LEGGE 186/68Disposizioni concernenti la produzione di materiali, apparecchiature, macchinari,installazioni e impianti elettrici ed elettronici. (1 Marzo 1968, n° 186)

Viene introdotto un concetto molto interessante: "la regola dell'arte".Tale regola la si trova scritta nelle Norme Tecniche stese dal CEI (per l'Italia).Le Norme Tecniche offrono una garanzia sulla bontà di un impianto, di un prodotto o di unamacchina, sia a chi lo produce, sia a chi lo acquista.La Norma Tecnica in vigore è quanto di meglio si possa offrire in termini di sicurezza. Non è escluso che una buona Norma Tecnica la si possa trovare anche al di fuori delle NormeCEI o che la si possa migliorare nel tempo.

A very interesting concept is introduced: "workmanship".Such rule is found written in the Technical Standards drafted by the CEI (for Italy).The Technical Standards offer a guarantee on the quality of a system, product or machine,both for the manufacturer as well as the purchaser.The Technical Standard in effect is the best that can be offered in terms of safety.It is not to be excluded that a good Technical Standard can also be found outside the CEIStandards or that it can be improved over time.

LEGGE 791/77Attuazione della direttiva del consiglio delle Comunità europee (n. 73/23/CEE)relativa alle garanzie di sicurezza che devono possedere il materiale elettrico destinatoad essere utilizzato entro taluni limiti di tensione. (18 Ottobre 1977, n° 791)

Ogni Nazione membro CEE, in vista di una futura unificazione, adotta il principio della "liberacircolazione" del materiale elettrico, ad una condizione indispensabile: i prodotti devono esseresicuri e non costituire pericolo per le persone, non solo per la nazione di origine, ma ancheper tutte quelle popolazioni europee che lo potrebbero acquistare. Nasce quindi l'esigenza diarmonizzare le singole, e a volte molto diverse, norme nazionali ad un livello di sicurezzaequivalente delle altre Nazioni della Comunità Europea. Il materiale che risponde allecorrispondenti norme tecniche deve recare un marchio di conformità, che per l’Italia èrappresentato dal marchio IMQ, oppure comprovare tale corrispondenza mediante attestatodi conformità che può essere rilasciato.

Every EEC Member Nation, in sight of a future unification, adopts the principle of the "freecirculation" of the electrical equipment, on an essential condition: the products must besecure and not constitute a danger for people, not only for the nation of origin, but also for allthose European populations that may purchase it. Thus there is born the need to harmonizethe single, and at times very different, national standards to a safety level equivalent to that ofthe other Nations of the European Community.The equipment that satisfies the corresponding technical standards must have a mark ofconformity, which is represented by the IMQ mark for Italy, or prove such correspondencethrough the conformity certificate that can be issued.

DECRETO DEL PRESIDENTE DELLA REPUBBLICA - DPR 224/88Attuazione della direttiva CEE n. 85/374 relativa al ravvicinamento delle disposizionilegislative, regolamentari e amministrative degli Stati membri in materia di responsabilitàper danno da prodotti difettosi, ai sensi dell'art. 15 della legge 16 aprile 1987, n. 183.(24 Maggio 1988, n° 224 )

L’attuazione della Direttiva in materia di responsabilità per danno da prodotti difettosiintroduce la "responsabilità del produttore": una colpa intesa come incapacità di offrire unprodotto con i criteri di sicurezza che ci si può attendere. Il Decreto ha come scopo la tuteladella vita di ciascuno e il risarcimento del danno causato da prodotti ritenuti non sicuri. Lenuove disposizioni riguardano le aziende sia come soggetti passivi che come soggetti attivi,infatti ciascun imprenditore deve tenere ben presente le conseguenze previste da questoDecreto nei casi in cui egli apponga sul suo o su altri prodotti il suo nome o il suo marchio edeve essere in grado di riconoscere il proprio prodotto dopo l’immissione sul mercato. Laresponsabilità di un danno è esclusa nel caso in cui lo stato delle conoscenze tecniche, almomento della messa in circolazione del prodotto, non abbia permesso di considerare ilprodotto come difettoso.

The implementation of the Directive on the subject of liability for damage from defectiveproducts introduces the "manufacturer’s liability": a negligence understood as the inability tooffer a product with the safety criteria that could be expected. The Decree has as its purposethe protection of the life of everyone and the compensation for damage caused by productsfound to be unsafe. The new dispositions consider the firms both as passive subjects and asactive subjects, in fact every entrepreneur has to take into consideration the consequencesforeseen by this Decree in the cases in which he affixes on his or other products his name ormark and must be able to identify his own product after introduction on the market.The liability for damage is excluded in the case in which the state of technical knowledge, atthe moment of the product’s introduction into circulation, did not allow for the determinationof the product as defective.

