On June 28 the United States Supreme Court announced its decisions on the four interre-lated issues that made up the constitutional challenge to the Patient Protection and Affordable Care Act (PPACA). The court decided the individual mandate is a tax and thereby constitutional, and that the Medicaid expansion is also legal, although its provisions were limited. The entire measure stands as is except that the federal government’s power to terminate states’ Medicaid funds has been reduced. For

purposes of implementation, virtually all of the law and all resulting regulations and dead-lines proceed as scheduled. The only part of the law that will change has to do with the level

of funds states may receive based on choices they make relative to their Medicaid programs.

With regard to the constitutionality of the individual mandate, the Justices voted five to four that Congress was within its authority to require that all Americans have health insurance coverage using its power of taxation. Justices Roberts, Ginsberg, Breyer, Sotomayor and Kagan voted to uphold the mandate. Justices Kennedy, Scalia, Alito and Thomas opposed the decision. The court also ruled that PPACA may allow states to expand their Medicaid programs. However, in the majority opinion, the Justices made it clear that if states do not want to participate in the PPACA expansion of Medicaid, they can continue to receive their existing level of funding for the

rest of the program.

Since the Court voted to uphold the individual mandate and Medicaid expansion provi-sions of the law, the question of whether or not these provisions of the law are sever-

able is moot. The majority opinion also made it clear that the federal Anti-Injunction Act does not

apply because the label “tax” is not controlling.

While we know that many of you may not agree with this decision, we must respect the actions of our nation’s highest court and move forward. This decision gives us a degree of closure and direction about PPACA’s future and will help guide our policy focus in the years to come.

Agents and brokers can remain a constant for their individual and employer clients as we head toward full implementation of the law’s insurance-market reforms and other requirements in 2014. As an association, we must work with our policymakers to ensure a better transition to preserve the integrity of the free market and ease the compliance and cost burden on health insurance consumers. Most important, we must double our efforts to reduce the cost of medical care, which is the true driver of health insurance premiums. Sadly, true means of cost containment were barely addressed by PPACA.

There is no doubt that the historic ruling will have a profound im-pact on the upcoming presidential and congressional elections. The US Supreme Court upheld the Affordable Care Act (ACA), ruling that the law’s individual mandate is a con-stitutional exercise of Congress’s power to impose taxes. With the Court’s decision, compliance efforts likely will move ahead at full speed with major provisions of the ACA becoming effective in 2013 and 2014.

In a 5-4 decision, Chief Justice Roberts, joined by Justices Ginsberg, Breyer, Sotomayor and Kagan, concluded, “The Affordable Care Act’s requirement that certain individu-als pay a financial penalty for not obtaining health insur-ance may reasonably be characterized as a tax. Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness.”

In the Court’s analysis of the ACA’s Medicaid provisions, it held that it would be unconstitutional for the federal government to withhold all Medicaid funding in order to force states to comply with the Medicaid expansion. Chief Justice Roberts wrote, “Nothing … precludes Con-gress from offering funds under the ACA to expand the availability of health care, and requiring that states ac-cepting such funds comply with the conditions on their use. What Congress is not free to do is to penalize States that choose not to participate in that new program by taking away their existing Medicaid funding.”

The Court ruled that the Anti-Injunction Act, which limits lawsuits challenging a tax before it is assessed, does not apply because Congress specifically provided that the penalty payment enforcing the individual man-date would not be treated as a “tax.” Notwithstanding acceptance of Congress’s penalty label for purposes of application of the Anti-Injunction Act, the Court ruled that for purposes of determining whether the individual mandate is constitutional, the penalty payment falls within Congress’s general power to tax and, therefore, is upheld.

The decision arises from cases brought by the state of Florida (and joined by 25 other states), the National Federation of Independent Business, and several individ-uals challenging the constitutionality of the individual mandate and the Medicaid expansion. The cases were

later consolidated.

In their dissent, Justices Kennedy, Scalia, Thomas and Alito wrote that the law should have been struck down in its entirety.

With the exception of the limitation on the federal government’s authority to withhold Medicaid funding, all provisions of the ACA stand and compliance efforts likely will move ahead at full speed. In preparation for the major coverage expansion to occur under the ACA in 2014, the Administration is expected to release a host of regulations dealing with the definition of minimum essential coverage, employer coverage and reporting requirements, and an array of new taxes and fees. Clients should be aware of provisions of the law set to take ef-fect in 2013 and 2014, including those listed in the table below.

