UniversityPoliceAuthorityandJurisdiction
TheOklahomaCityUniversityPoliceDepartment(OCUPD)isdevotedtoprovidingthecampuscommunitywithemergencyandnon-emergencyservicesinatimelyandefficientmanner.OCUPDisproactiveinaddressingcriminalactivityandsafetyconcerns.Thisisaccomplishedbyethical,well-trained,dedicatedpolicepersonnelwhosuccessfullyconfrontcriminalactivitywithpowersofarrestandtheimplementationofprofessionalcrimepreventiontechniques.TheOCUPDiscommissionedbytheuniversity,andofficersarecertifiedbytheStateofOklahomaCouncilforLawEnforcement
EducationandTraining(CLEET).OCUPDOfficersareauthorizedtostop,question,anddetainanyonebehavinginasuspiciousmanner,andifappropriate,arrestpersonsengagedincriminalactivityonanycampuspropertiesandthesurroundingarea.TheOCUPDmaintainsregularcontactwithotherlocal,stateandfederallawenforcementagenciesforthepurposeofsharinginformationconcerningknownorsuspectedcriminalactivity.TheOCUPDhasstatutoryauthoritytoconductlawenforcementactivitiesonitspropertyandalsoinanareaofconcurrentjurisdictionwiththeOklahomaCityPoliceDepartment.TheareaofconcurrentjurisdictionisfromN.W.23rdStreetonthesouthtoN.W.30thStreetonthenorth,andfromPennsylvaniaAvenueonthewesttoDouglasAvenueontheeast.ItalsoincludesOklahomaCityUniversityownedstructures,includingtheUniversityManorApartments*at1844NW23rdStreetnotwithintheaforementionedboundaries,andthepropertiesownedbytheUniversityatthedowntownLawSchoollocatedat800NHarveyAvenue.TheareaofconcurrentjurisdictionwasestablishedthroughanAgreementforCampusPoliceJurisdictionandAuthority,betweenOklahomaCityUniversityandtheCityofOklahomaCity,establishedonOctober9th,2007.*TheUniversityManorApartmentsweresoldin2016andarenolongerpartoftheOCUPDjurisdiction.

TheOklahomaCityUniversityPoliceDepartment(OCUPD)ischargedbytheUniversitywiththeresponsibilityofmaintainingconditionsnecessaryforasafeandsecurelearningenvironmentandstrivesforacrime-freecampus.OCUPDislocatedat1635NW23rdStreet.TheUniversityhasdesignatedasinglenumber,405-208-5911,tobeusedforreportingallemergencies.TrainedUniversitydispatchersmonitorthisnumber24hoursaday365daysayear.OCUPDiscomprisedof13full-timeofficerscommissionedbytheUniversityandstatecertifiedbytheOklahomaCouncilonLawEnforcementEducationandTraining(CLEET).EmergenciesAnycriminalactoremergencyoccurringonorinthevicinityoftheOCUcampusshouldbereportedtotheOCUPDeitherbyphone,405-208-5911,orinpersonwithoutdelay.Additionally,blueemergencytelephonesatoutdoorlocationsaroundthecampusprovideareadilyaccessiblemeansfordirectlycontactingtheOCUPDdispatcherduringanemergency.Non-EmergenciesOCUPDprovideslawenforcementservices,includingtheinvestigationofcriminaloffensesandtrafficcollisionsoccurringonUniversityproperty,andhandlesofficialreportsrelatedtothoseincidents.Toreportacrimethatisinprogressoracrimethatjustoccurred,calltheemergencynumber405-208-5911.Toreportacriminalincidentafterthefactinwhichnoonewasinjured,thesuspecthasleftthearea,theredoesnotappeartobeanyphysicalevident,andtherearenoothercircumstancesthatwouldnecessitatetheimmediatepresenceofapoliceofficer,calltheOCUPD’snon-emergencynumber405-208-5001.Toreportcrimesthatoccuroffcampus,contacttheOklahomaCityPoliceDepartmentat405-231-2121.TheOCUPDworkswithotherlocalagenciesandareawareofoff-campuscrimeswhenthoseagenciesrequestassistanceorwhentheyroutinelypassoninformationthatmaybeofmutualinterest.Students,faculty,staff,campusguestsandothersarerequestedtocooperatefullywithpoliceofficers.Failuretodoso,makingafalsereport,orobstructinganinvestigationmayresultinsanctions,fines,orotherdisciplinaryactionbytheUniversityor,ifapplicable,criminalprosecution.AllincidentsreportedtoOCUPDaresummarizedandmaintainedinadailycrimelogavailableforinspectionuponrequestatOCUPD’smainoffice.ThisinformationisalsoupdatedweeklyontheOCUPDwebsiteintheBlottersection.OCUPDwillpromptlyandthoroughlyinvestigateallreportsofanycrimeorincidentincludingthreatsof(oractual)violenceandofsuspiciousindividualsoractivities.Ifrequested,theidentityofthereportingpartymaybekeptanonymousandwillbe

PreparingtheAnnualDisclosureofCrimeStatistics
OklahomaCityUniversityhaspreparedthisreportincompliancewiththeJeanneCleryDisclosureofCampusSecurityPolicyandCrimeStatisticsAct.TheAnnualSecurityandFireReportispublishedeachyearbyOctober1st.Crimestatisticsforthereportaresolicitedfromalllawenforcementagenciesthathaveorsharelawenforcementjurisdiction.TheDeanofStudentsprovidesdisciplinaryactionstatisticsconcerningalcohol,drug,andweaponviolations.Ane-mailnotificationissenteachyeartoallstudents,facultyandstaffmembersprovidingtheweblinktoaccesstheAnnualSecurityandFireReport.Prospectivestudentsandprospectiveemployeesmayobtainthereportfromtheweblinkathttp://okcu.edu/police/ThisreportisinclusiveoftheOCUMainCampusandOCULawSchool.Differencesinmaps,crimestatistics,policy,emergencyprocedures,shelterlocations,defibrillatorlocationsandotheritemsarenoted,andsometimesseparatedinthisdocument.

The crime statistics are reported in accordance with Uniform Crime Reporting (UCR)proceduresand the JeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeStatistics Act. Data sources include the Oklahoma City University Police Department,OklahomaCityPoliceDepartmentandOCUStudentAffairs.

Off-CampusStudentFunctions
Universitypolicelearnofoff-campuscrimesfromotherlocalagencieswhenthoseagenciesrequestassistanceorwhentheyroutinelypassoninformationthatmaybeofmutualinterest.OCUPD,membersoftheOfficeofStudentAffairs,sororityandfraternityadvisersandmembersoftheOklahomaCityPoliceDepartmentmeetatvarioustimestoshareinformationandredefinelinesofcommunication.BecauseOCUPD’sjurisdictiondoesnotextendtoalloff-campusstudentfunctions,whetherunofficiallyorofficiallyrecognized,itsroleininvestigationsofsuchcriminalactivityislimitedtoinformationsharing,cooperationandcoordinationwiththeinvestigatingagencyuponrequest.

TheCleryActidentifiescertaincategoriesofstudents,UniversityemployeesandcontractorsasCSAswhohavefederallymandatedresponsibilitiestoreportallegedCleryActcrimesthattheywitnessorarereportedtothem.ACleryActcrimeisconsidered“reported”whenitisbroughttotheattentionofaCSA,UniversityPoliceorlocallawenforcementpersonnelbyavictim,witness,otherthirdpartyoreventheoffender.ThecrimereportingpartyneednotbeUniversityaffiliated.ThelawdefinesthefollowingfourcategoriesofCSAs:
1. UniversityPolice(UP)Departmentswornlawenforcementpersonnelanddepartmentadministrators.
2. Non-policepeopleorofficesresponsibleforcampussecurity—communityserviceofficers,campuscontractsecuritypersonnel,parkingenforcementstaff,personnelprovidingaccesscontroland/orsecurityatcampusfacilities,athleticeventsorotherspecialevents,safetyescortstaff,residentialcommunityassistantsandothersimilarpositions.
3. Officialswithsignificantresponsibilityforstudentandcampusactivities—anOfficialisdefinedasanypersonwhohastheauthorityandthedutytotakeactionorrespondtoparticularissuesonbehalfoftheUniversity.TodeterminewhichindividualsoforganizationsareCSAs,considerjobfunctionsthatinvolverelationshipswithstudents.LookforOfficials(i.e.,notsupportstaff)whosefunctionsinvolverelationshipswithstudents.Ifsomeonehassignificantresponsibilityforstudentandcampusactivities,thentheywouldbeconsideredaCSA.SomeexamplesofCSAsinthiscategoryinclude,butarenotlimitedto:academicdeans;studentaffairs/residentiallifeofficials;coordinatorofGreekaffairs(orrelatedpositions);athleticadministrators,includingdirectors,assistantdirectorsandcoaches;studentactivitiescoordinatorsandstaff;studentjudicialofficials;facultyandstaffadvisorstostudentorganizations;studentcenterbuildingstaff;studentpeereducationadvisors;andadministratorsatbranchcampuses.
4. Anyindividualororganizationspecifiedinaninstitution'sstatementofcampussecuritypolicyasanindividualororganizationtowhichstudentsandemployeesshouldreportcriminaloffenses.