DECRETO DEL PRESIDENTE DELLA REPUBBLICA - DPR 447/91Regolamento di attuazione della Legge 5 Marzo 1990 n. 46 in materia di sicurezza degliimpianti. (6 Dicembre 1991, n° 447 )

Queste disposizioni legislative prescrivono l’obbligo di fare ricorso ad installatori qualificati nel caso diinstallazione, ampliamento o manutenzione degli impianti. La parte più importante della legge èsicuramente la Dichiarazione di Conformità, che molto spesso, viene ridotta ad una semplice firma suun determinato modulo. Il titolare dell’impresa sottovaluta il fatto che, sottoscrivendo tale dichiarazione,si assume delle responsabilità. Prima di firmare, è necessario effettuare degli accertamenti.L’installatore deve utilizzare componenti recanti il marchio IMQ o equivalenti europei oppure componentisprovvisti di marchio IMQ, ma dotati di dichiarazione del costruttore sulla base di norme, componentidotati di marcatura CE o equivalenti europei. L’installatore, acquistando materiali, deve prestare moltaattenzione a queste prescrizioni. La Dichiarazione deve riportare i seguenti allegati:progetto (se obbligatorio); relazione con tipologie dei materiali utilizzati con un riassunto sulle informazioniprincipali dell’impianto, una relazione in cui si dichiara di aver utilizzato componenti conformi alle norme,schede dei componenti utilizzati; scheda dell’impianto realizzato; riferimento a dichiarazioni precedenti; copiadel certificato di riconoscimento dei requisiti tecnico - professionali.

These legislative dispositions prescribe the obligation to make use of qualified technicians in the case ofinstallation, amplification or maintenance of the systems.The most important part of the law is certainly the Declaration of Conformity, which is reduced veryoften to a simple signature on a determined form. The holder of the enterprise underestimates the factthat, by signing such declaration, he is taking on some responsibilities. Before signing, it is necessaryto perform verifications.The technician must use components bearing the IMQ or equivalent European mark or componentslacking the IMQ mark but equipped with the manufacturer’s declaration on the basis of standards,components equipped with CE or equivalent European marking. The technician, when purchasingmaterial, must pay close attention to these prescriptions.The Declaration must contain the followings attachments:design (if mandatory); report with typologies of the material used with a summary of the principalinformation of the system, a report in which the manufacturer declares to have used up-to-standardcomponents, schedules of the components used; schedule of the realized system; reference to previousdeclarations; copy of the certificate of identification of the technical – professional requirements.

DECRETO LEGISLATIVO 476/92Attuazione della direttiva 89/336/CEE del consiglio del 3 maggio 1989, in materia diravvicinamento delle legislazioni degli Stati membri relative alla compatibilitàelettromagnetica, modificata dalla direttiva 92/31/CEE del Consiglio del 28 aprile 1992.(4 Dicembre 1992, n° 476)

Il Decreto richiede che, al momento dell’immissione sul mercato o alla loro messa in servizio, gliapparecchi elettrici/elettronici siano conformi alle disposizioni indicate e riportinoobbligatoriamente la Marcatura CE. Attraverso questo Decreto l’Unione Europea ha emanatospecifiche disposizioni riguardanti l’immissione sul mercato di prodotto che per il lorofunzionamento utilizzano energia elettrica. La Direttiva sulla Compatibilità Elettromagneticaviene indicata con l’abbreviazione EMC che sta per Electromagnetic Compatibility. Gliapparecchi elettromagnetici devono essere realizzati in modo che i campi elettromagneticigenerati siano ad un livello tale che permetta agli altri apparecchi di funzionare correttamentee che a loro volta possiedano un adeguato livello di protezione di tali disturbi.

The Decree requires that, upon introduction on the market or commissioning, theelectrical/electronic instruments be in compliance with the indicated dispositions and havethe mandatory CE Marking. Through this Decree the European Union has issued specificdispositions concerning the introduction on the market of products that use electricity fortheir operation. The Directive on the Electromagnetic Compatibility is indicated with the abbreviation EMC,which is for Electromagnetic Compatibility.The electromagnetic instruments must be realized so as to ensure that the electromagneticfields produced are at a level that allows other instruments to work correctly and that they inturn possess a suitable level of protection against such interference.

