  • 1. The plans call for a variance to reduce the yard areaby one third in order to convert a carport into anexpanded garage and build a deck on top of the garage. This is too massive of a buildout for the existing yardarea and in my opinion does not meet the criteria toreceive a Certificate of Appropriateness for this historicneighborhood. 2. The proposed garage and deck will extend into thelight well of my building and restrict the light and aircirculation in six rooms of my apartment house (twobedroom windows, two bathroom windows and twowindows for the kitchens) in the downstairs and upstairsapartments. Even before the proposed garage anddeck are built the light well gets very little light andairflow. And in the downstairs apartment it is moreextreme of a case in that the bathroom and bedroomare always dark. Over the years those rooms off thelight well have had persistent mold problems. A deckover the garage will make the downstairs bedroom andbathroom completely absent of light and air circulation. This will exacerbate the existing mold problem andcreate greater concerns for the health of my downstairstenant. 3. Noise emanating from the deck, motor sounds and acar door opener are other reasons to modify the buildingpermits slightly. The proposed deck placed directlyadjacent to both my insulated exterior apartment walland light well will make living in my apartments very

  • difficult when deck entertainment is going on. Anothernoise issue is that the proposed steps leading to thegarage are directly in front of the light well so that thenoise will be transferred to the light well and into mybedrooms, bathrooms and kitchens from the 188 Haightpeople walking up and down the stairs. 4. My small apartment house which I bought 40 yearsago has been in our family for many years and currentlymy son (A registered nurse at Davies Hospital), his wifeand newborn (3 weeks old) live in the upstairsapartment directly adjacent to the proposed project. They have lived in the apartment for eight years andduring that time have seen the 188 Haight home flip atleast three times. During those years they have beensubjected to constant construction noise and dust bydifferent owners, each one adding their “improvement”to the home and rear yard and then moving on. Ofcourse, I am not using that as an argument to deny aneighbor’s building permit proposal or variance requestbut I do comment that more construction noise and dustis not something which my family looks forward to. In summary, I suppose there are good and bad designswhen considering how neighbors can be affected byconstruction proposals next door. I would hope thisplan could be modified in such a way to ameliorate myconcerns. For example shorten the garage and thedeck length so that it does not obstruct the light well inmy apartment house. Build a free standing wall on thedeck adjacent to my apartment for reducing sound

  • transmission. And, lastly, change the staircase leadingto garage by reversing the placement of the garage andstorage areas. I believe these are fairly easy changesand not costly fixes. It is my understanding that the Zoning Administratordenies variances when the “improvement” is materiallyinjurious to properties in the vicinity. I hope that I havemade constructive arguments to justify denying thisvariance as it has been presented and that mysuggestions for remedy will be seriously considered. I would be agreeable to work with the owners of 188Haight Street and the architect in order to arrive at amutually acceptable proposal.Thank you for your time and consideration.     · Approve the plans and specifications, and award Contract No. WW-632, Southeast Water Pollution Control Plant (SEP) Existing Digester Gas Handling Improvements, in the amount of $9,536,000, to the lowest, qualified, responsible and responsive bidder, Monterey Mechanical, to upgrade critical equipment at SEP in order to maintain existing digestion facilities until new facilities are available for service.

    · Approve Modification No. 2 Contract No. WW-617, As-Needed Sewer Cleaning and Inspection, with Pipe and Plant Solutions, Inc., to adjust contract bid item quantities to match actual quantities used, increasing the contract by $155,674, for a total contract amount of $2,178,934.

    · Approve the selection of Black & Veatch Corporation; Award Agreement No. PRO.0022, HHWP Power Transmission Line Clearance Mitigation - East, to provide design support to mitigate ground, wire, and structural clearance issues, for an amount not-to-exceed $12,000,000, and with a duration of 10 years, subject to Board of Supervisors approval, pursuant to Charter Section 9.118.

    · Authorize the General Manager to execute a Memorandum of Understanding with the Santa Clara Valley Water District (SCVWD) to undertake a Feasibility Study to identify purified water supply alternatives for the SFPUC and the Bay Area Water Supply and Conservation Agency, for an amount not to exceed $75,000, and with a total duration of 24 months (two years). The Feasibility Study will provide a preliminary understanding of viable options for participation in SCVWD’s Expedited Purified Water Program.

    · Authorize the General Manager to request approval from the Board of Supervisors to accept and expend on behalf of the City and County of San Francisco, a Rim Fire Alternate Project grant, for the purchase of capital equipment and the upgrade of communication equipment in the amount of $377,115 from the Federal Emergency Management Agency and the California Office of Emergency Services. The Local (SFPUC) share of project costs will be $69,836. (Ritchie)

    · Approve the Water Supply Assessment for the proposed 10 South Van Ness Project, pursuant to the State of California Water Code Section 10910 et seq.; California Environmental Quality Act (CEQA) Section 21151.9; and CEQA Guidelines Section 15155.

    · Approve the Revised Water Supply Assessment for the proposed Seawall Lot 337 and Pier 48 Mixed-Use Project, pursuant to the State of California Water Code Section 10910 et seq.; California Environmental Quality Act (CEQA) Section 21151.9; and CEQA Guidelines Section 15155.