TheUniversitycontinually(withchangesandadditions),andannually,identifiestheindividualsdesignatedasCampusSecurityAuthoritiesandassignsmandatorytrainingtoeducatetheCSA’sintheirresponsibilitiesandreportingrequirements.

EmergencyAlerts&TimelyWarnings
AnyonewithinformationwarrantingaTimelyWarningorEmergencyNotificationshouldreportthecircumstancestoOCUPDimmediately.TheUniversitywillissuewarningsornotificationsasappropriatetokeepthecampuscommunityinformedaboutsafetyandsecuritymattersonanongoingbasisandtopreventsimilarcrimesfromoccurring.ThedecisiontoissueaTimelyWarningorEmergencyNotificationshallbedecidedonacase-by-casebasisincompliancewiththeCleryActandconsideringallavailablefacts.Thetimingofthenotificationshall,inthefirstinstance,bebaseduponwhetherthecrimeisconsideredaseriousorcontinuingthreattostudentsoremployeesandthepossibleriskofcompromisinglawenforcementefforts.
EmergencyAlertsOklahomaCityUniversitywillimmediatelyissueanEmergencyNotificationtothecampuscommunityupontheconfirmationofasignificantemergencyordangeroussituationinvolvinganimmediatethreattothehealthorsafetyofstudentsorstaffoncampus.Warningsmayonlybewithheldiftheywouldcompromiseeffortstocontaintheemergency.TheBlueAlertSystem(PoweredbyRAVE)isOCU'smethodofalertingthecampuscommunityofanemergency.Thesystemusesredundantcommunication,includinge-mail,textmessagingandsocialmediatobroadcastthealert.Thesystemisonlyusedforemergencyannouncementsandnotforday-to-dayinformationdissemination.StudentcanenrollfortheOCUBlueAlertSystematthefollowingwebpage:http://een.okcu.edu.TimelyWarningsIntheeventthatasituationarises,whetheronoroffcampus,thatconstitutesanongoingorcontinuingthreat,atimelywarningwillbeissuedatthediscretionoftheChiefofPolice.Thiswarningmaybedistributedbye-mail,publicationontheOCUPDwebsite,orannouncedbywayoftheBlueAlertEmergencyMessagingSystem,orothermethodsdeemednecessarybythesituation.Timelywarningsareissuedforcrimestopersonsorproperty,suchas,butnotlimitedtoarson,burglary,aggravatedassault,criminalhomicide,motorvehicletheft,robberyandsexoffenses,ifthereisareasontobelievethereisanongoingthreatthatasimilarcrimemayoccur.

AccesstoCampusFacilities
Forthesafetyofitsstudents,faculty,staff,andguests,OklahomaCityUniversityseekstomaintainaclosedcampusanddiscouragestrespassers.Students,faculty,andstaffmustcarryUniversityidentificationcardsatalltimes,andmustpresentthemtoanyUniversityofficialuponrequest.WiththeexceptionoftheTom&BrendaMcDanielUniversityCenter,allUniversitybuildingsareclosedandsecuredbymidnight.Forsafetyreasons,studentsarenottoremaininclosedandsecuredUniversitybuildingsaftermidnightunlessaccompaniedbyafull-timeUniversityemployee.
VisitationhoursareestablishedinUniversityhousingandinfraternityandsororityfacilities.StudentsshouldconsulttheOklahomaCityUniversityStudentHandbookregardingthosepoliciesandanyadditionalpoliciesthatmaybeestablishedbydormitoryauthoritiesregardingothersafetymeasures.
WhiletheUniversitystrivestomaintainadequateeveninglighting,individualsarediscouragedfromwalkingunaccompaniedduringtheeveningandlatenighthours.AcalltoOCUPDdispatchforanescortwillenhanceindividualsafety.

MaintenanceofCampusFacilities
ThePhysicalPlantsupervisescustodialservicesandmaintainsthebuildings,grounds,andutilitysystems.Universityemployeesroutinelyinspectbuildingdoorlockingmechanisms,windows,andfirealarmsystems.Burnedoutlights,brokendoors,andwindowsandmalfunctioningalarmsystemsarerepairedasquicklyaspossible.Universitycommunitymembersareencouragedtoreportmaintenanceproblems,includinglightingandelevatorconcernsto405-208-5382,orafternormalbusinesshoursto405-208-5383.

CrimePreventionPrograms
SafetyEscorts–“Neverwalkalone”On-campussafetyescortsareavailable24hoursaday,year-round.Off-campussafetyescortstodesignatedlocationsareavailable.PleasecalltheOCUPDdispatchat405-208-5001(on-campusext.5001)torequestanescort.Thedispatcherwillprovideinstructionsastowheretomeetanofficer.NewStudentOrientationAtthecommencementofeachfallsemesteracampussafetymeetingisheldforallnewfirst-timestudents.Themeetingincludestopicsrelatedtocrimeprevention,reportingcrimeandothercampusviolations,sexualassaultpreventionandconsent,personalsafetyandbystanderintervention.Priortotheopeningofthefallsemester,newfirst-timestudentscompleteonlineeducationmodulesfocusedonAlcoholandOtherDrugsPrevention&Awareness,CampusSafety&ResidenceLife,DatingViolence&SexualAssaultPrevention&Awareness,andHarassmentPrevention&Awareness.Question,Persuade,andRefer(Suicidepreventionandawareness)QPRisasimpleeducationalprogramthatteachesordinarycitizenshowtorecognizeamentalhealthemergencyandhowtogetapersonatriskthehelptheyneed.Itisalsoanactionplanthatcanresultinlivessaved.OCUoffersQPRtrainingworkshopsatleasttwotimesperyear.InterpersonalViolenceAwarenessCampaignEachOctober,theUniversityCounselingCentercoordinatesanawarenesscampaignforinterpersonalviolencesuchasdomesticabuse,datingviolence,sexualassault,andstalking.Thecampaignincludeseducationalopportunitiesforstudentsaswellasactivitiesdesignedtoheightenawarenessabouttheseissues.SexualAssaultAwarenessandPreventionEachApril,theUniversityCounselingCentercoordinatesanawarenesscampaignaddressingsexualassault.Thecampaignincludeseducationalopportunitiesandresourcestohelpeducatestudents,faculty,andstaffaboutsexualassaultandprevention.

• Marijuanaisanaddictivedrug,althoughmanystillbelievethatitisharmless.Itimpairsshort-termmemorycomprehension,concentration,reactiontime,andmotivation.Itmayalsocauseparanoiaandpsychosis.Marijuanasmokecontainsmorecancer-causingagentsthantobaccosmoke.Thewaymarijuanaissmokedenhancestheriskofcontractinglungdiseaseandcancer.
• Whilecocaineandcrackcanspeedupperformance,theireffectisshort-lived.Morelastingrisksareshortattentionspan,irritabilityanddepression,seizureandheartattack.
• Prescriptiondrugsareoftenusedtoreducestress.However,theyarenotsafe,unlesstheyaretakenasdirected.Ifabused,theycanleadtosluggishnessorhyperactivity,impairedreflexes,addiction,andbraindamage.

ReportingAllformsofsexualviolence,dating/domesticviolence,andstalkingshouldbereported,nomattertheseverity.OklahomaCityUniversity’sprimaryconcernissafety;thereforeindividualsshouldnotbedeterredinreportingeveniftheuseofalcoholorotherdrugswasinvolved.OklahomaCityUniversityencouragesvictimsofsexualviolence,dating/domesticviolence,andstalkingtotalktosomeoneaboutwhathappenedsotheycanreceivesupportandsothattheinstitutioncanrespondappropriately.OklahomaCityUniversityoffersbothconfidentialreportingandnon-confidentialreportingoptions.Itisimportanttobeawarethatdifferentindividualswhovictimscancontactforassistancefollowinganincidentmayhavedifferentresponsibilitiesregardingconfidentiality,dependingontheirposition.Understatelaw,someindividualscanassureavictimofconfidentiality,includingcounselorsandcertifiedvictims’advocates.Ingeneral,however,anyotherinstitutionemployeecannotguaranteecompleteconfidentiality,unlessspecificallyprovidedbylaw.Asisthecasewithallcollegesanduniversities,theinstitutionmustbalancetheneedsoftheindividualvictimwithanobligationtoprotectthesafetyandwell-beingofthecommunityatlarge.Differentemployeesoncampushavedifferentabilitiestomaintainavictim’srequestforconfidentiality.