DECRETO DEL PRESIDENTE DELLA REPUBBLICA - DPR 392/94Regolamento recante disciplina del procedimento di riconoscimento delle imprese aifini della installazione, ampliamento e trasformazione degli impianti nel rispetto dellenorme di sicurezza. (18 Aprile 1994, n° 392)

Alla sua uscita il Decreto passò quasi inosservato, anche se contiene disposizioni digrande attualità riguardanti l’adeguamento degli impianti tecnici.Vengono introdotte interessanti innovazioni riguardanti la Dichiarazione di Conformità,le verifiche e la possibilità di far ricorso all’atto notorio per regolarizzare i vecchi impianti. Gli impianti elettrici precedenti al 13 marzo 1990 (data di pubblicazione della Legge46/90) non possiedono la Dichiarazione di Conformità poiché all'epoca non era richiesta.

When it was issued the Decree passed almost unnoticed, even though it contains largelytopical dispositions concerning the modification of technical systems.Interesting innovations are introduced concerning the Declaration of Conformity,the verifications and the possibility to resort to an affidavit to regularize the old systems.The electrical systems previous to 13 March 1990 (publication date of Law 46/90) donot possess the Declaration of Conformity since it was not required at the time.

DECRETO LEGISLATIVO 626/94Attuazione delle direttive 89/391/CEE, 89/654/CEE, 89/655/CEE, 90/269/CEE,90/270/CEE, 90/394/CEE e 90/679/CEE riguardanti il miglioramento della sicurezzae della salute dei lavoratori sul luogo di lavoro. (19 Settembre 1994, n° 626)

Il Decreto introduce ben 8 direttive europee che riguardano la sicurezza sul lavoro. Il datore di lavoro si avvale della collaborazione di un "Servizio di prevenzione e protezione".Nel settore elettrotecnico, i pericoli riguardano determinate categorie di persone, che sono:1) utenti occasionali (devono poter essere protetti totalmente dai rischi); 2) conducenti di impianti e macchinari (dispongono di informazioni riguardanti il loro compito); 3) manutentori non elettrici (devono poter operare in sicurezza); 4) manutentori elettrici (devono avere il massimo della formazione). Esiste poi una guida all’individuazione dei rischi sotto forma di 2 schede, la primariguardante le cabine elettriche di media tensione, la seconda riguardante gli impianti didistribuzione.

The Decree introduces as many as 8 European directives that concern work safety.The employer uses the collaboration of a "Prevention and protection service".In the electrotechnical sector, the dangers concern certain categories of people, which are:1) occasional users (must be able to be totally protected from risks); 2) drivers of systems and machines (must have information concerning their assignment); 3) non-electrical maintenance workers (must be able to operate in safety); 4) electrical maintenance workers (must have the maximum training). There exists then a type of guide for the identification of the risks in the form of 2schedules, the first regarding the electricity substations of average voltage, the secondregarding the distribution systems.

L’obiettivo principale di questo Decreto è quello di tutelare la sicurezza del consumatore. LaDirettiva Bassa Tensione escludeva dal suo campo di applicazione le prese per uso domestico equindi queste ricadono sotto il campo di applicazione della presente Direttiva 92/59/CEE. Viene introdotto un nuovo concetto: quello dei requisiti di sicurezza essenziali come obiettivo daraggiungere per i prodotti in circolazione. I Paesi che fanno parte dell’Unione Europea sonoobbligati a creare una rete di controllo del mercato ed a comunicare ogni piccola variazione allaCommissione Europea che deve essere informata sulle azioni di ogni Paese. La presente Direttiva92/59/CEE ha unificato le legislazioni nazionali e ha eliminato ogni forma di protezione agli scambicommerciali.

The main objective of this Decree is that of protecting the safety of the consumer.The Low Voltage Directive excluded from its field of application the sockets for domestic useand thus these fall under the field of application of the Directive 92/59/CEE. A new conceptis introduced: that of the essential safety requirements as an objective to be achieved for theproducts in circulation.The Countries that belong to the European union are obligated to create a market monitoringnetwork and to communicate every small variation to the European Commission that must beinformed about the actions of every Country. The Directive 92/59/CEE has unified thenational laws and has eliminated every form of trade protection.

DECRETO LEGISLATIVO 626/96Attuazione della direttiva 93/68/CEE in materia di marcatura CE del materiale elettricodestinato ad essere utilizzato entro taluni limiti di tensione. (25 Novembre 1996, n° 626)

Il decreto prescrive che ogni componente elettrico con una tensione nominale compresa tra 50 e1000 V in corrente alternata e fra 75 e 1500 V in corrente continua debba riportare laMarcatura CE, obbligatoria dall’inizio del ’97.L’introduzione di questo decreto fu fatta essenzialmente per 2 scopi: - Amministrativo: libera circolazione all’interno dei vari Paesi dei componenti elettrici - Tecnico: rispetto dei requisiti essenziali di sicurezza Apporre il marchio CE non significa solo rispondere alla Direttiva Bassa Tensione, ma a tutte leDirettive che riguardano il componente in questione.Il costruttore di componenti elettrici deve presentare la Dichiarazione di Conformità CE e la Documen-tazione Tecnica e deve tenerle a disposizione, per 10 anni, delle "autorità di controllo competenti".