    · Public Hearing: Discussion and Possible Action to authorize the General Manager to establish a 500-gallon-a-day residential household water use threshold for customers in single-family homes and individually metered multifamily units, that would be effective during designated drought periods and would result in a $150 excess use fine for each 30-day period a customer’s average daily water use exceeds the threshold.

    · Approve the plans and specifications, and award Contract No. WW-614R2, North Point Outfall Rehabilitation, in the amount of $12,485,980, to the lowest, qualified, responsible and responsive bidder, The Dutra Group, to rehabilitate the aging North Point Outfall System.

The project is a comprehensive plan for the 230-acre, 17-block portion of the city’s South of Market neighborhood bounded by Second Street on the east, Sixth Street on the west, Townsend Street on the south, and an irregular border that generally follows Folsom, Howard and Stevenson Streets to the north. The proposal is the draft Central SoMa Plan, published in August 2016, which seeks to encourage and accommodate housing and employment growth within the Plan Area by: (1) amending existing use districts and planning controls to support mixed-use and office development in portions of the Plan Area where such uses may currently be restricted or not permitted; (2) amending existing height and bulk districts to permit greater heights and densities than currently allowed; (3) modifying street and circulation patterns within and adjacent to the Plan Area; and (4) establishing new, and improving existing, open spaces. The Plan proposes planning policies and controls for land use; urban form (building height, setback and design); functional circulation changes to Folsom, Howard, Harrison, Bryant, Brannan, Third, and Fourth Streets in areas within and beyond the Plan Area; as well as policies and implementation measures related to open space, historical preservation and sustainability. The Plan requires General Plan, Planning Code, and Zoning Map text amendments as well as adoption of a Special Use District (SUD) to permit the Plan’s uses at the locations, heights and intensities proposed. Preliminary recommendation: Review and Comment

    · 1028 MARKET STREET - North side of Market Street between Jones and Taylor streets - Certification of the Final Environmental Impact Report. The proposed project includes demolition of the existing two-story, 33,310-gross-square-foot (gsf) historic commercial building and construction of a 13-story, approximately 120-foot-tall, multi-family residential development, with a maximum of 186 residential units, 9,657 gsf of ground-floor retail/restaurant uses (four tenant spaces), and a one-level 15,556 gsf below-grade basement level parking garage for up to 40 parking spaces. The project site is located in the Downtown General Commercial (C-3-G) Zoning District and the 120-X Height and Bulk District, within the Downtown Plan area. The Final EIR/EIS concluded that implementation of the 1028 Market Street project would result in significant unavoidable environmental impacts related to: historic architectural resources. Preliminary Recommendation: Certify the Final EIR/EIS

    · ACADEMY OF ART UNIVERSITY - Academy of Art University (AAU) is a private postsecondary academic institution that occupies buildings throughout the City (predominantly in the northeast quadrant). AAU plans on expanding its facilities and programs to accommodate a projected on-site student enrollment of approximately 17,282 students and 3,511 faculty and staff by 2020, resulting in a total increase of approximately 6,100 students and 1,220 faculty and staff. The Proposed Project consists of four general components: study area growth, project site growth, legalization of prior unauthorized changes, and shuttle service expansion. Study area growth consists of approximately 110,000 net square feet (sf) of additional residential uses (to house approximately 400 students, equivalent to about 220 rooms) and 669,670 sf of additional institutional space in 12 geographic areas (study areas) where AAU could occupy buildings to accommodate future growth. The study areas generally include the following areas: Study Area 1 (SA-1), Lombard Street/Divisadero Street; SA-2, Lombard Street/Van Ness Avenue; SA-3, Mid Van Ness Avenue; SA-4, Sutter Street/Mason Street; SA-5, Mid-Market Street; SA-6, Fourth Street/Howard Street; SA-7, Rincon Hill East; SA-8, Third Street/Bryant Street; SA-9, Second Street/Brannan Street; SA-10, Fifth Street/Brannan Street; SA-11, Sixth Street/Folsom Street; and SA-12, Ninth Street/Folsom Street. Project site growth consists of six additional sites that have been occupied, identified, or otherwise changed by AAU since publication of the September 2010 Notice of Preparation (NOP) for this EIR. The six project sites would include a total of 411,070 sf of institutional, bus storage, and community facility uses. The project sites include the following addresses: 2801 Leavenworth Street (The Cannery) (Assessor’s Block/Lot: 0010/001); 700 Montgomery Street (Assessor’s Block/Lot:0196/028); 625 Polk Street (Assessor’s Block/Lot:0742/002); 150 Hayes Street (Assessor’s Block/Lot:0811/022); 121 Wisconsin Street (Assessor’s Block/Lot:3953/004); and 2225 Jerrold Avenue (Assessor’s Block/Lot:5286A/020). The Proposed Project also includes extension of AAU’s shuttle service to serve growth in the study areas and at the project sites. The Proposed Project also includes legalization of changes in use and/or appearance undertaken without benefit of permits prior to issuance of the NOP at 28 of AAU’s 34 existing sites. The Proposed Project includes the occupation and use of existing buildings, as well as construction activities that would be limited to interior tenant improvements, exterior modifications such as signage, window replacements, and security system installation, and in limited circumstances, seismic upgrades. Adoption of CEQA Findings for the Department Proposed Project, which reflects revisions in the Proposed Project to include only residential conversions where the conversion to student housing serves a higher intensity use than what would otherwise be located on the subject site; support conversion of industrial to institutional uses only where the conversion to institutional remains industrial in nature or maintains an industrial component and is therefore best situated on the subject site rather than elsewhere in the City; support conversions of commercial to institutional uses only where the conversion to institutional use maintains a publicly-accessible, active use, and therefore is best situated on the subject site rather than elsewhere in the City; and support conversions of office uses where the institutional use is office in nature, such as the institution’s administrative headquarters, and is appropriate for the subject site. Based on these policy determinations, the Department Proposed Project includes review of all Program-Level Growth and Project-Level Growth analyzed in the EIR. However, the Department Proposed Project would result in the full legalization of 29 of AAU’s 40 existing and project sites, with 3 pending recommendations. The project proposes to legalize the conversion of two Residential Units and one Commercial Unit to three Dwelling Units and 8 Student Housing rooms. (Proposed Continuance to July 27, 2017)