PastoralorMentalHealthCounselors
ToBeexemptfromdisclosingreportedoffensestoappropriateOklahomaCityUniversityofficials,apastoralormentalhealthcounselormustbeactingintheirroleasapastoralorprofessionalcounselor.Thisexemptiondoesnotrelievecounselorsofthedutytoexercisereasonablecaretoprotectaforeseeablevictimfromdangerposedbythepersonbeingcounseled.Whenspeakingtoavictimorwitnesstoacrime,counselorsareencouragedtoinformtheindividualtoreportthecrimetopolice.Apastoralcounselorisapersonwhoisassociatedwithareligiousorderordenomination,isrecognizedbythatreligiousorderordenominationassomeonewhoprovidesconfidentialcounseling,andisfunctioningwithinthescopeofthatrecognitionasapastoralcounselor.Amentalhealthcounselorisapersonwhoseofficialresponsibilityincludesprovidingmentalhealthcounselingtomembersoftheinstitution’scommunityandwhoisfunctioningwithinthescopeofhisorherlicenseorcertification.Thisdefinitionalsoappliestoprofessionalcounselorswhoarenotemployeesoftheinstitutionbutareundercontracttoprovidecounselingtotheinstitution.NotethatthepastoralcounselorormentalhealthcounselormustreportthecrimetoOklahomaCityUniversitypoliceforthepurposesofincludingtheincidentintheannualcrimestatisticsonly.Personalinformationwillnotbeconveyedwhenmakingthisdisclosureunlessthevictimconsentstosuchdisclosure.
CampusHealthServicesProviders
CampusHealthServicesprovidersareconfidentialreportingoptions.TheyarenotrequiredtoreportanyinformationaboutanincidenttotheTitleIXCoordinatorwithoutavictim’spermission.However,theywillreportincidentswithoutanyidentifiableinformationtoOklahomaCityUniversityPoliceforthepurposeoftheCleryAct.
Whiletheseprofessionalcounselorsandhealthservicesprovidersmaymaintainavictim’sconfidentiality,theymayhavereportingorotherobligationsunderstatelaw,suchasmandatoryreportingtolawenforcement

IfOklahomaCityUniversitydeterminesthattheallegedindividual(s)poseaseriousandimmediatethreattothecampus,OklahomaCityUniversitymayissueatimelywarningtothecommunity.Anysuchwarningwillnotincludeanyinformationthatidentifiesthevictim.
Non-ConfidentialReportingOptionsOklahomaCityUniversityandtheCleryActrequireallotheremployees(excludingcounselorsandhealthcareproviders)whobecomeawareofaninstanceofsexualviolencetoreporttheinstancetotheOklahomaCityUniversityPolice.Thevictim’snameshouldnotbereportedtothepolicewithoutthevictim’spermission.Thereportshouldincludethenature,date,time,andgenerallocationofanincident.Thisisalimitedreportwhichincludesnoinformationthatwoulddirectlyorindirectlyidentifythevictim.Thisallowsfortheinstitutiontotrackpatterns,evaluatetheprogram,anddevelopappropriatecampus-wideresponses.NotethattheCleryActrequiresothercrimestobereported.Whenaninstanceofsexualviolenceisreportedtoa“responsibleemployee”thereportercanexpecttheincidentwillbereportedtotheTitleIXCoordinatororDeanofStudentsOffice.AresponsibleemployeemustreporttotheTitleIXCoordinatororDeanofStudentsOfficeallrelevantdetailsabouttheallegedsexualharassmentorsexualviolencesharedbythevictimincludingnames,date,timeandspecificlocationoftheallegedincident.Totheextentpossible,informationreportedtoaresponsibleemployeewillbesharedonlywithpeopleresponsibleforhandlingtheinstitution’sresponsetothereport.Aresponsibleemployeeshouldnotshareinformationaboutthevictimtolawenforcement.A“responsibleemployee”isanemployeewhohastheauthoritytoredresssexualviolence,whohasthedutytoreportincidentsofsexualviolenceorotherstudentmisconduct,orwhoastudentcouldreasonablybelievehasthisauthorityorduty.Examplesincludebutarenotlimitedtofacultymembers,advisors,employeesinstudentservicesofficesandanyoneinasupervisoryrole.Whenavictimtellsaresponsibleemployeeaboutanincidentofsexualviolence,thevictimhastherighttoexpecttheinstitutionwillinvestigatetheallegedsexualviolence,endanysexualviolence,preventthesexualviolencefromreoccurring,andeducateonsexualviolence.

Beforeavictimrevealsanyinformationtoaresponsibleemployee,theemployeeshouldensurethatthevictimunderstandstheemployee’sreportingobligationsandifthevictimwantstomaintainconfidentiality,thenthestudentshouldbedirectedtoaconfidentialresource.RequestsforConfidentialityfromaNon-ConfidentialReporterIfavictimdisclosesanincidenttoaresponsibleemployeebutwishestomaintainconfidentialityorrequeststhatnoinvestigationintoaparticularincidentbeconductedorconductactiontaken,OklahomaCityUniversitymustweighthatrequestagainsttheobligationtoprovideasafeenvironmentforallstudents,includingthevictim.TheTitleIXCoordinator,nottheresponsibleemployee,makesthedeterminationtohonorrequestsforconfidentiality.Iftheinstitutionhonorstherequestforconfidentiality,avictimmustunderstandthattheinstitution’sabilitytomeaningfullyinvestigateandrespondtotheincidentmaybelimited.Althoughrare,therearetimeswhentheUniversitymaynotbeabletohonoravictim’srequestinordertoprovideasafeenvironmentforallstudents.Whenweighingavictim’srequestforconfidentialityorthatnoinvestigationorconductprocessbepursued,thefollowingwillbeconsidered:
Theincreasedriskthattheallegedrespondentwillcommitadditionalactsofsexualorotherviolence,suchas:
• whethertherehavebeenothersexualviolencecomplaintsaboutthesameallegedrespondent;
• whethertheallegedrespondenthasahistoryofarrestsorrecordsfromapriorschoolindicatingahistoryofviolence;
• whethertheallegedrespondentthreatenedfurthersexualviolenceorotherviolenceagainstthevictimorothers;
• whetherthesexualviolencewascommittedbymultiplerespondents;• whetherthesexualviolencewasperpetratedwithaweapon;• whetherthevictimisaminor;• whethertheinstitutionpossessesothermeanstoobtainrelevant
informationofthesexualviolence(e.g.,securitycamerasorpersonnel,physicalevidence);
• whetherthevictim’sreportrevealsapatternofperpetration(e.g.,viaillicituseofdrugsoralcohol)atagivenlocationorbyaparticulargroup.

2. “Courseofconduct”meansapatternofconductcomposedofaseriesoftwo(2)
ormoreseparateactsoveraperiodoftime,howevershort,evidencingacontinuityofpurpose.Constitutionallyprotectedactivityisnotincludedwithinthemeaningof“courseofconduct”;
3. “Emotionaldistress”meanssignificantmentalsufferingordistressthatmay,but
doesnotnecessarilyrequire,medicalorotherprofessionaltreatmentorcounseling;
4. “Unconsentedcontact”meansanycontactwithanotherindividualthatis
initiatedorcontinuedwithouttheconsentoftheindividual,orindisregardofthatindividual'sexpresseddesirethatthecontactbeavoidedordiscontinued.Constitutionallyprotectedactivityisnotincludedwithinthemeaningofunconsentedcontact.Unconsentedcontactincludesbutisnotlimitedtoanyofthefollowing:

Ahostileacademicorworkenvironmentmayexistwhereanenvironmentispermeatedbyinnuendo;insultsorabusivecommentsdirectedatanindividualorgroupbasedongender,race,nationality,sexualorientationorotherprotectedstatus;orgratuitouscommentsregardinggender,race,sexualorientation,orotherprotectedstatusthatarenotrelevanttothesubjectmatteroftheclassoractivitiesonthejob.
Ahostileenvironmentcanarisefromanunwarrantedfocusonsexualtopicsorsexuallysuggestivestatementsintheclassroomorworkenvironment.Itcanalsobecreatedbyanunwarrantedfocuson,orstereotypingof,particularracialorethnicgroups,sexualorientations,gendersorotherprotectedstatuses.Anenvironmentmayalsobehostiletowardanyonewhomerelywitnessesprohibitedharassmentinhisorherimmediatesurroundings,althoughtheconductisdirectedatothers.
Thedeterminationofwhetheranenvironmentishostileisbasedonthetotalityofthecircumstances,includingsuchfactorsasthefrequencyoftheconduct,theseverityoftheconduct,whethertheconductishumiliatingorphysicallythreatening,andwhethertheconductunreasonablyinterfereswithanindividual'slearningorwork.
5.SexualHarassment
SexualharassmentisaformofsexdiscriminationprohibitedbyTitleIXoftheEducationalAmendmentsof1972andTitleVIIoftheCivilRightsActof1964.Sexual

