Further to your email I have had a numberof discussions with our lawyer (lan McCombe, Brookfield) and surveyor

(Chris Williams, Williams & King). The recommended way forward is to apply to Council for 223,2246 & 224f

certifications usingthe BC numberand/or certificate of compliance number. Therefore, I have asked Chris Williams

Robert has referred this matter to me. From what I can see, I don't think any further consents are required. If CodeCompliance was granted in 2014, then that should conclude the matter for Council. 1 suggest Dale consults a lawyerdealing with property work and asks them to apply for registration of his title. If he doesn't already have a lawyer, youcan refer him to me and I could recommend somebody. He is already using Williams and King as his surveyor.

The plan shall be in accordancewith the landscape plan prepared by Natural Habitats and referenced LA02.The final landscape plan shall be subject to the approval of Council's Dulyauthorised Officer.

The plan shall provide a schedule of plant numbers and species including theirlocations and the means and method of maintaining these plants for a minimumof one further planting season or one year whichever is the longer. Alllandscaping is to be completed within 6 months of the final building consentinspection.

3. Provide for the approval of Council's Council's Duly authorised Officer andprior to the commencement of any site works a final schedule of materials tobe used for the proposed development. 1. Archaeological sites are protected pursuant to the Historic Places Act 1993. It is anoffence, pursuant to the Act, to modify, damage or destroy an archaeological site withoutan archaeological authority obtained from the trust. Should any site be inadvertentlyuncovered, the procedure is that work should cease, with the trust and local iwjconsulted immediately. The New Zealand Police should also be consulted if thediscovery includes koiwi (human remains).

2. Earthworks within 5rn of the MHWS, Lakes, Rivers, or Wetlands on land where theground slope is less tlian 8 degrees will require Northland Regional Council Consentand may require Resource Consent from FNDC see rule 12 7.6.1,3.

Statutory Information

Reasons for the Decision

1. Description of the Activity:The application seeks resource consent to construct a dwelling within the GeneralCoastal Zone and Outstanding Landscape. The proposal in addition to breachingvisual amenity rules also breaches earthworks and vegetation clearance provisions.

Landscape and Visual

The site is noted as being within the General Coastal Zone and additionally has anOutstanding Landscape notation. The zoning and overlay require resource consentsfor development works involving buildings and earthworks with a view to ensure thatdevelopment fits within the visual catchment and does not detract from local andcoastal amenity.

It is considered that the site and location has a high amenity value. It is furtherconsidered that development of the site will be visible from various points given thetopography of the site and the limitation of available areas within the site to bedeveloped.

The proposed development follows a pattern of development similar to that which islocated on adjoining properties. The effective use of colours, materials design,building location, and effective landscaping has resulted in only minor visual effectsresulting from existing development on adjacent sites. The visual perspectives

provided within the application depict a design which complements existingdevelopment and which can adequately be mitigated accordingly. It is acknowledgedthat the house will be somewhat dominating over the access road and beach untillandscaping becomes effective but this will currently only affect neighbouring propertyowners all of whom have provided their written approval to the development.From the Coastal Marine Area the visual effects are less dominant and considered tobe not more than minor as the existing ridgeline, vegetated forest backdrop, proposedlandscaping and house location are less visual. The position of the dwelling will bemore than 30m below the ridge peak. The dwelling therefore comfortably fits withinthe immediate eiivironment.

The design of the house being two storey is not at odds with the design of otherstructures within the bay. The smaller footprint allows for a reduction in the quantity ofearthworks required to accommodate the development. The design is not contrary todesign guidel nes.

The proposed development is to be constructed using materials that with berecessive and blend into the receiving environment. The proposed colours have beenprovided as part of the overall mitigation measures.The proposal has been considered in conjunction with assessinent criteria for builtdevelopment within the General Coastal Zone and Outstanding Landscape. It isconsidered that the visual impacts of the dwelling will be not more than minor andcapable of fur:her mitigation by appropriate conditions of consent.

Flora and Fauna

The site is predominately in overgrown pasture (Kikuyu) with a small area ofregenerating vegetation on the north eastern end of the site a low lying areaadjoining a wetland and dam: and a woodlot. It is probable that stock is grazed on thesjte occasionally although there is no recent evidence of this and there are no postand wire fences or water troughs existing on the site.The proposal involves the removal of some vegetation for the house site location andthe access drive. This vegetation as noted previously is regenerating and onlybetween 2-3m high. The landscape plan identifies all of the northern portion of thesite as being subject to proposed landscaping and includes beach slope plantings,restoration plantings. and new plantings which surrounds the extent of thedevelopment works (house site and driveway). Additional landscaping is proposedwithin the lower lying areas adjoining a wetland area where surplus fill from onsiteearthworks is to be deposited.

It is not considered that the proposed development including the loss of somevegetation will result in more than minor effects. The proposed mitigation measureswill improve the extent and variety of vegetation on the application site. It is notconsidered that the proposed development will adversely affect fauna within theimmediate location.

