Community Infrastructure Levy (CIL) Draft Charging Schedule

Planning Act 2008 (as amended by the Localism Act 2011),Community Infrastructure Levy Regulations 2010 (as amended)

Introduction

Under the Regulation 15 of the Community Infrastructure Levy Regulations 2010 (as amended) it is a requirement to invite representation on the preliminary draft form, this statement of compliance sets out:

the names of any persons whom the authority consulted in connection with the preparation of the CIL;

how those persons were consulted; a summary of the main issues raised in those consultations; and how those issues have been addressed in the production of the policy.

This statement is a record of the consultation undertaken during the production of the CIL. It is a living document that is updated at each stage of the adoption process.

Purpose of the CILThe CIL will be a policy that sits in the Local Plan suite of documents. It is a District-wide document that establishes a levy to be placed upon new development of all types in order to collect funds for strategic infrastructure improvements. The CIL does not consider planning issues, such as the amount, type or location of development.

The CIL consultation includes a range of supporting information, such as the Economic Viability Appraisal and the Infrastructure Delivery Plan

The CIL Regulations 2010 (Amended) state that a Sustainability Appraisal, a Strategic Environmental Assessment, and an Assessment under the Habitats Regulations are not required.

Further to these documents, a series of background papers and other “evidence” that has supported the Core Strategy is also available.

The CIL will undergo a series of public consultation stages, culminating in an Examination In Public (EIP) before an Inspector appointed by the Secretary of State. The Inspector will hear any outstanding objections and issue a ruling as to the soundness and legal compliance of the CIL. If the CIL is found to be Sound and legally compliant, the Council may adopt the CIL and begin charging the levy on new development.

Consultation Methods

In order to engage with the community, the Council will:

Make copies of documents available to view online at www.selby.gov.uk/CIL Place copies of documents at the following locations for viewing at normal

opening times:o Access Selby, Market Cross Shopping Centre, Selbyo Selby Library, 52 Micklegateo Sherburn in Elmet Library, Finkle Hillo Tadcaster Library, Station Roado Barlby Library, Howden Roado Mobile Libraries

Place a formal advertisement in the local press on the first day of the consultation (or as near to it as possible depending on printing/publication of the press).

Issue a press release to all the local press contacts Place an article in Selby District Council’s Citizen Link newspaper depending

on publication dates. Send a letter or e-mail informing people of the availability of the documents

to: North Yorkshire County Council District Councillors Selby District Parish Councils Neighbouring Local Authorities Other Consultees as included on the most up to date Planning

Consultation Database, including Organisations normally involved in planning matters Developers, agents, builders that operate in Selby District Other interested persons whom have given their details

Production timetableThe CIL must undergo a process of development and formal adoption, the timetable for which is established in the Council’s Local Development Scheme 2013-2016 (available on the website www.selby.gov.uk). An extract from the LDS showing the timetable may be found below:

STAGE 1: PRE-PRODUCTIONThe Council commissioned (jointly with Ryedale District Council and the North York Moors National Park Authority) specialist consultants Roger Tym (now part of Peter Brett Associates (PBA)) to undertake an Economic Viability Appraisal (EVA) on its behalf. That work began in November 2012.

At the same time, the Council also undertook to update the Infrastructure Development Plan (IDP) that has previously supported the Core Strategy and later the former Site Allocations DPD. Together, these exercises informed the preparation of the Preliminary Draft Charging Schedule.

The EVA, updated IDP, Preliminary Draft Charging Schedule (including draft Charging Zones), and draft consultation material were considered by The Executive on 5 December 2013, and approved for public consultation.

The Scrutiny Committee called in the Executive’s decision and considered the report on 18 December 2013. The committee heard from Officers and a representative from Peter Brett Associates. The Committee resolved to endorse the Executive decision and take no further action on the call in, other than to recommend additional consultation material be prepared for use by non-specialists.

The additional material was prepared and endorsed by the Director of Community Services in consultation with the Leader of the Council and the Chair of Scrutiny Committee prior to consultation.

Additional information on infrastructure was also received which has led to amendments to the IDP. This updated information does not alter the viability calculations, but does indicate additional justification for the CIL. The updated IDP and revised summary in the EVA endorsed by the Director of Community Services in consultation with the Leader of the Council prior to consultation.

STAGE 2: Preliminary Draft Charging Schedule consultation The 6-week public consultation period began on 14 January 2014, ending on 28 February 2014. 37 individual representations were received. Respondents include

4 neighbouring authorities 5 Parish Councils/ Ward Councillors 8 private individuals / companies 6 Government agencies / infrastructure partners 7 Developers / agents 3 Supermarket operators 4 interest groups

The responses were reviewed and led to a number of changes in the CIL material. The Executive confirmed the Council’s response at its meeting of 5 June 2014 and approved the consultation material for the Draft Charging Schedule consultation at the subsequent meeting on 3 July following more information about the indicative Regulation 123 list and the calculations about residential viability.

A report updating it on the progress of the CIL was scheduled to be heard by the Council’s Scrutiny Committee at its meeting of 25 June. Due to the timing of the Draft Charging Schedule approval, this will now be heard in the Autumn.

STAGE 3: Draft Charging Schedule consultation The 6-week consultation period began14 July 2014, ending on 18 September 2014. This is slightly later than set out in the LDS due to democratic process schedules.