harassmentisunwelcomeconductofasexualnatureandcanincludeunwelcomesexualadvances,requestsforsexualfavors,andotherverbal,nonverbal,orphysicalconductofasexualnature,suchassexualassaultoractsofsexualviolence.Sexuallyharassingconductcanoccurbetweenpeopleofthesameordifferentgenders.
“Quidproquo”sexualharassment:Onetypeofsexualharassmentisknownas"quidproquo"sexualharassment,whichmayoccurwhenapersoninapositionofauthoritymakeseducationaloremploymentbenefitsconditionaluponanindividual'swillingnesstoengageinortolerateunwantedsexualconduct.Thisharassmentmayincludethefollowingunwelcometypesofbehavior:
• submissiontotheconductismadeatermorconditionofanindividual'semployment,academicstatus,orprogress;
• submissionto,orrejectionof,theconductbytheindividualisusedasabasisofemploymentoracademicdecisionsaffectingtheindividual;
• theconducthasthepurposeoreffectofhavinganegativeimpactupontheindividual'sworkoracademicperformance,orofcreatinganintimidating,hostileoroffensiveworkoreducationalenvironment;and/or
• submissionto,orrejectionof,theconductbytheindividualisusedasthebasisforanydecisionaffectingtheindividualregardingbenefitsandservices,honors,programs,oractivitiesavailableatorthroughtheUniversity.
“Hostileenvironment”sexualharassment:Ahostileenvironmentbasedonsexmayexistwhenthereisharassingconductthatis:
• sufficientlyserious–thatis,sufficientlysevereorpervasive–todenyorlimitaperson’sabilitytoparticipateinorbenefitfromaschool’sprogrambasedonsex.Inanemploymentcontext,ahostileenvironmentbasedonsexmayexistwhenthereisharassingconductthatissufficientlysevereorpervasivethatitcreatesaworkenvironmentthatisintimidating,hostile,abusive,oroffensivetoreasonablepeople.
• Thedenialorlimitationofparticipationintheschool’sprogramisdeterminedfromalloftherelevantcircumstances,bothobjectiveandsubjective,andincludesconsiderationofthetypeofharassment(e.g.,whetheritwasverbalorphysical);thefrequencyandseverityoftheconduct;theage,sex(gender),andrelationshipoftheindividualsinvolved(e.g.,teacher-studentorstudent-student);thesettingandcontextinwhichtheharassmentoccurred;whetherotherincidentshaveoccurredattheuniversity;andotherrelevantfactors.Themoreseveretheconduct,theless

needthereistoshowarepetitiveseriesofincidentstoproveahostileenvironment,particularlyiftheharassmentisphysical.Indeed,asingleinstanceofrapeorothersexualviolenceissufficientlyseveretocreateahostileenvironment.
6.SexualViolence
Asalludedtoabove,sexualviolenceisaformofsexualharassmentprohibitedbyTitleIX.Sexualviolencereferstophysicalsexualactsperpetratedagainstaperson’swillorwhereapersonisincapableofgivingconsentduetothevictim’suseofdrugsoralcohol.Anindividualalsomaybeunabletogiveconsentduetoanintellectualorotherdisability.
Consentistheknowingandvoluntaryassenttoengageincertainconduct.Consentmayonlybegivenbysomeoneoflegalagewiththecapacitytodoso.Someonewhoisincapacitatedlackstheabilitytomakearationaldecisionandthereforecannotadequatelyconsent.Someonemaybeincapacitatedifheorsheisdrunk,unconscious,ormedicated.Aperson’ssilenceshouldnotbeinterpretedasconsent.
Anumberofdifferentactsfallintothecategoryofsexualviolence,includingrape,sexualassault,sexualbattery,andsexualcoercion.AllsuchactsofsexualviolenceareformsofsexualharassmentcoveredunderTitleIX.
UnderOklahomalaw(21O.S.§142.20),sexualassaultincludesrape,rapebyinstrumentation,orforciblesodomy.

IV.POLICYPROHIBITINGRETALIATION
OklahomaCityUniversitywillnottolerateretaliation,whichisanyadverseactiontakenagainst,oranyattempttopenalize,apersonwhoreportsorparticipatesinaninvestigationinvolvingdiscriminationorharassment.Retaliationmayinclude

V.UNIVERSITYCOMPLIANCECOORDINATOR
A.GeneralDuties
InthisPolicy,theterm“ComplianceCoordinator”referstothesamecampusofficerasdoestheterm“TitleIXCoordinator.”
OklahomaCityUniversityshallhaveaComplianceCoordinatorwhowill
• ensurethattheUniversitycomplieswiththisPolicy;• receiveandaddresscomplaintsaboutdiscrimination,harassment,and
retaliation;and• ensurethepromotionofequalopportunitypracticeswithintheUniversity.
B.DutiesRegardingaComplaint
TheComplianceCoordinatorshall
• receivealldiscrimination,harassment,andretaliationcomplaints;• notifythePresident,Provost/VicePresidentforAcademicAffairs,and
GeneralCounselwhenacomplaintisfiled;• coordinatetheinvestigationofeachcomplaint;• assistincounselingthecomplainant;• monitorthetimelinesprovidedforinthecomplaintprocedure;• participateindisciplinaryproceedingsasprovidedinthisdocument;and• facilitateresolutionofeachcomplaint.
C.ConflictsofInterest
IftheComplianceCoordinatorisnamedinacomplaint,isimplicatedbyallegationsinacomplaint,orhasanactualorperceivedconflictofinterest(asdeterminedbythePresident,Provost/VicePresidentforAcademicAffairs,and/ortheGeneralCounsel),theinvestigationofacomplaintmaybeassignedtootherstaffortooutsidepersonsororganizationsundercontractwiththeUniversity.

VI.REPORTINGDISCRIMINATION,HARASSMENT,ANDRETALIATION
A.GeneralDutytoReport
Whereviolationsofsexualmisconduct,harassment,anddiscriminationmayhaveoccurred,allOklahomaCityUniversityemployeeswhohavewitnessedorwhohavebeenadvisedofsuchallegedviolationshaveadutytoreportclaimsofsexualmisconduct,harassment,anddiscriminationtotheComplianceCoordinator(orothermemberoftheComplianceteam).TheonlyemployeeswhodonothaveadutytoreportareemployeeswhoarestatutorilyprohibitedfromreportingbecauseofaprivilegerecognizedunderOklahomalaw(12O.S.§§2501etseq.)–e.g.,attorney-clientprivilege,physician-andpsychotherapist-patientprivilege,religiousprivilege,etc.Suchaprivilegewouldnegatethedutytoreportonlywhentheemployeereceivingthecomplaintisactingintheprivilegedcapacity.
OklahomaCityUniversityencouragesanypersonwhobelievesthatheorshehasexperienceddiscrimination,harassment,retaliation,orviolencebasedonaprotectedstatusinconjunctionwithaUniversityactivity,athleticprogram,educationalprogram,employment,orinconjunctionwithanapplicationforenrollmentoremployment,toreportthatcomplainttotheComplianceCoordinatororothermemberoftheComplianceteam.
Employeesmustpromptly(i.e.,within24hoursofreceivinginformation)reportknowledgeofsexualmisconduct,discrimination,andharassmenttotheComplianceCoordinatororotherpublishedmemberoftheComplianceteam.Failuretodosomayresultindisciplinaryactionuptoandincludingtermination.
IftheUniversityknows,orreasonablyshouldknow,aboutpossiblesexualmisconduct,discrimination,andharassment,theUniversitymustpromptlyinvestigatetodeterminewhatoccurredandthentakeappropriatestepstoresolvethesituation.
B.DutytoReportChildAbuse
Oklahomalawrequireseverypersonhavingreasontobelievethatanunmarriedchildundertheageof18isavictimofabuse(includingsexabuse)orneglecttoreportthematterpromptlytotheOklahomaDepartmentofHumanServices.
UnderOklahomalaw,“abuse”meansharmorthreatenedharmorfailuretoprotectthehealth,safety,orwelfareofachildbyapersonresponsibleforthechild’shealth,safety,orwelfare.Thisincludes,butisnotlimitedto,non-accidentalphysicalor

• theOklahomaCityUniversitypoliceortheOklahomaCitypolice;• theComplianceCoordinator;and/or• StudentHealthServices.
2.ObtainingMedicalAttention
Apersonwhohasexperiencedsexualviolence,includingsexualassault,sexualbattery,orsexualcoercionshouldgototheVictims’ResourcesPageontheUniversitywebsiteforinformationonobtainingimmediatemedicalattention.
3.ImportantThingstoRemember
TheUniversity’sprimaryconcernisstudentsafety.
Theuseofalcoholordrugsnevermakesavictimatfaultforsexualviolence,includingsexualassault,sexualbattery,sexualcoercion,orothersexoffenses.
TheUniversitywilladdressanyviolationofUniversityPoliciesorrules,suchasthoseinvolvingtheuseofalcoholordrugs,bythepersonexperiencingorwitnessingsexualviolence,includingsexualassaultorothersexoffenses,separatelyfromthecomplaintofsexualviolence.
4.PreservingEvidenceApersonwhohasexperiencedsexualviolence,includingsexualassault,shouldrememberthatitisimportanttopreserveallevidence,foruseinprosecutingtheperpetrator.