The effects are deemed to be not more than minor.

Earthworks

The earthworks elements cover two primary areas which include the access andhouse site and the dam and fill locations.

The access has been sensibly positioned to achieve an appropriate gradient andminimise the degree of excavation required (especially the extent of cut faces). Thereis adequate onsite provision for parking with a garage being proposed as part of theapplication.

There are works proposed for the small dam as denoted within the plans. This workincludes additional dam wall width with the proposed width of the dam wall increasing

from between 2.5-3.5m wide to provide an additional 4ni of width. The material usedfor the increased dam wall and fill are which is low lying will be sourced from theearthworks required to be completed for the house site and access.Suitable mitigation measures are proposed including silt controls and replanting ofexposed areas which are not considered to result in adverse effects.

Objective 2

To preserve the natural character of the coastal environment and protect natural features andlandscaoe values through:

• recognising [lie characteristics and qualities that contribute to natural character. naturalfeatures and landscape values and their location and distribution;

• identifying those areas where various forms of subdivision, use, and development would beinappropriate and protecting them from such activities;

Objective 6

To enable people and communities to provide for their social, economic, and cilltural wellbeingancj their health and safely, through subdivision, use, and development, recognising that:• the protection of the values of the coastal environment does not preclude use and

development in appropriate places and forms, and within appropriate limits,• some uses and developments which depend upon the use of natural and physical

resources in the coastal environment are important to the social, economjc and culturalwellbeing of people and communities;

• econoniic and cultural wellbeing of people and communities;• historic heritage in the coastal environrnent is extensive but not fully known, and vulnerable

tc loss or damage from inappropriate subdivision. use, and development.POLICIES

Policy 1 Extent and characteristics of the coastal environment

(1) Recognise that the extent and characteristics of the coastal environment vary from regionto region and locality to locality; and the issues that arise may have different effects indifferent localities.

(2) Recognise that the coastal environment includes:0 elements and features that contribute to the natural character, landscape, visual

qualities or amenity values;

Iii relation to the coastal environment:

consider where development that maintains the character of the existing builtenvironment should be encouraged, and where development resulting in a change incharacter would be acceptable,consider how adverse visual impacts of development can be avoided in areassensitive to such effects. such as headlands and prominent ridgelines, and as far aspracticable and reasonable apply controls or conditions lo avoid those effects:

(i) sel back development from the coastal marine area and other water bodies,where practicable and reasonable, to protect the natural character, open space,public access and amenity values of the coastal environment; and

0) where appropriate, buffer areas and sites of significant indigenous biologicaldiversity, or historic heritage value.

It is considered that the proposed dwelling and associated works is in keeping withthe Objectives and Policies of the NZ Coastal Policy Statement. The proposeddevelopment and proposed mitigation measures address the minor visual effectsresulting from the proposed development.

(b) The Operative Far North District Plan;

The following objectives and policies from the Operative Far North District Plan wereof particular relevance to the application:Objectives 10.6.3.1, 10-6.3.2, 12.1.3.1, 12,3.3.3 and policies 10.6.4.1, 10.6.4.2,10,6,4.3, 10.6,4.6, 12.10.4.1, 121.4.2, 12.1.4.3, 12.1.4.5, 12.1.4.9, 12.1.4.10,12.3.4.1, and 12.3.4.4 that seek to ensure that development proposals within thecoastal environment involving Outstanding Landscapes and earthworks result in onlyminor effects and maintain high amenity values.

Part 2 Matters

The Council has taken into account the purpose & principles outlined in sections 5,67 & 8 of the Act It is considered that granting this resource consent applicationachieves the purpose of the Act.

5. Notification and Affected Parties

The Council has determined (by way of an earlier report and resolution) that theadverse environmental effects associated with the proposed activity are no more thanminor and that there are no affected persons or affected order holders

6. Overall Evaluation

The proposal has been carefully considered and it has been concluded that theeffects of the proposed development are not more than minor. The proposalrepresents a development which is sympathetic in terms of material choice, housedesign, and its proposed location. This conclusion can be reinforced by the impositionof appropriate conditions.

The proposal is additionally considered to be consistent with the relevant objectives andpolicies of the NZ Coastal Policy Statement and District Plan, The proposal isconsidered to satisfy the requirements of Part 2 of the Act and is consistent with thesustainable management purpose of the RMA.

This resource consent has been prepared by Wayne Smith, Senior Planner and isgranted under delegated authority (pursuant to section 34A of the ResourceManagement Act 1991) from the Far North District Council by:

On the Site plan under Area 4, it shows a single dwelling and an existing shed; however the approved plans show adwelling, existing shed and an additional shed directly behind the dwelling ( making it three structures shown on theApproved Plan and only 2 on the Site Plan), please clarify the discrepancy, and or amend the Site Plan to show thethird structure.

Upon talking to the person who went onsite about a year ago, it appears the carport has not been roofed - as perthe attached image.

Nor have we been instructed by the client to create a leasehold title overthis portion.

My understanding is the BC has been obtained.