The final message I need to convey really has to do with NAHU and your future. Through attending Cap Conference, I gained a much greater understanding of the role NAHU plays in all of our business lives. 30, 2012 - On the last day of the National Association of Health Underwriters’ 2012 Capitol Conference hundreds of attendees received exciting industry news that made the ballroom erupt with a roar of applause and cheers. “We now officially have a Senate companion bill [to H.R. 1206, the MLR legislation in the House] to be dropped in the next few days,” said Janet Trautwein, CEO of the organization. Trautwein also shared that since the group of more than 700 NAHU members arrived in D.C. nearly a dozen members of Congress have signed on as co-sponsors of the legislation that would remove brokers from the medical loss ratio calculation. NAHU

All of us need to make every effort to educate our state representa-tives and business owners as to the impact reform is going to have on them. By doing so, all of us will be increasing the value we bring to our clients as well as improving our chances of playing a key part in our future ability to be paid as professional advisors.

Political reactionsThe Court’s ruling will not end the political debate over health care, which will remain a central issue in the 2012 elections and beyond. The law stands as the centerpiece of the domestic record of President Obama, who today said, “Whatever the politics, today’s decision was a victory for people all over this coun-try whose lives will be more secure because of this law and the Supreme Court’s decision to uphold it.” The President added, “With today’s an-nouncement it is time for us to move forward to implement and, where necessary, to improve this law.”

In comments in response to the rul-ing, presumed Republican presiden-tial nominee Gov. Mitt Romney said, “What the Supreme Court did not do on its last day in session, I will do in my first day in office. I will act to repeal Obamacare.”

Following the release of the deci-sion, House Majority Leader Eric Cantor (R-VA) announced that the House on July 11 will hold a vote on legislation to repeal the ACA in its entirety. The measure likely will pass the Republican-controlled House, but it is unlikely to advance in the Democratic-controlled Senate.

Repeal of the ACA has been a prima-ry focus of congressional Republi-cans and remains a central objective of many Republicans’ campaigns in the November elections. Efforts to repeal all or part of the law will remain difficult unless Republicans maintain control of the House, win the presidency, and win at least a majority in the Senate in the Novem-ber 2012 elections.

Republicans to date have not co-alesced around a proposal to replace the ACA. Further efforts to control rising health care costs, including re-forms to federal health entitlement programs and health-related tax expenditures, will be at the center of budget and deficit-reduction de-bates that are expected to dominate Washington after the November elections.

Background on the lawThe Affordable Care Act was enacted in March 2010; it comprises the Patient Protection and Affordable Care Act of 2010 (which President Obama signed on March 23, 2010) and the Health Care and Education Reconciliation Act of 2010 (which the President signed on March 30, 2010).The primary goals of the ACA are to: (i) expand coverage to an estimated 32 million Americans without health

insurance; (ii) reform the delivery system to improve quality and drive efficiency; and (iii) lower the overall costs of providing health care.

To accomplish the goal of expanding coverage, the ACA mandates that all Americans maintain a minimum lev-el of health coverage (the so-called individual mandate) or face a tax penalty. The law expands Medicaid coverage and provides federal pre-mium tax credits and cost-sharing subsidies to assist low and moderate income individuals without afford-able employer-sponsored insur-ance in obtaining health insurance through state-based insurance Ex-changes. The ACA mandates, for the first time, that employers with 50 or more full-time employees provide certain minimum benefits or pay penalty fees.

The law also implemented insurance market reforms, including a ban on exclusions for pre-existing condi-tions, premium rate restrictions, extension of dependent coverage through age 26, and mandatory cov-erage of preventive services.

A mix of Medicare and Medicaid reimbursement cuts; provisions to reduce fraud, waste, and abuse in those public programs; other deliv-ery system reforms; and a series of tax increases on individuals, corpo-rations and the health industry are used to offset the cost of the law.

Local SCAHU chap-ters raised more than $26,000 to give to local charities.

PAHU donated more than $11,000 to the Greenville Free Medi-cal Clinic, LAHU raised $5,000 for the Hope Lodge Cancer Center and CAHU donated $7,000 to Camp Kemo. GSPD donated more

than $1,000 in supplies and money to the Grand Strand Humane Society and $2,500 to Fostering Hope. Thank you to everyone who participated in these events.

Local chapters provide members with a way to reach out in the community with its public charities and provide monthly or quarterly meetings for members to attend and receive CE credit for education. The following are the highlights from this year’s chapter educational sessions.

The largest crowd at PAHU’s monthly luncheon was more than 55 attendees. The meeting included a LinkedIn ses-

sion provided by Judy Schlather from OneAmerica.

LAHU’s highest attended meeting featured speakers from the Department of Labor talking about compliance issues. This program offered two hours of CE.

CAHU’s largest monthly luncheon meeting included a CAP Conference Panel Discussion by attendees: Jona-than Hudgens, Gabe Ricks, Mark Riley and Watts Hucka-bee. An updated session of this topic will be held in 2013 around the state.

GSPD’s most popular topic this year was healthcare re-form, and the spring meeting was coordinated with the BlueChoice Healthplan agents meeting which helped the meeeting to be GSPD’s best attended meeting.