5.AssistanceinNotifyingAppropriateLawEnforcementAuthorities
TheUniversityencouragesanyonewhohasexperienced,witnessed,orbecomeawareofsexualviolence,includingsexualassault,tonotifylawenforcementauthorities,includingtheOklahomaCityUniversitypolicedepartmentandtheOklahomaCityPolice.
Uponrequest,theUniversitywillassistthatpersoninnotifyingthoseauthorities.
6.ObtainingCounseling,MentalHealthServices,andOtherServices
Apersonwhohasexperiencedsexualviolence,includingsexualassault,mayreceiveon-oroff-campuscounseling,mentalhealth,andotherservices.TheComplianceCoordinatorwillassistsuchpersonsinaccessingappropriateservices.
7.ChangestoAcademicandLivingSituations
Ifastudentwhohasexperiencedsexualviolence,includingsexualassault,asksforachangeinhisorherschedule,campusresidence,orotheractivitiesinlightofthatsexualviolenceorassault,theUniversitywillcomplyifsuchachangeisreasonablyavailable.
VII.COMPLAINTPROCEDUREANDINVESTIGATION
A.TheInitialComplaint
WhentheComplianceCoordinatorreceivesnotice,eitherfromthecomplainantorfromanyothersource,thataviolationofthisPolicyhasoccurred,theComplianceCoordinatorwill:
1. initiateanynecessaryremedialactionstoensurethesafetyofthecomplainantaswellasthecampusatlarge;
2. determinetheidentityandcontactinformationofthecomplainant(whetherthatbethereporter,theallegedvictim,aUniversityrepresentative,orotherparty);
3. identifytheportionsofthisPolicyallegedlyviolated;4. advisethecomplainantthatheorsheneednotparticipateininformal
resolution;5. notifythepersonbringingthecomplaintofhisorherrighttofileaformal
complaintandexplaintheprocedurefordoingso;

6. assurethecomplainantthatheorshewillnotberequiredtoconfront,orworkoutproblemswith,thepersonaccusedofprohibitedconduct;

8. ifthecomplaintisemployment-related,advisethecomplainantthatheorshemayfileacomplaintwiththeU.S.EqualEmploymentOpportunityCommission(EEOC)wheresuchacomplaintiswithinthatagency’sjurisdiction;and
9. ifthecomplainantallegesabuseorneglectofachildundertheageof18,reportthematterpromptlytotheOklahomaDepartmentofHumanServices(noprivilegeorcontractshallrelieveanypersonfromthisrequirement,andfailuretoreportisamisdemeanorunderOklahomalaw).
B.QualificationsforComplianceCoordinators,Investigators,andAdjudicatorsofComplaintsInvolvingSexualDiscrimination,SexualHarassment,orSexualViolence
1.ComplaintsInvolvingSexualDiscriminationorSexualHarassment
Acomplaintinvolvingallegationsofsexualdiscrimination,sexualharassment,orsexualviolenceshallbereviewed,handled,investigated,andadjudicatedonlybypersonswithtrainingorexperiencein:
• handlingcomplaintsinvolvingsexualdiscriminationorsexualviolence;• theUniversity’srelevantgrievanceprocedures;and• relevantconfidentialityrequirements.
2.ComplaintsInvolvingSexualViolence
Acomplaintallegingsexualviolence,includingsexualassaultorsexualcoercion,shallbereviewed,handled,investigated,andadjudicatedonlybypersonswithadequatetrainingorknowledgeregardingsexualviolence.
C.InformalResolution
1.InitiatinganInformalComplaint
Thepurposeoftheinformalcomplaintprocessistoallowanindividualwhobelievesheorshehasbeendiscriminatedagainstorharassedtoresolvetheissuethroughamediationprocessratherthantheformalcomplaintprocess.Thisprocessisappropriateforsimplemisunderstandingsorwhenthecomplainantdoesnot

wishtofileaformalcomplaint.Resolutionmayrequirenothingmorethanaclarificationofthemisunderstandingoranapologyfromtherespondentandanassurancethattheoffendingbehaviorwillcease.
However,seriousallegations,includingallegationsofpervasiveharassment,mayneedtobeinvestigatedevenifthecomplainingpartyconsidersthematterresolvedordoesnotwishtoinvoketheformalprocedure.Further,mediationisnotappropriateforvictimsofsexualassault.InaninformalprocesstheComplianceCoordinatorshalladvisethecomplainantofhisorherrightsandresponsibilitiesunderboththeformalandinformalprocesses.Complainantswhoallegesexualviolence,sexualmisconduct,orsexualharassmentshallbeadvisedthattheinformalresolutionprocessisoptionalandthatitisnotaprerequisiteforfurtherinstitutionalaction.
Ifthecomplainantdeclaresthatheorshepreferstoproceedwiththeinformalprocess,theComplianceCoordinatorshalladvisethecomplainant:
• whathisorherrightsandresponsibilitiesareundertheinformalandformalprocesses;
• thatinformalresolutionprocessisnotrequiredbeforeaformalcomplaintcanbesubmittedandinvestigated;and
• thatthecomplainantmay,atanytime,halttheinformalresolutionprocessandfileaformalcomplaint.
TheComplianceCoordinatorshallpresenttothecomplainantadocumentthat:
• describestheinformalandformalcomplaintprocesses;• clearlyindicatesthatthecomplainanthasselectedtheinformalprocess;and• statesthebasicsofthecomplainant’sallegations.
Thecomplainantshallsignanddatethedocument.
2.InvestigationandResolution
Uponreceivingasignedinformalcomplaint,theComplianceCoordinatorshall:
• conductanimmediateinitialinvestigationtodeterminewhetherthereisreasonablecausetochargetheaccusedindividualwithviolationofUniversityPolicy;

• iftheinitialinvestigationindicatesthatthereissufficientevidencetocontinuewiththecomplaintinvestigation,developaninvestigationplan,includingawitnesslist,evidencelist,intendedtimeframe,andorderofinterviewsforallwitnessesandtheaccusedindividual;
• commenceathorough,fair,andimpartialinvestigation;• completetheinvestigationpromptlyandwithoutunreasonabledeviation
fromtheinvestigationplanandtimeframe;• preparefindings,basedonapreponderanceoftheevidence,concerning
whetheraviolationofUniversityPolicydidoccur;• presentthefindingstotheaccusedindividual;and• concurrentlywithpresentingfindingstotheaccused,sharethefindingswith
thecomplainantandupdatehimorheronthestatusoftheinvestigationandtheoutcome.
• atinformalresolutionneednotincludeanyinvestigationunlesstheCompliance
EffortsCoordinatordeterminesthataninvestigationiswarrantedbyresultsofaninitialinvestigationorbytheseriousnessofthecharges.Evenifthecomplainantdecidestodismissaninformalcomplaint,theComplianceCoordinatormayrequiretheinvestigationtocontinueifheorshedeterminesthattheallegationsareseriousenoughtowarrantaninvestigation.D.FormalComplaint1.TheWrittenComplaint
AcomplainantwhoselectsaformalresolutionprocessshallfileawrittencomplaintwiththeComplianceCoordinator.ThecomplainantshallusetheUniversity’sComplaintofProhibitedDiscrimination,Harassment,orRetaliationForm,availableonlineandfromtheComplianceCoordinator.Thecomplaintshallincludethefollowinginformation:
• thecomplainant’snameandaddress;• thenameandtitleoftheperson(s)againstwhomthecomplaintismade;• astatementoftheaccused’sspecificactsthatallegedlyviolatedthisPolicy;• thespecificdatesonwhichthoseactionsallegedlytookplace;• aclearandconcisestatementofanyotherfactsthatformthebasisofthe
complaint;

• ifthecomplainantisnottheallegedvictim,thecomplainant’srelationship,ifany,tothepersonwhoexperiencedtheprohibitedconduct;

2.Timeliness
Generally,anycomplaintshouldbefiledwiththeComplianceCoordinatorwithin365calendardaysoftheallegeddiscrimination,harassment,orretaliation,tofacilitatetheprocessofgatheringfactsandevidence.Complaintsthatarefiledafterthattimewillbereviewed,butalengthylapseoftimemaymakeaninvestigationdifficult.
3.NotificationoftheAccused
Oncethecomplaintisfiled,theComplianceCoordinatorshallinformtheaccusedofthefilingandthegeneralnatureofthecomplaintassoonaspossibleandinamannerthatisappropriateunderthecircumstances.
TheComplianceCoordinatorshalladvisetheaccused:
• thattheaccuracyoftheallegationshasnotbeenassessed;• thattheaccusedwillhaveanopportunitytopresenthisorhersideofthe
matter;and• thatanyconductthatcouldbeviewedasretaliatoryagainstthecomplainant
orwitnessesmustbeavoided.
4.ReviewbytheComplianceCoordinator
TheComplianceCoordinatorshalldeterminewhether:
• thewrittencomplaintiscomplete;• thewrittencomplaintallegesconductprohibitedbythisPolicy;and• thecomplainantexperiencedtheallegedconductorisapersonal
representativeofsomeonewhoexperiencedtheallegedconduct,witnessedtheallegedconduct,orisafacultymemberorstaffmemberwholearnedoftheallegedconductinhisorherofficialcapacity.