    · 1916 OCTAVIA STREET - Located on the east side of Octavia Street between Broadway and Vallejo Streets (District 2) - Request for Conditional Use Authorization for the conversion of 20 Residential Units to Student Housing. The project proposes to legalize the conversion of one Residential Unit to 22 Student Housing rooms. (Proposed Continuance to July 27, 2017)

    · 1055 PINE STREET - Located on the south side of Pine Street between Jones and Taylor Streets (District 3) – Request for Conditional Use Authorization for the conversion of Residential Units to Student Housing. The project proposes to legalize the conversion of 59 Residential Hotel rooms to Student Housing rooms. (Proposed Continuance to July 27, 2017)

    · 860 SUTTER STREET - Located on the north side of Sutter Street between Leavenworth and Jones Streets (District 3) - Request for Conditional Use Authorization for the conversion of Residential Units to Student Housing. The project proposes to legalize the conversion of 50 Residential Hotel rooms and 39 Tourist Hotel rooms to 89 Student Housing rooms. (Proposed Continuance to July 27, 2017)

    · 1080 BUSH STREET - Located on the north side of Bush Street between Leavenworth and Jones Streets (District 3) - Request for Conditional Use Authorization for the conversion of 15 Residential Hotel Rooms to Student Housing. Currently, the subject property possesses four dwelling units. The proposed project would demolish the existing garages, subdivide the existing lot into two lots, reconfigure and retain two dwelling units in 2906 Folsom Street, and construct two new dwelling units at 2904 Folsom Street and 3203 25th Street. Overall, the project would maintain four dwelling units on the project site. Preliminary Recommendation: Disapprove

It ismy understanding that the owners at 188 Haight Street have applied for a building permit toconstruct a garage and deck sharing the same wall as my apartment. I have looked at the plans and see that the deck will be built into the light well that suppliesthe only light and fresh air I receive into my bedroom and bathroom. Because of thelocation of my bathroom and bedroom on the downhill side of the next door, I do not get alot of fresh air and light which comes from the lightwell. Even in the daytime I receive verylittle light. This causes mold in both the bedroom and bathroom which I am constantlywiping down. If a deck will be built it will hover over my lightwell windows and cause even less light andair to flow. I am opposed to this plan. My wife and I have lived at the adjacent residence, 285 Rose Street, for over8 years. The Variance request for the construction of a one car-garage with rooftop deck, accessible from RoseStreet, is directly alongside our small one-bedroom apartment and would share a wall with our bathroom, bedroom,and living room. After reviewing the plans for this project we would like to request that the Variance not be grantedfor the following reasons:

    1. The Variance extends past our light well and would further reduce the little light we have in our kitchen,bathroom, and bedroom. These windows are the only source of natural light in these rooms.

    2. Since the Variance extends past our light well, this also would reduce our air quality and circulation.We’ve had mold issues in the past, so a combination of reduced light and air circulation will cause moremold to grow. This causes serious concern for the health of our newborn daughter as well as our own.

    3. Currently the garage at 188 Haight Street shares a wall with our living room. The Variance wouldextend the garage past our bedroom and bathroom walls as well. This will cause more noise for us fromthe garage door opening, neighbors accessing the stairs, (which go past our windows), and socializingon the rooftop patio. Our apartment house is historic with uninsulated walls and single pane windows,so noise travels easily. This Variance will further exacerbate noise from 188 Haight Street.

    We have enjoyed living in this quiet neighborhood for many years and now have a newborn child and areconcerned for her well-being due to this Variance. Over the years, we have endured the noise from variousconstruction projects at 188 Haight Street from the different owners who make these improvements and then sellthe home. Our family has owned 281-287 Rose Street for 40, years and we would greatly appreciate if youconsider not granting the Variance for this project. Thank you for your time.
