Committee. The representation of the Chief of DA WR or his designee should continue in the POST Commission as it is written in Public Law 29-012.

Bill 287 in "Section 3" a new section is to Article 3; Chapter 32 Title 17 GCA proposes to set the minimum four (4) members required for quorum. We suggest that the majority of the voting members be set at 50% plus one (or 6 voting members plus 1, or 7

Thank-you for allowing me to submit testimony on Bill 287-30, as the senior Conservation Officer for the Department of Agriculture, I have on several occasions attended the POST Commission meetings these past years. And on several of those scheduled meetings, no action or discussions could be taken since a quorum was not met.

Bill 287-30 intends to reduce the composition of the existing POST Commission from the 14 voting members to 7 voting members and set a quorum of 4 members for any action to be taken. By reducing the POST Commission from 14 to 7, in my opinion, does not solve the lack of quorum issue. I would suggest that you reconsider reinstating the membership composition back to 14 members, and introduce a section to sanction the committee members appointing authority who fail to show up or send a suitable representative to the commissions meetings.

Training courses may exceed the designated topics and hours.

The POST Commission is envisioned to posses a strong capacity to make greater contribution to the law enforcement environment for Guam, and is in position to provide ample opportunity for growth with its administrative personnel to carry out the mission of POST by those assigned personnel and staff towards enhancing the mantra for POST. And to promote quality values throughout the law enforcement organizations.

And lastly, to ensure that responsibilities are being gradually increased to improve advancement potential by establishing concrete and valid curriculum in concert with the two local higher education (UOG) and vocational (GCC) institutions. Dear Chairman Palacios:

The Office of the Attorney General supports the intent ofBill No. 287 to amend the current POST Commission statutes by changing the membership and the minimum quorum requirements. The current POST statute requires fifteen (15) voting members from the community and the various government or law enforcement agencies. As a result, it takes a quorum of at least 8 POST members in order to conduct meetings and take action. This has proven to be unwieldy and difficult to achieve. It was not uncommon to have only seven (7) out offifteen (15) voting members show up for a POST meeting, which meant that no official meeting or action could occur. The proposed amendments to reduce the voting membership to seven (7) and to have a minimum quorum of four (4) voting members will be helpful for the POST Commission.

Thank you again for your continued support to the men and women of the Guam Customs and Quarantine Agency and Happy New Year to you and your family.

I received your Legislative Alert on earlier this month regarding Bill 287-30. I agree the current membership composition of the Peace Officer Standards and Training Commission (POST) and minimum meeting quorum requirement need to be relooked but I particularly object to the removal of Guam Customs and Quarantine Agency (CQA) from the principle membership of the POST Commission. CQA is a major contributor to the community of Guam in the areas of public safety and law enforcement. CQA provides law enforcement at all ports of entry into Guam to include the Guam International Airport, the Port Authority of Guam, the U.S. Postal Service, Andersen Air Force Base, U.S. Naval Base Guam, and in the future, the Marine Corps Base Guam.

CQA officers possess proficiency and updated knowledge on numerous technical disciplines to include: 1) the identification of pandemic illness (i.e. Hl.N 1, Avian Flu, etc.) signs or symptoms displayed by individuals entering Guam and working closely with Dept of Public Health & Social Services; 2) the identification and confiscation of illegal narcotics through Guam's borders and working closely with the Drug Enforcement Agency and the U.S. Postal Services; 3) the recognition and interception of oounterfeit merchandise made possible through formal intellectual property right training; 4) the identification and confiscation of non-allowable agricultural products into Guam to include invasive species (i.e. brown tree snake, coqui ~ rhinoceros beetle, etc.) while working closely with U.S. Dept of Agriculture Plant Inspection Station; 5) the identification and confiscation of all endangered species or their by­products while also working closely with the U.S. Department of Fisheries and Wildlife; 6) identification and verification of all weapons systems entering Guam and working closely with the Guam Polire Department to get all imported weapons properly registered in a timely manner; 7) identification and screening of all inbound passengers

for possible identity theft, human trafficking and illegal stayovers and working closely with U.S. Customs and Immigration Enforcement and the U.S. Customs and Border Protection.

CQA also operates a Customs Officer Academy with the mission to graduate a minimum of one cycle (25 or more recruits) per calendar year. This mission will gradually allow CQA to have enough officers to work at every port of entry in light of the military buildup. Additionally, CQA operates a K9 Detector Dog Academy which is capable of training both the detector dogs and their handlers. CQA has already trained detector dogs and handlers for the Department of Corrections to assist their officers with identification and confiscation of illegal narcotics within their compound. CQA has also trained both detector dogs and handlers for the Department of Agriculture & University of Guam freused primarily on the eradication and mitigation of one of Guam's most problematic invasive species known as the coconut rhinoceros beetle. The Guam Police Department and the CNMI Customs Agency have both requested that our K9 Detector Dog Academy train more dogs and handlers for their departments/agencies for narcotics detection so the demand for this type of training is increasing.

Mr. Chairperson, CQA continues to be a major contributor to the law enforcement community especially when it comes to the monitoring and securing of Guam's borders as well as assisting other local and federal law enforcement agencies. I humbly ask that you reconsider retaining CQA on the POST membership composition. Thank you for your time and I look forward to your positive consideration.

BILL NO: 287-30 (COR) AN ACT TO CHANGE THE ME:MBERSHIP COMPOSITION OF THE PEACE OFFICER STANDARDS AND TRAINING COl\'IMISSION AND TO ESTABLISH MINIMUM QUORUM REQUIREMENT FOR THE COMMISSION MEETINGS, BY AMENDING SECTION 32302 (a) AND ADDING A NEW SECTION 32302.01, TO ARTICLE 3, CHAPTER 32, TITLE 17 GUAM CODE ANNOTATED.

RAMIFICATIONS/IMPLICATIONS/ISSUES/HIGHLIGHTS: 1. Bill intends to change the membership composition of Peace Officer Standards

and Training Commission and establishes a minimum quorum requirement of POST meetings.

2. Bill composes membership to seven (7) members and deletes Director of Customs and Quarantine Agency, Director of the Department of Youth Affairs, the Superintendent of the Guam Park Patrol Officers of the Department of Parks and Recreation, the Chief of the Division of Aquatic and Wildlife Resources of the Department of Agriculture, a person at large selected by the Commission, a non-voting representative from the University of Guam appointed by the President, a non-voting representative from the Guam Community College appointed by the President, the Chief Marshall, the Chief Probation Officer of the Unified Guam Judiciary, a non-voting representative from the Department of Administration, a representative from the Mayor's Council of Guam.

3. Bill sets forth a minimum of four (4) members present to constitute a quorum and would make any action of the Commission valid.