5.DefectiveComplaint
IftheComplianceCoordinatordeterminesthatthewrittencomplaintisdefective,heorsheimmediatelyshallreturnittothecomplainantwithawrittencompletewrittenexplanationofwhyaninvestigationwillnotbeinitiated.Thisexplanationshallstatethat:
• thecomplaintdoesnotmeettherequirementsofthispolicy;• themannerinwhichthecomplaintisdefective;and• thefactthatthecomplainantmaysubmitarewrittencomplaint.
E.FormalInvestigation1.SelectionoftheInvestigator
IftheComplianceCoordinatordeterminesthewrittencomplaintissufficient,heorshe,inhisorherdiscretion,mayassigntheinvestigationtoaninternaldesigneeortoathirdpartyoperatingundercontract.Incasesofsexualdiscrimination,sexualharassment,orsexualviolence,theinvestigatormustmeetthequalificationsestablishedin§VII.BofthisPolicy.
2.StartoftheInvestigation
Oncetheinvestigatorhasbeenselected,heorsheshallconducttheinvestigationinatimelymannerandshallcompleteitexpeditiouslyunlessthematterisinformallyresolvedandthecomplainantdismissesthecomplaint.
3.RelationoftheInvestigationtoLawEnforcementInvestigation
TheinvestigationconductedpursuanttothisPolicymaybeconcurrentwithaninvestigationbylawenforcementofficers,butitisnotdependentonanylawenforcementinvestigation.
Ifthewrittencomplaintallegessexualdiscrimination,sexualharassment(includingsexualviolence),orretaliationforclaimsofsexualdiscriminationandsexualharassment,thelawenforcementinvestigationdoesnotrelievetheUniversityofitsindependentobligationunderTitleIXtoinvestigate.
F.ProtectionfortheComplainantduringanInvestigationofSexualHarassmentorSexualViolence

OncetheUniversityhasnoticeofallegationsofsexualharassmentorviolence,theUniversityshallpromptlytakestepstoprotectthecomplainantasnecessary,includingnotifyingthecomplainantofhisorheroptionstoavoidcontactwiththeallegedperpetrator.TheUniversitymayprohibittheallegedperpetratorfromhavinganycontactwiththecomplainantduringtheinvestigation.TheUniversitywillminimizetheburdenplacedonthecomplainantforavoidingtheallegedperpetrator.
Onceacomplaintisfiled,theindividual(s)accusedofengaginginprohibitedconductshouldbeadvisedofthatfilingandthegeneralnatureofthecomplaint.Thisshouldoccurassoonaspossibleandinamannerthatisappropriateunderthecircumstances.TheUniversitywillalsoadvisetheaccusedthatanassessmentoftheaccuracyoftheallegationshasnotyetbeenmade,thatthecomplaintwillbeinvestigated,thattheaccusedwillbeprovidedanopportunitytopresenthis/hersideofthematter,andthatanyconductthatcouldbeviewedasretaliatoryagainstthecomplainantoranywitnessesmustbeavoided.

Employee(s)and/orstudent(s)shallbeentitledtobeaccompaniedbyamemberoftheUniversity'scommunity(suchasacolleague,parent,studentadvocate,etc.)atallcomplaintmeetings.Allparticipantsareprohibitedfromdisclosinganyinformationconcerningthecontentofameetingorhearingtoanynon-participant.Participantsarealsoprohibitedfromanyretaliatoryconductrelatedtoinformationdisclosedduringameetingorhearing.
Advisorsandattorneysmaybepresentduringanymeetingsorhearingsbutcannotparticipatedirectlyintheprocess.
B.RightsoftheComplainant(s)
Acomplainanthastheright:

• tobeinformed,whenanyformalinvestigationbegins,oftheallegations,theidentityofthecomplainant(s),anyknownfactssurroundingtheallegations,andaproposedtimelineforresolvingthecomplaint;

IX.RESOLUTIONOFTHECOMPLAINT
A.TheInvestigativeReport
1.Preparation
a.InformalComplaintReport
IfthecomplainantselectstheinformalresolutionprocessandtheComplianceCoordinatordeterminesthattheallegationswarrantaninvestigation,the

ComplianceCoordinator,orhisorherdesignee,shallprepareacompletewritteninvestigativereportattheconclusionofhisorherinvestigation.Thereportshallbepreparedevenincaseswherethecomplainantconsidersthematterresolvedorchoosesnottopursueaformalcomplaint.
b.FormalComplaintReport
Ifaformalcomplainthasbeenfiled,theComplianceCoordinator,orhisorherdesignee,shallprepareacompletewritteninvestigativereportunless:
• thematterisinformallyresolvedorthecomplainantvoluntarilydismissestheformalcomplaint,and
• theComplianceCoordinatordeterminesthattheallegationsarenotseriousorpervasiveenoughtowarrantcompletingtheinvestigation.
2.ContentsofReport
Theinvestigativereportshall:
• describethecircumstancesgivingrisetothecomplaint;• summarizethestatementsprovidedbyeachwitness,includingthe
complainantandanywitnessesidentifiedbythecomplainantinthecomplaint;
• analyzeanyrelevantdataorotherevidencecollectedduringtheinvestigation;
• specificallystatewhethertheinvestigatorfindsitmorelikelythannotthattheaccusedcommittedprohibiteddiscrimination,harassment,orretaliationregardingeachallegationinthecomplaint;
• statetheinvestigator’sproposedresolutionofthecomplaint,including,ifappropriate,proposedsanctionsagainsttheaccused;and
• state,asappropriate,therightofthecomplainantortheaccusedtobringfurtherproceedingsunder§IX.CofthisPolicy(FurtherProceedings).
3.NoticeandDistributionoftheInvestigativeReport
a.TimingandDistributionProcedures
Unlessunusualorcomplexcircumstancesexist,theComplianceCoordinator,orhisorherdesignee,shallcompleteanddistributetheinvestigativereporttotheGeneralCounsel,President,Provost/VicePresidentforStudentAffairs,andanyotherDeanorVicePresidentdeemedbytheComplianceCoordinatortohaveaneedtoknowofthefindingsoftheReport(whetherthecomplaintwasinformalorformal)within60daysofthefilingofthecomplaint.

TheComplianceCoordinatorwillnotdistributethefullreporttothecomplainantandtheaccusedbutwillprovidethemwithanotificationofthefindingsofthereport,inaccordancewithanylegalrestrictionsondisclosureofinformationtothoseparties.
Incasesofallegedemploymentdiscrimination,theComplianceCoordinator,orhisorherdesignee,shallcompletetheinvestigativereportwithin90daysofthefilingofaformalwrittencomplaintandwithinthattimewilldistributethereportandmakethenotificationsdescribedabove.
Inanycaseinvolvingemploymentdiscrimination,thecomplainanthastherighttofileacomplaintwiththeEEOCorstateagencywherethecaseiswithinthejurisdictionofthatagency.
b.IftheAccusedisaStudent
TheFamilyEducationalRightsandPrivacyAct(FERPA)generallyprohibitsthenonconsensualdisclosureofpersonallyidentifiableinformationfromastudent’seducationalrecord.However,FERPApermitstheUniversitytodisclosetoaharassedstudentinformationaboutthesanctionimposeduponastudentwhowasfoundtohaveengagedinharassmentwhenthesanctiondirectlyrelatestotheharassedstudent.Thisinformationincludesanorderthattheharasserstayawayfromtheharassedstudent,orthattheharasserisprohibitedfromattendingschoolforaperiodoftime,orthattheharassertransferredtootherclassesoranotherresidencehall.Disclosureofotherinformationintheaccusedstudent’s“educationrecord,”includinginformationaboutsanctionsthatdonotrelatetotheharassedstudent,mayresultinaviolationofFERPA.
Whenharassingconductinvolvesacrimeofviolenceoranon-forciblesexoffense,FERPApermitstheUniversitytodisclosetotheallegedvictimthefinalresultsofadisciplinaryproceedingagainsttheallegedperpetrator,regardlessofwhethertheUniversityconcludedthataviolationwascommitted.Additionally,theUniversitymaydisclosetoanyone–notjusttheallegedvictim–thefinalresultsofadisciplinaryproceedingifitdeterminesthatthestudentisanallegedperpetratorofacrimeofviolenceoranon-forciblesexoffense,and,withrespecttotheallegationmade,thestudenthascommittedaviolationoftheUniversity’srulesorPolicies.Inaddition,theUniversityissubjecttothefederalCleryAct,whichrequiresthat“boththeaccuserandtheaccusedmustbeinformedoftheoutcomeofanyinstitutionaldisciplinaryproceedingbroughtallegingasexoffense.”CompliancewiththisrequirementdoesnotconstituteaviolationofFERPA.Furthermore,theFERPAlimitationsonre-disclosureofinformationdonotapplytoinformationthattheUniversityisrequiredtodiscloseundertheCleryAct.Accordingly,theUniversitymaynotrequireacomplainanttoabidebyanondisclosureagreement,inwritingorotherwise,thatwouldpreventthere-disclosureofthisinformation.