The decree prescribes that every electrical component with a nominal voltage between 50and 1000 V in alternating current and between 75 and 1500 V in direct current must havethe CE Marking, mandatory from the beginning of 1997.This decree was introduced essentially for 2 purposes: - Administrative: free circulation of electrical components within the various Countries- Technicalrespect of the essential safety requirements Affixing the CE mark doesn't mean satisfying only the Low Voltage Directive, but all theDirectives that concern the component in question.The manufacturer of electrical components must present the EC Conformity Declaration andthe Technical Documentation and has to keep these at the disposal of the "competentsupervisory authorities" for 10 years.

DECRETO LEGISLATIVO 277/97Modificazioni al decreto legislativo 25 novembre 1996, n. 626, recante attuazionedella direttiva 93/68/CEE in materia di marcatura CE del materiale elettricodestinato ad essere utilizzato entro taluni limiti di tensione. (31 Luglio 1997, n° 277)

I prodotti soggetti alla direttiva Bassa Tensione conformi ai requisiti previsti dalla Legge 791/77 eimmessi nel mercato prima del 31/12/96 possono essere liberamente venduti e installati, senzalimitazioni di tempo, anche se sprovvisti della Marcatura CE. I grossiti di materiale elettricopossono vendere e gli installatori installare senza limitazioni di tempo anche i prodotti non marcatiCE purchè siano conformi alla Legge 791/77. L'articolo 2 di questo decreto introduce inoltrepesanti sanzioni amministrative che colpiranno aziende, grossisti ed installatori che violino i requisitidi sicurezza imposti dalla Legge 791/77 premiando le aziende serie e punendo i "soliti furbi".Di fatto, con questa Legge, l'attenzione del mercato è spostata dalla marcatura amministrativa CEal rispetto delle norme e quindi al marchio IMQ consentendo ai grossisti, istallatori ed utilizzatorifinali di effettuare scelte più precise fra aziende serie ed aziende poco serie.

The products subject to the Low Voltage Directive in compliance with the requirements providedby Law 791/77 and introduced in the market before 31/12/96 can be freely sold andinstalled, without time limitations, even if lacking the CE Marking. The wholesalers of electricalequipment can also sell and the installers can also install, without time limitations, the non-CEmarked products provided that they are in compliance with Law 791/77. Article 2 of thisdecree introduces, furthermore, severe administrative sanctions that will strike firms,wholesalers and installers that violate the safety requirements imposed by Law 791/77,rewarding the serious firms and punishing the usual "sly" ones.In fact, with this Law, the attention of the market is shifted from the administrative CE marking tothe respect of the norms and thus to the IMQ mark allowing the wholesalers, installers and finalusers to effect more precise choices between serious firms and less serious firms.

DECRETO DEL PRESIDENTE DELLA REPUBBLICA - DPR 462/2001Regolamento di semplificazione del procedimento per la denuncia di installazioni edispositivi di protezione contro le scariche atmosferiche, di dispositivi di messa a terradi impianti elettrici e di impianti elettrici pericolosi. (22 Ottobre 2001, n° 462)

Il regolamento semplifica la procedura per la denuncia di installazioni e dispositivi di protezionecontro le scariche atmosferiche, di dispositivi di messa a terra di impianti elettrici e di impiantielettrici pericolosi. In vigore dal 23 gennaio 2002 definisce le nuove modalità per la messa in esercizio,l’omologazione, la prima verifica e le verifiche periodiche degli impianti in oggetto.Esso si applica agli ambienti di lavoro per le attività soggette al DPR 547/55. Il DPR 462/2001 abroga gli artt. 40 e 328 del DPR 547/55, gli artt. 2, 3 e 4 del DM12/09/1959 nonché i modelli A, B e C allegati al medesimo decreto. Il regolamento vieneapplicato anche ai procedimenti in essere alla data della sua entrata in vigore.

The rule simplifies the procedure for reporting installations and devices for protection against atmospheric discharges, grounding devices of electrical systems and dangerouselectrical systems.In effect since 23 January 2002, it defines the new formalities for the operation,homologation, first verification and the periodic verifications of the systems in question. Itapplies to the work environments for the activities subject to the DPR 547/55.The DPR462/2001 repeals the Arts. 40 and 328 of the DPR 547/55, the Arts. 2, 3 and 4 of theDM 12/09/1959 as well as the forms A, B and C attached to the same decree.The rule isalso applied to the procedures existing on the date of its coming into effect.
