FIRST DAY

Senate Chamber Monday, September 10, 2007

In accordance with law, as set forth in the Constitution of the State of North

Carolina and pursuant to the Proclamation issued by the Governor, the Honorable Michael F. Easley, on September 10, 2007, the Senate of the 2007 General Assembly convenes in Extra Session 2007 at the hour of 7:30 P.M. in the Senate Chamber of the Legislative Building in the City of Raleigh

The Senate meets pursuant to adjournment and is called to order by The

Honorable Marc Basnight, President Pro Tempore, who presides in the absence of the Lieutenant Governor.

Prayer is offered by The Honorable Steve Goss, Senator from Watauga

County as follows: "Our heavenly Father we pray with the patience of Job realizing that you are

with us every moment of everyday. Sometimes, Father, things seem to move very slowly, but we know in things of importance it's sometimes so necessary. So now we move forward to the business of this State and may we all do each thing and everything to your glory. In your holy name we pray, Amen."

Senator Rand submits Senate Resolution 1 which is read and disposed of as

Upon motion of Senator Rand, the resolution is placed before the Senate for immediate consideration upon adoption.

The text of Senate Resolution 1 is as follows:

A SENATE RESOLUTION ADOPTING THE PERMANENT RULES OF THE SENATE FOR THE 2007 EXTRA SESSION OF THE 2007 GENERAL ASSEMBLY.

Be it resolved by the Senate: SECTION 1. The permanent rules of the 2007 Regular Session, with the

following amendments, are the rules governing the 2007 Extra Session of the 2007 General Assembly:

RULE 32. List of standing/select committees. – The standing committees shall be:

Appropriations. Finance. Rules and Operations of the Senate.

All committees shall be comprised of the members who were appointed to those committees during the 2007 Regular Session.

RULE 40. Introduction of bills. – Every bill introduced shall contain on the outside cover the title of the document and the name of the Senator or Senators presenting it. The Principal Clerk of the Senate shall receive, number, and present each bill to the Senate for first reading.

RULE 40.1. Limitation on introduction and consideration of resolutions and bills. – The only resolutions that may be introduced or considered in the Senate are resolutions adjourning the 2007 Extra Session sine die. The only bills, parts of bills, or amendments to bills that may be introduced or considered in the Senate are bills, parts of bills, or amendments regarding matters listed in the proclamation of the Governor dated September 10, 2007.

RULE 41. (Reserved). RULE 43. First reading; reference to committee. – All bills introduced and

all House bills received upon a message from the House of Representatives, upon presentation to the Senate, shall be read in the regular order of business by their number and title which shall constitute the first reading of the bill. The Chair of the Rules and Operations of the Senate Committee or, in the Chair's absence, the Vice-Chair of the Committee shall refer to a Senate committee all bills introduced in the Senate. Upon the referral being made, the Chair of the Committee on Rules and Operations of the Senate shall notify the Principal Clerk of the Senate of the referral, and the Reading Clerk shall announce the referral of the bill. The Principal Clerk shall inform the Presiding Officer of the referral. The title and referral shall be entered upon the Journal.

RULE 43.1. Second reading. – All bills reported by committee shall be placed before the Senate for second reading and immediate consideration upon passage.

RULE 50. Third reading requirements. – When a bill or resolution has passed its second reading, it shall be placed on the calendar for immediate

consideration on its third reading, unless prohibited by Article II, Section 23, of the North Carolina Constitution.

RULE 56.1. Amendments and committee substitutes adopted by the House to bills originating in the Senate. – (a) Whenever the House has adopted an amendment or a committee substitute for a bill originating in the Senate and has returned the bill to the Senate for concurrence in that amendment or committee substitute, the Senate may concur in that amendment or committee substitute on the same legislative day.

RULE 59. (Reserved). SECTION 2. This resolution is effective upon adoption. Upon motion of Senator Rand, Senate Resolution 1 is adopted (46-1).

INTRODUCTION OF BILLS AND RESOLUTIONS A joint resolution filed for introduction is presented to the Senate, read the

first time, and disposed of, as follows: By Senator Rand: S.J.R. 2, A JOINT RESOLUTION PROVIDING FOR ADJOURNMENT

SINE DIE OF THE 2007 EXTRA SESSION. The joint resolution is placed on the Calendar for Tuesday, September 11.

APPOINTMENT OF COMMITTEES

Senator Dannelly, Deputy President Pro Tempore, announces that the Standing Committees of the Senate heretofore appointed during the 2007 General Assembly and outlined in S.R. 1 (2007-Extra Session) are hereby appointed to serve during this 2007 Extra Session.

The Chair orders a special message sent to the House of Representatives

informing that Honorable Body that the Senate is organized and ready to proceed with the public business of the Extra Session of the 2007 General Assembly as stated in the Proclamation issued by the Governor.

Upon motion of Senator Dannelly, seconded by Senator Hagan, the Senate

The Senate meets pursuant to adjournment and is called to order by The

Honorable Marc Basnight, President Pro Tempore, who presides in the absence of the Lieutenant Governor.

Prayer is offered by The Honorable Steve Goss, Senator from Watauga

County as follows: "God our creator, in your apostles words we read that with you a day is a

thousand years and a thousand years is a day. When we remember September 11, 2001, when time stood still in America and throughout the world, we once again rediscover our finite nature. So, God, we simply say in remembrance in hope, may we, through your infinite nature and wisdom, know that you will never leave us or forsake us. May we simply realize that even in the horrors of that moment in our past, we have the hope of your presence today, tomorrow, and forevermore. In your abiding love we pray. Amen."

I am filing my protest to House Bill 4 in the special session due to the fact that debate was deliberately cut short by the majority leader. I protest the bill for the following reason and state that the actions today are injurious to the economic well being of the state. Article 5. Section 9

The bill would allow refinancing of projects by corporations. This expressly stated in the Section that NC will not refinance a project that is already underway. The plant in Wilson, NC has already begun the process and would be entitled to the benefits in the bill.

Sec. 9. Capital projects for industry

Notwithstanding any other provision of this Constitution, the General Assembly may enact general laws to authorize counties to create authorities to issue revenue bonds to finance, but not to refinance, the cost of capital projects consisting of industrial, manufacturing and pollution control facilities for industry and pollution control facilities for public utilities, and to refund such bonds.

In no event shall such revenue bonds be secured by or payable from any

public moneys whatsoever, but such revenue bonds shall be secured by and payable only from revenues or property derived from private parties. All such capital projects and all transactions therefore shall be subject to taxation to the extent such projects and transactions would be subject to taxation if no public body were involved therewith; provided, however, that the General Assembly may provide that the interest on such revenue bonds shall be exempt from income taxes within the State.

The power of eminent domain shall not be exercised to provide any property