B.LackofObjectiontotheFindings
Ifneitherthecomplainantnortheaccusedobjects,inwriting,totheinvestigativefindingswithintencalendardaysafterreceivingnoticeofthosefindings,theinvestigativereport’sfindingsandtheproposedresolutionshallbecomefinalandbinding.
C.FurtherProceedings
Appeals
AllrequestsforappealconsiderationmustbesubmittedinwritingtotheTitleIXCoordinatorwithinten(10)daysofthedeliveryofthewrittenfindingoftheTitleIXCoordinator.Anypartymayappealthefindingsand/orsanctionsonlyunderthegroundsdescribed,below.
Anypartymayappeal,butappealsarelimitedtothefollowinggrounds:
• Aproceduralerrororomissionoccurredthatsignificantlyimpactedtheoutcomeofthehearing(e.g.substantiatedbias,materialdeviationfromestablishedprocedures,etc.).
• Toconsidernewevidence,unknownorunavailableduringtheoriginalhearingorinvestigation,thatcouldsubstantiallyimpacttheoriginalfindingorsanction.Asummaryofthisnewevidenceanditspotentialimpactmustbeincluded.
• ThesanctionsimposedfalloutsidetherangeofsanctionstheUniversityhasdesignatedforthisoffenseandthecumulativerecordoftherespondingparty.
Athree-memberappealspanel,comprisedofUniversityEmployeeswhohavecompletedTitleIXTraining,andwhohavenotbeeninvolvedintheprocesspreviously,willbedesignatedbytheTitleIXCoordinator.
Theappealspanelwillreviewtheappealrequest(s).Theoriginalfindingandsanction/responsiveactionswillstandiftheappealisnottimelyorisnotbasedonthegroundslistedabove,andsuchadecisionisfinal.Thepartyrequestingappealmustshowthatthegroundsforanappealrequesthavebeenmet,andtheotherpartyorpartiesmayshowthegroundshavenotbeenmet,orthatadditionalgroundsaremet.Theoriginalfindingandsanctionarepresumedtohavebeendecidedreasonablyandappropriately.Whenanypartyrequestsanappeal,theTitleIXCoordinatorwillsharetheappealrequestwiththeotherparty(ies),whomayfilearesponsewithinten(10daysand/orbringtheirownappealonseparategrounds.Ifnewgroundsareraised,theoriginalappealingpartywillbepermittedtosubmita

Wheretheappealspanelfindsthatatleastoneofthegroundsismetbyatleastoneparty,additionalprinciplesgoverningthehearingofappealswillincludethefollowing:
• Decisionsbytheappealspanelaretobedeferentialtotheoriginaldecision,makingchangestothefindingonlywherethereisclearerrorandtothesanction/responsiveactiononlyifthereisacompellingjustificationtodoso.
• Appealsarenotintendedtobefullre-hearings(denovo)oftheallegation.Inmostcases,appealsareconfinedtoareviewofthewrittendocumentationorrecordoftheinvestigation,andpertinentdocumentationregardingthegroundsforappeal.Anappealisnotanopportunityforappealspaneliststosubstitutetheirjudgmentforthatoftheoriginalinvestigator(s)merelybecausetheydisagreewithitsfindingand/orsanctions.
• Appealsgrantedbasedonnewevidenceshouldnormallyberemandedtotheinvestigator(s)forreconsideration.OtherappealsmayberemandedatthediscretionoftheProvost/VicePresidentforAcademicAffairsorhisorherdesignee,or,inlimitedcircumstances,heardbythethree-memberappealspanel.
SanctionsimposedastheresultoftheinitialinvestigationareimplementedimmediatelyunlesstheProvost/VicePresidentforAcademicAffairsorhisorherdesigneestaystheirimplementationinextraordinarycircumstances,pendingtheoutcomeoftheappeal.Forstudents:Graduation,studyabroad,internships/externships,etc.doNOTinandofthemselvesconstituteexigentcircumstances,andstudentsmaynotbeabletoparticipateinthoseactivitiesduringtheirappeal.
• TheappealspanelshallnotifytheProvost/VicePresidentforAcademicAffairsorhisorherdesigneeofthepanel’sdeterminationoftheoutcomeoftheappealwithin45daysofreceiptoftheappeal.
• TheProvost/VicePresidentforAcademicAffairsorhisorherdesigneewillconferwiththeappealspanel,incorporatetheresultsofanyremandedgrounds,andrenderawrittendecisionontheappealtoallpartieswithinthree(3)daysoftheresolutionoftheappealorremand.
• Onceanappealisdecided,theoutcomeisfinal:furtherappealsarenotpermitted,evenifadecisionorsanctionischangedonremand.
• Allpartieswillbeinformedinwritingwithinthree(3)daysoftheoutcomeoftheAppealsPanel,withoutsignificanttimedelaybetweennotifications,andinaccordancewiththestandardsfornoticeofoutcomeasdefinedabove.
• Inrarecaseswhereaprocedural[orsubstantive]errorcannotbecuredbytheoriginalinvestigator(s)(asincasesofbias),theappealspanelmayrecommendanewinvestigationprocess,includinganewassigned

investigator.Theresultsofaremandcannotbeappealed.Theresultsofanewinvestigationprocesscanbeappealed,once,onanyofthethreeapplicablegroundsforappeals.
• IncaseswheretheappealresultsinreinstatementtotheUniversityand/orresumptionofprivileges,allreasonableattemptswillbemadetorestoretherespondingpartytotheirpriorstatus,recognizingthatsomeopportunitieslostmaybeirreparableintheshortterm.
2.InitiationofFurtherProceedings
Thecomplainant,theaccused,and/orthepersonallegedtohaveexperiencedtheprohibiteddiscrimination,harassment,orretaliationmayfileawrittenobjectiontotheinvestigativefindingsnolaterthantencalendardaysfromthedatethepartiesarenotifiedoftheadministrativedetermination.
ThewrittenobjectionshouldbefiledwiththeComplianceCoordinator.
3.ParticipationbytheComplianceCoordinator
TheUniversity’sComplianceCoordinatorshallhavetheauthoritytoattendmeetingsand/orhearingsscheduledbytheProvost/VicePresidentforAcademicAffairsand/ortheAssistant/AssociateProvostandshallparticipateasapartyinallfurtherproceedings,exceptdeliberations.
EithertheComplianceCoordinatororotheradviserstotheProvost/VicePresidentforAcademicAffairsand/ortheAssistant/AssociateProvostwillassistthoseofficerswithapplyingtheprinciplessetforthinthisPolicy.Theseadvisersmusthavethequalificationsdescribedin§VII.BofthisPolicy.
X.SANCTIONSFORVIOLATIONSOFTHISPOLICY
A.StaffEmployeeSanctionsforViolationsofthisPolicy
InaccordancewiththeUniversity’spoliciesandprocedures,theUniversitymayimposesanctionssuchasverbalreprimands,mandatoryenrollmentinseminarspertainingtoprohibiteddiscriminationandsexualharassmentissues,writtenreprimands,demotions,suspensionswithoutpay,anddismissalfromemployment.Inaddition,casesinvolvingseriousmisconductsuchassexualassaultmaybereferredtolocallawenforcementforpossiblecriminalprosecution.
B.StudentSanctionsforViolationsofthisPolicy

InaccordancewiththeUniversity’sstudentdisciplinaryprocedures,theUniversitymayimposesanctionssuchasverbalreprimands,mandatoryenrollmentinseminarspertainingtoprohibiteddiscriminationandsexualharassmentissues,writtenreprimands,dismissalfromclassand/orotherUniversityactivities,suspensionorexpulsion,dependingupontheseverityoftheact.Inaddition,casesinvolvingseriousmisconductsuchassexualassaultmaybereferredtolocallawenforcementforpossiblecriminalprosecution.
C.FacultySanctionsforViolationsofthisPolicy
InaccordancewiththeUniversity’spoliciesandprocedures,andinaccordancewithSectionVIII.C.2.coftheFacultyHandbook,theProvost/VicePresidentforAcademicAffairshasthediscretiontosuspendafacultymemberwithpaypendingfinaldecisiononterminationorlong-termsuspension,withnoticetotheFacultySenateExecutiveCommitteeandallpartiesconcerned.
TheOklahomaCityUniversityFacultyHandbook,SectionIX.A,providesaproceduretobeusedin“CasesinWhichaFacultyMemberisChargedwithSexualHarassmentorOtherUnlawfulDiscrimination.”ThisprocedurewillbeusedtoextentthatitcomplieswithTitleVIIoftheCivilRightsActof1964,TitleIXoftheEducationalAmendmentsof1972,andguidanceoftheDepartmentofEducationconcerningrequiredcampusproceedingspursuanttothesefederalstatutes.
D.InterimSuspensions
Inextraordinarycircumstances,wherepotentiallyseriousandimmediateharmmayresulttopersonsaffiliatedwiththeUniversityandafterconsultationwiththePresident,theComplianceCoordinatormayrelieve,reassign,orremovestaffmembersoradministratorsfromtheircurrentpositions/environmentatanytimeduringoraftertheinvestigationperiod.TheDeanofStudentswillfunctioninthesamemannerforstudents.Asnotedintheimmediatelyprecedingparagraph,theProvost/VicePresidentforAcademicAffairsmayexercisesimilarauthoritywithrespecttofacultymembers.
XI.EXTENSIONSOFDEADLINESSPECIFIEDINTHISPOLICY
Ifforreasonsbeyonditscontrol,theUniversityisunabletocomplywiththedeadlinesspecifiedinthispolicy,theComplianceCoordinatorwillnotifyeachofthepartiesinwritingandshallspecifytheanticipatedreviseddeadlines.

