Heard learned counsel for the parties.

Aggrieved against the order dated 9.1.2012, contained in Annexure-1

to the appeal, passed by the respondents, after warrant trial, reducing the

rank of the applicant and for deprivation of GCB (Good Conduct Batches),

preferred this appeal under Section 15 of the A.F.T. Act, 2007.

In column 6 of the appeal, meant for declaration of remedies

exhausted, there is no mention about the provision available under the Nevy

Act for redressal of grievance with respect to the person tried summarily. On

the contrary, learned Standing Counsel draws attention of this Court towards

Section 23 of the Navy Act relating to the remedy available to an aggrieved

person. Section 23 of the Navy Act is reproduced as under :

“23. Remedy of aggrieved persons. – (1) If an officer or

sailor thinks tht he has suffered any personal, oppression, injustice

or other ill-treatment at the hands of any superior officer, he my

make a complaint in accordance with the regulations made under

this Act.

(2) The regulations referred to in sub-section (1) shall

provide for the complaint to be forwarded to the Central

Government for its consideration if the complainant is not satisfied

with the decision on his complaint.”

As such, we are of the opinion that the appellant has an alternative

remedy, which he has not exhausted before coming to this Tribunal by

means of the present appeal.

Learned counsel for the appellant submits that since the order dated

9.1.2012 was passed long back, therefore, the appellant preferred this appeal

before this Tribunal agitating the remedy provided under Section 23 of the

Navy Act.

We are of the view that the remedy provided to the appellant under

Section 23 of the Navy Act, referred to above, is available with the

appellant, we hereby direct the appellant to approach before the concerned

authority by means for filing a representation with respect to his promotion

within a period of one month and the respondents are directed to entertain

the representation of the appellant and decide the same, if filed within a

period of one month from today, with a reasoned and speaking order,

preferably within a period of three months. The appellant, thereafter, shall

have the liberty to challenge the said order, if aggrieved, before the

appropriate Court, if so advised.

With the above observation and direction, this O.A. is disposed of

finally.

argument that the order of punishment dated 18.12.2008 be set aside, by

Section 123 of the Army Act is vitiated since it has not been conducted in

accordance with Rules.

As it comes out from the charge-sheet, page 42 of the paper book,

annexed as Annexure-1 to this Original Application that two charges were

levelled against the applicant, one for deserting from service for about 7

years, 6 months and 21 days, and the other for being deficient of Identity

Card, which is a Government property.

There seems to be some substance in the argument of learned

counsel for the applicant with respect to the manner in which SCM was

initiated. Accordingly, we admit this O.A.

Present: Shri P.K. Shukla, learned counsel for the applicant,

and Smt. Deepti P. Bajpai, learned counsel for the respondents, along

with Capt. Priti Tyagi, Departmental Representative.

While going through the records and summary court martial

proceedings it comes out that Sep Sanjay Kumar was dismissed from

service. It comes out that he was discharged from Military Hospital

on 07.9.1998 and latter on join the duty on 5.5.1999. Since after

discharge from hospital, he did not report to the unit and has gone

home and latter on again joined voluntarily on 05.5.1991 and

thereafter again admitted in Military Hospital on 23.06.199 and

discharged on 23.9.1999.

We, therefore, direct respondents’ counsel to produce discharge

slips of hospital of 07.09.1998 and 23.09.1999 and other original

records on the next date.

List for further hearing on 27.03.2015 before this Court.