XII.CONFIDENTIALITY
TheUniversitydoesnotrevealinformationaboutsuchmattersexceptasnecessarytofulfillitslegalobligations.
Potentialcomplainantsaresometimesreluctanttopursueacomplaintiftheirnameswillberevealed.TheinabilitytorevealthenameofacomplainantorfactsthatarelikelytorevealtheidentityofthecomplainantcanseverelylimittheabilityoftheUniversitytorespond.
Complainantsmustalsorecognizethatpersonswhoareaccusedofwrongdoinghavearighttopresenttheirsideofthematter,andthisrightmaybejeopardizediftheUniversityisprohibitedfromrevealingthenameofthecomplainantorfactsthatarelikelytodisclosetheidentityofthecomplainant.
Ifacomplainantinsiststhathisorhernamenotberevealed,theresponsibleofficershouldtakeallreasonablestepstoinvestigateandrespondtothecomplaintconsistentwiththecomplainant’srequestaslongasdoingsodoesnotjeopardizetherightsofotherstudentsoremployees.ItisalsoimportantthatcomplainantsandwitnessesunderstandthepossibilitythattheymaybechargedwithallegationsofdefamationiftheycirculatethechargesoutsideoftheUniversity’sprocess.Ingeneral,personswhoareparticipatinginaUniversity’sinvestigativeordisciplinaryprocessthatisrelatedtoachargeofdiscriminationareprotectedfromtortclaimssuchasdefamation.However,personswhomakeallegationsoutsideoftheseprocessesorwhodiscusstheirclaimswithpersonsoutsideoftheprocessmayexposethemselvestotortcharges.
XIII.NOTICE,TRAINING,ANDEDUCATIONFORSTUDENTS,FACULTY,ANDEMPLOYEES
TheComplianceCoordinatorshallmakearrangementsfororprovidetrainingtoemployees,facultymembers,andstudentsontheUniversity’sprohibiteddiscriminationpolicyandprocedures.Facultymembers,membersoftheadministrativestaff,andmembersofthesupportstaffwillbeprovidedwithacopyoftheUniversity’swrittenpolicyonprohibiteddiscriminationatthebeginningofthesemesteroftheacademicyearafterthepolicyisadopted.
AllUniversityemployeeswillreceivethistrainingandacopyofthisPolicyandrelatedproceduresuponemploymentandannuallythereafter.
Atrainingprogramwillbemadeavailabletoallstudentsatleastonceannually.Thestudenttrainingwillincludeanexplanationofthepolicy,howitworks,andhowtofileacomplaint.Inaddition,acopyoftheUniversity’swrittenPolicyonprohibited

discrimination,asitpertainstostudents,andadditionalresourceswillbeprovidedonlineandaspartofanyorientationprogramconductedfornewstudentsatthebeginningofeachsemesterorsummersession,asapplicable.
XIV.ACADEMICFREEDOM
TheUniversityreaffirmsitscommitmenttoacademicfreedombutrecognizesthatacademicfreedomdoesnotallowanyformofprohibiteddiscrimination.Itisrecognizedthatanessentialfunctionofeducationisaprobingofopinionsandanexplorationofideasthatmaycausesomestudentsdiscomfort.Itisfurtherrecognizedthatacademicfreedominsuresthefaculty’srighttoteachandthestudent’srighttolearn.Finally,nothinginthesePoliciesandproceduresshallbeinterpretedtoprohibitbonafideacademicrequirementsforaspecificuniversityprogram,course,oractivity.Wheninvestigatingprohibiteddiscriminationcomplaintscontainingissuesofacademicfreedom,theComplianceCoordinatorwillconsultwithafacultymemberappointedbytheFacultySenateExecutiveCommitteewithrespecttocontemporarypracticesandstandardsforcoursecontentanddelivery.
XV.COUNSELING
TheUniversityprovidescounselingforvictimsofsexualassault.Formoreinformation,pleaserefertotheVictims’ResourcesPageontheUniversitywebsite.
XVI.RECORDSRETENTION
AconfidentialfileofallmaterialandinterviewsrelatingtotheinvestigationofthechargewillbemaintainedintheHumanResourcesOfficeinaccordancewiththeUniversity’sDocumentRetentionPolicy.TheComplianceCoordinatorandtheassignedinvestigatorsofthecomplaintwillbetheonlypersonswhohaveaccesstothefile.Thefilewillthenbehandledinamannerconsistentwithapplicablestateandfederalguidelinesformaintainingrecordsforthistypeofcomplaint.Nothingwillbeplacedintheaccusedperson'sUniversitypersonnelfileunlessdisciplinaryactionistakenagainsttheperson.
XVII.FALSEALLEGATIONSANDMISUSEOFTHISPOLICY
Intentionalfalseaccusationsand/oraccusationsmadewithoutgoodcauseofprohibiteddiscrimination,harassment,orsexualmisconductwillnotbetolerated.Accusationsofprohibiteddiscrimination,harassment,orsexualmisconductcanhavefar-reachingconsequencesanddisruptiveeffectsonthelivesofthoseaccused.Thisprovisiondoesnotapplytoaccusationsmadeingoodfaith.

TheUniversityreservestherighttotakeactionincasesofvexatiousorotherwiseunwarranteduseofthecomplaint/grievanceprocedureprovidedhereinforhandlingprohibiteddiscriminationandharassmentincidents.TheuseofthreatsoffilingprohibiteddiscriminationorharassmentchargesmightbeconsideredaformofcoercionandsuchincidentsshouldbereferredtotheComplianceCoordinatorforconsultationand/ordisciplinaryaction.
XVIII.FAILURETOCOOPERATEANDPROVISIONOFFALSEINFORMATION
Anytrustee,employee,facultymember,volunteer,studentorvendorwhorefusestocooperatewithorotherwiseinterfereswithaninvestigationconductedbyoronbehalfoftheUniversityoraninvestigationattheUniversitybyfederal,stateorlocallawenforcementagencies,willbesubjecttodisciplinaryaction,uptoandincludingtermination,expulsion,removalfromcampusand/orcancellationofcontract.

OklahomaCityUniversityconsidersthesafetyofourstudentstobeessentialtothecreationandmaintenanceofanenvironmentwherelearningisencouragedandsupported.ThepurposeofthispolicyistoestablishprocedurestoguidetheUniversity’sresponsetoreportsofmissingresidentstudentsinaccordancewiththerequirementsoftheHigherEducationOpportunityActof2008.EachOklahomaCityUniversitystudentwhoiseighteen(18)yearsofageorolderorwhoislegallyemancipatedhastheopportunitytovoluntarilyidentifyanindividualorindividualsfortheDeanofStudentstocontactwhenevercircumstancesindicatethatthestudentmaybemissingorotherwiseendangered.Todesignate“confidentialemergencycontacts,”studentsmaylog-intotheirBlueLinkaccountandclickon“updateemergencycontacts”andaddasecondcontactinadditiontoparentsorguardians.Toindicatethecontactisconfidential,pleaseselecttheitem“confidentialmissingperson”inthedropdownboxdesignatingrelationship.
Onlyuniversityofficialswithaccesstostudentcontactinformationwillhaveaccesstothisinformation.Intheeventthestudentisunder18yearsofageandisnotemancipated,theUniversitywillmakeanymissingstudentnotificationdirectlytothecustodialparent(s)orguardian(s).Ifamemberoftheuniversitycommunityhasreasontobelievethatastudentwhoresideson-campusismissing,heorsheshouldimmediatelynotifytheOCUPDat405-208-5911or405-208-5001ortheDeanofStudentsat405-208-7900.Uponreceivinginformationthatastudentcannotbelocatedandmaybemissing,OCUPDofficersandDeanofStudentswillcoordinateaninvestigationwhichwillincludethefollowing:

Ifthestudentcannotbelocatedafterreasonableefforts,OCUPDwillnotifytheOklahomaCityPoliceDepartmentnolaterthan24hoursafterthestudenthasbeenreportedmissing.FollowingnotificationoftheappropriatelawenforcementauthoritytheUniversitywillcooperateintheinvestigationandofferassistancetolocateamissingperson.

FiredrillsareinitiatedeachsemesterbytheOCUPoliceDepartmentandsupervisedbytheOklahomaCityFireDepartmentforallresidencehallsandcampusclassroombuildingsatrandom.Anall-campusemergencydrillisheldonceeachsemester.Periodically,emergencydrillswillbeperformedineachbuilding.TheOCURiskManager,theChiefoftheOCUPoliceandtheOKCFiredepartmentwillplanbuildingevacuationdrills.Alistofdrillswillbemaintainedeachyear.Exactdateswillbedeterminedandtheappropriatepersonnelwillbenotifiedseveraldaysbeforethedrill.OklahomaCityUniversityhasadoptedUniversalEmergencyProceduresandconductsthefollowingdrills:

Amedicalemergencyisdefinedassuddenonsetoflossofconsciousness,shortnessofbreath,acutechangeinbehaviorsuchasconfusion,uncontrolledbleeding,acutepainorcomplaintofchestpain.Ifanypersononcampusiscomplainingofanyofthese,call911fromanoncampusphone(or405-208-5911bycell)immediately.Donothesitate.Takeaction,evenifindoubt.StartCPRifthepersonisnotbreathingandhasnopulse.HavesomeonegetthenearestAEDimmediately.TheOCUPoliceDepartmentwillcometoyourlocationtoassistyouandhelplocalemergencyrespondersfindyourlocation.ResponsetimeforEMSAorOklahomaCityFireDepartmentmaybeaslittleas3to5minutes.ItisabsolutelyfreeforcommunityemergencyresponderstocometotheUniversity.ThereisnochargeorpenaltytotheUniversity.Ambulancepersonnelwillprovideminorinjurycareatnochargeifthepatientisnotexperiencingamedicalemergency.Ifthepersonisunconscious,havingdifficultybreathingorchestpain,isbleedingprofusely,isinseverepainorismedicallyunstable,theparamedicswillassess,stabilizeandtransportthepersontoalocalhospital.Thepatientischargedonlyiftransportedtoahospital.
